CIRCULAR
ON PROMULGATION OF
THE REGULATION ON ORGANIZATION AND OPERATION OF UPPER-SECONDARY SCHOOLS FOR THE
GIFTED
Pursuant to Law on Education dated June 6, 2019;
Pursuant to Decree No. 86/2022/ND-CP dated
October 24, 2022 of the Government defining the function, tasks, powers and
organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 127/2018/ND-CP dated
September 21, 2018 of the Government stipulating the responsibilities for state
management of education
At the request of the Director of the Department
of Secondary Education,
The Minister of Education and Training
promulgates this Circular on promulgation of the Regulation on organization and
operation of upper-secondary schools for the gifted.
Article 1. Promulgate together with this
Circular the Regulation on organization and operation of upper-secondary
schools for the gifted.

This Circular supersedes the Circular No.
06/2012/TT-BGDDT dated February 2, 2012 by the Minister of Education and Training
on promulgating the Regulation on organization and operation of upper secondary
schools for the gifted and Circular No. 12/2014/TT-BGDDT dated April 18, 2014
by the Minister of Education and Training on amendments to Articles 23 and 24
of the Regulation on organization and operation of upper secondary schools for
the gifted, enclosed with Circular No. 06/2012/TT-BGDDT dated February 15, 2012
of the Minister of Education and Training.
The enrollment in classes for non-gifted students
of upper-secondary schools for the gifted in accordance with the Circular No.
06/2012/TT-BGDDT dated February 15, 2012 of the Minister of Education and
Training promulgating the Regulation on organization and operation of upper
secondary schools and Circular No. 12/2014/TT-BGDDT dated April 18, 2014 of the
Minister of Education and Training on amendments to Articles 23 and 24 of the
Regulation on organization and operation of upper-secondary schools for the
gifted promulgated together with Circular No. 06/2012/TT-BGDDT dated February
15, 2012 of the Minister of Education and Training shall be carried out until
the end of the school year 2023-2024.
Classes for non-gifted students that have been
enrolled and organized in upper-secondary schools for the gifted continue to
comply with the provisions of Circular No. 06/2012/TT-BGDĐT dated February 15,
2012 of the Minister of Education and Training promulgating the Regulation on
organization and operation of upper secondary schools for the gifted and
Circular No. 12/2014/TT-BGDDT dated April 18, 2014 of the Minister of Education
and Training on amendments to Article 23 and Article 24 Regulations on
organization and operation of upper secondary schools for the gifted
promulgated together with the Circular No. 06/2012/TT-BGDDT dated February 15,
2012 of the Minister of Education and Training until they finish the 12th
grade.
Article 3. Presidents of People's Committees
of provinces and centrally affiliated cities, Directors of Departments of
Education and Training, Rectors of universities with upper secondary schools
for the gifted, and relevant organizations and individuals shall implement this
Circular./.

Chapter I
GENERAL PROVISIONS
Article 1. Scope and regulated entities
1. This Regulation sets forth the organization and
operation of upper secondary schools for the gifted (hereinafter referred to as
gifted schools) including: general regulations; classrooms, professional
groups, office groups; administrators, teachers, staff and students; enrollment
and organization of educational activities.
2. The organization and operation of gifted schools
shall comply with the provisions of the Charter of the lower-secondary schools,
upper-secondary schools and multi-level schools and this Regulation.
3. This Regulation applies to gifted schools and
related organizations and individuals.
Article 2. Objectives, tasks and powers of
gifted schools
1. A gifted school is for students who achieve good
results in conduct and learning in order to develop their aptitudes for a
number of subjects on the basis of ensuring a comprehensive general education,
creating a source of talents, meeting the development needs of the country.
2. The gifted school shall perform the tasks and
powers of upper-secondary schools as prescribed in the Charter of
lower-secondary schools, upper-secondary schools and multi-level schools and
also perform the following additional duties and powers:

b) Research and apply appropriately and effectively
the educational program and advanced methods of management, teaching,
examination and evaluation; promote the implementation of education in science,
technology, engineering, art and mathematics in general education;
c) Develop administrators, teachers and employees
in sufficient quantity and structure; good at expertise and profession; have
scientific research capacity; use foreign languages in communication, teaching
and scientific research;
d) Coordinate with relevant units in organizing
professional training, retraining, foreign languages and informatics for
administrators, teachers and staff to meet the objectives and tasks of the
gifted school;
dd) Develop cooperation activities with local and
foreign education and training institutions and scientific research
institutions to improve the quality of education;
e) Formulate planning and development plans and
increase investment in teaching facilities and equipment in accordance with law
to meet the goals and tasks of the gifted school;
g) Organize and manage student boarding activities;
h) Build, manage and effectively use the
information system and database in service of the management, education and
assessment of the quality and operational efficiency of the school;
i) Keep track of the learning and working process
of former students;
k) In each school year, chair at least 01 (one)
seminar on the organization and management of educational activities in the
school with the participation of lower-secondary schools, upper-secondary
schools, etc. in order to share solutions and results of performing tasks and
powers of gifted schools as prescribed in Clause 2 of this Article.

1. The system of gifted schools includes gifted
schools of provinces and centrally affiliated cities (hereinafter referred to
as provincial gifted schools) and gifted schools affiliated to higher education
institutions.
2. Each province, centrally affiliated city has at
least 01 (one) gifted school.
Article 4. Managing authorities of gifted
schools
1. Provincial gifted schools are managed by the
Department of Education and Training.
2. Gifted schools affiliated to higher education
institutions are managed by higher education institutions according to
regulations on organization, administrators, teachers, staff, facilities,
finance, enrollment and specified in the Regulation on organization and
operation of the higher education institutions; under the management of the Department
of Education and Training where the school is located in terms of implementing
educational programs and plans, administration of graduation exams, and
granting diplomas.
Article 5. Policy on investment in education
quality assurance
1. Gifted schools are given priority in the
following:
a) Arrange administrators, teachers and employees
to meet the prescribed payroll quotas and standards;
b) Invest in building synchronous and modern
material facilities and teaching equipment in accordance with law;

d) Invite teachers, lecturers, local and foreign
experts to give lectures, provide professional training, and guide scientific
research for administrators, teachers and students according to regulations;
dd) Gifted schools affiliated to higher education
institutions are allowed to use facilities, teaching equipment, laboratories,
practice room and utilize lecturers of higher education institutions to teach
students.
2. The People's Committees of the provinces and
centrally-affiliated cities (hereinafter referred to as the People's Committees
of provinces) shall submit to the competent authorities for decision on
additional budget funding for gifted schools under the provisions of the law on
facilities, incentives for administrators, teachers and staff, and enable
administrators and teachers of gifted classes specified in Clause 1, Article 8
of this Regulation to attend training and retraining courses at home and abroad.
3. Higher education institutions with gifted
schools shall decide to supplement investment in education quality assurance
for gifted schools affiliated to higher education institutions in accordance
with law.
Article 6. Incentive policies for administrators,
teachers, staff and students
1. Administrators, teachers and staff of gifted
schools are entitled to incentive policies according to the Government's
regulations.
People's Committees of provinces (for provincial
gifted schools), higher education institutions (for gifted schools affiliated
to higher education institutions) shall, according to the provisions of law, on
their own or seeking approval from competent authorities to, decide on policies
to supplement the incentives and rewards for administrators, teachers and staff
who achieve outstanding performance as to their assigned tasks.
2. Students of gifted schools who have won prizes
in excellent student competitions in academic subjects; national and
international science and technology competitions will be considered for
scholarships and receive commendation as prescribed.
People’s Committees of provinces (for provincial
gifted schools), higher education institutions (for gifted schools affiliated
to higher education institutions) shall decide on policies on supplementing the
scholarship and commendation for students who achieve excellent performance in
study and practice, have achievements in excellent student competitions in
academic subjects; national and international science and technology competitions.

Article 7. Property of the gifted school
Gifted schools are entitled to investment in
facilities and equipment like upper-secondary schools in accordance with the
regulations for national standard schools, and also in the following:
1. Study rooms, study supporting rooms with
sufficient quantity and standards with synchronous equipment, adequately
qualified for teaching 02 (two) sessions/day.
2. Modern and synchronous teaching equipment
serving the teaching of gifted students and the organization of cultural,
artistic and scientific research activities of teachers and students.
3. Dormitories, canteens for students who are in
need of boarding accommodations.
4. Official houses for teachers.
5. Stadiums, multi-purpose houses, swimming pools
and other sports equipment and facilities.
Chapter II
CLASSES, PROFESSIONAL GROUPS, OFFICE GROUPS

1. Classes in gifted schools are offered according
to subjects in the general education program promulgated by the Minister of
Education and Training, including: Literature, History, Geography, Foreign
Languages, Mathematics, Information Science, Physics, Chemistry, Biology
(hereinafter referred to as gifted classes).
2. Do not offer non-gifted classes in gifted
schools.
3. Each gifted class has no more than 35 students.
4. On the basis of educational quality assurance
and at the request of the principal of the gifted school, the managing
authority of the gifted school shall decide the number of subjects in which
gifted classes are offered (hereinafter referred to as specialized subjects)
and the number of gifted classes by each specialized subject.
Article 9. Professional groups
The professional group of the gifted school is established
and performs the tasks as prescribed in the Charter of lower-secondary schools,
upper-secondary schools and multi-level schools and also perform the following
additional duties:
1. Develop programs and develop teaching materials
for specialized subjects according to the advanced education program for
specialized subjects prescribed by the Minister of Education and Training;
research, apply advanced teaching methods, test and assessment methods to
teaching, test and evaluate students' learning and conduct performance.
2. Advise the principal in formulating and
organizing the implementation of a plan to develop cooperation activities
between the school and local and foreign high-quality educational and training
institutions and scientific research institutions to improve high quality
education and management.
3. Organize scientific research, make their own
equipment and teaching aids; support teachers in scientific research and guide
students in scientific research.

5. Improve professional competence and practice of
group members.
6. Keep track of the learning and working process
of former students.
7. In each school year, chair at least 01 (one)
professional meeting with attendance of teachers of other lower-secondary
schools and upper-secondary schools in order to share solutions and results of
the professional group in researching how to effectively apply local and
international educational program and teaching methods, testing and assessment
methods.
Article 10. Office group
The office group of the gifted school is
established and performs the tasks as prescribed in the Charter of
lower-secondary schools, upper-secondary schools and multi-level schools and
also perform the following additional duties:
1. Cooperate with the professional groups in
formulating and organizing the implementation of a plan to develop cooperation
activities between the school and local and foreign high-quality educational
and training institutions and scientific research institutions to improve high
quality education and management.
2. Cooperate with the professional groups in
collecting statistics and keeping track of the learning and working process of
former students.
Chapter III
ADMINISTRATORS, TEACHERS, STAFF AND STUDENTS

In addition to the standards, duties and rights
specified in the Charter of the lower-secondary school, upper-secondary schools
and multi-level schools and professional title standards of upper-secondary
school teachers, the principal of a gifted school shall meet the following
standards, duties and has the following rights:
1. Satisfy the prescribed standards on selection of
administrators of core general education institutions, and reach a good level
for using foreign languages and applying information technology.
2. Initiate the performance of the tasks of the
gifted school according to Clause 2, Article 2 of this Regulation in order to
achieve the objectives of the gifted school.
3. Propose or conduct the recruitment of teachers
and staff according to their authority; propose to the competent authority to
dismiss teachers and staff who do not meet the requirements of performing the
tasks of the gifted school out of the gifted school, invite visiting teachers,
send teachers to training and retraining at home and abroad.
4. Direct the development of plans for improving
professional competence, foreign languages, and IT for administrators,
teachers, staff, etc. in order to meet the objectives and tasks of the gifted
school.
5. In each school year, act as a chair in holding
at least 01 (one) thematic seminar as prescribed at Point k, Clause 2, Article
2 of this Regulation.
Article 12. Vice principal
In addition to the standards, duties and rights
specified in the Charter of the lower-secondary school, upper-secondary schools
and multi-level schools and professional title standards of upper-secondary
school teachers, the vice principal of a gifted school shall meet the following
standards, duties and has the following rights:
1. Satisfy the prescribed standards on selection of
administrators of core general education institutions, and reach a good level
for using foreign languages and applying information technology.

3. In each school year, act as a coordinator in
holding at least 01 (one) thematic seminar as prescribed at Point k, Clause 2,
Article 2 of this Regulation.
Article 13. Teachers
In addition to the standards, duties and rights
specified in the Charter of the lower-secondary school, upper-secondary schools
and multi-level schools and professional title standards of upper-secondary
school teachers, the teacher of a gifted school shall meet the following
standards, duties and has the following rights:
1. Satisfy the prescribed standards on selection of
teachers of core general education institutions, and reach a good level for
using foreign languages and applying information technology.
2. Comply with the principal's assignment in
initiating the performance of the tasks of the gifted school according to
Clause 2, Article 2 of this Regulation in order to achieve the objectives of
the gifted school.
3. In each school year, act as a chair or a
coordinator in holding at least 01 (one) professional meeting of the
professional group as prescribed in Clause 7 Article 9 of this Regulation.
Article 14. Staff
In addition to the standards, duties and rights
specified in the Charter of the lower-secondary school, upper-secondary schools
and multi-level schools and professional title standards of upper-secondary
school teachers, the staff member of a gifted school shall meet the following
standards, duties and has the following rights:
1. Have the professional competence that meets the
requirements to perform the objectives and tasks of the gifted school.

Article 15. Recruitment, employment and
management of administrators, teachers and staff of gifted schools
1. The recruitment, employment and management of
administrators, teachers and staff of gifted schools shall comply with
regulations of law.
2. People’s Committees of provinces, higher
education institutions that manage gifted schools shall, based on applicable
regulations of law and specific conditions of the provinces and institutions,
on their own or seeking approval from the competent authorities to, issue their
own policies on recruitment, employment and management of administrators,
teachers and staff of gifted schools. In recruiting teachers and staff of
gifted schools, priority will be given to talented and gifted people who meet the
requirements of professional competence, suitable to the teacher's job
position, staff of gifted schools.
Article 16. Students
In addition to the duties and rights of students as
prescribed in the Charter of lower-secondary schools, upper-secondary schools
and multi-level schools, they shall also perform the following additional
duties and rights:
1. Actively participate in competitions, contests,
cultural and social activities and scientific research at the request of the
school.
2. Intellectually advanced students may skip a
grade according to the decision of the gifted school’s managing authority.
3. To be provided with boarding accommodations if
needed; enjoy incentives as prescribed for students of gifted schools.
4. Former students of gifted schools are enabled to
participate in school activities.

ENROLLMENT AND ORGANIZATION OF EDUCATIONAL ACTIVITIES
Article 17. Enrollment to the first grade
1. Enrollment rules
a) Comply with the Regulation on enrollment of lower-secondary
and upper-secondary boarding ethnic schools promulgated by the Ministry of
Education and Training;
b) Only choose students with intelligent advance,
good performance in conduct and study at the lower secondary level, and have
the ability to study at gifted schools;
c) Ensure accuracy, objectivity, fairness,
transparency and equality between gifted schools in the provinces and gifted
schools in higher education institutions.
2. Enrollment plan
a) Provincial gifted schools: annually, the Department
of Education and Training shall submit to the provincial People's Committee for
approval of the enrollment plan of the gifted school;
b) Gifted schools affiliated to higher education
institutions: annually, the principal of the gifted school shall submit to the
school council of the higher education institution that manages the gifted
school for approval of the enrollment plan of the gifted school;

3. The Department of Education and Training and the
higher education institutions having gifted schools shall stipulate the
enrollment registration, the application documents and the enrollment
conditions.
4. Entrance exam
a) Department of Education and Training (for gifted
schools in the province), the higher education institution (for gifted schools
in higher education institutions) shall:
- Regulate exam subjects, exam form and allotted
time for each exam subject according to each specialized subject; the weight
value of each exam subject (if any), cut-off score;
- Issue decisions on the establishment of question
paper setting council, invigilation council, marking council, grade review
council;
- Approve the list of students who have been
admitted to the gifted school.
b) The question paper setting, invigilation,
marking and grade review shall comply with the Regulation of upper secondary
school graduation exams.
5. Enrollment results are publicly announced on the
portal of the managing authority of the gifted school and the portal of the
gifted school within 03 (three) days from the date of announcement of the
enrollment results.
6. Before August 30 every year, the gifted school
shall send a report on enrollment results to the gifted school’s managing
authority.

1. The transfer of students from a gifted school to
a non-gifted upper-secondary school must comply with the regulations on transferring
and receiving students studying at lower-secondary schools and upper-secondary
schools of the Ministry of Education and Training.
2. The transfer of students from a gifted school to
another gifted school shall comply with the regulations on transferring and
receiving students studying at lower-secondary schools and upper-secondary
schools of the Ministry of Education and Training and meet extra requirements
as follows:
a) If the sending gifted school and the receiving
gifted school has held the enrollment by a common exam (the same exam question,
the exam period), such student must be adequately qualified to be admitted to
the receiving gifted school.
b) If the sending gifted school and the receiving
gifted school has not held the enrollment by a common exam (the same exam
question, the exam period), or such common exam (with the same exam question,
the exam period) has been administered but the mentioned student is
inadequately qualified to be admitted to the receiving gifted school, he/she must
take the entrance exam and meet the requirements pertaining to supplementary
enrollment in the receiving gifted school as prescribed in Article 19 of this
Regulation.
Article 19. Supplementary enrollment in gifted
schools
1. In case the gifted school needs more students,
the principal of the gifted school shall develop a plan for supplementary
enrollment in the gifted school and request the Department of Education and
Training (for gifted schools in the province), the higher education institution
(for gifted school affiliated to higher education institution) to approve the
plan for supplementary enrollment in the gifted school.
2. Eligible candidates for the supplementary
entrance exam to a gifted school are students from a gifted school who apply to
transfer to another gifted school specified at Point b, Clause 2, Article 18 of
this Regulation; non-gifted upper-secondary school students who achieve a good
level of academic performance and conduct in the school year immediately
preceding the year of supplementary enrollment.
3. The administration of entrance exams and
announcement of results of supplementary enrollment in gifted schools comply
with Clauses 4 and 5, Article 17 of this Regulation.
4. At least 30 (sixty) days before the exam date,
the gifted school shall publicly announce its supplementary enrollment plan on
the web portal of their own and of the gifted school’s managing authority.

1. Education program
a) As for specialized subjects: Implement advanced
education programs for specialized subjects prescribed by the Minister of
Education and Training;
b) As for the remaining subjects: Implement the
general education program promulgated by the Minister of Education and
Training;
c) The principal of the gifted school shall decide
the teaching in foreign languages according to regulations; develop teaching
materials according to the advanced education program for specialized subjects
prescribed by the Minister of Education and Training.
2. Education plan
a) The educational plan of the gifted school shall
be developed to organize the implementation of the educational program of the
gifted school as prescribed in Clause 1 of this Article;
b) The educational plan of the gifted school must
ensure the full implementation of the general education plan as prescribed, and
spend time enhancing advanced teaching of specialized subjects, foreign
languages, IT and strengthening life skills and social skills of students.
c) Gifted schools organize educational activities
according to the Charter of lower-secondary schools, upper-secondary schools
and multi-level schools, and also strengthen the organization of educational
activities about arts, music and sports to develop students' moral, intellectual,
physical and aesthetic skills; strengthen the organization of scientific
research, technical creation, life value education, life skills and social
activities for students; focus on forming subject clubs and other clubs
suitable to the needs of students and circumstances of the school.
Article 21. Detecting and fostering excellent
students

2. Students with outstanding talents are cared for,
nurtured, monitored for development and assessed regularly to have appropriate
fostering methods to develop the students' talents to the fullest.
3. Increase the use of assessment methods and tools
suitable for gifted students in order to improve the detection and fostering of
students' capacity.
Article 22. Evaluation and accreditation of
education quality
The gifted school shall evaluate and accredit
education quality in accordance with the regulations of the Ministry of
Education and Training on the assessment and accreditation of education quality
for lower-secondary schools, upper-secondary schools and multi-level schools.
The results of the evaluation and accreditation of the educational quality of
the gifted schools must meet the standards of the national standard schools.
