CIRCULAR

GUIDELINES FOR SELECTION OF TEXTBOOKS IN GENERAL EDUCATION INSTITUTIONS

Pursuant to the Law on Education dated June 14, 2005; the Law on amendments to the Law on Education dated November 25, 2009;

Pursuant to the Resolution No. 88/2014/QH13 dated November 28, 2014 of the National Assembly on renovation of general education programs and textbooks; the Resolution No. 51/2017/NQ14 dated November 21, 2017 of the National Assembly amending roadmap for implementation of new general education programs and textbooks under the Resolution No. 88/2014/QH13 dated November 28, 2014;

Pursuant to the Government’s Decree No. 69/2017/ND-CP dated May 25, 2017 defining functions, tasks, power and organizational structure of the Ministry of Education and Training;

At the request of the Director of Primary Education Department and Director of Secondary Education Department;

The Minister of Education and Training promulgates a Circular providing guidelines for selection of textbooks in general education institutions.

Article 1. Scope and regulated entities

1. This Circular provides guidelines for selection of textbooks in general education institutions.

2. This Circular applies to primary schools, lower secondary schools, upper secondary schools, multi-grade schools and educational institutions implementing general education programs (hereinafter referred to as “general education institutions”), and relevant organizations and individuals.

Article 2. Principles for textbook selection  

1. Only textbooks included in the list of textbooks approved by the Minister of Education and Training shall be selected by general education institutions.

2. 01 (one) title of textbooks shall be selected for each subject or each educational activity in each grade.

3. The textbook selection process must be carried out in an obvious, transparent and lawful manner.

Article 3. Textbook selection criteria

1. Selected textbooks must be appropriate to local socio-economic characteristics.

Chapter II

ORGANIZATION AND OPERATION OF TEXTBOOK SELECTION COUNCIL

Article 4. Textbook selection council 

1. The textbook selection council of a general education institution (hereinafter referred to as “Council”) shall be established by the head of the general education institution to assist him/her in selecting textbooks. Each general education institution shall establish 01 (one) Council only. With regard to a multi-grade school, 01 (one) Council shall be established to take charge of selecting textbooks for each grade.

2. A Council is comprised of heads, deputy heads, leaders of departments/specialist teams, representative teachers of subjects and educational activities (hereinafter referred to as “subjects”) for which textbooks will be selected, and representatives of the parents' board of the general education institution.  Total members of the Council must be an odd number and not fewer than 11 (eleven) persons, and 2/3 of which must be leaders of specialist teams and teachers. With regard to a general education institution having less than 10 (ten) classes, the Council is comprised of at least 07 (seven) persons.

3. Persons engaged in the compilation or appraisal of textbooks organized by publishers, or engaged in the guidance on compilation, publishing, printing and release of textbooks and those working at publishers whose textbooks will be selected shall not be eligible to be members of the Council.

4. The Council shall have the following duties:

a) Select textbooks in accordance with the provisions herein and specific textbook selection criteria adopted by the People’s Committee of the relevant province or central-affiliated city (hereinafter referred to as “provincial People's Committee”);

b) Propose the list of textbooks to be used to the head of the general education institution;

Article 5. Council’s structure

1. The Council's Chairperson is the head of the general education institution. If the head of the general education institution is not eligible to act as a Council's member as prescribed in Clause 3 Article 4 hereof and is absent due to force majeure events, deputy head of the general education institution shall act as the Council’s Chairperson.

2. Deputy Chairperson of the Council is deputy head of the general education institution or a specialist team’s leader.

3. The Council’s Secretary is a specialist team’s leader.

4. Council’s members are leaders of specialist teams, representative teachers of subjects, and representatives of the parents' board of the general education institution.

Article 6. Duties and rights and Council’s members

1. The Council’s Chairperson shall have the following duties and rights:

a) Assume responsibility for the Council’s operations, develop and organize the implementation of working plans of the Council;

b) Organize operations of the Council; assign duties to Deputy Chairperson, Secretary and members of the Council;

d) Perform other duties and rights as prescribed in Points a, b Clause 4 of this Article;

dd) Take accountability for the Council’s decisions on textbook selection.

2. The Council’s Deputy Chairperson shall have the following duties and rights:

a) Assume responsibility for duties assigned by the Council’s Chairperson;

b) Perform other duties and rights as prescribed in Points a, b, d Clause 4 of this Article.

3. The Council’s Secretary shall have the following duties and rights:

a) Assist the Council’s Chairperson in preparing working contents/programs of the Council;

b) Make working records of the Council;

c) Perform other duties and rights as prescribed in Points a, b, d Clause 4 of this Article.

a) Attend meetings of the Council; get opinions of students and their parents about the selection of textbooks; examine and evaluate textbooks according to textbook selection criteria and relevant documents provided by the Council;

b) Assume responsibility for his/her opinions about textbook selection;

c) If a member cannot attend the Council’s meeting, he/she shall be required to report it to the Council’s Chairperson and provide the later with his/her written opinions about textbook selection before the meeting; these opinions shall be considered when reaching textbook selection results in the first voting of the Council;

d) Perform other duties as assigned by the Council’s Chairperson.

Article 7. Council’s working principles

1. The Council shall work according to the principle of democracy, objectiveness and transparency.

2. A meeting of the Council is said to be valid if at least 2/3 (two-thirds) of its members, including the Council’s Chairperson, Deputy Chairperson and Secretary, are present.

3. Results of each meeting of the Council must be recorded in writing. The meeting's record must bear signatures of the Council’s Chairperson, Deputy Chairperson, Secretary and members attending the meeting.

Article 8. Textbook selection procedures 

1. The specialist team shall examine, discuss and evaluate textbooks of subjects of their responsible specialty according to textbook selection criteria. Teachers shall ballot for a title of textbooks for each subject within the scope of evaluation and selection of the specialist team. The specialist team shall submit a report to the Council on the list of selected textbooks sorted in descending order of assenting votes. The list of selected textbooks must bear the signatures of the leader and teachers of the relevant specialist team.

2. The Council shall convene a meeting to discuss and evaluate textbooks included in the list of selected textbooks provided by the specialist team according to the principles in Article 2 hereof and relevant textbook selection criteria. The Council shall select textbooks by ballot. A textbook shall be selected if more than 1/2 (a half) of the Council's members voted for it. In case no textbook is voted for by more than 1/2 (a half) of the Council's members, the Council shall discuss and analyze the listed textbooks according to the relevant textbook selection criteria and hold the ballot again. After the second ballot, if no textbook is selected with assenting votes by more than 1/2 (a half) of the Council's members, the Council shall decide to select the textbook with the highest assent votes from the list of textbooks provided by the specialist team as prescribed in Clause 1 of this Article. The Council shall make a record of textbook selection results which must bear the signatures of the Council’s Chairperson, Deputy Chairperson, Secretary and members attending the meeting.

3. The Council shall provide the list of selected textbooks to the head of the general education institution for consideration and approval.

4. Based on the Council’s proposal, the head of the general education institution shall decide the list of textbooks to be used in that general education institution.

Article 9. Announcement of selected textbooks

The head of the general education institution shall make the list of textbooks to be used publicly available and post the same at the general education institution at least 04 (four) months before beginning a new school year.

Chapter IV

IMPLEMENTATION ORGANIZATION

1. Based on textbook selection criteria in Article 3 hereof, provide specific textbook selection criteria appropriate to local general education institutions.

2. Direct the provincial department of education and training, provincial department of education, science and technology (hereinafter referred to as “provincial department of education and training”), People's Committees of rural/urban districts, district-level towns and provincial cities (hereinafter referred to as “district-level People's Committees”) in instructing, supervising and inspecting the selection of textbooks by general education institutions in accordance with regulations herein.

3. Provide funding, within their management, for general education institutions to cover textbook selection costs.

Article 11. Responsibilities of provincial departments of education and training

1. Pursuant to the provisions in Article 3 hereof, provide opinions to the relevant provincial People’s Committee about the promulgation of specific textbook selection criteria appropriate to local general education institutions.

2. Direct, instruct, supervise and inspect the textbook selection by general education institutions within their management.

3. Report the Ministry of Education and Training and the relevant provincial People's Committee, and provide publishers whose textbooks are selected with information on the list and quantity of textbooks supplied by each publisher, including reserve textbooks, in order to ensure the availability of textbooks before beginning a new school year.

Article 12. Responsibilities of district-level people’s committees

1. Direct district-level departments of education and training in instructing, supervising and inspecting the textbook selection by general education institutions within their management.

Article 13. Responsibilities of district-level departments of education and training

1. Direct, instruct, supervise and inspect the textbook selection by general education institutions within their management.

2. Consolidate and submit reports to the relevant district-level People’s Committee and provincial department of education and training on textbook selection results of general education institutions within their management.

Article 14. Responsibilities of general education institutions

1. Organize the selection of textbooks according to the provisions herein and relevant regulations adopted by the relevant provincial People's Committee; submit reports on textbook selection results to the relevant provincial department of education and training (by upper secondary schools) or district-level department of education and training (by primary schools and lower secondary schools).

2. Use selected textbooks during teaching and learning activities; instruct teachers, students and their parents in using textbooks in accordance with law regulations.

3. Assume responsibility before education authorities, students and their parents for their decisions on textbook selection.

This Circular comes into force from March 15, 2020.

Article 16. Responsibility for implementation

Chief of Office, Director of Primary Education Department, Director of Secondary Education Department and heads of relevant units affiliated to the Ministry of Education and Training, Chairpersons of People’s Committees at all levels, Directors of provincial Departments of Education and Training, Heads of district-level Departments of Education and Training, heads of general education institutions, and relevant organizations and individuals are responsible for the implementation of this Circular./.
