CIRCULAR

ON CONDITIONS AND PROCEDURES FOR AND COMPETENCE IN RECOGNITION OF DEGREES AWARDED BY FOREIGN EDUCATIONAL INSTITUTIONS FOR USE IN VIETNAM

Pursuant to the Education Law dated June 14, 2019;

Pursuant to the Law on Higher Education dated June 18, 2012 and Law on Amendments to Law on Higher Education dated November 19, 2018;

Pursuant to the Government’s Decree No. 69/2017/ND-CP dated May 25, 2017 on functions, duties, powers and organizational structure of the Ministry of Education and Training;

At the request of the Head of Quality Control Department;

The Minister of Education and Training hereby promulgates a Circular on conditions and procedures for and competence in recognition of degrees awarded by foreign educational institutions for use in Vietnam.

Article 1. Scope and regulated entities

2. This Circular is applicable to:

a) Quality Control Department affiliated to the Ministry of Education and Training;

b) Education authorities affiliated to People’s Committees of provinces and central-affiliated cities (hereinafter referred to as “Departments of Education and Training”);

c) Organizations and individuals involved in recognition of degrees awarded by foreign educational institutions for use in Vietnam.

Article 2. Degree recognition

Recognition of a degree awarded by a foreign educational institution for use in Vietnam (hereinafter referred to as “degree recognition”) refers to the recognition of a learner’s qualification written on a degree of the education system of the home country of the foreign educational institution and determination of the equivalent qualification in the Vietnamese Qualifications Framework.

Article 3. Degree recognition rules

1. Degree recognition shall be carried out at the request of the degree holder or the personnel authority or a worker management unit with the permission of the degree holder (hereinafter collectively referred to as “applicants”).

2. A degree awarded by a foreign educational institution may be recognized when the learner has completed an accredited educational program according to regulations of the home country of the institution and the degree is recognized by the competent education authority of this country according to regulations in Article 4 of this Circular.

4. Higher education institutions shall self-assess degrees for use in training activities based on conditions provided for in Article 4 herein and take responsibility before the law for degree assessment results. Where necessary, higher education institutions may request degree holders to apply for degree recognition in compliance with regulations in Article 7 herein.

Article 4. Conditions for degree recognition

1. Degrees awarded by foreign educational institutions may be recognized when the study or research duration of the degree programs are appropriate to the structural framework of the national education system and either of the following conditions is fulfilled:

a) The degree program has been accredited by an accrediting organization of the home country of the foreign educational institution as suitable for the mode of study;

b) The foreign educational institution is permitted to provide training and award the degree by the competent education authority of its home country or has been accredited by an accrediting organization of its home country.

2. Degrees awarded by foreign educational institutions operating in another country besides their home countries (including in Vietnam) may be recognized when these institutions are permitted to establish a branch and provide training or participate in joint training or training cooperation by competent education authorities of both countries; provide training according to their licenses and meet the regulations in Clause 1 of this Article.

3. Online-learning and blended-learning degrees awarded by foreign educational institutions may be recognized when they meet the regulations in Point a Clause 1 herein and either of the following conditions:

a) The Ministry of Education and Training permits provision of the degree program in Vietnam to learners living and studying in Vietnam;

b) The competent education authority of the country where the degree program is provided permits provision of the program to learners living and studying in that country;

Article 5. Exemption from degree recognition

1. The following degrees awarded by foreign educational institutions are exempt from degree recognition when they are used in Vietnam:

a) Degrees awarded by foreign educational institutions under agreements on degree equivalence or mutual degree recognition or degree-related conventions to which the Socialist Republic of Vietnam is a signatory and which have been published by the Ministry of Education and Training;

b) Degrees awarded by foreign educational institutions to learners sent to study by the Ministry of Education and Training using state budget;

c) Degrees awarded by foreign educational institutions to learners under Vietnam-based joint training programs approved by the competent authority after the entry into force of the Law on Amendments to Law on Higher Education (Law No. 34/2018/QH14 dated 19/11/2018).

2. Requirements for the degrees mentioned in Clause 1 herein:

a) Their names are in compliance with regulations on degrees of the Vietnamese national educational system;

b) Training duration and admission requirements adhere to regulations of the Ministry of Education and Training;

c) For in-class learning and blended learning, online classes must constitute no more than 30% of total classes of each program.

Article 6. Competence in degree recognition

1. Head of Quality Control Department affiliated to the Ministry of Education and Training has the power to recognize bachelor’s degrees, master’s degrees, doctoral degrees and equivalent degrees.

2. Directors of Departments of Education and Training have the power to recognize lower secondary diplomas, upper secondary diplomas and certificates of completion of the national curriculum.

Article 7. Degree recognition procedures

1. Each applicant shall provide information on the degree using the form in Appendix I enclosed therewith on the online public service portal of the Ministry of Education and Training or Department of Education and Training (hereinafter collectively referred to as “recognition authority”). The following proof for degree verification may be submitted directly or by post to the recognition authority:

a) Copy of the degree or copy from the master degree register together with a notarized Vietnamese translation and copies of directly relevant degrees and certificates;

b) Copy of the degree’s appendix or transcript together with a notarized Vietnamese translation;

c) Proof of overseas study (if any);

d) Letter of authorization of verification of degree’s information (if requested by the awarding institution).

3. The degree recognition result shall be written on a certificate according to Appendixes II and III enclosed therewith. If a degree is not eligible for recognition or there are insufficient grounds to verify information on the degree by the deadline mentioned in Clause 2 herein, the recognition authority must notify the applicant in writing. If the recognition authority is unable to determine the qualification equivalent to the degree in the Vietnamese Qualifications Framework, it shall provide information and recognize the degree’s value according to the education system of the home country of the awarding institution.

4. The recognition authority shall prepare a degree recognition certificate issuance book, which includes full name and date of birth of degree holders; name of awarding institutions; mode of study; equivalent qualification in the Vietnamese Qualifications Framework or qualification according to the education system of the home country of the awarding institution; and book entry number.

Article 8. Annulment of degree recognition results

1. In case it is verified that a degree is not lawful or a degree recognition application is not honest, the degree recognition result will be annulled.

2. Head of the recognition authority has the power to issue decisions on annulment of degree recognition result and certificate revocation, which must include the reason for such annulment and revocation.

3. Every decision on annulment of degree recognition result and certificate revocation shall be posted on the portal of the recognition authority and sent to the degree holder, inspection and violation detection authority (if any), workplace of the degree holder (if any) and relevant regulatory bodies and organizations.

Article 9. Responsibilities of recognition authority

1. Quality Control Department

a) Take responsibility for degree recognition results and settle complaints and denunciations (if any);

a) Take responsibility for degree recognition results and settle complaints and denunciations (if any);

b) Report number of recognized degrees to the Ministry of Education and Training before December 25 of every year.

Article 10. Effect

1. This Circular takes effect from June 01, 2021 and supersedes Decision No. 77/2007/QD-BGDDT, Circular No. 26/2013/TT-BGDDT and Circular No. 17/2017/TT-BGDDT.

2. Chief of the Ministry Office, Head of Quality Control Department, heads of relevant affiliates of the Ministry of Education and Training; Directors of Departments of Education and Training; heads of parent universities, academies and universities; and relevant organizations and individuals shall implement this Circular./.
