NGHỊ ĐỊNH

QUY ĐỊNH CƠ SỞ DỮ LIỆU QUỐC GIA VỀ TIẾP CÔNG DÂN, XỬ LÝ ĐƠN, GIẢI QUYẾT KHIẾU NẠI, TỐ CÁO

Căn cứ Luật Tổ chức Chính phủ số 63/2025/QH15;

Căn cứ Luật Ban hành văn bản quy phạm pháp luật số 64/2025/QH15 được sửa đổi, bổ sung bởi Luật số 87/2025/QH15;

Căn cứ Luật Tiếp công dân số 42/2013/QH13 được sửa đổi, bổ sung bởi Luật số 136/2025/QH15;

Căn cứ Luật Khiếu nại số 02/2011/QH13 được sửa đổi, bổ sung bởi Luật số 136/2025/QH15;

Căn cứ Luật Tố cáo số 25/2018/QH14 được sửa đổi, bổ sung bởi Luật số 136/2025/QH15;

Căn cứ Luật Dữ liệu số 60/2024/QH15;

Căn cứ Luật Chuyển đổi số số 148/2025/QH15;

Theo đề nghị của Tổng Thanh tra Chính phủ;

Chính phủ ban hành Nghị định quy định Cơ sở dữ liệu quốc gia về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định về xây dựng, cập nhật, quản lý, khai thác, sử dụng Cơ sở dữ liệu quốc gia về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo (sau đây gọi tắt là Cơ sở dữ liệu); tổ chức cập nhật, xử lý, khai thác, sử dụng dữ liệu liên quan đến tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo trên môi trường số; trách nhiệm của cơ quan, tổ chức, cá nhân có liên quan.

Điều 2. Đối tượng áp dụng

Áp dụng đối với các bộ, cơ quan ngang bộ, Ủy ban nhân dân các cấp, cơ quan, tổ chức, người có thẩm quyền tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo và các cơ quan, tổ chức, cá nhân có liên quan.

Điều 3. Vị trí, vai trò và giá trị pháp lý của Cơ sở dữ liệu

1. Cơ sở dữ liệu được xây dựng và quản lý tập trung, thống nhất trên phạm vi toàn quốc, nhằm thu thập, lưu trữ, quản lý, kết nối, chia sẻ và khai thác dữ liệu phục vụ tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo.

2. Dữ liệu trong Cơ sở dữ liệu được cập nhật, quản lý theo thời gian thực; có giá trị pháp lý theo quy định của pháp luật về giao dịch điện tử, dữ liệu và pháp luật có liên quan; được khai thác, sử dụng thay thế giấy tờ, tài liệu bản giấy trong trường hợp đáp ứng điều kiện về tính toàn vẹn, xác thực, khả năng truy cập, sử dụng và pháp luật không có quy định khác.

3. Dữ liệu trong Cơ sở dữ liệu được số hóa, chuẩn hóa, bao gồm dữ liệu có cấu trúc và dữ liệu phi cấu trúc, được tổ chức và quản lý theo cấu trúc phù hợp, bảo đảm khả năng kết nối, chia sẻ, liên thông và khai thác giữa các cơ quan, tổ chức trong hệ thống chính trị theo quy định của pháp luật; xác định và phân loại theo cấp độ an toàn dữ liệu trong quá trình lưu trữ, chia sẻ và khai thác, bảo đảm kiểm soát, theo dõi hoạt động truy cập và kịp thời phát hiện, xử lý sự cố, bảo đảm an ninh mạng, đồng thời xác định rõ trách nhiệm của cơ quan, tổ chức, cá nhân có liên quan khi xảy ra sự cố làm lộ, mất hoặc bị truy cập trái phép dữ liệu.

4. Cơ sở dữ liệu được đặt tại Trung tâm dữ liệu quốc gia.

Điều 4. Nguyên tắc xây dựng, cập nhật, quản lý, khai thác và sử dụng Cơ sở dữ liệu

1. Tuân thủ các quy định của pháp luật về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, bảo vệ bí mật nhà nước, bảo vệ dữ liệu cá nhân và các quy định pháp luật khác có liên quan.

2. Bảo đảm phù hợp với Khung kiến trúc tổng thể quốc gia số, Khung kiến trúc dữ liệu quốc gia, Khung quản trị, quản lý dữ liệu quốc gia, Từ điển dữ liệu dùng chung; đáp ứng tiêu chuẩn, quy chuẩn kỹ thuật; bảo đảm khả năng kết nối, chia sẻ dữ liệu theo quy định của pháp luật.

3. Dữ liệu được rà soát, cập nhật, quản lý bảo đảm kịp thời, đầy đủ, chính xác, thống nhất, đồng bộ và đúng thẩm quyền, trình tự, thủ tục theo quy định của pháp luật.

4. Bảo đảm việc quản lý, vận hành, khai thác, sử dụng Cơ sở dữ liệu chặt chẽ, an toàn, ổn định, thông suốt; việc khai thác, sử dụng dữ liệu được thực hiện theo phân quyền, đúng mục đích, bảo đảm an toàn thông tin, an ninh mạng theo quy định của pháp luật.

5. Bảo đảm lấy người dân làm trung tâm, tạo điều kiện để người dân theo dõi, giám sát quá trình xử lý vụ việc của mình trên môi trường số.

6. Việc quản lý, vận hành Cơ sở dữ liệu phải bảo đảm công khai, minh bạch, có khả năng truy xuất nguồn gốc, lịch sử cập nhật và chủ thể thực hiện, có thể kiểm tra, giám sát, làm rõ trách nhiệm của cơ quan, tổ chức, cá nhân.

7. Bảo đảm tự động hóa, số hóa toàn trình quản lý, xử lý dữ liệu, hạn chế tối đa việc xử lý thủ công.

Chương II

XÂY DỰNG, QUẢN LÝ, KHAI THÁC CƠ SỞ DỮ LIỆU

Mục 1. DỮ LIỆU TRONG CƠ SỞ DỮ LIỆU

Điều 5. Cập nhật dữ liệu trong Cơ sở dữ liệu

1. Dữ liệu cập nhật trong Cơ sở dữ liệu được tổ chức theo mô hình dữ liệu phù hợp, bao gồm:

a) Dữ liệu về tiếp công dân, xử lý đơn;

b) Dữ liệu về khiếu nại và giải quyết khiếu nại;

c) Dữ liệu về tố cáo và giải quyết tố cáo;

d) Dữ liệu về kiến nghị, phản ánh và kết quả xử lý;

đ) Các dữ liệu khác phục vụ yêu cầu quản lý nhà nước theo quy định của pháp luật.

2. Dữ liệu phải được chuẩn hóa theo tiêu chuẩn, quy chuẩn kỹ thuật, bảo đảm khả năng kết nối, chia sẻ, khai thác tự động hoặc theo yêu cầu.

3. Dữ liệu trong Cơ sở dữ liệu quy định tại khoản 1 Điều này phục vụ công tác quản lý nhà nước về tiếp công dân, giải quyết khiếu nại, tố cáo được xây dựng bảo đảm:

a) Phản ánh đầy đủ quá trình xử lý, giải quyết vụ việc từ khi tiếp nhận đến khi kết thúc;

b) Thể hiện rõ số lần khiếu nại, tố cáo;

c) Phân loại được tính chất, mức độ của vụ việc;

d) Phục vụ công tác tổng hợp, phân tích, đánh giá kết quả và dự báo tình hình tiếp công dân, giải quyết khiếu nại, tố cáo.

4. Các dữ liệu quy định tại Điều này được cập nhật vào Cơ sở dữ liệu đối với vụ việc phát sinh kể từ ngày Cơ sở dữ liệu được đưa vào vận hành chính thức.

Đối với dữ liệu của các vụ việc đã phát sinh trước thời điểm Cơ sở dữ liệu được đưa vào vận hành chính thức, việc cập nhật được thực hiện trong các trường hợp sau:

a) Đơn đang trong quá trình xử lý; vụ việc khiếu nại, tố cáo đang giải quyết;

b) Vụ việc theo quy định tại khoản 2 Điều 6 Nghị định này;

c) Theo kế hoạch chuyển đổi, kế thừa dữ liệu được quy định tại khoản 2 Điều 30 của Nghị định này.

Điều 6. Nguồn dữ liệu cập nhật vào Cơ sở dữ liệu

1. Dữ liệu được cập nhật vào Cơ sở dữ liệu bao gồm dữ liệu phát sinh trực tiếp từ việc tiếp công dân, xử lý đơn; vụ việc khiếu nại có thông báo thụ lý khiếu nại, vụ việc tố cáo có quyết định thụ lý giải quyết tố cáo kể từ ngày Cơ sở dữ liệu được đưa vào vận hành chính thức.

2. Vụ việc khiếu nại, tố cáo phức tạp, kéo dài không thuộc trường hợp được quy định tại khoản 1 Điều này được cập nhật theo văn bản yêu cầu của Thanh tra Chính phủ hoặc Thủ trưởng cơ quan có thẩm quyền.

Điều 7. Thời điểm nhập dữ liệu vào Cơ sở dữ liệu

1. Cơ quan, người có thẩm quyền có trách nhiệm cập nhật dữ liệu ngay từ thời điểm tiếp nhận khiếu nại, tố cáo, kiến nghị, phản ánh và tiếp tục cập nhật đầy đủ, kịp thời trong suốt quá trình tiếp công dân, xử lý đơn, thụ lý, giải quyết và công khai kết quả. Việc cập nhật dữ liệu phải bảo đảm liên tục, đồng bộ, phản ánh đúng trạng thái xử lý vụ việc theo từng thời điểm. Trường hợp không cập nhật hoặc chậm cập nhật sẽ bị xử lý trách nhiệm tùy theo mức độ vi phạm.

2. Đối với báo cáo định kỳ, báo cáo vụ việc, báo cáo chuyên đề, báo cáo đột xuất về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, xử lý kiến nghị, phản ánh cập nhật theo yêu cầu của Thanh tra Chính phủ và thuộc trường hợp quy định tại khoản 2 Điều 6 của Nghị định này, cơ quan có trách nhiệm cập nhật trong thời hạn 15 ngày kể từ ngày nhận được văn bản yêu cầu của Thanh tra Chính phủ.

3. Việc cập nhật dữ liệu vào Cơ sở dữ liệu được thực hiện theo phương thức tự động đối với các hệ thống thông tin nghiệp vụ có kết nối, chia sẻ dữ liệu với Cơ sở dữ liệu và phải bảo đảm các yêu cầu sau đây:

a) Dữ liệu được truyền, nhận theo tiêu chuẩn, quy chuẩn kỹ thuật, định dạng dữ liệu do cơ quan có thẩm quyền ban hành;

b) Bảo đảm tính đầy đủ, chính xác, kịp thời và thống nhất của dữ liệu giữa các hệ thống;

c) Xác định rõ trách nhiệm của cơ quan quản lý hệ thống nguồn và cơ quan quản lý Cơ sở dữ liệu trong việc bảo đảm chất lượng dữ liệu;

d) Có cơ chế kiểm tra, đối soát, phát hiện và xử lý sai lệch dữ liệu trong quá trình đồng bộ;

đ) Tuân thủ các quy định về bảo mật thông tin, an ninh mạng theo quy định của pháp luật.

Trường hợp chưa đáp ứng điều kiện cập nhật tự động thì việc cập nhật được thực hiện theo quy định tại các khoản 1 và 2 Điều này.

Điều 8. Cập nhật bổ sung, điều chỉnh và bảo đảm chất lượng dữ liệu trong Cơ sở dữ liệu

1. Trong thời hạn 05 ngày làm việc, kể từ ngày phát hiện thông tin trong Cơ sở dữ liệu chưa đầy đủ, chính xác hoặc có sự sai lệch về nội dung giữa dữ liệu điện tử và hồ sơ, tài liệu nghiệp vụ bằng giấy thì cơ quan, tổ chức, cá nhân cập nhật dữ liệu phải tiến hành kiểm tra, cập nhật bổ sung, điều chỉnh.

2. Dữ liệu trong Cơ sở dữ liệu phải được kiểm tra, làm sạch, chuẩn hóa và đồng bộ theo quy định, bảo đảm tính đầy đủ, chính xác, nhất quán và khả năng khai thác, sử dụng.

Việc kiểm tra, làm sạch, chuẩn hóa và đồng bộ dữ liệu bao gồm:

a) Rà soát, phát hiện và xử lý dữ liệu trùng lặp, thiếu, sai hoặc không thống nhất;

b) Chuẩn hóa dữ liệu theo danh mục, tiêu chuẩn, quy chuẩn kỹ thuật do cơ quan có thẩm quyền ban hành;

c) Đối chiếu, bảo đảm sự thống nhất giữa dữ liệu điện tử với hồ sơ, tài liệu nghiệp vụ;

d) Đồng bộ dữ liệu giữa các hệ thống thông tin, cơ sở dữ liệu có liên quan;

đ) Cập nhật, điều chỉnh dữ liệu kịp thời khi có thay đổi hoặc phát hiện sai lệch.

Cơ quan, tổ chức, cá nhân có trách nhiệm cập nhật dữ liệu chịu trách nhiệm về tính chính xác, đầy đủ của dữ liệu do mình cung cấp, cập nhật.

Mục 2. TIẾP NHẬN VÀ XỬ LÝ VỤ VIỆC TRÊN CƠ SỞ DỮ LIỆU

Điều 9. Theo dõi, cập nhật và quản lý dữ liệu

1. Cơ quan, tổ chức, người có thẩm quyền giải quyết có trách nhiệm tổ chức xử lý vụ việc theo quy định của pháp luật.

2. Thông tin về quá trình xử lý vụ việc phải được cập nhật đầy đủ, kịp thời, chính xác trên Cơ sở dữ liệu, bao gồm:

a) Tiếp nhận;

b) Phân loại, chuyển xử lý;

c) Thụ lý, xác minh, thu thập tài liệu, chứng cứ (nếu có);

d) Tổ chức đối thoại (nếu có);

đ) Kết quả giải quyết và các nội dung có liên quan;

e) Kết thúc vụ việc.

3. Việc cập nhật dữ liệu là trách nhiệm bắt buộc của cơ quan, tổ chức, người có thẩm quyền trong quá trình giải quyết vụ việc.

Cơ sở dữ liệu có chức năng theo dõi tiến độ xử lý, cảnh báo quá thời hạn giải quyết theo quy định của pháp luật.

4. Dữ liệu về quá trình xử lý vụ việc là căn cứ phục vụ công tác quản lý nhà nước, chỉ đạo, điều hành, kiểm tra, thanh tra.

5. Mỗi bước xử lý vụ việc phải xác định rõ cá nhân chịu trách nhiệm, thời điểm thực hiện, nội dung xử lý.

6. Cơ sở dữ liệu phải ghi nhận đầy đủ nhật ký xử lý; dữ liệu nhật ký không được sửa đổi, xóa bỏ trái quy định.

Điều 10. Nhập dữ liệu tiếp nhận khiếu nại, tố cáo, kiến nghị, phản ánh vào Cơ sở dữ liệu

1. Việc ghi nhận, nhập dữ liệu về tiếp nhận khiếu nại, tố cáo, kiến nghị, phản ánh vào Cơ sở dữ liệu được thực hiện trên cơ sở các hình thức tiếp nhận theo quy định của pháp luật về tiếp công dân, khiếu nại, tố cáo.

2. Nội dung tiếp nhận phải được ghi nhận đầy đủ, chính xác, kịp thời. Việc ghi nhận được thực hiện trên sổ tiếp công dân điện tử trong Cơ sở dữ liệu; trường hợp tiếp nhận bằng đơn giấy thì phải được số hóa, cập nhật vào Cơ sở dữ liệu.

3. Trường hợp tiếp nhận qua dịch vụ bưu chính thì cơ quan tiếp nhận có trách nhiệm kiểm tra, nhập dữ liệu và cập nhật vào Cơ sở dữ liệu theo quy định.

4. Việc tiếp nhận phải bảo đảm công khai, minh bạch, đúng thẩm quyền, trình tự, thủ tục theo quy định của pháp luật.

Điều 11. Cập nhật dữ liệu về phân loại, xử lý đơn

1. Việc phân loại, xử lý đơn được thực hiện theo quy định của pháp luật về tiếp công dân, khiếu nại, tố cáo; các thông tin về phân loại, xử lý đơn phải được cập nhật đầy đủ, kịp thời vào Cơ sở dữ liệu.

2. Việc phân loại, chuyển đơn được thực hiện đồng thời trên Cơ sở dữ liệu, bảo đảm xác định rõ cơ quan, tổ chức, đơn vị, người có thẩm quyền giải quyết, thời điểm chuyển và trạng thái xử lý.

Cơ quan tiếp nhận đơn có trách nhiệm xác nhận việc tiếp nhận trên Cơ sở dữ liệu và tổ chức xử lý, giải quyết theo quy định.

Điều 12. Kiểm soát trùng lặp vụ việc

1. Cơ sở dữ liệu có chức năng kiểm tra, đối chiếu thông tin nhằm phát hiện các vụ việc có dấu hiệu trùng lặp hoặc đã được giải quyết. Trường hợp phát hiện vụ việc có dấu hiệu trùng lặp hoặc đã được giải quyết, Cơ sở dữ liệu cảnh báo để người tiếp nhận xem xét.

2. Việc kiểm soát trùng lặp phải bảo đảm khách quan, chính xác, không làm hạn chế quyền khiếu nại, tố cáo, kiến nghị, phản ánh của công dân theo quy định của pháp luật.

3. Cơ sở dữ liệu có thể ứng dụng công nghệ phân tích dữ liệu, trí tuệ nhân tạo để hỗ trợ phát hiện trùng lặp về nội dung hoặc vụ việc đã được giải quyết.

4. Người có thẩm quyền có trách nhiệm rà soát, kiểm chứng và chịu trách nhiệm về tính chính xác của kết quả do trí tuệ nhân tạo cung cấp trước khi sử dụng. Kết quả xử lý tự động của trí tuệ nhân tạo không được dùng làm căn cứ duy nhất để đưa ra kết luận giải quyết hoặc áp dụng các biện pháp xử lý đối với người khiếu nại, người tố cáo.

Điều 13. Tạo lập và quản lý mã vụ việc

Sau khi thực hiện tiếp nhận vụ việc, trường hợp thuộc thẩm quyền giải quyết, người tiếp nhận phải thực hiện các nhiệm vụ nhập dữ liệu như sau:

1. Mỗi vụ việc khiếu nại, tố cáo, kiến nghị, phản ánh sau khi được tiếp nhận phải được lập thành một hồ sơ điện tử trên Cơ sở dữ liệu và được cấp mã vụ việc.

2. Mã vụ việc là dãy ký tự được tạo lập tự động, duy nhất đối với từng vụ việc được tạo lập trên Cơ sở dữ liệu nhằm phục vụ việc quản lý, khai thác thông tin trong toàn bộ quá trình xử lý, giải quyết vụ việc, bảo đảm không trùng lặp, có khả năng tra cứu, theo dõi và liên thông giữa các cơ quan có liên quan.

3. Mã vụ việc được sử dụng thống nhất trong toàn bộ quá trình tiếp nhận, xử lý, giải quyết, công khai và lưu trữ vụ việc.

4. Mã vụ việc là căn cứ để người khiếu nại, tố cáo, kiến nghị, phản ánh tra cứu tình trạng xử lý vụ việc theo quy định.

Điều 14. Thông báo kết quả xử lý!

1. Cơ quan, tổ chức, người có thẩm quyền có trách nhiệm thông báo cho người khiếu nại, tố cáo, kiến nghị, phản ánh về việc tiếp nhận, thụ lý, chuyển đơn và kết quả giải quyết theo quy định của pháp luật.

2. Người khiếu nại, tố cáo, kiến nghị, phản ánh được tra cứu thông tin về vụ việc thông qua mã vụ việc theo quy định.

3. Việc thông báo được thực hiện thông qua hệ thống điện tử, tin nhắn, thư điện tử hoặc các phương thức phù hợp khác.

Điều 15. Công khai kết quả giải quyết

1. Việc công khai kết quả giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh trên Cơ sở dữ liệu được thực hiện theo quy định của pháp luật về tiếp công dân, khiếu nại, tố cáo.

2. Nội dung công khai bao gồm các thông tin cơ bản sau đây:

a) Số, ngày, tháng, năm ban hành quyết định giải quyết;

b) Cơ quan, người có thẩm quyền ban hành;

c) Nội dung chính của kết quả giải quyết.

3. Trước khi công khai, cơ quan có thẩm quyền phải rà soát, xử lý, không công khai các thông tin thuộc bí mật nhà nước, thông tin cá nhân và các thông tin nhạy cảm theo quy định của pháp luật.

Chương III

TRÁCH NHIỆM XÂY DỰNG, QUẢN LÝ, KHAI THÁC CƠ SỞ DỮ LIỆU

Mục 1. QUẢN TRỊ, BẢO VỆ VÀ CHIA SẺ DỮ LIỆU

Điều 16. Quản trị và chia sẻ dữ liệu

1. Nguyên tắc quản trị dữ liệu

a) Dữ liệu trong Cơ sở dữ liệu được quản lý thống nhất, tập trung, bảo đảm tính toàn vẹn, nhất quán và khả năng khai thác liên thông trên phạm vi toàn quốc;

b) Việc tạo lập, cập nhật, quản lý và sử dụng dữ liệu phải tuân thủ nguyên tắc quản trị theo vòng đời dữ liệu, bảo đảm truy xuất được nguồn gốc, thời điểm cập nhật, chủ thể cập nhật và lịch sử thay đổi dữ liệu;

c) Thực hiện nguyên tắc “thu thập một lần, sử dụng nhiều lần”; cơ quan, tổ chức, cá nhân không được yêu cầu cung cấp lại thông tin, dữ liệu đã có trong Cơ sở dữ liệu, trừ trường hợp dữ liệu chưa được cập nhật, có căn cứ xác định dữ liệu không chính xác hoặc cần xác minh, đối chiếu để bảo đảm tính chính xác;

d) Dữ liệu chỉ được sử dụng đúng mục đích, phạm vi và thẩm quyền theo quy định; nghiêm cấm việc sử dụng dữ liệu vượt quá phạm vi được giao hoặc phục vụ mục đích cá nhân;

đ) Việc lưu trữ, bảo quản thông tin, tài liệu được thực hiện theo quy định của pháp luật về văn thư lưu trữ;

e) Bảo đảm tính chính xác, thống nhất của dữ liệu định danh cá nhân thông qua việc cập nhật, đồng bộ với Cơ sở dữ liệu quốc gia về dân cư theo quy định của pháp luật. Khi phát hiện dữ liệu không chính xác, chưa đầy đủ hoặc chưa được cập nhật, gây ảnh hưởng đến việc khai thác, tra cứu, cơ quan, tổ chức quản lý dữ liệu có trách nhiệm thông báo và phối hợp với cơ quan có thẩm quyền để kiểm tra, cập nhật kịp thời.

2. Phân loại, phân cấp quản lý dữ liệu

a) Dữ liệu phải được phân loại theo mức độ bảo mật, phạm vi khai thác và giá trị sử dụng; việc phân loại là căn cứ để xác định chế độ quản lý, lưu trữ, khai thác và chia sẻ;

b) Việc phân cấp quản lý dữ liệu phải xác định rõ trách nhiệm của từng cơ quan, tổ chức trong việc tạo lập, cập nhật, kiểm tra, phê duyệt và khai thác dữ liệu; việc phân cấp phải bảo đảm không chồng chéo, xác định rõ chủ thể chịu trách nhiệm.

3. Chia sẻ, khai thác và kiểm soát dữ liệu

a) Việc chia sẻ dữ liệu giữa các cơ quan nhà nước được thực hiện thông qua kết nối, liên thông hệ thống thông tin và nền tảng chia sẻ, điều phối dữ liệu của Trung tâm dữ liệu quốc gia theo quy định, trừ trường hợp pháp luật có quy định khác;

b) Việc chia sẻ dữ liệu phải bảo đảm đúng thẩm quyền, đúng mục đích, có kiểm soát truy cập và ghi nhận đầy đủ lịch sử khai thác;

c) Cơ quan, tổ chức, cá nhân được cấp quyền truy cập chỉ được khai thác dữ liệu trong phạm vi được phân quyền; nghiêm cấm việc sao chép, chuyển giao, cung cấp lại dữ liệu cho bên thứ ba khi chưa được phép;

d) Trường hợp khai thác dữ liệu phục vụ nghiên cứu, xây dựng chính sách phải thực hiện ẩn danh, tổng hợp dữ liệu theo quy định, bảo đảm không làm lộ thông tin cá nhân hoặc bí mật nhà nước.

Điều 17. Quản lý, bảo vệ Cơ sở dữ liệu

1. Cơ sở dữ liệu được quản lý, bảo vệ chặt chẽ, bảo đảm an ninh mạng, bảo mật thông tin theo quy định của pháp luật.

2. Cơ quan được giao quản lý Cơ sở dữ liệu có trách nhiệm:

a) Xây dựng, ban hành và tổ chức thực hiện quy chế quản lý, vận hành, khai thác Cơ sở dữ liệu;

b) Thiết lập các biện pháp kỹ thuật, nghiệp vụ để bảo đảm an toàn hệ thống, phòng, chống truy cập trái phép, tấn công mạng, mất mát, hư hỏng dữ liệu;

c) Tổ chức kiểm tra, đánh giá định kỳ và đột xuất về an toàn hệ thống, kịp thời phát hiện, xử lý rủi ro;

d) Bảo đảm duy trì hoạt động ổn định, liên tục của hệ thống; có phương án dự phòng, khôi phục khi xảy ra sự cố.

Mục 2. KẾT NỐI, KHAI THÁC VÀ SỬ DỤNG DỮ LIỆU

Điều 18. Kết nối, chia sẻ dữ liệu

1. Cơ sở dữ liệu phải được kết nối, chia sẻ với:

a) Cơ sở dữ liệu quốc gia về dân cư;

b) Cơ sở dữ liệu tổng hợp quốc gia;

c) Hệ thống thông tin báo cáo của cơ quan Đảng, Nhà nước, Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam và các tổ chức chính trị - xã hội;

d) Các cơ sở dữ liệu quốc gia và chuyên ngành khác có liên quan.

2. Việc kết nối, chia sẻ dữ liệu được thực hiện theo nguyên tắc tự động hoặc theo yêu cầu; bảo đảm kịp thời, chính xác; đúng thẩm quyền, mục đích sử dụng; tuân thủ quy định pháp luật về an ninh mạng, bảo vệ dữ liệu cá nhân, bảo vệ bí mật nhà nước và các quy định pháp luật khác có liên quan.

3. Các cơ quan, bộ, ngành, địa phương có trách nhiệm chuẩn hóa, làm sạch, cập nhật và đồng bộ dữ liệu theo tiêu chuẩn, quy chuẩn với Cơ sở dữ liệu; kết nối, chia sẻ dữ liệu thuộc phạm vi quản lý của mình với Cơ sở dữ liệu thông qua các cơ sở dữ liệu, hệ thống thông tin quy định tại khoản 1 Điều này bảo đảm đồng bộ, thống nhất, không trùng lặp.

4. Việc kết nối, chia sẻ dữ liệu được thực hiện theo phương thức tự động; bảo đảm tuân thủ tiêu chuẩn, quy chuẩn kỹ thuật thống nhất; đồng thời hạn chế việc chia sẻ dữ liệu bằng phương thức thủ công, xây dựng lộ trình chuyển đổi bắt buộc sang phương thức tự động.

Điều 19. Khai thác dữ liệu phục vụ chỉ đạo, điều hành

1. Cơ sở dữ liệu có chức năng hỗ trợ phân tích, tổng hợp, trực quan hóa dữ liệu phục vụ công tác chỉ đạo, điều hành.

2. Cơ sở dữ liệu có khả năng hỗ trợ phát hiện, cảnh báo các trường hợp sau:

a) Vụ việc khiếu nại, tố cáo phức tạp, kéo dài;

b) Vụ việc khiếu nại, tố cáo đông người;

c) Vụ việc khiếu nại, tố cáo có nguy cơ phát sinh điểm nóng về an ninh, trật tự - an toàn xã hội.

3. Việc khai thác, sử dụng dữ liệu được thực hiện theo phân quyền, đúng mục đích, bảo đảm an toàn, bảo mật thông tin theo quy định pháp luật.

4. Cơ sở dữ liệu ứng dụng công nghệ phân tích dữ liệu lớn, trí tuệ nhân tạo để hỗ trợ phát hiện, đánh giá tình hình khiếu nại, tố cáo, dự báo rủi ro và hỗ trợ cơ quan, tổ chức, người có thẩm quyền phân tích, ra quyết định.

Điều 20. Thẩm quyền, phạm vi khai thác Cơ sở dữ liệu

1. Cơ quan, tổ chức, cá nhân được cấp quyền truy cập vào Cơ sở dữ liệu để thực hiện các hoạt động liên quan đến nhập, chuyển, xử lý đơn; giải quyết theo dõi, nhận kết quả; khai thác và sử dụng dữ liệu theo chức năng, nhiệm vụ và phạm vi quyền hạn được giao.

2. Cơ quan, tổ chức, cá nhân có quyền yêu cầu cung cấp thông tin, dữ liệu trong Cơ sở dữ liệu bao gồm:

a) Tổng Bí thư, Chủ tịch nước, Thủ tướng Chính phủ, Chủ tịch Quốc hội, Thường trực Ban Bí thư, Phó Chủ tịch nước, các Phó Thủ tướng Chính phủ và thành viên Chính phủ, các Phó Chủ tịch Quốc hội và Ủy viên Ủy ban Thường vụ Quốc hội có quyền yêu cầu cung cấp thông tin, dữ liệu trong phạm vi toàn quốc;

b) Ủy ban Kiểm tra Trung ương, Văn phòng Trung ương Đảng và các Ban Đảng Trung ương, Văn phòng Chủ tịch nước, Văn phòng Chính phủ, Văn phòng Quốc hội, Hội đồng Dân tộc và các Ủy ban của Quốc hội, Ủy ban Trung ương Mặt trận Tổ quốc Việt Nam và các đại biểu Quốc hội có quyền yêu cầu cung cấp thông tin, dữ liệu trong phạm vi toàn quốc;

c) Các ban của Hội đồng nhân dân cấp tỉnh, Văn phòng Đoàn đại biểu Quốc hội và Hội đồng nhân dân cấp tỉnh, Văn phòng Ủy ban nhân dân cấp tỉnh, Văn phòng tỉnh ủy, thành ủy và các Ban thuộc tỉnh ủy, thành ủy, Ủy ban Mặt trận Tổ quốc tỉnh và đại biểu Hội đồng nhân dân cấp tỉnh có quyền yêu cầu cung cấp thông tin, dữ liệu trong phạm vi quản lý của Ủy ban nhân dân cấp tỉnh.

d) Văn phòng Hội đồng nhân dân và Ủy ban nhân dân cấp xã, Văn phòng và các ban thuộc Đảng ủy cấp xã, cơ quan Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã, đại biểu Hội đồng nhân dân cấp xã có quyền yêu cầu cung cấp thông tin, dữ liệu trong phạm vi quản lý của Ủy ban nhân dân cấp xã.

đ) Các cơ quan, tổ chức, cá nhân khác có quyền yêu cầu cung cấp thông tin theo quy định của pháp luật.

3. Việc khai thác, sử dụng dữ liệu thuộc danh mục bí mật nhà nước trong Cơ sở dữ liệu được thực hiện theo quy định pháp luật về bảo vệ bí mật nhà nước.

4. Việc khai thác dữ liệu được thực hiện chủ yếu thông qua phương thức điện tử trên cơ sở phân quyền truy cập; hạn chế việc cung cấp dữ liệu bằng văn bản, trừ trường hợp pháp luật có quy định khác.

5. Công dân có quyền được cung cấp thông tin cá nhân của mình do cơ quan nhà nước thu thập, lưu trữ trong Cơ sở dữ liệu theo quy định; có quyền yêu cầu cơ quan có thẩm quyền xem xét, cập nhật, sửa đổi, bổ sung khi phát hiện thông tin không chính xác theo quy định của pháp luật.

Điều 21. Thủ tục yêu cầu và thực hiện yêu cầu cung cấp thông tin, dữ liệu từ Cơ sở dữ liệu

1. Cơ quan, tổ chức, người có thẩm quyền yêu cầu cung cấp thông tin, dữ liệu thực hiện yêu cầu bằng văn bản hoặc trên môi trường điện tử, trừ trường hợp pháp luật có quy định khác, trong đó xác định rõ nội dung thông tin, dữ liệu cần cung cấp, mục đích khai thác, sử dụng thông tin, dữ liệu.

2. Cơ quan có trách nhiệm cung cấp thông tin, dữ liệu xem xét, thực hiện cung cấp thông tin, dữ liệu theo yêu cầu, bảo đảm đúng nội dung, đối tượng trong thời hạn 05 ngày làm việc, kể từ ngày nhận được yêu cầu. Trường hợp vì lý do khách quan mà chưa cung cấp được thông tin, dữ liệu theo yêu cầu thì phải thông báo bằng văn bản cho cơ quan, tổ chức, cá nhân yêu cầu và nêu rõ lý do. Trường hợp cung cấp thông tin, dữ liệu trên môi trường điện tử được thực hiện ngay hoặc trong thời gian sớm nhất khi Cơ sở dữ liệu cho phép.

3. Cơ quan được yêu cầu cung cấp thông tin, dữ liệu có quyền từ chối yêu cầu trong các trường hợp sau:

a) Không thuộc các trường hợp quy định tại khoản 2 Điều 20 của Nghị định này;

b) Khi có căn cứ cho rằng yêu cầu đó trái pháp luật, vi phạm quy định về bảo vệ bí mật nhà nước, bí mật cá nhân, xâm phạm quyền, lợi ích hợp pháp của các cơ quan, tổ chức, cá nhân.

Việc từ chối cung cấp thông tin, dữ liệu phải được thực hiện bằng văn bản hoặc thông báo trên Cơ sở dữ liệu và nêu rõ lý do từ chối.

Điều 22. Trách nhiệm cung cấp thông tin từ Cơ sở dữ liệu

1. Thanh tra Chính phủ có trách nhiệm cung cấp thông tin theo yêu cầu tại các điểm a, b và đ khoản 2 Điều 20 của Nghị định này.

2. Văn phòng bộ, cơ quan ngang bộ hoặc đơn vị được Bộ trưởng, Thủ trưởng cơ quan ngang bộ giao cập nhật thông tin vào Cơ sở dữ liệu có trách nhiệm cung cấp thông tin thuộc phạm vi quản lý theo yêu cầu của Bộ trưởng, Thủ trưởng cơ quan ngang bộ.

3. Thanh tra tỉnh có trách nhiệm cung cấp thông tin theo yêu cầu tại điểm c và đ khoản 2 Điều 20 của Nghị định này.

4. Ủy ban nhân dân cấp xã có trách nhiệm cung cấp thông tin theo yêu cầu tại điểm d khoản 2 Điều 20 của Nghị định này và các thông tin khác từ Cơ sở dữ liệu trong phạm vi thẩm quyền theo quy định của pháp luật về khiếu nại, tố cáo và tiếp công dân.

Mục 3. TỔ CHỨC THỰC HIỆN VÀ TRÁCH NHIỆM CÁC CƠ QUAN, TỔ CHỨC, CÁ NHÂN

Điều 23. Trách nhiệm của Thanh tra Chính phủ

1. Thanh tra Chính phủ là cơ quan quản lý, vận hành thống nhất Cơ sở dữ liệu; chịu trách nhiệm quản trị, vận hành kỹ thuật, bảo đảm an toàn, an ninh Cơ sở dữ liệu trên phạm vi toàn quốc.

2. Chỉ đạo Ban Tiếp công dân trung ương thực hiện việc cập nhật đầy đủ, kịp thời thông tin, dữ liệu về công tác tiếp công dân, xử lý đơn khiếu nại, tố cáo, kiến nghị, phản ánh vào Cơ sở dữ liệu. Các đơn vị khác thuộc Thanh tra Chính phủ có trách nhiệm cập nhật kịp thời thông tin, dữ liệu những vụ việc được giao chủ trì giải quyết vào Cơ sở dữ liệu.

3. Chủ trì, phối hợp với Bộ Khoa học và Công nghệ, Bộ Công an ban hành danh mục dữ liệu, quy định về tiêu chuẩn, quy chuẩn kỹ thuật của dữ liệu và hướng dẫn cập nhật, quản lý, khai thác, sử dụng dữ liệu từ Cơ sở dữ liệu.

4. Ban hành tiêu chí phân loại dữ liệu và quy định cụ thể về phân cấp quản lý dữ liệu trong Cơ sở dữ liệu, bảo đảm thống nhất trong toàn quốc.

5. Cung cấp thông tin về công tác tiếp công dân, xử lý đơn, giải quyết; khiếu nại, tố cáo, kiến nghị, phản ánh từ Cơ sở dữ liệu do mình cập nhật, quản lý theo yêu cầu của cơ quan, tổ chức, người có thẩm quyền theo quy định của pháp luật.

6. Tổ chức, chỉ đạo, hướng dẫn việc cập nhật, khai thác, sử dụng Cơ sở dữ liệu trên phạm vi toàn quốc; chuẩn hóa và hướng dẫn kết nối, đồng bộ với các Cơ sở dữ liệu khác có liên quan.

7. Kiểm tra, thanh tra trách nhiệm của Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân cấp tỉnh trong việc tổ chức cập nhật, quản lý, khai thác, sử dụng Cơ sở dữ liệu theo quy định.

8. Thực hiện chuẩn hóa, điện tử hóa chế độ báo cáo; bảo đảm kết nối, chia sẻ, liên thông dữ liệu giữa Cơ sở dữ liệu với Hệ thống thông tin báo cáo của Chính phủ và Trung tâm Thông tin, chỉ đạo điều hành của Chính phủ, Thủ tướng Chính phủ theo quy định của pháp luật.

9. Tổ chức phân tích dữ liệu số, xây dựng hệ thống cảnh báo sớm các vụ việc khiếu nại, tố cáo phức tạp, kéo dài, đông người; phục vụ công tác chỉ đạo, điều hành của Chính phủ, Thủ tướng Chính phủ.

10. Tổ chức đào tạo, bồi dưỡng kỹ năng công nghệ thông tin, quản trị dữ liệu đáp ứng yêu cầu sử dụng Cơ sở dữ liệu thông suốt, hiệu quả; tổ chức triển khai cơ chế hỗ trợ kỹ thuật thống nhất, đồng bộ từ trung ương đến địa phương nhằm bảo đảm việc quản lý, vận hành Cơ sở dữ liệu hiệu quả.

11. Thực hiện các nhiệm vụ khác do Chính phủ, Thủ tướng Chính phủ giao.

Điều 24. Trách nhiệm của bộ, cơ quan ngang bộ và Ủy ban nhân dân các cấp

1. Tổ chức cập nhật kịp thời thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh thuộc thẩm quyền vào Cơ sở dữ liệu.

2. Tổ chức, chỉ đạo cập nhật, thông báo kịp thời khi có sự thay đổi hoặc có sai sót thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh.

3. Tổ chức, chỉ đạo, hướng dẫn các cơ quan, đơn vị, cá nhân trong phạm vi quản lý của mình cung cấp thông tin, dữ liệu để cập nhật vào Cơ sở dữ liệu.

4. Quản lý, khai thác, sử dụng thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh do cơ quan mình cập nhật vào Cơ sở dữ liệu.

5. Cung cấp thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh từ Cơ sở dữ liệu do mình cập nhật, quản lý theo yêu cầu của cơ quan, tổ chức, người có thẩm quyền theo quy định của Nghị định này và pháp luật khác có liên quan.

6. Bảo đảm nguồn lực cho hoạt động thu thập, cập nhật, khai thác, quản lý và sử dụng thông tin, dữ liệu thuộc phạm vi quản lý của mình.

7. Kiểm tra việc cập nhật, quản lý, khai thác, sử dụng Cơ sở dữ liệu của thủ trưởng các cơ quan, đơn vị và cá nhân thuộc phạm vi quản lý của mình.

8. Người đứng đầu cơ quan, đơn vị chịu trách nhiệm trực tiếp trước pháp luật và cấp có thẩm quyền về tính đầy đủ, chính xác, kịp thời của dữ liệu thuộc phạm vi quản lý được cập nhật, quản lý, khai thác, sử dụng trên Cơ sở dữ liệu.

Điều 25. Trách nhiệm của cơ quan thanh tra và đơn vị được giao nhiệm vụ tiếp công dân

Cơ quan thanh tra trong Quân đội nhân dân, Công an nhân dân, Ngân hàng Nhà nước Việt Nam, Thanh tra Cơ yếu, cơ quan Thanh tra được thành lập theo điều ước quốc tế, đơn vị được giao nhiệm vụ tiếp công dân có trách nhiệm giúp Thủ trưởng cơ quan quản lý nhà nước cùng cấp:

1. Tổ chức việc cập nhật, quản lý, khai thác và sử dụng thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo thuộc phạm vi quản lý của Thủ trưởng cơ quan quản lý nhà nước cùng cấp.

2. Chỉ đạo, hướng dẫn, đôn đốc, kiểm tra, thanh tra việc cập nhật, quản lý, khai thác, sử dụng thông tin, dữ liệu về tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo trong phạm vi quản lý của bộ, ngành, địa phương mình.

Điều 26. Trách nhiệm của cơ quan, tổ chức, người có thẩm quyền tiếp công dân, giải quyết khiếu nại, tố cáo, xử lý kiến nghị, phản ánh

1. Cung cấp thông tin, dữ liệu về tiếp công dân, giải quyết khiếu nại, tố cáo, xử lý kiến nghị, phản ánh cho cơ quan có trách nhiệm cập nhật khi được yêu cầu và thực hiện cập nhật theo yêu cầu của cơ quan có thẩm quyền; chịu trách nhiệm về tính chính xác của thông tin do mình cung cấp.

2. Sử dụng thông tin, dữ liệu về tiếp công dân, giải quyết khiếu nại, tố cáo, xử lý kiến nghị, phản ánh do mình thu thập, cung cấp để phục vụ công tác quản lý.

Mục 4. ĐÁNH GIÁ VÀ BẢO ĐẢM NGUỒN LỰC

Điều 27. Đánh giá hiệu quả Cơ sở dữ liệu

1. Nguyên tắc đánh giá

a) Việc đánh giá phải được thực hiện thường xuyên, liên tục, dựa trên Cơ sở dữ liệu, bảo đảm khách quan, minh bạch, có thể kiểm chứng;

b) Kết quả đánh giá là căn cứ bắt buộc để xem xét trách nhiệm của cơ quan, tổ chức, cá nhân trong việc thực hiện nhiệm vụ;

c) Không thực hiện đánh giá mang tính hình thức, không gắn với dữ liệu thực tế của Cơ sở dữ liệu.

2. Nội dung đánh giá

a) Mức độ đầy đủ, chính xác, kịp thời của việc cập nhật dữ liệu;

b) Tiến độ xử lý, thời hạn giải quyết vụ việc; tỷ lệ giải quyết đúng hạn, quá hạn;

c) Số lượng, tính chất các vụ việc phức tạp, kéo dài, khiếu kiện đông người;

d) Mức độ tuân thủ quy định về bí mật nhà nước, bảo vệ dữ liệu cá nhân và an ninh mạng theo quy định của pháp luật;

đ) Hiệu quả khai thác, sử dụng dữ liệu phục vụ công tác chỉ đạo, điều hành;

e) Mức độ hài lòng của người dân, tổ chức đối với việc tiếp công dân và giải quyết vụ việc.

3. Chỉ số đánh giá và công cụ đánh giá

a) Thanh tra Chính phủ chủ trì xây dựng, ban hành bộ chỉ số đánh giá công tác tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo (KPI) trên Cơ sở dữ liệu, bảo đảm định lượng, đo lường được và áp dụng thống nhất trên phạm vi toàn quốc;

b) Cơ sở dữ liệu phải có chức năng tự động tổng hợp, phân tích, trực quan hóa dữ liệu và cung cấp công cụ đánh giá theo thời gian thực;

c) Thiết lập cơ chế cảnh báo tự động đối với các trường hợp chậm xử lý, có dấu hiệu vi phạm hoặc nguy cơ phát sinh vụ việc phức tạp, kéo dài.

4. Trách nhiệm thực hiện và sử dụng kết quả đánh giá

a) Thanh tra Chính phủ tổ chức đánh giá trên phạm vi toàn quốc; định kỳ công bố hoặc báo cáo kết quả theo quy định;

b) Bộ, ngành, địa phương có trách nhiệm tổ chức đánh giá trong phạm vi quản lý và chịu trách nhiệm về tính chính xác của dữ liệu phục vụ đánh giá;

c) Người đứng đầu cơ quan, đơn vị chịu trách nhiệm trực tiếp về kết quả thực hiện các chỉ số đánh giá.

Điều 28. Đầu tư xây dựng và duy trì Cơ sở dữ liệu

1. Kinh phí đầu tư xây dựng, nâng cấp, mở rộng Cơ sở dữ liệu được bố trí từ nguồn ngân sách nhà nước hoặc nguồn kinh phí khác theo quy định pháp luật.

2. Kinh phí thực hiện việc quản lý, duy trì, cập nhật và khai thác, sử dụng, phân tích dữ liệu phục vụ công tác chỉ đạo, điều hành được bố trí từ nguồn chi thường xuyên theo phân cấp ngân sách hoặc nguồn kinh phí khác theo quy định của pháp luật.

3. Kinh phí cho hoạt động vận hành Cơ sở dữ liệu, bảo đảm hạ tầng kỹ thuật, kết nối, chia sẻ dữ liệu được bố trí theo quy định của pháp luật về ngân sách nhà nước và pháp luật có liên quan.

Chương IV

ĐIỀU KHOẢN THI HÀNH

Điều 29. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành từ ngày 01 tháng 7 năm 2026.

2. Nghị định số 55/2022/NĐ-CP ngày 23 tháng 8 năm 2022 của Chính phủ quy định cơ sở dữ liệu quốc gia về công tác tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành.

Điều 30. Quy định chuyển tiếp

1. Cơ sở dữ liệu về công tác tiếp công dân, xử lý đơn, giải quyết khiếu nại, tố cáo, kiến nghị, phản ánh đã được xây dựng theo quy định của Nghị định số 55/2022/NĐ-CP được tiếp tục cập nhật, quản lý, khai thác, sử dụng cho đến khi Cơ sở dữ liệu chưa được đưa vào vận hành chính thức, bảo đảm không làm gián đoạn hoạt động cập nhật, quản lý, khai thác, sử dụng dữ liệu.

2. Thanh tra Chính phủ có trách nhiệm ban hành và tổ chức thực hiện kế hoạch chuyển đổi, kế thừa dữ liệu từ cơ sở dữ liệu quy định tại khoản 1 Điều này sang Cơ sở dữ liệu theo quy định tại Nghị định này trong thời hạn không quá 12 tháng kể từ ngày Cơ sở dữ liệu được đưa vào vận hành chính thức trên phạm vi toàn quốc, bảo đảm tính đầy đủ, chính xác của dữ liệu, an ninh mạng và tuân thủ quy định của pháp luật về lưu trữ, bảo vệ bí mật nhà nước và bảo vệ dữ liệu cá nhân.

Điều 31. Trách nhiệm thi hành

1. Tổng Thanh tra Chính phủ có trách nhiệm hướng dẫn và tổ chức thực hiện Nghị định này.

2. Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương và các cơ quan liên quan chịu trách nhiệm tổ chức thực hiện Nghị định này./.

The Government of Vietnam hereby promulgates the Decree on the National Database on Citizen Reception, Application Processing, and Settlement of Complaints and Denunciations.

Chapter I

GENERAL PROVISIONS

Article 2. Regulated entities

This Decree applies to ministries, ministerial agencies, People’s Committees at all levels, agencies, organizations, and persons competent to conduct citizen reception, application processing, and the settlement of complaints and denunciations, as well as other relevant agencies, organizations, and individuals.

Article 3. Position, role, and legal value of the Database

1. The Database shall be developed and managed in a centralized and unified manner nationwide for collecting, storing, managing, connecting, sharing, and utilizing data for citizen reception, application processing, and the settlement of complaints and denunciations.

2. Data in the Database shall be updated and managed in real time; shall have legal validity in accordance with the law on electronic transactions, the law on data, and other relevant laws; and may be utilized and used in place of paper-based records and documents where the requirements regarding integrity, authenticity, accessibility, and usability are satisfied and where otherwise not provided by law.

3. Data in the Database shall be digitized and standardized, including structured and unstructured data, and shall be organized and managed according to an appropriate structure to ensure connectivity, sharing, interoperability, and utilization among agencies and organizations within the political system in accordance with the law; shall be identified and classified according to data security levels during storage, sharing, and utilization to ensure the control and monitoring of access activities and the timely detection and handling of incidents, thereby ensuring cybersecurity; and shall clearly define the responsibilities of relevant agencies, organizations, and individuals in the event of incidents resulting in the disclosure, loss, or unauthorized access to data.

4. The Database shall be hosted at the National Data Center.

Article 4. Principles for the development, updating, management, utilization, and use of the Database

1. Ensuring compliance with the laws on citizen reception, application processing, and the settlement of complaints and denunciations, the protection of state secrets, the protection of personal data, and other relevant laws.

3. Ensuring that the data are reviewed, updated, and managed in a timely, complete, accurate, consistent, and synchronized manner and in compliance with the relevant jurisdiction and procedures prescribed by law.

4. Ensuring that the management, operation, utilization, and use of the Database are conducted in a strict, secure, stable, and uninterrupted manner; and that data utilization and use are carried out according to authorization, for proper purposes, and in compliance with information security and cybersecurity requirements prescribed by law.

5. Ensuring a citizen-centered approach and facilitating citizens to monitor and supervise the processing of their cases in the digital environment.

6. Ensuring that the management and operation of the Database guarantee openness, transparency, traceability of origin, update history, and implementing entities, thereby enabling inspection, supervision, and clarification of the responsibilities of agencies, organizations, and individuals.

7. Ensuring automation and end-to-end digitization of data management and processing activities while minimizing manual processing to the greatest extent possible.

Chapter II

DEVELOPMENT, MANAGEMENT, AND UTILIZATION OF THE DATABASE

Section 1. DATA IN THE DATABASE

a) Data on citizen reception and application processing;

b) Data on complaints and the settlement of complaints;

c) Data on denunciations and the settlement of denunciations;

d) Data on recommendations, feedback, and processing results;

dd) Other data serving state management requirements as prescribed by law.

2. Data shall be standardized in accordance with applicable standards and technical regulations, and ensure the capacity for connectivity, sharing, and utilization either automatically or upon request.

3. The data in the Database specified in Clause 1 of this Article serving the state management of citizen reception and the settlement of complaints and denunciations shall be developed to ensure that:

a) They fully reflect the entire process of handling and settling a case from receipt to completion;

b) They clearly indicate the number of complaints or denunciations filed;

d) They serve the aggregation, analysis, assessment, and forecasting of the situation regarding citizen reception and the settlement of complaints and denunciations.

4. The data specified in this Article shall be updated in the Database for cases arising from the date on which the Database is officially put into operation.

For data relating to cases arising before the official operation of the Database, updating shall be carried out in the following cases:

a) Applications that are undergoing processing; complaints or denunciations that are under settlement;

b) Cases specified in Clause 2 Article 6 of this Decree;

c) In accordance with the data conversion and inheritance plan prescribed in Clause 2 Article 30 of this Decree.

Article 6. Data sources for updating the Database

1. Data updated in the Database shall include data arising directly from citizen reception and application processing activities; complaint cases for which a notice of complaint acceptance has been issued; and denunciation cases for which a decision on acceptance for settlement of denunciation has been issued, from the date on which the Database is officially put into operation.

2. Complex and prolonged complaint and denunciation cases that do not fall within the cases specified in Clause 1 of this Article shall be updated upon the written request of the Government Inspectorate or the Director of a competent authority.

1. Competent authorities and persons shall be responsible for updating data from the time of receipt of complaints, denunciations, petitions, and feedback, and continue to update data fully and promptly throughout the process of citizen reception, application processing, acceptance for settlement, settlement, and disclosure of results. Data updates must ensure continuity and synchronization and accurately reflect the processing status of each case at any given time. Failure to update or delayed updating shall result in accountability measures depending on the severity of the violation.

2. With respect to periodic reports, case reports, thematic reports, and ad hoc reports on citizen reception, application processing, the settlement of complaints and denunciations, and the handling of petitions and feedback that are updated at the request of the Government Inspectorate and fall within the cases specified in Clause 2 Article 6 of this Decree, the responsible agency shall complete the update within 15 days from the date of receipt of the written request from the Government Inspectorate.

3. Data updates in the Database shall be performed automatically for professional information systems that are connected to and share data with the Database, and must satisfy the following requirements:

a) Ensuring that data are transmitted and received in accordance with standards, technical regulations, and data formats issued by competent authorities;

b) Ensuring the completeness, accuracy, timeliness, and consistency of data among systems;

c) Clearly defining the responsibilities of the agency managing the source system and the agency managing the Database in ensuring data quality;

d) Having mechanisms for inspection, reconciliation, detection, and handling of data discrepancies during synchronization;

dd) Complying with the law on information security and cybersecurity.

Where the conditions for automatic updating have not yet been met, data updates shall be carried out in accordance with Clauses 1 and 2 of this Article.

1. Within 5 working days from the date on which information in the Database is found to be incomplete, inaccurate, or inconsistent between electronic data and paper-based operational files and documents, the agency, organization, or individual responsible for updating the data shall conduct verification and make supplementary updates or modifications.

2. Data in the Database shall be inspected, cleansed, standardized, and synchronized in accordance with regulations to ensure completeness, accuracy, consistency, and usability.

The inspection, cleansing, standardization, and synchronization of data shall include:

a) Reviewing, detecting, and handling duplicate, missing, incorrect, or inconsistent data;

b) Standardizing data in accordance with catalogues, standards, and technical regulations issued by competent authorities;

c) Comparing and ensuring consistency between electronic data and operational files and documents;

d) Synchronizing data among relevant information systems and databases;

dd) Promptly updating and adjusting data when changes occur or discrepancies are identified.

Agencies, organizations, and individuals responsible for updating data shall be accountable for the accuracy and completeness of the data they provide and update.

Article 9. Monitoring, updating, and managing data

1. Agencies, organizations, and persons competent to settle cases shall be responsible for organizing the handling of cases in accordance with the law.

2. Information relating to the case-handling process shall be fully, promptly, and accurately updated in the Database, including:

a) Receipt;

b) Classification and transfer for processing;

c) Acceptance for settlement, verification, and collection of documents and evidence (if any);

d) Organization of dialogue (if any);

dd) Settlement results and related matters;

e) Closure of the case.

The Database shall have functions to monitor processing progress and issue alerts regarding overdue settlement periods as prescribed by law.

4. Data relating to the case-handling process shall serve as a basis for state management, direction, administration, inspection, and inspection activities.

5. Each step in the case-handling process must clearly identify the responsible individual, the time of implementation, and the processing content.

6. The Database shall maintain complete processing logs; log data must not be modified or deleted contrary to regulations.

Article 10. Entry of data on the receipt of complaints, denunciations, petitions, and feedback into the Database

1. The recording and entry of data relating to the receipt of complaints, denunciations, petitions, and feedback into the Database shall be carried out based on the forms of receipt prescribed by the law on citizen reception, complaints, and denunciations.

2. Receipt information must be recorded fully, accurately, and promptly. Such recording shall be made in the electronic citizen reception register in the Database; where receipt is made through paper-based applications, such applications must be digitized and updated into the Database.

3. Where the receipt is made through postal services, the receiving agency shall be responsible for reviewing, entering, and updating the data into the Database in accordance with regulations.

4. The receipt process must ensure openness, transparency, and compliance with the relevant authority and procedures prescribed by law.

1. The classification and processing of applications shall be carried out in accordance with the law on citizen reception, complaints, and denunciations; information relating to application classification and processing must be fully and promptly updated into the Database.

2. Application classification and transfer shall be carried out simultaneously on the Database, ensuring clear identification of the agency, organization, unit, or competent person responsible for settlement, the time of transfer, and the processing status.

The agency receiving the application shall be responsible for confirming the receipt on the Database and organizing the processing and settlement thereof in accordance with regulations.

Article 12. Control of duplicate cases

1. The Database shall have functions to inspect and compare information to detect cases that show signs of duplication or cases that have already been settled. Where a case showing signs of duplication or a previously settled case is detected, the Database shall issue a warning for the receiving officer's consideration.

2. The control of duplicate cases must ensure objectivity and accuracy and must not restrict citizens’ rights to lodge complaints, make denunciations, submit petitions, or provide feedback in accordance with the law.

3. The Database may apply data analytics technologies and artificial intelligence to support the detection of duplicated content or cases that have already been settled.

4. Competent persons shall be responsible for reviewing, verifying, and assuming responsibility for the accuracy of results provided by artificial intelligence before use. Automated processing results generated by artificial intelligence must not be used as the sole basis for issuing settlement conclusions or applying handling measures to complainants or denouncers.

Article 13. Generation and management of case codes

1. Each complaint, denunciation, petition, or feedback matter shall, after it is received, be established as an electronic file in the Database and assigned a case code.

2. A case code is a string of characters automatically generated and unique to each case established in the Database for managing and utilizing information throughout the entire process of handling and settling the case, ensuring uniqueness and enabling search, monitoring, and interoperability among relevant agencies.

3. The case code shall be used consistently throughout the entire process of receiving, processing, settling, disclosing, and storing the case.

4. The case code shall serve as the basis for complainants, denouncers, petitioners, and persons providing feedback to look up the processing status of their cases in accordance with regulations.

Article 14. Notification of processing results

1. Agencies, organizations, and competent persons shall be responsible for notifying complainants, denouncers, petitioners, and persons providing feedback of the receipt, acceptance for settlement, transfer of applications, and settlement results in accordance with the law.

2. Complainants, denouncers, petitioners, and persons providing feedback may access information related to their cases via the case code in accordance with regulations.

3. Notifications shall be made through electronic systems, text messages, electronic mail, or other appropriate methods.

2. The disclosed contents shall include the following basic information:

a) Number and date of issuance of the settlement decision;

b) Issuing authority;

c) Main contents of the settlement result.

3. Before disclosure, the competent authority shall review and process the information to ensure that information constituting state secrets, personal information, and other sensitive information prescribed by law are not disclosed.

Chapter III

RESPONSIBILITIES FOR THE DEVELOPMENT, MANAGEMENT, AND UTILIZATION OF THE DATABASE

Section 1. DATA GOVERNANCE, PROTECTION, AND SHARING

Article 16. Data governance and sharing

a) Data in the Database shall be managed in a unified and centralized manner, ensuring integrity, consistency, and interoperable utilization nationwide;

b) The generation, updating, management, and use of data must comply with data lifecycle governance principles, ensuring traceability of the source, update time, updating entity, and history of data changes;

c) The principle of “collect once, use multiple times” shall be applied; agencies, organizations, and individuals shall not be required to re-provide information or data already available in the Database, except where such data have not yet been updated, there are grounds to determine that the data are inaccurate, or verification and comparison are necessary to ensure accuracy;

d) Data shall be used only for proper purposes, within the permitted scope, and in accordance with assigned authority; the use of data beyond the assigned scope or for personal purposes is strictly prohibited;

dd) The storage and preservation of information and documents shall be carried out in accordance with the law on records and archives management;

e) The accuracy and consistency of personal identification data shall be ensured through updating and synchronization with the National Population Database in accordance with the law. Where inaccurate, incomplete, or outdated data are detected and affecting utilization and search activities, the agency or organization managing the data shall be responsible for notifying and cooperating with competent authorities to inspect and update such data in a timely manner.

2. Data classification and decentralization of data management

a) Data shall be classified according to confidentiality level, scope of utilization, and value of use; such classification shall serve as the basis for determining the applicable regulations concerning management, storage, utilization, and sharing;

b) The decentralization of data management must clearly define the responsibilities of each agency and organization in the generation, updating, inspection, approval, and utilization of data; such decentralization must avoid overlap and clearly identify the entity responsible.

a) Data sharing among state agencies shall be carried out through the connection and interoperability of information systems and the data-sharing and coordination platform of the National Data Center in accordance with regulations, unless otherwise provided by law;

b) Data sharing must be conducted within the proper jurisdiction and for proper purposes, with access control measures in place and complete records of utilization history maintained;

c) Agencies, organizations, and individuals granted access rights may only utilize data within the scope of their authorization; copying, transferring, or re-providing data to third parties without permission is strictly prohibited;

d) Where data are utilized for research or policy formulation purposes, anonymization and data aggregation measures must be applied in accordance with regulations to ensure that personal information or state secrets are not disclosed.

Article 17. Management and protection of the Database

1. The Database shall be managed and protected in a strict manner, ensuring cybersecurity and information security in accordance with the law.

2. The agency assigned to manage the Database shall be responsible for:

a) Developing, promulgating, and organizing the implementation of regulations on the management, operation, and utilization of the Database;

b) Establishing technical and professional measures to ensure system security and prevent unauthorized access, cyberattacks, data loss, and data damage;

d) Ensuring the stable and continuous operation of the system; and having contingency and recovery plans in place in the event of incidents.

Section 2. DATA CONNECTION, UTILIZATION, AND USE

Article 18. Data connection and sharing

1. The Database shall be connected to and share data with:

a) The National Population Database;

b) The National Integrated Database;

c) Reporting information systems of CPV agencies, State agencies, the Central Committee of the Vietnamese Fatherland Front, and socio-political organizations;

d) Other relevant national and specialized databases.

2. Data connection and sharing shall be carried out automatically or upon request, ensuring timeliness and accuracy; compliance with relevant jurisdiction and intended purposes of use; and adherence to the laws on cybersecurity, personal data protection, protection of state secrets, and other relevant laws.

4. Data connection and sharing shall be carried out by automated means, ensuring compliance with uniform standards and technical regulations; at the same time, manual data-sharing methods shall be minimized, and a mandatory roadmap for transition to automated methods shall be established.

Article 19. Utilization of data for direction and administration

1. The Database shall have functions to support data analysis, aggregation, and visualization for direction and administration purposes.

2. The Database shall be capable of supporting the detection of and issuing alerts regarding the following cases:

a) Complex and prolonged complaint and denunciation cases;

b) Complaint and denunciation cases involving large numbers of persons;

c) Complaint and denunciation cases with the potential to become hotspots affecting security, order, and social safety.

3. The utilization and use of data shall be carried out in accordance with access authorization, for proper purposes, and in a manner that ensures information security and confidentiality in accordance with the law.

4. The Database shall apply big data analytics and artificial intelligence technologies to support the detection and assessment of the concerned situation relating to complaints and denunciations, risk forecasting, and the provision of analytical and decision-support assistance to agencies, organizations, and competent persons.

1. Agencies, organizations, and individuals granted access rights to the Database may carry out activities relating to data entry, application transfer and processing, settlement, monitoring, receipt of results, and the utilization and use of data in accordance with their assigned functions, tasks, and entitlements.

2. Agencies, organizations, and individuals entitled to request the provision of information and data from the Database include:

a) The General Secretary of the CPV, the President of Vietnam, the Prime Minister of Vietnam, the Chairperson of the National Assembly of Vietnam, the Standing Member of the Secretariat of Vietnam, the Vice President of Vietnam, Deputy Prime Ministers of Vietnam and members of the Government of Vietnam, Deputy Chairpersons of the National Assembly of Vietnam, and members of the Standing Committee of the National Assembly of Vietnam, who may request information and data on a nationwide basis;

b) The Central Inspection Commission, the Office of the CPV Central Committee and CPV Central Commissions, the Office of the President of Vietnam, the Office of the Government of Vietnam, the Office of the National Assembly of Vietnam, the Council for Ethnic Affairs and Committees of the National Assembly of Vietnam, the Central Committee of the Vietnamese Fatherland Front, and National Assembly deputies, who may request information and data on a nationwide basis;

c) Committees of provincial People's Councils, Offices of National Assembly Delegations and provincial People's Councils, Offices of provincial People's Committees, Offices of provincial committees and municipal committees and their affiliated commissions, provincial Vietnamese Fatherland Front Committees, and provincial People's Council deputies, who may request information and data within the management scope of the provincial People's Committee;

d) Offices of commune-level People's Councils and People's Committees, offices and commissions under commune-level CPV Committees, agencies of the Vietnamese Fatherland Front at the commune level, and commune-level People's Council deputies, who may request information and data within the management scope of the commune-level People's Committee;

dd) Other agencies, organizations, and individuals entitled to request information in accordance with the law.

3. The utilization and use of data classified as state secrets in the Database shall comply with the law on protection of state secrets.

4. Data utilization shall be carried out primarily through electronic means on the basis of access authorization; the provision of data in written form shall be limited, except where otherwise provided by law.

Article 21. Procedures for requesting and fulfilling requests for information and data from the Database

1. Agencies, organizations, and competent persons requesting information and data shall submit requests in writing or by electronic means, except where otherwise provided by law, specifying the information and data requested and the purpose for which such information and data will be used.

2. The agency responsible for providing information and data shall review the request and provide the requested information and data, ensuring compliance with the requested contents and eligible recipients, within 5 working days from receipt of the request. Where information or data cannot be provided due to objective reasons, the agency shall notify the requesting agency, organization, or individual in writing and specify the reasons. Where information and/or data are provided through electronic means, such provision shall be made immediately or as soon as permitted by the Database.

3. The agency may refuse to provide information and data in the following cases:

a) The request does not fall within the cases specified in Clause 2 Article 20 of this Decree;

b) There are grounds to believe that the request is unlawful, violates regulations on the protection of state secrets or personal privacy, or infringes upon the lawful rights and interests of agencies, organizations, or individuals.

Any refusal to provide information or data must be made in writing or notified through the Database, specifying the reasons for refusal.

Article 22. Responsibility for providing information from the Database

1. The Government Inspectorate shall be responsible for providing information upon request as specified in Points a, b, and dd Clause 2 Article 20 of this Decree.

3. Provincial Inspectorates shall be responsible for providing information upon request as specified in Points c and dd Clause 2 Article 20 of this Decree.

4. Commune-level People's Committees shall be responsible for providing information upon request as specified in Point d Clause 2 Article 20 of this Decree and other information from the Database within their jurisdiction in accordance with the law on complaints, denunciations, and citizen reception.

Section 3. IMPLEMENTATION AND RESPONSIBILITIES OF AGENCIES, ORGANIZATIONS, AND INDIVIDUALS

Article 23. Responsibilities of Government Inspectorate

1. Operate as the agency responsible for the unified management and operation of the Database and assume responsibility for the Database's governance, technical operation, safety, and security nationwide.

2. Direct the Central Citizen Reception Office to fully and promptly update information and data relating to citizen reception, the processing of applications concerning complaints, denunciations, petitions, and feedback in the Database. Other units under the Government Inspectorate shall be responsible for promptly updating information and data relating to cases assigned to them for primary handling in the Database.

3. Take charge and cooperate with the Ministry of Science and Technology of Vietnam and the Ministry of Public Security of Vietnam in promulgating data catalogues, regulations on data standards and technical regulations, and guidelines on the updating, management, utilization, and use of data from the Database.

4. Promulgate criteria for data classification and detailed regulations concerning data management decentralization within the Database, ensuring nationwide consistency.

5. Provide information relating to citizen reception, application processing, and the settlement of complaints, denunciations, petitions, and feedback from the Database that it updates and manages, upon request of agencies, organizations, and competent persons in accordance with the law.

7. Inspect the responsibilities of Ministers, Directors of ministerial agencies, and Presidents of provincial People's Committees in organizing the updating, management, utilization, and use of the Database in accordance with regulations.

8. Standardize and digitize reporting regulations; ensure data connectivity, sharing, and interoperability between the Database and the Reporting Information System of the Government of Vietnam, and the Information and Direction Centers of the Government of Vietnam and the Prime Minister of Vietnam, in accordance with the law.

9. Organize digital data analysis and develop an early-warning system for complex, prolonged, and large-scale complaint and denunciation cases, serving the direction and administration activities of the Government of Vietnam and the Prime Minister of Vietnam.

10. Organize training and capacity-building in information technology and data governance skills to ensure the smooth and effective use of the Database, and implement a unified and synchronized technical support mechanism from central to local levels to ensure the effective management and operation of the Database.

11. Perform other tasks assigned by the Government of Vietnam and the Prime Minister of Vietnam.

Article 24. Responsibilities of ministries, ministerial agencies, and People's Committees at all levels

1. Organize the timely updating of information and data relating to citizen reception, application processing, and the settlement of complaints, denunciations, petitions, and feedback falling within their jurisdiction in the Database.

2. Organize, direct, and promptly notify relevant parties when there are changes to, or errors in, information and data relating to citizen reception, application processing, and the settlement of complaints, denunciations, petitions, and feedback.

3. Organize, direct, and guide agencies, units, and individuals under their management in providing information and data for updating in the Database.

5. Provide information and data relating to citizen reception, application processing, and the settlement of complaints, denunciations, petitions, and feedback from the Database that they update and manage, upon request of agencies, organizations, and competent persons in accordance with this Decree and other relevant laws.

6. Ensure resources for the collection, updating, utilization, management, and use of information and data within their management scope.

7. Inspect the updating, management, utilization, and use of the Database by heads of agencies, units, and individuals under their management.

8. Heads of agencies and units shall bear direct responsibility before the law and competent authorities for the completeness, accuracy, and timeliness of data within their management scope that are updated, managed, utilized, and used in the Database.

Article 25. Responsibilities of inspectorates and units assigned citizen reception functions

Inspectorates within the People’s Army, the People’s Public Security Forces, the State Bank of Vietnam, the Government Cipher Committee Inspectorate, inspectorates established under international treaties, and units assigned citizen reception functions shall assist the Directors of state management agencies at the same level in:

1. Organizing the updating, management, utilization, and use of information and data relating to citizen reception, application processing, and the settlement of complaints and denunciations within the management scope of the Directors of state management agencies at the same level.

2. Directing, guiding, urging, inspecting, and conducting inspections of the updating, management, utilization, and use of information and data relating to citizen reception, application processing, and the settlement of complaints and denunciations within the management scope of their ministries, central authorities, or local authorities.

Article 26. Responsibilities of agencies, organizations, and persons competent to conduct citizen reception, settle complaints and denunciations, and handle petitions and feedback

2. Use information and data relating to citizen reception, the settlement of complaints and denunciations, and the handling of petitions and feedback that they collect and provide for management purposes.

Section 4. ASSESSMENT AND RESOURCE ASSURANCE

Article 27. Assessment of effectiveness of the Database

1. Principles of assessment

a) Assessment shall be conducted regularly and continuously on the basis of the Database, ensuring objectivity, transparency, and verifiability;

b) Assessment results shall constitute a mandatory basis for considering the responsibilities of agencies, organizations, and individuals in the performance of their tasks;

c) Assessments of a purely formal nature that are not linked to actual data in the Database shall not be conducted.

2. Assessment contents

a) The completeness, accuracy, and timeliness of data updates;

c) The number and nature of complex, prolonged, and large-scale petitioning cases involving many persons;

d) The level of compliance with regulations on the protection of state secrets, personal data protection, and cybersecurity in accordance with the law;

dd) The effectiveness of data utilization and use for direction and administration purposes;

e) The satisfaction level of citizens and organizations regarding citizen reception and case settlement.

3. Assessment indicators and assessment tools

a) The Government Inspectorate shall take charge of developing and promulgating a set of key performance indicators (KPIs) for citizen reception, application processing, and the settlement of complaints and denunciations on the Database, ensuring that such indicators are quantitative, measurable, and uniformly applied nationwide;

b) The Database shall have functions for automatic aggregation, analysis, and visualization of data and for providing real-time assessment tools;

c) An automatic warning mechanism shall be established for cases involving delayed processing, signs of violations, or risks of developing into complex and prolonged cases.

b) Ministries, central authorities, and local authorities shall be responsible for conducting assessments within their management scope and for the accuracy of the data used for assessment purposes;

c) Heads of agencies and units shall bear direct responsibility for the results reflected by the assessment indicators.

Article 28. Investment in development and maintenance of the Database

1. Funding for the development, upgrading, and expansion of the Database shall be allocated from the state budget or other lawful funding sources in accordance with the law.

2. Funding for the management, maintenance, updating, utilization, use, and analysis of data serving direction and administration activities shall be allocated from recurrent expenditure budgets according to budget decentralization arrangements or from other lawful funding sources in accordance with the law.

3. Funding for the operation of the Database, including the maintenance of technical infrastructure and data connectivity and sharing, shall be allocated in accordance with the law on the state budget and other relevant laws.

Chapter IV

IMPLEMENTATION PROVISIONS

2. Government Decree No. 55/2022/ND-CP dated August 23, 2022 shall cease to have effect from the effective date of this Decree.

Article 30. Transitional provisions

1. The database on citizen reception, application processing, and the settlement of complaints, denunciations, petitions, and feedback established under Government Decree No. 55/2022/ND-CP shall continue to be updated, managed, utilized, and used until the Database has been officially put into operation, ensuring that activities relating to the updating, management, utilization, and use of data are not interrupted.

2. The Government Inspectorate shall be responsible for promulgating and implementing a plan for the conversion and inheritance of data from the database specified in Clause 1 of this Article to the Database prescribed in this Decree within a period not exceeding 12 months from the date on which the Database is officially put into operation nationwide, ensuring data completeness and accuracy, cybersecurity, and compliance with the law on archives, protection of state secrets, and personal data protection.

Article 31. Implementation responsibilities

1. The Inspector-General of the Government Inspectorate shall be responsible for guiding and organizing the implementation of this Decree.

2. Ministers, Directors of ministerial agencies, Presidents of People’s Committees of provinces and centrally affiliated cities, and relevant agencies shall implement this Decree./.
