SỬA ĐỔI, BỔ SUNG MỘT SỐ ĐIỀU CỦA LUẬT BẦU CỬ ĐẠI BIỂU QUỐC HỘI VÀ LUẬT BẦU CỬ ĐẠI BIỂU HỘI ĐỒNG NHÂN DÂN

Căn cứ Hiến pháp nước Cộng hoà xã hội chủ nghĩa Việt Nam năm 1992 đã được sửa đổi, bổ sung một số điều theo Nghị quyết số 51/2001/QH10;
Quốc hội ban hành Luật sửa đổi, bổ sung một số điều của Luật bầu cử đại biểu Quốc hội năm 1997 đã được sửa đổi, bổ sung một số điều theo Luật bầu cử đại biểu Quốc hội số 31/2001/QH10 và Luật bầu cử đại biểu Hội đồng nhân dân số 13/2003/QH11.

Điều 1. Sửa đổi, bổ sung một số điều của Luật bầu cử đại biểu Quốc hội.

1. Điều 12 được sửa đổi, bổ sung như sau:

“Điều 12

1. Mỗi đơn vị bầu cử đại biểu Quốc hội chia thành nhiều khu vực bỏ phiếu. Khu vực bỏ phiếu bầu cử đại biểu Quốc hội đồng thời là khu vực bỏ phiếu bầu cử đại biểu Hội đồng nhân dân các cấp.

2. Mỗi khu vực bỏ phiếu có từ ba trăm đến bốn nghìn cử tri. Ở miền núi, hải đảo và những nơi dân cư không tập trung thì dù chưa có tới ba trăm cử tri cũng được thành lập một khu vực bỏ phiếu.

Việc chia khu vực bỏ phiếu do Uỷ ban nhân dân xã, phường, thị trấn quyết định và do Uỷ ban nhân dân cấp trên trực tiếp phê chuẩn. Đối với những nơi không có đơn vị hành chính xã, phường, thị trấn thì việc chia khu vực bỏ phiếu do Ủy ban nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh quyết định.

Đơn vị vũ trang nhân dân thành lập khu vực bỏ phiếu riêng, trừ trường hợp đơn vị vũ trang nhân dân và địa phương có chung một khu vực bỏ phiếu.

Bệnh viện, nhà hộ sinh, nhà an dưỡng, cơ sở chăm sóc người khuyết tật, cơ sở chăm sóc người cao tuổi có từ năm mươi cử tri trở lên có thể thành lập khu vực bỏ phiếu riêng.

Cơ sở giáo dục, cơ sở chữa bệnh đối với những người đang chấp hành quyết định xử lý vi phạm hành chính có thể thành lập khu vực bỏ phiếu riêng.”

2. Điều 13 được sửa đổi, bổ sung như sau:

“Điều 13

Các tổ chức phụ trách bầu cử đại biểu Quốc hội bao gồm:

1. Hội đồng bầu cử ở trung ương;

2. Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh ở tỉnh, thành phố trực thuộc trung ương;

3. Ban bầu cử ở đơn vị bầu cử;

4. Tổ bầu cử ở khu vực bỏ phiếu.”

3. Điều 14 được sửa đổi, bổ sung như sau:

“Điều 14

1. Chậm nhất là một trăm lẻ năm ngày trước ngày bầu cử, Uỷ ban thường vụ Quốc hội thành lập Hội đồng bầu cử ở trung ương để thực hiện công tác bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân các cấp. Hội đồng bầu cử có từ mười lăm đến hai mươi mốt người gồm Chủ tịch, các Phó Chủ tịch, Tổng thư ký và các uỷ viên là đại diện Uỷ ban thường vụ Quốc hội, Chính phủ, Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam, một số cơ quan, tổ chức hữu quan.

2. Đối với bầu cử đại biểu Quốc hội, Hội đồng bầu cử có những nhiệm vụ và quyền hạn sau đây:

a) Lãnh đạo, chỉ đạo việc tổ chức bầu cử trong cả nước; kiểm tra, đôn đốc việc thi hành quy định của pháp luật về bầu cử;

b) Chỉ đạo công tác thông tin, tuyên truyền và vận động bầu cử;

c) Chỉ đạo công tác bảo vệ an ninh, trật tự, an toàn xã hội trong cuộc bầu cử;

d) Nhận và xem xét hồ sơ của người được tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, lực lượng vũ trang nhân dân, cơ quan nhà nước ở trung ương giới thiệu ứng cử đại biểu Quốc hội; gửi tiểu sử tóm tắt của những người ứng cử đến Ban thường trực Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam;

đ) Nhận hồ sơ và danh sách người ứng cử đại biểu Quốc hội do Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh gửi đến;

e) Quy định mẫu thẻ cử tri và phiếu bầu cử đại biểu Quốc hội;

g) Lập và công bố danh sách những người ứng cử đại biểu Quốc hội theo từng đơn vị bầu cử trong cả nước;

h) Giải quyết khiếu nại, tố cáo về công tác bầu cử đại biểu Quốc hội của Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh, Ban bầu cử và Tổ bầu cử; giải quyết khiếu nại, tố cáo về bầu cử đại biểu Quốc hội do Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh hoặc Ban bầu cử chuyển đến; giải quyết khiếu nại, tố cáo về người ứng cử đại biểu Quốc hội; giải quyết khiếu nại về kết quả bầu cử đại biểu Quốc hội;

i) Nhận và kiểm tra biên bản xác định kết quả bầu cử do Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh, Ban bầu cử gửi đến; làm biên bản tổng kết cuộc bầu cử đại biểu Quốc hội trong cả nước;

k) Quyết định việc bầu cử lại, bầu cử thêm đại biểu Quốc hội hoặc huỷ bỏ kết quả bầu cử đại biểu Quốc hội ở đơn vị bầu cử;

l) Công bố kết quả bầu cử đại biểu Quốc hội trong cả nước;

m) Cấp giấy chứng nhận cho người trúng cử đại biểu Quốc hội;

n) Trình Uỷ ban thường vụ Quốc hội và Quốc hội khoá mới biên bản tổng kết cuộc bầu cử đại biểu Quốc hội trong cả nước và những hồ sơ, tài liệu về bầu cử đại biểu Quốc hội.

4. Điều 15 được sửa đổi, bổ sung như sau:

“Điều 15

1. Chậm nhất là chín mươi lăm ngày trước ngày bầu cử, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh để thực hiện công tác bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh. Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh có từ hai mươi mốt đến ba mươi mốt người gồm Chủ tịch, các Phó Chủ tịch, Thư ký và các uỷ viên là đại diện Thường trực Hội đồng nhân dân, Uỷ ban nhân dân, Uỷ ban Mặt trận Tổ quốc cùng cấp, một số cơ quan, tổ chức hữu quan.

Danh sách Ủy ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh phải được báo cáo lên Uỷ ban thường vụ Quốc hội, Chính phủ, Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam và Hội đồng bầu cử.

2. Đối với bầu cử đại biểu Quốc hội, Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh có những nhiệm vụ và quyền hạn sau đây:

a) Chỉ đạo việc chuẩn bị và tổ chức bầu cử đại biểu Quốc hội ở các đơn vị bầu cử; kiểm tra, đôn đốc việc thi hành quy định của pháp luật về bầu cử đại biểu Quốc hội của Ban bầu cử, Tổ bầu cử;

b) Chỉ đạo thực hiện công tác thông tin, tuyên truyền và vận động bầu cử đại biểu Quốc hội ở địa phương;

c) Chỉ đạo thực hiện công tác bảo vệ an ninh, trật tự, an toàn xã hội trong cuộc bầu cử đại biểu Quốc hội ở địa phương;

d) Nhận và xem xét hồ sơ của người được tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, lực lượng vũ trang nhân dân, cơ quan nhà nước ở địa phương giới thiệu ứng cử đại biểu Quốc hội và hồ sơ của người tự ứng cử đại biểu Quốc hội; gửi danh sách trích ngang và tiểu sử tóm tắt của những người được giới thiệu ứng cử và những người tự ứng cử đại biểu Quốc hội đến Ban thường trực Uỷ ban Mặt trận Tổ quốc tỉnh, thành phố trực thuộc trung ương;

đ) Nhận tài liệu và phiếu bầu cử đại biểu Quốc hội từ Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương và phân phối cho các Ban bầu cử chậm nhất là hai mươi lăm ngày trước ngày bầu cử;

e) Lập danh sách những người ứng cử đại biểu Quốc hội theo đơn vị bầu cử và báo cáo Hội đồng bầu cử;

g) Chỉ đạo, kiểm tra việc lập và niêm yết danh sách cử tri;

h) Giải quyết khiếu nại, tố cáo về công tác bầu cử đại biểu Quốc hội của Ban bầu cử, Tổ bầu cử; giải quyết khiếu nại, tố cáo về bầu cử đại biểu Quốc hội do Ban bầu cử, Tổ bầu cử chuyển đến; giải quyết khiếu nại, tố cáo về người ứng cử đại biểu Quốc hội;

i) Nhận và kiểm tra biên bản xác định kết quả bầu cử đại biểu Quốc hội của các Ban bầu cử; lập biên bản xác định kết quả bầu cử đại biểu Quốc hội ở địa phương;

k) Thông báo kết quả bầu cử đại biểu Quốc hội ở địa phương;

l) Báo cáo tình hình tổ chức và tiến hành bầu cử đại biểu Quốc hội theo quy định của Hội đồng bầu cử;

m) Chuyển hồ sơ, biên bản xác định kết quả bầu cử đại biểu Quốc hội đến Hội đồng bầu cử;

n) Tổ chức việc bầu cử lại, bầu cử thêm đại biểu Quốc hội theo quyết định của Hội đồng bầu cử.

5. Điều 16 được sửa đổi, bổ sung như sau:

“Điều 16

1. Chậm nhất là sáu mươi ngày trước ngày bầu cử, Uỷ ban nhân dân tỉnh, thành phố trực thuộc trung ương sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban Thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập ở mỗi đơn vị bầu cử một Ban bầu cử từ chín đến mười lăm người gồm Trưởng ban, các Phó Trưởng ban, Thư ký và các uỷ viên là đại diện Thường trực Hội đồng nhân dân, Uỷ ban nhân dân, Uỷ ban Mặt trận Tổ quốc cùng cấp, một số cơ quan, tổ chức hữu quan.

2. Ban bầu cử có những nhiệm vụ và quyền hạn sau đây:

a) Kiểm tra, đôn đốc việc thi hành quy định của pháp luật về bầu cử đại biểu Quốc hội của các Tổ bầu cử;

b) Kiểm tra, đôn đốc việc bố trí các phòng bỏ phiếu;

c) Kiểm tra việc lập và niêm yết danh sách cử tri;

d) Phân phối tài liệu và phiếu bầu cử đại biểu Quốc hội cho các Tổ bầu cử chậm nhất là mười lăm ngày trước ngày bầu cử;

đ) Niêm yết danh sách những người ứng cử đại biểu Quốc hội trong đơn vị bầu cử;

e) Chỉ đạo, kiểm tra công việc bầu cử đại biểu Quốc hội tại các phòng bỏ phiếu;

g) Nhận và kiểm tra biên bản kết quả kiểm phiếu bầu cử đại biểu Quốc hội do các Tổ bầu cử gửi đến; làm biên bản xác định kết quả bầu cử đại biểu Quốc hội ở đơn vị bầu cử để gửi đến Hội đồng bầu cử, Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh;

h) Nhận và chuyển đến Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh khiếu nại, tố cáo về người ứng cử đại biểu Quốc hội; giải quyết khiếu nại, tố cáo về công tác bầu cử đại biểu Quốc hội của các Tổ bầu cử;

i) Báo cáo tình hình tổ chức và tiến hành bầu cử đại biểu Quốc hội theo quy định của Hội đồng bầu cử, Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh;

k) Chuyển hồ sơ, tài liệu về bầu cử đến Uỷ ban nhân dân tỉnh, thành phố trực thuộc trung ương;

l) Tổ chức thực hiện việc bầu cử lại, bầu cử thêm đại biểu Quốc hội.”

6. Điều 17 được sửa đổi, bổ sung như sau:

“Điều 17

1. Chậm nhất là ba mươi lăm ngày trước ngày bầu cử, Uỷ ban nhân dân xã, phường, thị trấn sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập ở mỗi khu vực bỏ phiếu một Tổ bầu cử để thực hiện công tác bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân các cấp. Tổ bầu cử có từ mười một đến hai mươi mốt người gồm Tổ trưởng, Tổ phó, Thư ký và các uỷ viên là đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội, tập thể cử tri ở địa phương.

Đối với những nơi không có đơn vị hành chính xã, phường, thị trấn thì Uỷ ban nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập ở mỗi khu vực bỏ phiếu một Tổ bầu cử từ mười một đến hai mươi mốt người gồm Tổ trưởng, Tổ phó, Thư ký và các uỷ viên là đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội, tập thể cử tri ở địa phương.

Đơn vị vũ trang nhân dân thành lập ở mỗi khu vực bỏ phiếu của mình một Tổ bầu cử từ năm đến chín người gồm Tổ trưởng, Tổ phó, Thư ký và các uỷ viên là đại diện Chỉ huy đơn vị và đại diện quân nhân.

Trong trường hợp đơn vị vũ trang nhân dân và địa phương có chung một khu vực bỏ phiếu thì Uỷ ban nhân dân xã, phường, thị trấn sau khi thống nhất với Thường trực Hội đồng nhân dân, Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp và Chỉ huy đơn vị vũ trang nhân dân quyết định thành lập Tổ bầu cử từ mười một đến hai mươi mốt người gồm Tổ trưởng, Tổ phó, Thư ký và các uỷ viên là đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội, tập thể cử tri ở địa phương, đại diện Chỉ huy đơn vị, đại diện quân nhân.

2. Tổ bầu cử có những nhiệm vụ và quyền hạn sau đây:

a) Phụ trách công tác bầu cử trong khu vực bỏ phiếu;

b) Bố trí phòng bỏ phiếu, chuẩn bị hòm phiếu;

c) Nhận tài liệu và phiếu bầu từ Ban bầu cử; phát thẻ cử tri, phiếu bầu có đóng dấu của Tổ bầu cử cho cử tri;

d) Thường xuyên thông báo cho cử tri biết ngày bầu cử, nơi bỏ phiếu, thời gian bỏ phiếu trong thời hạn mười ngày trước ngày bầu cử;

đ) Bảo đảm thực hiện nghiêm chỉnh nội quy phòng bỏ phiếu;

e) Giải quyết khiếu nại, tố cáo về công tác bầu cử do mình phụ trách;

g) Kiểm phiếu và làm biên bản kết quả kiểm phiếu để gửi đến Ban bầu cử;

h) Giao biên bản kết quả kiểm phiếu và toàn bộ phiếu bầu cho Uỷ ban nhân dân xã, phường, thị trấn;

i) Báo cáo tình hình tổ chức và tiến hành bầu cử theo quy định của các tổ chức phụ trách bầu cử cấp trên;

k) Tổ chức thực hiện việc bầu cử lại, bầu cử thêm.”

7. Điều 21 được sửa đổi, bổ sung như sau:

“Điều 21

Hội đồng bầu cử hết nhiệm vụ đối với bầu cử đại biểu Quốc hội sau khi đã trình Quốc hội khoá mới biên bản tổng kết cuộc bầu cử đại biểu Quốc hội và hồ sơ, tài liệu về bầu cử đại biểu Quốc hội.

Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh, Ban bầu cử, Tổ bầu cử hết nhiệm vụ đối với bầu cử đại biểu Quốc hội sau khi Hội đồng bầu cử kết thúc việc tổng kết công tác bầu cử đại biểu Quốc hội trong cả nước.”

8. Điều 25 được sửa đổi, bổ sung như sau:

“Điều 25

Chậm nhất là ba mươi lăm ngày trước ngày bầu cử, cơ quan lập danh sách cử tri niêm yết danh sách đó tại trụ sở Uỷ ban nhân dân xã, phường, thị trấn và tại những nơi công cộng của khu vực bỏ phiếu, đồng thời thông báo rộng rãi danh sách cử tri và việc niêm yết để nhân dân kiểm tra.”

9. Điều 26 được sửa đổi, bổ sung như sau:

“Điều 26

Khi kiểm tra danh sách cử tri, nếu thấy có sai sót thì trong thời hạn hai mươi lăm ngày, kể từ ngày niêm yết, mọi người có quyền khiếu nại bằng miệng hoặc bằng văn bản với cơ quan lập danh sách cử tri. Cơ quan lập danh sách cử tri phải ghi vào sổ những khiếu nại đó. Trong thời hạn năm ngày, kể từ ngày nhận được khiếu nại, cơ quan lập danh sách cử tri phải giải quyết và thông báo cho người khiếu nại biết kết quả giải quyết.

Trường hợp người khiếu nại không đồng ý về kết quả giải quyết thì có quyền khởi kiện tại Toà án nhân dân huyện, quận, thị xã, thành phố thuộc tỉnh. Trong thời hạn năm ngày, kể từ ngày nhận được khiếu kiện, Toà án nhân dân phải giải quyết xong. Quyết định của Toà án nhân dân là quyết định cuối cùng.”

10. Điều 46 được sửa đổi, bổ sung như sau:

“Điều 46

Căn cứ vào danh sách chính thức những người ứng cử đại biểu Quốc hội được Đoàn Chủ tịch Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam giới thiệu, Hội đồng bầu cử gửi đến các Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh hữu quan danh sách những người được giới thiệu về ứng cử tại địa phương.

Hội đồng bầu cử lập và công bố danh sách những người ứng cử đại biểu Quốc hội theo từng đơn vị bầu cử trong cả nước theo danh sách chính thức do Ban thường trực Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam và Uỷ ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh gửi đến chậm nhất là hai mươi lăm ngày trước ngày bầu cử.

Trong danh sách những người ứng cử đại biểu Quốc hội phải ghi rõ họ, tên, ngày, tháng, năm sinh, giới tính, quê quán, nơi thường trú, dân tộc, tôn giáo, trình độ văn hoá, chuyên môn, nghề nghiệp, chức vụ, nơi làm việc của người ứng cử. Danh sách những người ứng cử được xếp theo vần chữ cái A, B, C...

Số người trong danh sách ứng cử đại biểu Quốc hội ở mỗi đơn vị bầu cử phải nhiều hơn số đại biểu được bầu ở đơn vị đó; nếu đơn vị bầu cử được bầu ba đại biểu thì số người trong danh sách ứng cử phải nhiều hơn số đại biểu được bầu ít nhất là hai người. Trong trường hợp khuyết người ứng cử vì lý do bất khả kháng thì do Hội đồng bầu cử quyết định.

Người ứng cử chỉ được ghi tên vào danh sách ứng cử ở một đơn vị bầu cử.”

11. Điều 55 được sửa đổi, bổ sung như sau:

“Điều 55

Trường hợp đặc biệt cần hoãn ngày bỏ phiếu hoặc bỏ phiếu sớm hơn ngày quy định thì Tổ bầu cử phải kịp thời báo cáo Ban bầu cử để đề nghị Ủy ban bầu cử trình Hội đồng bầu cử xem xét, quyết định”.

12. Điều 58 được sửa đổi, bổ sung như sau:

“Điều 58

Mỗi cử tri có quyền bỏ một phiếu bầu đại biểu Quốc hội.

Cử tri phải tự mình đi bầu, không được nhờ người khác bầu thay, trừ trường hợp quy định tại Điều 59 của Luật này; khi bầu cử phải xuất trình thẻ cử tri.”

13. Điều 60 được sửa đổi, bổ sung như sau:

“Điều 60

Khi cử tri viết phiếu bầu, không ai được xem, kể cả thành viên Tổ bầu cử. Nếu viết hỏng, cử tri có quyền đổi phiếu bầu khác.

Khi cử tri bỏ phiếu xong, Tổ bầu cử có trách nhiệm đóng dấu “đã bỏ phiếu” vào thẻ cử tri.”

14. Điều 68 được sửa đổi, bổ sung như sau:

“Điều 68

1. Sau khi kiểm phiếu xong, Tổ bầu cử phải lập biên bản kết quả kiểm phiếu. Biên bản phải ghi rõ:

a) Tổng số cử tri của khu vực bỏ phiếu;

b) Số cử tri đã tham gia bỏ phiếu;

c) Số phiếu phát ra;

d) Số phiếu thu vào;

đ) Số phiếu hợp lệ;

e) Số phiếu không hợp lệ;

g) Số phiếu bầu cho mỗi người ứng cử;

h) Những khiếu nại nhận được, những khiếu nại đã giải quyết và kết quả giải quyết, những khiếu nại chuyển đến Ban bầu cử giải quyết.

2. Biên bản được lập thành ba bản, có chữ ký của Tổ trưởng, Thư ký và hai cử tri được mời chứng kiến việc kiểm phiếu. Biên bản được gửi đến Ban bầu cử và Uỷ ban nhân dân, Ban thường trực Uỷ ban Mặt trận Tổ quốc xã, phường, thị trấn chậm nhất là ba ngày sau ngày bầu cử.”

15. Điều 82 được sửa đổi, bổ sung như sau:

“Điều 82

Chậm nhất là hai mươi ngày trước ngày bầu cử bổ sung, Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập ở đơn vị bầu cử Ban bầu cử bổ sung từ ba đến năm người gồm Trưởng ban, Phó Trưởng ban, Thư ký và các uỷ viên là đại diện chính quyền địa phương và Uỷ ban Mặt trận Tổ quốc ở địa phương.”

16. Điều 83 được sửa đổi, bổ sung như sau:

“Điều 83

Chậm nhất là mười lăm ngày trước ngày bầu cử bổ sung, Ủy ban nhân dân xã, phường, thị trấn thành lập ở mỗi khu vực bỏ phiếu một Tổ bầu cử bổ sung từ năm đến bảy người gồm Tổ trưởng, Tổ phó, Thư ký và các uỷ viên là đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội, tập thể cử tri ở địa phương.”

Điều 2. Sửa đổi, bổ sung một số điều của Luật bầu cử đại biểu Hội đồng nhân dân.

1. Điều 13 được sửa đổi, bổ sung như sau:

“Điều 13

1. Mỗi đơn vị bầu cử đại biểu Hội đồng nhân dân mỗi cấp chia thành một hoặc nhiều khu vực bỏ phiếu. Khu vực bỏ phiếu bầu cử đại biểu Hội đồng nhân dân đồng thời là khu vực bỏ phiếu bầu cử đại biểu Quốc hội.

2. Việc thành lập khu vực bỏ phiếu được thực hiện theo quy định tại Điều 12 của Luật bầu cử đại biểu Quốc hội.”

2. Điều 15 được sửa đổi, bổ sung như sau:

“Điều 15

Các tổ chức phụ trách bầu cử đại biểu Hội đồng nhân dân bao gồm:

1. Hội đồng bầu cử ở trung ương;

2. Ủy ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh ở tỉnh, thành phố trực thuộc trung ương, Ủy ban bầu cử đại biểu Hội đồng nhân dân cấp huyện ở huyện, quận, thị xã, thành phố thuộc tỉnh, Ủy ban bầu cử đại biểu Hội đồng nhân dân cấp xã ở xã, phường, thị trấn (sau đây gọi chung là Ủy ban bầu cử);

3. Ban bầu cử đại biểu Hội đồng nhân dân cấp tỉnh, Ban bầu cử đại biểu Hội đồng nhân dân cấp huyện, Ban bầu cử đại biểu Hội đồng nhân dân cấp xã ở đơn vị bầu cử (sau đây gọi chung là Ban bầu cử);

4. Tổ bầu cử ở khu vực bỏ phiếu.”

3. Bổ sung Điều 15a sau Điều 15 như sau:

“Điều 15a

1. Hội đồng bầu cử được thành lập theo quy định tại khoản 1 Điều 14 của Luật bầu cử đại biểu Quốc hội.

2. Đối với bầu cử đại biểu Hội đồng nhân dân, Hội đồng bầu cử có những nhiệm vụ và quyền hạn sau đây:

a) Lãnh đạo, chỉ đạo việc tổ chức bầu cử trong cả nước; kiểm tra, đôn đốc việc thi hành quy định của pháp luật về bầu cử;

b) Chỉ đạo công tác thông tin, tuyên truyền và vận động bầu cử;

c) Chỉ đạo công tác bảo vệ an ninh, trật tự, an toàn xã hội trong cuộc bầu cử;

d) Quy định mẫu phiếu bầu cử đại biểu Hội đồng nhân dân;

đ) Hủy bỏ kết quả bầu cử đại biểu Hội đồng nhân dân và quyết định ngày bầu cử lại ở đơn vị bầu cử đó.”

4. Điều 16 được sửa đổi, bổ sung như sau:

“Điều 16

1. Việc thành lập Ủy ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh được thực hiện theo quy định tại khoản 1 Điều 15 của Luật bầu cử đại biểu Quốc hội.

Đối với bầu cử đại biểu Hội đồng nhân dân, Ủy ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh có nhiệm vụ, quyền hạn theo quy định tại khoản 3 Điều này.

2. Chậm nhất là chín mươi lăm ngày trước ngày bầu cử đại biểu Hội đồng nhân dân, Uỷ ban nhân dân cấp huyện, cấp xã sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập Ủy ban bầu cử tương ứng gồm đại diện Thường trực Hội đồng nhân dân, Uỷ ban nhân dân, Uỷ ban Mặt trận Tổ quốc, một số cơ quan, tổ chức hữu quan.

Ủy ban bầu cử đại biểu Hội đồng nhân dân cấp huyện có từ mười một đến mười lăm người.

Ủy ban bầu cử đại biểu Hội đồng nhân dân cấp xã có từ chín đến mười một người.

Ủy ban bầu cử gồm Chủ tịch, các Phó Chủ tịch, Thư ký và các ủy viên.

Danh sách Ủy ban bầu cử đại biểu Hội đồng nhân dân cấp huyện và cấp xã phải được báo cáo lên Thường trực Hội đồng nhân dân, Uỷ ban nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cấp trên trực tiếp.

3. Ủy ban bầu cử có những nhiệm vụ và quyền hạn sau đây:

a) Chỉ đạo việc tổ chức bầu cử đại biểu Hội đồng nhân dân ở địa phương; kiểm tra, đôn đốc việc thi hành quy định của pháp luật về bầu cử đại biểu Hội đồng nhân dân;

b) Chỉ đạo thực hiện công tác bảo vệ an ninh, trật tự, an toàn xã hội trong cuộc bầu cử đại biểu Hội đồng nhân dân ở địa phương;

c) Chỉ đạo công tác thông tin, tuyên truyền và vận động bầu cử đại biểu Hội đồng nhân dân ở địa phương;

d) Nhận và xem xét hồ sơ của những người được tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, tổ chức kinh tế, đơn vị vũ trang nhân dân, cơ quan nhà nước, thôn, tổ dân phố ở địa phương giới thiệu ứng cử và những người tự ứng cử đại biểu Hội đồng nhân dân; gửi danh sách trích ngang và tiểu sử tóm tắt của những người ứng cử và những người tự ứng cử đại biểu Hội đồng nhân dân đến Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp;

đ) Giải quyết những khiếu nại, tố cáo về công tác bầu cử đại biểu Hội đồng nhân dân của các Ban bầu cử, Tổ bầu cử;

e) Công bố số đơn vị bầu cử, danh sách các đơn vị và số đại biểu được bầu của mỗi đơn vị bầu cử đại biểu Hội đồng nhân dân ở địa phương mình;

g) Nhận hồ sơ và công bố danh sách những người ứng cử đại biểu Hội đồng nhân dân theo từng đơn vị bầu cử; giải quyết những khiếu nại, kiến nghị về việc lập danh sách đó;

h) Nhận tài liệu và phiếu bầu cử đại biểu Hội đồng nhân dân từ Uỷ ban nhân dân cùng cấp và phân phối cho các Ban bầu cử chậm nhất là hai mươi lăm ngày trước ngày bầu cử;

i) Nhận và kiểm tra biên bản xác định kết quả bầu cử đại biểu Hội đồng nhân dân do các Ban bầu cử gửi đến; làm biên bản tổng kết cuộc bầu cử đại biểu Hội đồng nhân dân ở địa phương;

k) Chỉ đạo việc bầu cử thêm, bầu cử lại đại biểu Hội đồng nhân dân theo quy định tại các điều 62, 63, 64 và 65 của Luật này;

l) Công bố kết quả bầu cử đại biểu Hội đồng nhân dân;

m) Trình Hội đồng nhân dân biên bản tổng kết cuộc bầu cử đại biểu Hội đồng nhân dân và chuyển giao các hồ sơ, tài liệu về cuộc bầu cử đại biểu Hội đồng nhân dân theo quy định của Luật này.”

5. Khoản 1 Điều 17 được sửa đổi, bổ sung như sau:

“ 1. Chậm nhất là bốn mươi lăm ngày trước ngày bầu cử đại biểu Hội đồng nhân dân, Uỷ ban nhân dân sau khi thống nhất với Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cùng cấp quyết định thành lập ở mỗi đơn vị bầu cử một Ban bầu cử gồm đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội. Ở cấp xã, thành phần Ban bầu cử có thêm đại diện tập thể cử tri ở địa phương.

Ban bầu cử đại biểu Hội đồng nhân dân cấp tỉnh có từ mười một đến mười ba người. Ban bầu cử đại biểu Hội đồng nhân dân cấp huyện có từ chín đến mười một người.

Ban bầu cử đại biểu Hội đồng nhân dân cấp xã có từ bảy đến chín người. Ban bầu cử gồm Trưởng ban, Phó Trưởng ban, Thư ký và các ủy viên.”

6. Điều 18 được sửa đổi, bổ sung như sau:

“Điều 18

1. Tổ bầu cử được thành lập ở mỗi khu vực bỏ phiếu để thực hiện công tác bầu cử đại biểu Hội đồng nhân dân các cấp và bầu cử đại biểu Quốc hội.

2. Việc thành lập Tổ bầu cử, nhiệm vụ, quyền hạn của Tổ bầu cử được thực hiện theo quy định tại Điều 17 của Luật bầu cử đại biểu Quốc hội.”

7. Điều 22 được sửa đổi, bổ sung như sau:

“Điều 22

Hội đồng bầu cử hết nhiệm vụ đối với bầu cử đại biểu Hội đồng nhân dân sau khi các Ủy ban bầu cử đã trình biên bản tổng kết cuộc bầu cử và hồ sơ, tài liệu về bầu cử tại kỳ họp thứ nhất của Hội đồng nhân dân khoá mới.

Ủy ban bầu cử hết nhiệm vụ đối với bầu cử đại biểu Hội đồng nhân dân sau khi Ủy ban bầu cử đã trình biên bản tổng kết cuộc bầu cử và hồ sơ, tài liệu về bầu cử tại kỳ họp thứ nhất của Hội đồng nhân dân khoá mới.

Ban bầu cử, Tổ bầu cử hết nhiệm vụ đối với bầu cử đại biểu Hội đồng nhân dân sau khi Ủy ban bầu cử kết thúc việc tổng kết công tác bầu cử đại biểu Hội đồng nhân dân.”

8. Điều 37 được sửa đổi, bổ sung như sau:

“ Điều 37

Hội nghị cử tri ở xã, phường, thị trấn tổ chức theo đơn vị thôn, tổ dân phố do Ban thường trực Uỷ ban Mặt trận Tổ quốc phối hợp với Thường trực Hội đồng nhân dân, Uỷ ban nhân dân cùng cấp triệu tập và chủ trì.

Hội nghị cử tri ở cơ quan nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội, tổ chức xã hội, tổ chức kinh tế, đơn vị sự nghiệp do Thủ trưởng cơ quan hoặc người đứng đầu của tổ chức phối hợp với Ban chấp hành công đoàn cùng cấp triệu tập và chủ trì. Hội nghị cử tri ở đơn vị vũ trang nhân dân là Hội nghị quân nhân do lãnh đạo, Chỉ huy đơn vị triệu tập và chủ trì.

Người được giới thiệu ứng cử, tự ứng cử đại biểu Hội đồng nhân dân, đại diện cơ quan, tổ chức, đơn vị, thôn, tổ dân phố có người ứng cử được mời tham dự các hội nghị này.

Tại các hội nghị này, cử tri đối chiếu với tiêu chuẩn đại biểu Hội đồng nhân dân để nhận xét, bày tỏ sự tín nhiệm đối với người tự ứng cử, người được giới thiệu ứng cử bằng cách giơ tay hoặc bỏ phiếu kín theo quyết định của Hội nghị.

Biên bản Hội nghị cử tri lấy ý kiến về những người ứng cử đại biểu Hội đồng nhân dân phải ghi rõ thành phần, số lượng người tham dự, diễn biến, kết quả Hội nghị. Biên bản Hội nghị cử tri lấy ý kiến về những người ứng cử đại biểu Hội đồng nhân dân cấp nào thì gửi đến Ban thường trực Uỷ ban Mặt trận Tổ quốc cấp đó để chuẩn bị cho Hội nghị hiệp thương lần thứ ba.

Ủy ban thường vụ Quốc hội phối hợp với Uỷ ban trung ương Mặt trận Tổ quốc Việt Nam hướng dẫn việc tổ chức Hội nghị cử tri nơi làm việc và nơi cư trú.”

9. Điều 44 được sửa đổi, bổ sung như sau:

“ Điều 44

Hội đồng bầu cử chỉ đạo công tác thông tin, tuyên truyền và vận động bầu cử trong phạm vi cả nước. Các Ủy ban bầu cử chỉ đạo công tác thông tin, tuyên truyền và vận động bầu cử tại địa phương mình.”

10. Điều 48 được sửa đổi, bổ sung như sau:

“Điều 48

Việc bỏ phiếu bắt đầu từ bảy giờ sáng đến bảy giờ tối. Tùy tình hình địa phương, Tổ bầu cử có thể quyết định cho bắt đầu sớm hơn nhưng không được trước năm giờ sáng hoặc kết thúc muộn hơn nhưng không được quá mười giờ đêm.

Trước khi bỏ phiếu, Tổ bầu cử phải kiểm tra hòm phiếu trước sự chứng kiến của cử tri.”

11. Điều 54 được sửa đổi, bổ sung như sau:

“Điều 54

Trong ngày bầu cử, cuộc bỏ phiếu phải được tiến hành liên tục. Trong trường hợp có sự kiện bất ngờ làm gián đoạn việc bỏ phiếu thì Tổ bầu cử phải lập tức niêm phong giấy tờ và hòm phiếu, kịp thời báo cáo cho Ban bầu cử biết, đồng thời phải có những biện pháp cần thiết để cuộc bỏ phiếu được tiếp tục.

Trong trường hợp đặc biệt cần hoãn ngày bỏ phiếu hoặc bỏ phiếu sớm hơn ngày quy định

thì Tổ bầu cử phải kịp thời báo cáo Ban bầu cử để đề nghị Ủy ban bầu cử trình Hội đồng bầu cử xem xét, quyết định.”

12. Điều 64 được sửa đổi, bổ sung như sau:

“Điều 64

Hội đồng bầu cử huỷ bỏ cuộc bầu cử ở đơn vị bầu cử có những vi phạm pháp luật nghiêm trọng theo đề nghị của Chính phủ và quyết định ngày bầu cử lại ở đơn vị bầu cử đó.”

13. Điều 70 được sửa đổi, bổ sung như sau:

“Điều 70

Chậm nhất là hai mươi ngày trước ngày bầu cử bổ sung đại biểu Hội đồng nhân dân cấp nào thì Uỷ ban nhân dân, Thường trực Hội đồng nhân dân và Ban thường trực Uỷ ban Mặt trận Tổ quốc cấp đó thành lập Ủy ban bầu cử bổ sung từ ba đến năm người và chậm nhất là mười lăm ngày trước ngày bầu cử bổ sung, thành lập ở mỗi đơn vị bầu cử bổ sung một Ban bầu cử bổ sung từ ba đến năm người gồm đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội.

Ủy ban bầu cử bổ sung gồm Chủ tịch, Thư ký và ủy viên. Ban bầu cử bổ sung gồm Trưởng ban, Thư ký và ủy viên.”

14. Điều 71 được sửa đổi, bổ sung như sau:

“Điều 71

Chậm nhất là mười ngày trước ngày bầu cử bổ sung, Uỷ ban nhân dân cấp xã thành lập ở mỗi khu vực bỏ phiếu một Tổ bầu cử bổ sung từ năm đến bảy người gồm đại diện cơ quan nhà nước, tổ chức chính trị - xã hội, tổ chức xã hội và tập thể cử tri ở địa phương.

Tổ bầu cử bổ sung gồm Tổ trưởng, Tổ phó, Thư ký và các ủy viên.”

Điều 3

1. Thay thế cụm từ “Ủy ban bầu cử” tại các điều 18, 19, 28, 31, 38, 40, 45, 49, 50, 69, 71, 72, 73, 75, 76 và 84 của Luật bầu cử đại biểu Quốc hội bằng cụm từ “Ủy ban bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân cấp tỉnh”.

Thay thế cụm từ “Đoàn Chủ tịch Ủy ban trung ương Mặt trận Tổ quốc Việt Nam” tại Điều 39 và Điều 84 của Luật bầu cử đại biểu Quốc hội bằng cụm từ “Ủy ban trung ương Mặt trận Tổ quốc Việt Nam”.

2. Thay thế cụm từ “Hội đồng bầu cử” tại các điều 12, 17, 21, 29, 31, 32, 36, 38, 40, 41, 43, 60, 62, 63, 66, 67 và 74 của Luật bầu cử đại biểu Hội đồng nhân dân bằng cụm từ “Ủy ban bầu cử”.

Điều 4

1. Luật này có hiệu lực thi hành từ ngày 01 tháng 01 năm 2011.

2. Ủy ban thường vụ Quốc hội, Chính phủ, Ủy ban trung ương Mặt trận Tổ quốc Việt Nam quy định chi tiết, hướng dẫn thi hành các điều, khoản được giao trong Luật; hướng dẫn những nội dung cần thiết khác của Luật này để đáp ứng yêu cầu quản lý nhà nước.

Luật này đã được Quốc hội nước Cộng hoà xã hội chủ nghĩa Việt Nam khoá XII, kỳ họp thứ 8 thông qua ngày 24 tháng 11 năm 2010.

AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF THE LAW ON ELECTION OF DEPUTIES TO THE NATIONAL ASSEMBLY AND THE LAW ON ELECTION OF DEPUTIES TO THE PEOPLE'S COUNCILS

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No.51/2001/QH10;
The National Assembly promulgates the Law Amending and Supplementing a Number of Articles of the 1997 Law on Election of Deputies to the National Assembly, which was amended and supplemented under Law No. 31/2001/ QH10, and Law No. 13/2003/QH11 on Election of Deputies to the People's Councils.

Article 1. To amend and supplement a number of articles of the Law on Election of Deputies to the National Assembly as follows:

1. To amend and supplement Article 12 as follows:

"Article 12.

1. Each constituency shall be divided into various electorates. Electorates for electing deputies to the National Assembly are concurrently those for electing deputies to the People's Councils at all levels.

2. Each electorate has between three hundred and four thousand voters. For a mountainous. island or sparsely populated area, an electorate may be established even though it has less than three hundred voters.

People's armed forces units shall establish their own electorates, except for cases in which people's armed forces units and localities share the same electorates.

A hospital, maternity house, sanitarium, nursing home for handicapped people or the elderly with fifty or more voters may establish its own electorate.

An educational establishment or medical treatment establishment for persons who are serving administrative sanctions may establish its own electorate."

2. To amend and supplement Article 13 as follows:

"Article 13.

Organizations in charge of the election of deputies to the National Assembly include:

1. The Central Election Council;

2. Provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils in provinces and centrally run cities;

3. Election Boards of the constituencies;

3. To amend and supplement Article 14 as follows:

"Article 14.

1. No later than one hundred and five days before the election day, the National Assembly Standing Committee shall set up the Central Election Council for election of deputies to the National Assembly and deputies to the People's Councils at all levels. It shall be composed of between fifteen and twenty-one persons, including the Chairman, Vice-Chairmen and Secretary General and members who are representatives of the National Assembly Standing Committee, the Government, the Vietnam Fatherland Front Central Committee, and a number of concerned agencies and organizations.

2. For the election of deputies to the National Assembly, the Election Council has the following tasks and powers:

a/ To lead and direct the organization of the election in the whole country; to supervise and urge the implementation of the election law;

b/ To direct election information, propaganda and electioneering work;

c/ To direct the maintenance of security and social order and safety during the election;

d/ To receive and consider the personal records of National Assembly candidates nominated by political, socio-political and social organizations, people's armed forces and state agencies at the central level; to forward the summarized biographies of the candidates to the Standing Board of the Vietnam Fatherland Front Central Committee;

e/ To receive the personal records and the list of National Assembly candidates from the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils;

g/ To draw up and publish lists of National Assembly candidates for all constituencies throughout the country;

h/ To settle complaints and denunciations about the work of the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils, Election Boards and Election Teams; about the election of deputies to the National Assembly, forwarded by the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils or by the Election Boards; about National Assembly candidates; and about the returns of the election of deputies to the National Assembly;

i/ To receive and check the reports confirming election returns which are sent by the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils and by the Election Boards; and prepare a summary report on the national election of deputies to the National Assembly;

j/ To decide upon election reruns or additional elections or to cancel the returns of the election of deputies to the National Assembly in the constituencies;

k/To make public the returns of the election of deputies to the National Assembly in the whole country;

1/To issue certificates to the elected National Assembly deputies;

m/ To submit to the National Assembly Standing Committee and the National Assembly of the new tenure the summary report on the national election of deputies to the National Assembly, records and documents related to the election."

4. To amend and supplement Article 15 as follows:

"Article 15.

The list of members of the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils must be reported to the National Assembly Standing Committee, the Government, the Vietnam Fatherland Front Central Committee and the Election Council.

2. For the election of deputies to the National Assembly, the provincial-level Committee for Election of Deputies to the National Assembly and Deputies to the People's Councils has the following tasks and powers:

a/ To direct the preparation and organization of the election of deputies to the National Assembly in the constituencies; to supervise and urge the implementation of the law on the election of deputies to the National Assembly by the Election Boards and Election Teams;

b/ To direct election information, propaganda and electioneering work in the locality;

c/ To direct the maintenance of security and social order and safety for the election in the locality;

d/ To receive and consider the personal records of National Assembly candidates nominated by political, socio-political and social organizations, the people's armed forces and state agencies in the locality and of self-nominated candidates for the National Assembly election; to send the list and summarized biographies of the nominated and self-nominated National Assembly candidates to the Standing Board of the Fatherland Front Committee of the province or centrally run city;

e/ To receive the documents and ballot papers for the election of deputies to the National Assembly from the provincial-level People's Committee and distribute them to the Election Boards at least twenty-five days before the election day;

f/ To draw up the list of National Assembly candidates for each constituency and report it to the Election Council;

g/ To direct and supervise the drawing up and posting of the voter list;

i/ To receive and check the reports confirming the returns of the election of deputies to the National Assembly from the Election Boards; make a report confirming the returns of the election of deputies to the National Assembly in the locality;

j/ To make public the returns of the election of deputies to the National Assembly in the locality;

k/ To report on the organization and process of the election of deputies to the National Assembly according to the regulations of the Election Council;

1/ To forward the records and reports confining the returns of the election of deputies to the National Assembly to the Election Council;

m/ To hold election reruns or additional elections of deputies to the National Assembly under decisions of the Election Council."

5. To amend and supplement Article 16 as follows:

"Article 16.

1. No later than sixty days before the election day, the provincial-level People's Committee shall, after consulting the Standing Body of the People's Council and the Standing Board of the Fatherland Front Committee of the same level, decide to set up in each constituency an Election Board composed of between nine and fifteen persons including the Head, Deputy Heads and secretary and other members who are representatives of the Standing Body of the People's Council, the People's Committee, the Fatherland Front Committee of the same level and a number of concerned agencies and organizations.

2. The Election Board has the following tasks and powers:

b/ To supervise and urge the establishment of polling stations;

c/ To supervise the drawing up and posting of the voter list;

d/ To distribute voter cards and ballot papers to the Election Teams no later than fifteen days before the election day;

e/ To post up the list of candidates in the constituency;

f/ To direct and check electoral work at the polling stations;

g/ To receive and check the reports on the vote count results submitted by the Election Teams; make a report confirming the election returns in the constituency and send it to the Election Council and the provincial-level Committee for Election of Deputies to the National Assembly and Deputies to the People's Councils;

h/ To receive and forward to the provincial-level Committee for Election of Deputies to the National Assembly and Deputies to the People's Councils complaints and denunciations about National Assembly candidates; and about the work of the Election Teams;

i/ To report on the organization and process of the election of deputies to the National Assembly according to the regulations of the Election Council and the provincial-level Committee for Election of Deputies to the National-Assembly and Deputies to the People's Councils;

j/ To send the records and documents on the election to the provincial-level People's Committee;

6. To amend and supplement Article 17 as follows:

"Article 17.

1. No later than thirty-five days before the election day, the commune, ward or township People's Committee shall, after consulting the Standing Board of the People's Council and the Standing Board of the Fatherland Front Committee of the same level, decide to establish in each electorate an Election Team for election of deputies to the National Assembly and deputies to the People's Councils of all levels. Such Team shall be composed of between eleven and twenty-one persons including the Head, Deputy Heads and secretary and other members who are representatives of state agencies, socio-political organizations, social organizations and voters in the locality.

In localities without administrative units being communes, wards and townships, the People's Committee of the rural district, urban district, town or provincial city shall, after consulting the Standing Board of the People's Council and the Standing Board of the Fatherland Front Committee of the same level, decide to establish in each electorate an Election Team composed of between eleven to twenty-one persons including me Head, Deputy Heads and secretary and other members who are representatives of state agencies, socio-political organizations, social organizations and voters in the locality.

A people's armed forces unit shall establish in each of its electorates, an Election Team composed of between five and nine persons, including the Head, Deputy Heads, and secretary and other members who are representatives of me unit's command and soldiers.

In case a People's Armed Force unit and the locality share an electorate, the People's Committee of the commune, ward or township shall, after consulting the Standing Board of the People's Council and the Standing Board of the Fatherland Front Committee of the same level and the command of the people's armed force unit, decide to form an Election Team composed of between eleven and twenty-one persons, including the Head, Deputy Heads and secretary and members who are representatives of state agencies, socio-political organizations, social organizations and voters in the locality together with representatives of the unit's command and soldiers.

2. The Election Team has the following tasks and powers:

a/ To take charge of the election in the electorate;

b/ To establish polling stations and ready ballot boxes;

d/ To regularly inform voters of the election day, polling venues and polling time within ten days before the election day;

e/ To ensure strict compliance with regulations at the polling stations;

f/ To settle complaints and denunciations about electoral work under its charge;

g/ To count the votes and produce a report on the vote count results for sending to the Election Board;

h/To send the report on the vote count results and all the votes to the commune, ward or township People's Committee;

i/ To report on the organization and election process according to the regulations of the higher level organizations in charge of the election;

j/ To hold election reruns or additional elections."

7. To amend and supplement Article 21 as follows:

"Article 21.

...

...

...

The provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils, Election Boards and Election Teams finish their tasks after the Election Council concludes the review of the election of deputies to the National Assembly in the whole country."

8. To amend and supplement Article 25 as follows:

"Article 25.

No later than thirty-five days before the election day, the agency that draws up the voter list shall post it at the office of the commune, ward or township People's Committee and public places in the electorate and at the same time widely announce the voter list and its posting so that the people can check the voter list."

9. To amend and supplement Article 26 as follows:

"Article 26.

When checking the voter list, if detecting any mistake, everyone may, within twenty-five days after the date of posting, make an oral or written complaint about it to the agency that draws up the voter list. The agency that draws up the voter list shall record such complaint in a book. Within five days after the date of receiving a complaint, the agency that draws up the voter list shall settle it and inform the complainant of the settlement.

In case the complainant disagrees with the settlement result, he/she may lodge a lawsuit with the People's Court of the rural or urban district, town or provincial city. Within five days after the date of receiving the lawsuit, the People's Court shall complete the settlement. The ruling of the People's Court is final."

10. To amend and supplement Article 46 as follows:

On the basis of the official list of candidates nominated by the Presidium of the Vietnam Fatherland Front Central Committee, the Election Council shall send to each Committee for Election of Deputies to the National Assembly and Deputies to the People's Councils a list of candidates in the locality.

No later than twenty-five days before the election day, the Election Council shall draw up and make public the list of candidates for each of the constituencies in the whole country according to the official list from the Standing Board of the Vietnam Fatherland Front Central Committee and the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils.

The list of National Assembly candidates must clearly state their full names, dates of birth, gender, native places, places of residence, nationality, religion, educational level, qualifications, profession, working post and workplace. The candidates' names shall be arranged in alphabetical order.

The number of candidates in the list for each constituency must be greater than the number of deputies to be elected therein; should a constituency be allowed to elect three deputies, the number of candidates in the list must be at least 2 persons more than the number of deputies to be elected. In case of vacancy of a candidate for a force majeure reason, the Election Council shall make decision.

Each candidate may have his/her name included in the list of candidates of only one constituency."

11. To amend and supplement Article 55 as follows:

"Article 55.

In a special case that the election day must be delayed or the voting must take place earlier than the scheduled election day, the Election Team shall promptly report it to the Election Board for requesting the Election Committee to report it to the Election Council for consideration and decision."

12. To amend and supplement Article 58 as follows:

Each voter has the right to cast only one ballot.

Voters shall cast their ballots in person, not through other persons, except the cases specified in Article 59 of this Law; and shall produce their voter cards when casting their ballots."

13. To amend and supplement Article 60 as follows:

"Article 60.

When a voter is marking his/her ballot paper, nobody, even members of the Election Team, may approach him/her. If the voter makes a writing error, he/she may ask the Election Team to change the ballot paper.

After the voter casts his/her ballot, the Election Team shall append the "ballot cast" mark to the voter card."

14. To amend and supplement Article 68 as follows:

"Article 68.

1. After counting the votes, the Election Team shall make a report on the vote count result. The report must clearly state:

...

b/ The number of voters who have cast their votes;

c/ The number of distributed ballot papers;

d/ The number of received ballot papers;

e/ The number of valid votes;

f/ The number of invalid votes;

g/ The number of votes for each candidate;

h/ The complaints received, complaints already settled and settlement results, and complaints referred to the Election Board for settlement.

2. The report shall be made in three copies, each with the signatures of the Head and the secretary of the Election Team and two voters who have witnessed the vote count. Within three days after the election day, the report shall be sent to the Election Board and the People's Committee and the Standing Board of the Fatherland Front Committee of the commune, ward or township."

15. To amend and supplement Article 82 as follows:

No later than twenty days before the additional-election day. the People's Committee of the concerned province or centrally run city shall, after consulting the Standing Board of the People's Council and the Standing Board of the Fatherland Front Committee of the same level, decide to set up in each constituency a By-Election Board composed of between three and five persons, including the Head, Deputy Head and secretary and other members who are representatives of the local administration and Fatherland Front Committee."

16. To amend and supplement Article 83 as follows:

"Article 83.

No later than fifteen days before the additional-election day, the People's Committee of the concerned commune, ward or township shall set up in each electorate an Additional-Election Team composed of between five and seven persons, including the Head, Deputy Head and secretary and other members who are representatives of state agencies, socio-political organizations, social organizations and voters in the locality."

Article 2. To amend and supplement a number of articles of the Law on Election of Deputies to the People's Councils.

1. To amend and supplement Article 13 as follows:

"Article 13.

1. Each constituency may be composed of one electorate or many electorates. Electorates for electing deputies to the People's Councils are concurrently electorates for electing deputies to the National Assembly.

2. The establishment of electorates complies with Article 12 of the Law on Election of Deputies to the National Assembly."

Article 15.

The organizations in charge of the election of deputies to the National Assembly include:

1. The Central Election Council;

2. The provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils in provinces and centrally run cities; district-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils of rural districts, urban districts, towns and provincial cities; commune-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils in communes, wards and townships (below collectively referred to as Election Committees);

3. The Boards of Election of Deputies to Provincial-Level People's Councils; the Boards of Election of Deputies to District-Level People's Councils and the Boards of Election of Deputies to Commune-Level People's Councils in the constituencies (below collectively referred to as Election Boards);

4. The Election Teams of the electorates."

3. To add the following Article 15a to Article 15:

""Article 15a.

1. The Election Council shall be established under Clause 1, Article 14 of the Law on Election of Deputies to the National Assembly.

a/ To lead and direct the organization of the election in the whole country; to supervise and urge the implementation of the election law;

b/ To direct election information, propaganda and electioneering work;

c/ To direct the maintenance of security and social order and safety during the election;

d/ To define the forms of ballot papers for the election of People's Council deputies;

e/ To cancel the returns of the election of deputies to the People's Councils and decide on the date of election reruns in the constituencies."

4. To amend and supplement Article 16 as follows:

"Article 16.

1. The establishment of the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils complies with Clause 1, Article 15 of the Law on Election of Deputies to the National Assembly.

For the election of deputies to the People's Councils, the provincial-level Committees for Election of Deputies to the National Assembly and Deputies to the People's Councils have the tasks and powers defined in Clause 3 of this Article.

A district-level Committee for Election of Deputies to a District-Level People's Council shall be composed of between eleven and fifteen persons.

A commune-level Committee for Election of Deputies to a Commune-Level People's Council shall be composed of between nine and eleven persons.

An Election Committee has the Chairman. Vice-Chairmen and secretary and members.

The list of members of the district- or commune-level Election Committee must be reported to the Standing Body of the People's Council, the People's Committee and the Standing Board of the Fatherland Front Committee of the immediate superior level.

3. The Election Committee has the following tasks and powers:

a/ To direct the election of deputies to the People's Councils in the locality; supervise and urge the implementation of the law on the election of deputies to the People's Councils;

b/ To direct the maintenance of security and social order and safety for the election of deputies to the People's Councils in the locality;

c/ To direct election information, propaganda and electioneering work in the locality;

d/ To receive and consider the personal records of People's Council candidates nominated by political, socio-political and social organizations, economic organizations, the people's armed forces units, the state agencies, villages and street population groups in the locality and the personal records of the self-nominated candidates for the People's Council election; to send the list and summarized biographies of the nominated and self-nominated People's Council candidates to the Standing Board of the Fatherland Front Committee of the same level;

f/ To announce the number and list of electorates and the number of People's Council deputies to be elected in each electorate in the locality;

g/ To receive the personal records and announce the list of People's Council candidates in each electorate; to settle complaints and petitions on the drawing up of such list;

h/ To receive the documents and ballot papers for the election of deputies to the People's Councils from the People's Committee of the same level and distribute them to the Election Boards at least twenty-five days before the election day;

i/ To receive and check the reports verifying the returns of the election of deputies to the People's Councils from the Election Boards; to prepare a summary report on the election returns in the locality;

j/ To direct additional elections or election reruns of deputies to the People's Councils under Articles 62, 63, 64 and 65 of this Law;

k/ To make public the returns of the election of deputies to the People's Councils;

1/ To submit to the People's Councils the summary report on the election of deputies to the People's Councils and transfer the records and documents on the election of deputies to the People's Councils under this Law."

5. To amend and supplement Clause 1, Article 17 as follows:

"1. No later than forty-five days before the day for election of deputies to the People's Councils, the People's Committee shall, after consulting the Standing Body of the People's Council and the Standing Board of the Fatherland Front Committee of the same level, decide to set up in each electorate an Election Board composed of representatives of state agencies, socio-political organizations and social organizations. At the commune level, such an Election Board shall be additionally composed of representatives of voters in the locality.

A district-level Board for Election of Deputies to the People's Councils shall be composed of between nine and eleven persons.

A commune-level Board for Election of Deputies to the People's Councils shall be composed of between seven and nine persons.

An Election Board shall be composed of the Head, Deputy Head and secretary and members."

6. To amend and supplement Article 18 as follows:

"Article 18.

1. An Election Team shall be established in each electorate to perform the work of election of deputies to the People's Councils at all levels and election of deputies to the National Assembly.

2. The establishment of Election Teams and the tasks and powers of Election Teams comply with Article 17 of the Law on Election of Deputies to the National Assembly."

7. To amend and supplement Article 22 as follows:

"Article 22.

The Election Committee fulfills its tasks of election of deputies to the People's Councils after the Election Committees submit to the first session of the new People's Council the summary reports on the election result, the records and documents related to the election.

The Election Boards and Election Teams finish their tasks of election of deputies to the People's Councils after the Election Committee concludes the review of the election of deputies to the People's Councils."

8. To amend and supplement Article 37 as follows:

"Article 37.

Commune, ward and township conferences of voters held according to hamlets and street population groups shall be jointly convened and presided over by the Standing Boards of the Fatherland Front Committees and the Standing Bodies of the People's Councils and the People's Committees of the same level.

Conferences of voters in state agencies, political organizations, socio-political organizations, social organizations, economic organizations or non-business units shall be convened and presided over by the heads of agencies or organizations in coordination with the Trade Union Executive Committees of the same level. Conferences of voters in people's armed force units are army men's conferences which shall be convened and presided over by the units' leaders or commanders.

Nominated and self-nominated People's Council candidates and representatives of agencies, organizations, units, hamlets and street population groups having candidates shall be invited to attend these conferences.

At these conferences, voters shall base themselves on the criteria of People's Council deputies to give their comments on and express their confidence in nominated and self-nominated candidates by show of hands or casting secret ballots as decided by the conferences.

Minutes of voters' conferences forgathering comments on People's Council candidates must clearly state the composition and number of participants as well as conferences' proceedings and outcomes. Minutes of voters' conferences for gathering comments on candidates of the People's Council of a level shall be sent to the Standing Board of the Fatherland Front Committee of such level for preparation for third consultation conferences.

9. To amend and supplement Article 44 as follows:

"Article 44.

The Election Council shall direct the work of election information, propaganda and electioneering nationwide. The Election Committees shall direct the work of election information, propaganda and electioneering in their respective localities."

10. To amend and supplement Article 48 as follows:

"Article 48.

The voting shall begin at seven hours and end at nineteen hours on the same day. Depending on the local situation, the Election Teams may decide to begin the voting earlier and end it later, but it must not begin before five hours and end after twenty-two hours on the same day.

Before the voting, the Election Teams shall check the ballot boxes to the witness of voters."

11. To amend and supplement Article 54 as follows:

"Article 54.

...

In special cases in which the voting needs to be postponed or held earlier than scheduled, the Election Teams shall promptly report them to the Election Boards in order to request the Election Committees to report to the Election Council for consideration and decision."

12. To amend and supplement Article 64 as follows:

"Article 64.

The Election Council shall cancel the election at electorates which commit serious violations of law at the proposal of the Government and decide on the date for election reruns at such electorates."

13. To amend and supplement Article 70 as follows:

"Article 70.

No later than twenty days before the date for additional election of deputies to the People's Council of a level, the People's Committee, the Standing Body of the People's Council and Standing Board of the Fatherland Front Committee of such level shall set up the Additional-Election Committee composed of between three and five persons, and no later than fifteen days before the additional-election date, set up at each additional electorate an Additional-Election Board composed of between three and five persons who are representatives of state agencies, socio-political organizations and social organizations.

An Additional-Election Committee shall be composed of the Chairman and secretary and members.

An Additional-Election Board shall be composed of the Head and secretary and members."

"Article 71.

No later than ten days before the additional-election date, the commune-level People's Committee shall set up at each polling station an Additional-Election Team composed of between five and seven persons who are representatives of state agencies, socio-political organizations, social organizations and voters in the locality.

An Additional-Election Team shall be composed of the Head, Deputy Head and secretary and members."

Article 3.

1. To replace the phrase "Election Committee" in Articles 18, 19, 28, 31, 38, 40, 45,49,50, 69, 71, 72, 73, 75, 76 and 84 of the Law on Election of Deputies to the National Assembly with the phrase "provincial-level Committee for Election of Deputies to the National Assembly and Deputies to the People's Councils."

To replace the phrase "Presidium of the Vietnam Fatherland Front Central Committee" in Articles 39 and 84 of the Law on Election of Deputies to the National Assembly with the phrase "Vietnam Fatherland Front Central Committee."

2. To replace the phrase "Election Council" in Articles 12,17,21,29,31,32,36,38,40,41, 43, 60, 62, 63, 66, 67 and 74 of the Law on Election of Deputies to the People's Councils with the phrase "Election Committee."

1. This Law takes effect on January 1, 2011.
