RESOLUTION

PROGRAM FOR DEVELOPMENT OF LAWS AND ORDINANCES IN 2020 AND ADJUSTMENTS TO LAW AND ORDINANCE DEVELOPMENT PLAN IN 2019

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of Socialist Republic of Vietnam;

Pursuant to the Law on organization of the National Assembly No. 57/2014/QH13;

Pursuant to the Law on promulgation of legislative documents No.80/2015/QH13;

At the request of the Standing Committee of the National Assembly on Report No. 386/TTr-UBTVQH14 dated May 06 2019 on program for development of laws and ordinances in 2020 and adjustments to law and ordinance development plan in 2019, and Report No.409/BC-UBTVQH14 dated June 10 2019 on explaining, absorbing and revising the draft resolution thereof.

HEREBY RESOLVES:

1. The following bills are added to the law and ordinance development plan of 2019:

Law on amendments to some articles of Law on Judicial Expertise (to be discussed in the 8th plenary session);

b) Law on amendments to some articles of Law on natural disaster management and Law on dikes and dike maintenance (to be discussed in the 8th plenary session)

c) Law on amendments to some articles of Law on construction (to be discussed in the 8th plenary session)

d) Ordinance of preferential treatment for people with meritorious services to the revolution (revised) (to be submitted to the Standing Committee of the National Assembly for approval in December’s meeting)

2. The deadlines for submission of the following bills are adjusted:

Law on amendments to some articles of Law on Investment and Law on Enterprises (to be discussed in the 8^th session instead of the 7^th session and to be ratified at the 9^th session)

b) Law on medical examination and treatment (revised) (to be discussed in the 9^th session instead of the 7^th session and to be ratified at the 10^th session)

c) Law on amendments to some articles of Land law (to be discussed in the 9^th session instead of the 7^th session and to be ratified at the 10^th session)

Article 2. The program for development of laws and ordinances in 2020

1. At 9^th plenary session:

a) The following documents shall be submitted to the National Assembly for ratification:

1. Law on amendments to some articles of Law on promulgation of legislative documents

2. Law on Youth (revised)

3. Law on public-private partnership

4. Law on Mediation and Dialogues at Court;

5. Law on amendments to some articles of Law on Judicial Expertise

6. Law on amendments to some articles of Law on natural disaster management and Law on dikes and dike maintenance

8. Law on amendments to some articles of Law on Investment and Law on Enterprises;

9. Resolution on the program for development of laws and ordinances in 2021

b) The following documents shall be submitted to the National Assembly for comments:

1. Law on Vietnamese guest workers (revised)

5. Law on amendments to some articles of Law on administrative sanctions;

6. Law on medical examination and treatment (revised);

2. At 10^th plenary session:

a) The following documents shall be submitted to the National Assembly for ratification:

1. Law on Vietnamese guest workers (revised)

2. Law on border defense;

3. Law on International agreements;

4. Law on amendments to some articles of Law on environment protection;

5. Law on amendments to some articles of Law on administrative sanctions;

6. Law on medical examination and treatment (revised);

7. Law on amendments to some articles of Land law;

1. Law on amendments to some articles of Law on prevention and control of HIV/AIDS;

2. Law on emulation and commendation (revised)

Article 3. Organizations of implementation

1. Competent agencies, organizations and individuals shall strictly implement provisions of the Law on promulgation of legislative documents to ensure the legality, accuracy and completeness of documents used on bills and drafts by using clear legislative techniques. Unqualified bills or drafts shall not be submitted. Avoid delay in documents submission; clearly identify the reason and the responsibility of each agency, organization and individuals in failing to complete the assigned tasks in the Program for development of laws and ordinances and report to the National Assembly.

2. The agencies in charge of drafting, revision, supervising and other relevant agencies shall take the responsibility of providing adequate information, supporting documents for the delegates to the National Assembly to promptly access and make comments on bills and drafts and therefore promote the role and responsibility of contributing to the formulation of laws and ordinances of both sides.

3. The Government shall allow sufficient time to discuss and comment on bills, drafts submitted to the National Assembly and the National Assembly Standing Committee; take responsibility of directing, urging and examining to ensure the quality and progress of bills and drafts; clearly define the responsibility of relating units and take actions against heads of units, organizations that fail to fulfill their duties; fully collect comments and regulate the participation of relevant units to ensure the quality of comments. The Government shall report conflict opinions from those of the Standing Committee offered during the processes to the National Assembly for consideration and decision; ensure the elaborating documents promulgated are conformable with of ratified lawsoft, ordinances and resolutions.

4. The Ethnic Council and other Committees of the National Assembly shall closely work with agencies of approval, drafting and review; promote the responsibility of the standing members in Ethnic Council and Committees and whole staff of Ethnic Council and Committees in reviewing, absorbing and revising bills and drafts; monitor and urge the preparation of bills and drafts relating to their fields and supervise the implementation of such documents after being ratified, including supervising the issuance of detailing and guiding documents for the ratified ones.

5. Delegates of the National Assembly shall spend sufficient time and effort to research and consult opinions from relevant agencies, organizations, experts, scientists and individuals on draft legislation under their consideration; actively discuss and debate to complete the bills and drafts.

6. The Government, the Vietnam General Confederation of Labor and other relevant agencies, organizations, within their tasks and scopes, shall urgently prepare bills serving the purpose of implementing the Central Committee’s resolutions as planned; promptly review and propose addition to the Program for development of laws and ordinances in 2019 and 2020.

The National Assembly Standing Committee, the Government, ministries, organizations and relevant individuals shall closely cooperate to effectively implement this Resolution.

This Resolution is passed by the 14^th National Assembly of the Socialist Republic of Vietnam at its 7^th session on June 11 2019.
