QUY ĐỊNH CHỨC NĂNG, NHIỆM VỤ, QUYỀN HẠN VÀ CƠ CẤU TỔ CHỨC CỦA TRUNG TÂM THÔNG TIN – KINH TẾ TÀI NGUYÊN NƯỚC

CỤC TRƯỞNG CỤC QUẢN LÝ TÀI NGUYÊN NƯỚC

Căn cứ Quyết định số 1035/QĐ-BTNMT ngày 19 tháng 5 năm 2008 của Bộ trưởng Bộ Tài nguyên và Môi trường quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Cục Quản lý tài nguyên nước;
Theo đề nghị của Giám đốc Trung tâm Thông tin - Kinh tế tài nguyên nước và Chánh Văn phòng Cục,

QUYẾT ĐỊNH

Điều 1. Vị trí và chức năng

Trung tâm Thông tin - Kinh tế tài nguyên nước là tổ chức sự nghiệp trực thuộc Cục Quản lý tài nguyên nước có chức năng thực hiện các hoạt động về thông tin, kinh tế; xuất khẩu, nhập khẩu trực tiếp công nghệ và sản phẩm hàng hóa trong lĩnh vực tài nguyên nước; thực hiện các hoạt động tư vấn, dịch vụ trong lĩnh vực tài nguyên nước và môi trường trên phạm vi cả nước theo quy định của pháp luật.

Trung tâm Thông tin - Kinh tế tài nguyên nước là đơn vị sự nghiệp tự bảo đảm chi phí hoạt động, có tư cách pháp nhân, có con dấu và tài khoản riêng theo quy định của pháp luật.

Điều 2. Nhiệm vụ và quyền hạn

1. Trình Cục trưởng kế hoạch dài hạn, năm (05) năm và hàng năm về hoạt động của Trung tâm; tổ chức thực hiện sau khi được phê duyệt.

2. Kiểm tra, tiếp nhận và tổ chức quản lý, lưu trữ tài liệu về kết quả, sản phẩm của các chương trình, đề án, dự án, đề tài (sau đây gọi chung là nhiệm vụ) và hồ sơ cấp phép trong lĩnh vực tài nguyên nước thuộc phạm vi quản lý của Cục.

3. Nghiên cứu, xây dựng, quản lý, duy trì và khai thác, sử dụng hệ thống thông tin, cơ sở dữ liệu, thư viện điện tử về tài nguyên nước và hệ thống thông tin, dữ liệu quan trắc tài nguyên nước.

4. Thu thập, tổng hợp, xử lý, thống kê, kiểm kê tài liệu, dữ liệu về tài nguyên nước; cung cấp dữ liệu về tài nguyên nước cho các cơ quan nhà nước, các tổ chức và cá nhân theo quy định của pháp luật.

5. Xây dựng, duy trì và quản lý trang thông tin điện tử, mạng thông tin nội bộ của Cục; tổ chức biên dịch, biên tập, xuất bản bản tin và các ấn phẩm về tài nguyên nước theo quy định của pháp luật.

6. Chuyển giao công nghệ, triển khai và hướng dẫn chuyên môn, nghiệp vụ về ứng dụng và phát triển công nghệ thông tin, cơ sở dữ liệu, công nghệ mới và kinh tế tài nguyên nước.

7. Nghiên cứu, đánh giá hiệu ích kinh tế - xã hội, môi trường trong quản lý, khai thác, sử dụng, bảo vệ và phát triển tài nguyên nước; đề xuất và tổ chức xây dựng các mô hình thí điểm, mô hình huy động sự tham gia của cộng đồng, dự án thử nghiệm về sử dụng các công cụ kinh tế trong quản lý, bảo vệ, khai thác sử dụng bền vững tài nguyên nước.

8. Nghiên cứu, đề xuất và tổ chức thí điểm các phương án, giải pháp thực hiện xã hội hóa việc cung ứng các dịch vụ về tài nguyên nước; định giá giá trị tài nguyên nước trong các hoạt động sản xuất, kinh doanh và dịch vụ.

9. Nghiên cứu cơ sở khoa học và tham gia xây dựng cơ chế, chính sách về thuế, phí, lệ phí trong lĩnh vực tài nguyên nước; các phương án, biện pháp tạo nguồn thu và các hình thức ưu đãi kinh tế liên quan đến quản lý, bảo vệ, phát triển, khai thác và sử dụng tài nguyên nước.

10. Nghiên cứu cơ sở khoa học và xây dựng định mức kinh tế - kỹ thuật, đơn giá sản phẩm trong lĩnh vực tài nguyên nước theo phân công của Cục trưởng.

11. Thực hiện việc phân loại, lập danh bạ nguồn nước; thực hiện việc nghiên cứu, đánh giá và tổng hợp các chỉ tiêu thống kê tài nguyên nước thuộc hệ thống chỉ tiêu thống kê ngành tài nguyên và môi trường theo phân công của Cục trưởng.

12. Thực hiện các chương trình, đề án, dự án, đề tài nghiên cứu khoa học và công nghệ về điều tra, khảo sát, kiểm kê, đánh giá tài nguyên nước, quy hoạch tài nguyên nước, quản lý, khai thác, sử dụng, bảo vệ, phát triển tài nguyên nước, phòng chống tác hại do nước gây ra và các hoạt động khác trong lĩnh vực tài nguyên nước theo nhiệm vụ được giao, đặt hàng hoặc đấu thầu. Tự quyết định biện pháp tổ chức thực hiện bảo đảm chất lượng, tiến độ theo yêu cầu.

13. Tham gia nghiên cứu cơ sở khoa học và xây dựng các văn bản quy phạm pháp luật, cơ chế chính sách về tài nguyên nước; thẩm định các chương trình, dự án, đề án trong lĩnh vực tài nguyên nước; tuyên truyền, phổ biến, giáo dục nâng cao nhận thức cộng đồng về tài nguyên nước; hướng dẫn chuyên môn, nghiệp vụ công tác quản lý tài nguyên nước cho các địa phương; kiểm tra, thanh tra, giải quyết tranh chấp về nguồn nước; thực hiện các dự án hợp tác quốc tế trong lĩnh vực tài nguyên nước và các lĩnh vực khác theo sự phân công của Cục trưởng.

14. Thực hiện các hoạt động sản xuất, kinh doanh, dịch vụ trong lĩnh vực thông tin, kinh tế và khai thác cơ sở dữ liệu tài nguyên nước; các hoạt động dịch vụ trong lĩnh vực tài nguyên nước và môi trường và các lĩnh vực khác theo quy định của pháp luật; liên doanh, liên kết sản xuất với các tổ chức và cá nhân trong và ngoài nước; xuất khẩu, nhập khẩu trực tiếp công nghệ và sản phẩm; tham gia đấu thầu thực hiện các hợp đồng sản xuất, cung ứng hàng hoá, dịch vụ thuộc lĩnh vực tài nguyên nước và môi trường theo quy định của pháp luật.

15. Quyết định việc đầu tư phát triển từ vốn vay, vốn huy động từ các tổ chức, cá nhân trong và ngoài nước, từ quỹ phát triển hoạt động sự nghiệp của Trung tâm theo quy định của pháp luật.

16. Quản lý tổ chức, cán bộ, viên chức, lao động, tài chính và tài sản thuộc Trung tâm theo phân cấp của Cục; thực hiện trách nhiệm của đơn vị dự toán cấp III theo quy định của pháp luật.

17. Thực hiện cải cách hành chính theo chương trình, kế hoạch cải cách hành chính của Cục và phân công của Cục trưởng.

18. Thống kê, báo cáo định kỳ và đột xuất tình hình thực hiện nhiệm vụ được giao.

19. Thực hiện các nhiệm vụ khác do Cục trưởng giao.

Điều 3. Cơ cấu tổ chức

1. Lãnh đạo Trung tâm:

Trung tâm Thông tin - Kinh tế tài nguyên nước có Giám đốc và không quá ba (03) Phó Giám đốc.

Giám đốc chịu trách nhiệm trước Cục trưởng về các nhiệm vụ được giao và chịu trách nhiệm trước pháp luật về mọi hoạt động của Trung tâm; quy định chức năng, nhiệm vụ của các đơn vị trực thuộc Trung tâm; xây dựng quy chế làm việc và điều hành hoạt động của Trung tâm.

Phó Giám đốc giúp việc Giám đốc, chịu trách nhiệm trước Giám đốc về lĩnh vực công tác được phân công.

2. Bộ máy giúp việc Giám đốc:

a) Phòng Hành chính tổng hợp;

b) Phòng Hệ thống thông tin;

c) Phòng Cơ sở dữ liệu;

d) Phòng Kinh tế tài nguyên nước;

đ) Phòng Tư vấn, dịch vụ Thông tin - Kinh tế tài nguyên nước.

Điều 4. Hiệu lực và trách nhiệm thi hành

Quyết định này có hiệu lực thi hành kể từ ngày ký và thay thế Quyết định số 279/QĐ-TNN ngày 31 tháng 12 năm 2003 của Cục trưởng Cục Quản lý tài nguyên nước quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Trung tâm Quản lý cơ sở dữ liệu tài nguyên nước.

Giám đốc Trung tâm Thông tin - Kinh tế tài nguyên nước, Chánh Văn phòng Cục, Thủ trưởng các đơn vị trực thuộc Cục chịu trách nhiệm thi hành Quyết định này./.

SPECIFYING FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF CENTRE FOR WATER RESOURCES INFORMATION - ECONOMIC

THE DIRECTOR GENERAL OF DEPARTMENT OF WATER RESOURCES MANAGEMENT

Pursuant to Decision No 1035/QD-BTNMT dated May 19th 2008 of Minister of Ministry of Natural Resources and Environment specifying functions, tasks, powers and organizational structure of Department of Water Resources Management
At the proposal by Director of Centre for Water Resources Information - Economic and the Chief of the Department’s Office

DECIDE:

Article 1: Position and Functions

Centre for Water Resources Information - Economic is a non-productive organization under Department of Water Resources which functions to implement activities on information and economic; directly export and import technology and products in the area of water resources; implement consultancy and service activities in the domain of water resources and environment within the whole country as regulated by Law

Centre for Water Resources Information – Economic is a non-productive organization that self finance their regular activities and has legal personality, seal and private account as the Law

To submit the Director General long-term plan, five-year plan and annual plan on activities of Centre; to implement these legislations and documents after being approved by authorised state agencies

To check, receive, synthetise, manage and store data and information including results and output of programs, researches and projects (tasks for short) and licensing dossiers on the domain of water resources within Department’s management

To research, develop, manage, maintain, exploit and utilize water resources database system and online library as well as system of water resources monitoring database and information

To collect, systhetise, treat, inventory water resources information and data; To provide water resources information and data to governments, agencies and individuals as regulated by the law

To develop, maintain and manage Website and LAN network of Department; to publish and edit news and magazine relating to water resources as regulated by the law

To transfer technologies relating to water resources; to conduct and guide specialist skills on application and development of information technology, database, advanced technology and water resources economic

To research and assess the social-economic and environmental effects in management, exploitation, utilization, protection and development of water resources; To propose and build the pilot models and models for mobilizing community participation, the pilot projects for using economic tools in management, protection, sustainable exploitation and utilization of water resources

To research, propose and pilot projects and solutions for socialization in supplying water resources services, to value water resources in business, production and service activities

To research science basis and to participate in developing mechanism and policies related to tariff and fees in the domain of water resources, projects and methods for generating revenue and the economic incentive forms concerned with management, protection, development, exploitation and utilization of water resources

To implement classification of water resources and establishment of water sources directory; to implement researches, assessment and integration of water resources statistical criterions belonging to system of natural resources and environment statistical criterions as assigned by the Director General

To implement the science researches, programs, projects and technologies on survey, investigation, inventory, assessment and planning of water resources; management, protection, development, exploitation and utilization of water resources; prevention of the harmful effect caused by water as well as other activities in the domain of water resources as assigned, ordered and bidden; To decide by themselves on implementation methods for ensuring quality and progress as requested

To participate in researching science basis and to develop legal documents, mechanisms and policies related to water resources; To appraise programs and projects in the domain of water resources; To disseminate, train and raise awareness on water resources; to guide professional competence on water resources management to localities; To inspect and settle all disputes in relation to water resources; To implement the international cooperation projects on the domain of water resources and the relevant others as assigned by the Director General

To implement business, production and service activities in the domain of water resources information, economic and database exploitation; service activities in the domain of water resources and environment and the relevant others as regulated by the Law; To export and import directly technologies and products; To participate in bidding for implementation of contracts on production, supplying goods, service in the domain of water resources and environment as regulated by the Law

To decide on the development investment from loan capital, capital mobilized from domestic and foreign organizations and individuals, and from their own non-business activity development funds as the Law

To manage organizational structure, officials, specialist, finance and assets under Centre as assigned by the Director General; to implement responsibility as financial unit at level III as the Law

To implement administrative reform in accordance with program and plan for administrative reform of Department and as assigned by the Director General

To report annually and unexpectedly situation of assigned tasks implementation

To implement other tasks as assigned by the Director General

1. The leadership of Centre

The Centre for Water Resources Information – economic has one director and not exceeding three (03) deputy directors

The Director is responsible to the Director General for implementing tasks as assigned and for regulating functions, tasks and powers of the units under Centre and working procedures for the Centre itself.

The Deputy Director is responsible to the Director for tasks assigned by the Director.

Article 4: Validity and Implementation Responsibility

The Decision shall take effect in 15 days after its signing and replace Decision No 279/QD-TNN dated 31, December, 2003 of the Director General of Department of Water Resources Management promulgating the functions, tasks, powers and organizational structure of Centre of Water Resources Database Management

The Director of the Centre for Water Resources Information – economic, the Chief of the Department’s Office, and heads of agencies and units under the Department are responsible for implementing this Decision./.
