DECISION

ASSIGNMENT OF TASKS WITHIN MANAGEMENT BOARD OF MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT OF VIETNAM

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT OF VIETNAM

Pursuant to the Government’s Decree No. 123/2016/ND-CP dated September 01, 2016 defining the functions, tasks, powers and organizational structure of ministries and ministerial agencies, and the Government’s Decree No. 101/2020/ND-CP dated August 28, 2020 providing amendments to the Government’s Decree No. 123/2016/ND-CP ;

Pursuant to the Government’s Decree No.15/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development of Vietnam (MARD);

At the request of the Head of the Organization and Personnel Department;

HEREBY DECIDES:

Article 1. Task assignment principles and work relationships between Minister and Deputy Ministers

2. Deputy Ministers shall assist the Minister in monitoring and directing work fields and areas as assigned by the Minister. Within the ambit of assigned powers and tasks, Deputy Ministers shall proactively work and assume responsibility before the Minister and legal responsibility for their performance of assigned tasks; promptly submit reports to and get opinions from the Minister about major, important or sensitive issues or issues on which there are contrary opinions before taking actions or issuing decisions on these issues.

Before issuing any decisions on matters or issues relating to local affairs or in fields that need cooperation, the Deputy Minister in charge of the matter or issue shall proactively get opinions from the Deputy Minister in charge of the relevant field or sector. Where necessary, the Deputy Minister in charge of the matter or issue and the Deputy Minister in charge of the relevant field or sector shall jointly work with relevant authorities to settle this matter or issue; if different opinions on the matter or issue are given by these Deputy Ministers, the former shall take charge of submitting the case to the Minister for consideration.

The Deputy Minister in charge of the matter or issue shall proactively work with relevant Ministries, central-government authorities, local governments and other agencies, and notify working results to the Deputy Minister in charge of the relevant field or sector and the Deputy Minister in charge of monitoring the relevant local area.

3. Where necessary or when the Deputy Minister in charge of the relevant field or sector is absent, the Minister shall directly direct, or assign another Deputy Minister to take charge of, the settlement of the matter or issue.

4. Within the scope of their assigned fields, Deputy Ministers shall have the following responsibilities and powers:

- Direct the formulation of strategies, plannings and plans; formulate and submit mechanisms, policies, bills, ordinances and draft legislative documents to the Minister for further submission to the Government or the Prime Minister or promulgation within his competence.

- Direct, inspect and expedite the implementation of guidelines, policies, laws, planning and state budget tasks in fields and sectors under their management; settle, within their competence, issues arising in fields and sectors under their management.

- Deputy Ministers shall sign documents in fields and sectors under their management; sign other documents as assigned by the Minister and then submit reports thereon to the Minister.

- Deputy Ministers shall not be allowed to settle issues which are not assigned by the Minister and implement decisions of the Minister.

Article 2. Assignment of specific tasks

1. Minister Le Minh Hoan

- Generally direct and assume responsibility before the National Assembly, the Government and the Prime Minister for the performance of state management tasks in the agriculture and rural development branch;

- Take charge of organization and personnel affairs;

- Take charge of strategies, plannings and plans for development and restructuring of agricultural sector;

- Take charge of drawing up guidelines for formulation of investment projects within his competence;

- Direct the performance of tasks in cultivation and plant protection fields, including: formulation and implementation of strategies, plannings, plans, programs, laws, and policies, and organization of production, processing and consumption activities in cultivation and plant protection fields;

- Take charge of the national food security programs and hi-tech agriculture programs;

- Take charge of affairs relating to development of the Communist Party of Vietnam, relationship with the Central Committee of the Communist Party of Vietnam, the Government, the Communist Party’s civil affairs committees of Ministries, central-government and local-government authorities; directly work with the National Assembly to settle issues concerning MARD as requested;

- Act as the Deputy Head of the Central Steering Committee for implementation of national target programs in the 2021-2030 period;

- Act as the Deputy Chairman of the Mekong Delta Region Coordinating Council;

- Act as the head of the Steering Committee for the Action Program for climate change adaptation in the agriculture and rural development branch;

- Act as the head of the Management Board of the Project on agricultural bio-industry development by 2030;

- Act as the head, deputy head or member of interdisciplinary steering committees as assigned by the Prime Minister;

- Act as the Chairman of MARD’s emulation and reward council;

- Act as the Chairman of Vietnam’s Sub-committees in Vietnam-Iraq Intergovernmental Committee, Vietnam-Iran Intergovernmental Committee, and Vietnam - Mongolia Intergovernmental Committee;

- Perform other tasks as assigned by the Government or the Prime Minister.

2. Deputy Ministers

- Direct the performance of tasks in fishery, animal husbandry and veterinary medicine fields, including: formulation of strategies, plannings, plans, programs, laws, mechanisms, and policies, and organization of production, processing and consumption activities; engage in the management of aquatic breeds and livestock breeds under the program on development, research and production of plant varieties and animal breeds to serve the restructuring of agricultural sector in 2021-2030 period;

- Direct the proposal of guidelines for investment projects, participate in performance of relevant contents during implementation of public investment projects, and direct the preparation and organization of implementation of ODA projects and international cooperation projects in fishery, animal husbandry, veterinary medicine, science and technology fields.

- Take charge of maritime search and rescue; natural disaster prevention and control in fishery sector;

- Take charge of office affairs;

- Take charge of scientific, technological and environmental affairs;

- Take charge of press and communications affairs of MARD;

- Take charge of statistical affairs;

- Act as the head of the Steering Committee for the program on development, research and production of plant varieties and animal breeds to serve the restructuring of agricultural sector in 2021-2030 period;

- Act as the Chairman of the Science and Technology Council of MARD;

- Joint the Government’s interdisciplinary steering committees and other steering committees of MARD as assigned;

- Monitor provinces and cities in the south central coast and the central highlands;

- Perform other tasks assigned by the Minister.

2.2. Deputy Minister Tran Thanh Nam

- Direct the performance of tasks in processing and agricultural product market fields, including: formulation and organization of implementation of strategies, plannings, plans, programs, laws, mechanisms, and policies in the fields of processing, trading and development of market for agricultural products;

- Direct the performance of tasks in the fields of rural development and establishment of new-style rural areas, including: formulation of strategies, policies, programs, and plans, and organization of establishment and development of new-style rural areas; vocational training for rural workers;

- Take charge of training affairs, including those of schools affiliated to MARD, and human resource training for the agriculture and rural development branch;

- Take charge of innovation and development of cooperatives and other types of cooperative business entities in agricultural sector;

- Take charge of general quality control of agricultural, forest and aquatic products, and agricultural supplies;

- Manage rural business lines/services and agricultural electromechanics;

- Manage salt production industry;

- Direct the proposal of guidelines for investment projects, participate in performance of relevant contents during implementation of public investment projects, and direct the preparation and organization of implementation of ODA projects and international cooperation projects in the fields of cooperative economy, cooperatives, development of agriculture professions, establishment of new-style rural areas, processing and agricultural product market, management of quality and safety of foods, agricultural extension, salt production, education and training;

- Take charge of incentive policies and mechanisms for enterprises investing in agriculture and rural development sectors;

- Perform state management tasks of professional associations/societies in the agriculture and rural development branch, and cooperate with central-level social organizations and socio-political organizations in performing tasks of the agriculture and rural development branch;

- Joint the Government’s interdisciplinary steering committees and other steering committees of MARD as assigned;

- Act as a member of Vietnam’s sub-committee in the coordination committee of Vietnam - Russia Tropical Center;

- Monitor provinces and cities in the southeast and Mekong Delta;

- Perform other tasks assigned by the Minister.

- Direct the performance of tasks in irrigation, and natural disaster prevention and control fields, including: formulation, provision of guidance on and inspection of implementation of strategies, programs, plannings and plans for irrigational development; mechanisms and policies on management and operation of hydraulic structures, domestic water supply systems; management of flood control systems and natural disaster prevention and control tasks;

- Take charge of financial affairs of MARD; arrange houses and land for agencies and units of MARD;

- Take charge of international cooperation;

- Take charge of fundamental construction (Deputy Minister in charge of the relevant field or sector shall propose investment guidelines and participate in the performance of relevant contents during the implementation of each specific project);

- Direct the proposal of guidelines for investment projects, preparation and organization of implementation of ODA projects and international cooperation projects in the fields of irrigation, natural disaster prevention and control, cultivation, and plant protection;

- Take charge of inspection tasks; settlement of complaints and denunciations; perform anti-corruption, thrift practice and waste combat tasks;

- Take charge of legislation affairs; act as the Chairman of MARD’s law education council;

- Take charge of managing partially state-owned enterprises of MARD;

- Act as the Chairman of MARD’s recruitment council;

- Act as the head of MARD's steering committee for implementation of democracy regulations;

- Act as the head of MARD's counter-terrorism steering committee;

- Act as the Commanding Officer of MARD’s military steering committee;

- Take charge of border demarcation and marker planting affairs;

- Take charge of implementing the Government’s Resolution No. 120/NQ-CP dated November 17, 2017 on sustainable and climate-resilient development of Mekong Delta;

- Act as the deputy head of the Steering Committee for the Action Program for climate change adaptation in the agriculture and rural development branch;

- Act as Deputy Chairman of Vietnam Mekong River Commission;

- Joint the Government’s interdisciplinary steering committees and other steering committees of MARD as assigned;

- Monitor provinces in the north central coast and Red River Delta;

2.4. Deputy Minister Nguyen Quoc Tri

- Direct the performance of tasks in forestry field, including: formulation and implementation of strategies, plannings, plans, programs, laws, and policies, and organization of production, processing and consumption of forest products;

- Take charge of emulation and reward affairs; act as the first Deputy Chairman of MARD’s emulation and reward council;

- Take charge of MARD’s administrative reform affairs;

- Take charge of information technology tasks and development of e-government of MARD;

- Take charge of digital transformation in agricultural sector;

- Take charge of hunger eradication, poverty reduction and employment affairs;

- Take charge of ethnic minority and mountainous regions-related affairs; act as a part-time member of the Government’s Committee for Ethnic Minority Affairs;

- Take charge of programs on eradiation and substitution of plants with narcotic effects; act as a member of the National Committee for prevention and control of HIV, drugs, prostitution and social evils.

- Act as Deputy Head of the Steering Committee for administrative reform and improvement of business environment in agricultural sector;

- Direct the proposal of guidelines for investment projects, participate in performance of relevant contents during implementation of public investment projects, and direct the preparation and organization of implementation of ODA projects and international cooperation projects in forestry field;

- Joint the Government’s interdisciplinary steering committees and other steering committees of MARD as assigned;

- Monitor provinces and cities in the northern midlands and mountainous region;

- Perform other tasks assigned by the Minister.

Article 3. This Decision comes into force from the day on which it is signed and replaces the Decision No. 4156/QD-BNN-TCCB dated October 28, 2022 of MARD's Minister. Depending on direction and administration requirements of MARD, appropriate revisions to this assignment of tasks may be made during the implementation of this Decision.

Minister, Deputy Ministers, heads of agencies and units of MARD, and relevant organizations and individuals are responsible for the implementation of this Decision./.
