RESOLUTION

APPROVING NATIONAL LAND USE PLANNING REQUIREMENTS FOR THE 2021 – 2030 PERIOD WITH VISION TOWARDS 2050

GOVERNMENT

Pursuant to the Law on Government Organization dated June 19, 2015;  

Pursuant to the Law on Planning dated November 24, 2017;

Pursuant to the Law on Amendments and Supplements to several Articles of 37 Laws related to planning dated November 20, 2018;

Pursuant to the Resolution No. 751/2019/UBTVQH14 dated August 16, 2019 of the National Assembly’s Standing Committee, giving explanations about certain articles of the Law on Planning;

Pursuant to the Government's Decree No. 37/2019/ND-CP dated May 7, 2019, specifying the implementation of a number of articles of the Law on Planning;

Pursuant to the report on assessment of implementation of national land use planning requirements for the 2021 – 2030 period with vision towards 2050;

Upon the request of the Ministry of Natural Resources and Environment at the Statement No. 105/TTr-BTNMT dated December 31, 2019 and the Official Dispatch No. 2230/BTNMT-TCQLDD dated April 23, 2020 regarding collection of and explanation about opinions of Cabinet members on the draft Resolution on approval of national land use planning requirements for the 2021 – 2030 period with vision towards 2050,

HEREBY RESOLVES

Article 1. Approval of national land use planning requirements for the 2021 – 2030 period with vision towards 2050, including the following main contents:

1. Planning name, boundaries and period

a) Planning name: National land use planning for the 2021 – 2030 period with vision towards 2050

b) Planning boundaries and period:

- Planning boundaries: National land use planning for the 2021 – 2030 period with vision towards 2050 and national land use plan for the five-year period (2021 - 2025) to be implemented throughout nationwide natural land areas.

- Planning period: For the 2021 – 2030 period with vision towards 2050.

a) Viewpoints

- As land is a special national resource important for national development, land use planning must ensure economical, efficient and sustainable use of land; increase in economic and financial value that land brings about to ensure the highest land use efficiency, meeting both immediate and long-term goals for socio-economic development; national defense and security maintenance.

- Land use planning is the fundamental planning and is aligned with the national master planning; is associated with sectoral, regional and local planning to create inter-regional and inter-provincial connectivity in order to exploit the land strengths and potentials of each region and locality which serve as the basis to change the land use structure in line with the process of economic restructuring and labor division to meet the requirements of industrialization, modernization and international economic integration.

- Strictly protect ​rice cultivation land, protective forest land, special-use forest land, land of nature conservation zones, land of production forests being natural forests and land of scenic relics to ensure national food security and sustainable forest management; ensure the better coordination between socio-economic development objectives, national defense and security tasks; protect ecological landscapes and biodiversity; protect water sources, adapt to climate change and sea level rise.

- Develop unoccupied land reserves by wasteland or sea land reclamation; construction of underground works in areas where conditions permit; investment in construction of infrastructure, development of industrial sectors, services and tourism to effectively exploit and use land potentials in midlands, mountainous, border, coastal and island areas. Allow conversion of paddy land in saline, drought, flooded areas to be used for other purposes and relocation of polluting production facilities away from downtown areas to improve effective land use and minimize environmental pollution.

- Priority is given to allocating enough available land areas to build synchronous infrastructure, focusing on developing key and highly-spread infrastructures; meeting land demands for urban, industrial and service development in the process of industrialization, modernization and new rural construction, especially in mountainous, border and island areas, to attract resources to effectively exploit available land reserves.

- Absorb and apply scientific and technological achievements of countries around the world and in the region; inherit existing achievements to improve quality, efficiency and feasibility, meeting the requirements for renovation of the socialist-oriented market economy management mechanism.

b) Objectives

National land use planning for the period of 2021 - 2030 with a vision towards 2050 is to actualize the national master planning in terms of land allocation and zoning for industries, sectors and localities; use land in a right, economical and effective manner; protect ecological environment, prevent and mitigate consequences of natural disasters, adapt to climate change and result in sustainable development in order to maximize land potentials and resources to meet requirements of industrialization, modernization, and restructuring the economy, ensuring national food security and goals of socio-economic development, national defense and security.

- Ensuring the consistency and uniformity between the planning and socio-economic development strategy and plan that entail the coordination between sectoral management and territorial management; ensuring national defense and security, and environmental protection.

- Ensuring compliance, continuity, inheritability, stability and hierarchy in the national planning system.

- Ensuring democracy, the involvement of agencies, organizations, communities and individuals; ensuring the coordination between national interests, regions, localities and the interests of the people, out of which the national interests are given top priority; ensuring conformance to gender equality rules.

- Ensuring scientificity, application of modern technologies, transfer connectivity, anticipatability, feasibility, frugality and efficient use of the country's resources; ensuring objectivity, publicity, transparency and conservation.

- The national land use planning must ensure specificity and connectivity between the regions. Ensuring the balance between land use demands of industries, sectors, localities and national capacities and land reserves for economical and efficient use of land.

- Land allocation and use included in the national sector planning, regional planning and provincial planning must be consistent with the national land use planning.

- Securing resources to implement the plan.

3. Subject matters of the national land use planning for the 2021 – 2030 period with vision towards 2050

- Making the analytical assessment of factors, natural conditions, resources, directly affecting situations and current land use status of industries and sectors.

- Forecasting any fluctuations in land use during the period 2021 – 2030.

-  Identifying views and targets of land use for the planning period from 2021 to 2030.

- Developing the land use plan to be implemented by 2030 to meet the national goals of socio-economic development, national defense, security, environmental protection, natural disaster prevention and climate change response.

- Identifying and marking land areas for national-level land use targets by 2030: Rice cultivation land (including specialized wet rice-growing land needing strict protection); protective forest land; special-use forest land; production forest land (including natural production forest land); industrial park land; land of economic zones; hi-tech park land; urban land; defense land; security land; land for national infrastructure development, including land for transportation, land for construction of cultural establishments, land for construction of healthcare establishments, land for construction of education and training establishments, land for construction of physical training and sport establishments, land for energy projects, land for post and telecommunications facilities; land for construction of national reserve warehouses, land with historical-cultural relics; land used for construction of landfills and waste treatment facilities; unused and unoccupied land, including those land not yet used during the planning period and other remaining unused or unoccupied land.

- Drawing the map for national land use planning.

- Assessing impacts of plans for land distribution and spatial arrangement on economy, society, environment and national defense and security assurance.

- Putting forward solutions and resources necessary for carrying out the planning.

b) National land use planning for the 5-year period (2021 - 2025)

- Determining the dimensional size of ​​all types of land in the national land use planning according to specific periods in the 5-year land use plan (2021 - 2025).

- Developing 5-year land use plans (2021 - 2025) for each socio-economic region and provincial administrative unit.

- Proposing land use plan implementation solutions.

c) National land use planning scheduled for 2050

- Determining land use views and objectives on the basis of socio-economic, population and urban development forecasts and projections; industrialization and modernization.

- Defining a vision of land use scheduled for 2050 to meet the country's development requirements as well as to adapt to climate change, including rice land; protective forest land; special-use forest land; production forest land; industrial park land; land of economic zones; hi-tech park land; urban land; defense land; security land; land for national infrastructure development.

d) Strategic environment assessment of the national land use planning for the 2021 – 2030 period with vision towards 2050.

- Surveying and collecting information, documents and data on the current state of the natural environment, the causes of environmental change currently related to the national land use planning to be implemented by 2030.

- Identifying legal and technical grounds for conducting strategic environmental assessment; carrying out strategic environmental assessment; summarizing main points of the planning scheme.

- Evaluating impacts of the national land use planning for the 2021 – 2030 period with vision towards 2050.

- Proposing solutions to maintaining positive trends; limiting and minimizing negative trends of major environmental issues during the process of implementation of national land use planning for the period of 2021 - 2030, with a vision to 2050.

- Planning environmental monitoring and observation activities.

- Seeking consultation during the implementation of the strategic environmental assessment.

- Formulating explanatory reports on the strategic environment assessment of the national land use planning for the 2021 – 2030 period with vision towards 2050.

dd) Formulating required reports on the national land use planning for the 2021 – 2030 period with vision towards 2050.

e) Handling strategic environmental assessment reports and integrating them into planning reports.

g) Establishing the database on the national land use planning for the 2021 – 2030 period with vision towards 2050.

h) Organizing scientific seminars and conferences; seeking consultation and public opinions.

k) Publicizing the national land use planning or plan for the 2021 – 2030 period with vision towards 2050.

4. Approaches to formulation of the national land use planning for the 2021 – 2030 period with vision towards 2050

National land use planning shall be implemented in a two-way approach (macro and micro) with the participation of ministries, sectors and localities, according to which the objects of the land use planning shall be placed in multi-sectoral and multi-domain integrated relationships between factors affecting land use. In the process of formulating national land use planning till the period of 2021 – 2030 with the vision to 2050, the following main approaches shall be employed:

a) Primary, secondary survey approach.

b) Data synthesis, analysis and processing approach.

c) GIS-based spatial analysis, multi-element analysis approach.

d) Qualitative and quantitative analysis approach.

dd) Macro and micro analysis approach.

e) Economic mathematics and forecasting approach.

5. Planning time limit

National land use planning for the 2021 – 2030 period with vision towards 2050 shall be formulated not more than 30 months from the date of approval of requirements for the national land use planning to be implemented till the 2021 – 2030 period with vision towards 2050.

6. Composition, quantity, standards and specifications of planning documents

a) The Government’s representation to the National Assembly to seek its approval of the national land use planning for the 2021 – 2030 period with vision towards 2050;

b) The National Assembly’s Resolution on approval of the national land use planning for the 2021 – 2030 period with vision towards 2050;

c) Report on the national land use planning for the 2021 – 2030 period with vision towards 2050;

d) Report on summarization of comments of agencies, organizations, communities and individuals on the planning activities; copies of comments of ministries, ministerial-level agencies and concerned localities; explanatory and handling report on comments on the planning activities;

dd) Explanatory report on the strategic environment assessment of the national land use planning for the 2021 – 2030 period with vision towards 2050.

e) Mapping system

Disk D shall be used for storing the database of the national land use planning for the 2021 – 2030 period with vision towards 2050.

7. Planning costs

a) Activities related to the national land use planning for the 2021 – 2030 period with vision towards 2050; activities related to the strategic environment assessment of the national land use planning for the 2021 – 2030 period with vision towards 2050, shall be funded by the public investment capital.

b) National land use planning for the 5-year period (2021 - 2025) shall be funded by expenditures used for economic activities.

Article 2. Implementation responsibilities

1. The Ministry of Natural Resources and Environment shall assume the following responsibilities:

a) Approve the detailed budget and select the unit qualified for the national land use planning for the 2021 – 2030 period with vision towards 2050 according to existing regulations.

c) Approve the adjustment and supplementation of these planning requirements when there is any change in the process of national land use planning for the period of 2021 - 2030 with a vision to 2050 and the 5-year land use plan (2021 - 2025) provided that they do not result in any change in the objectives of these requirements.

2. Ministries and sectors shall have the following responsibilities:

a) Report on land use situations in the period of 2011 - 2020 within their remit; raise land use demands in the period of 2021-2030 with vision to 2050 and 5-year land use plan (2021 - 2025), and list of key projects and construction works using land, to the Ministry of Natural Resources and Environment.

b) Cooperate with the Ministry of Natural Resources and Environment in providing developmental strategies and master plans related to land use during the planning period of 2021-2030 with vision to 2050 (including draft versions); information, documents, figures and maps.

3. People’s Committees of centrally-affiliated cities and provinces shall assume the following responsibilities:

a) Report on implementation of the land use planning or plan for the period of 2011 - 2020; raise land use demands in the period of 2021-2030 with vision to 2050 and 5-year land use plan (2021 - 2025), and list of key projects and construction works using land, to the Ministry of Natural Resources and Environment.

b) Cooperate with the Ministry of Natural Resources and Environment in providing local information, documents and figures related to the national land use planning.

4. During the process of the national land use planning for the period of 2021 – 2030 with vision to 2050 and a 5-year land use plan (2021 - 2025), the designated planning consultancy body shall be authorized to select qualified domestic and foreign experts in accordance with law.

5. Cooperating mechanism: Ministries, sectors and localities shall, within the scope of their respective functions and tasks, regularly exchange and provide information falling within their respective remit to ensure timeliness and accuracy of contents of requirements for planning activities, and create frame data for national land use planning information system and database.
