In Vietnam, is it permissible for street vendors to make a sale in front of pagodas

Is it permissible for street vendors to make a sale in front of pagodas in Vietnam? Is it permissible to cry wares at night? I intend to sell some religious goods in front of pagodas. Is it permissible for street vendors to make a sale in front of pagodas in Vietnam? Looking forward to your consultancy.  

Is it permissible for street vendors to make a sale in front of pagodas in Vietnam?

Pursuant to Clause 1, Article 6 of the Decree 39/2007/NĐ-CP stipulating scope of business location of individuals doing trade as follows: 

1. Unless otherwise provided by law, strictly prohibit individuals performing commercial activities at the following zones, roads and locations:

a) Zones in ranked historical relics, cultural areas, and other beauty spots;

b) Zones of state agencies, diplomat agencies, and international organizations;

c) Zones in the safe belt of warehouses containing ammunition, explosives, plants producing ammunition, explosives, and barracks of Vietnam People's Army;

d) Zones of airports, seaports, international border-gates, train stations, harbors, bus station, and ferries and on means of transport;

dd) Schools, hospitals, religion or belief establishments;

e) Places for temporary stopping, parking of means of transport joining traffic, including roads and waterways;

Pursuant to Point a, Clause 1, Article 3 of the same Decree stipulating as follows: 

1. Individuals doing trade mean individuals who everyday themselves conduct one, several or all activities allowed by law on goods purchase and sale, service provision and other activities with purpose of profitability but do not register their business as prescribed by law on business registration and not be called as “trader” as prescribed by the Commercial Law. Particularly including individuals doing the following trade activities:

a) Street trading (trading in public places) means activities of purchase and sale without a fixed location (purchase on street, sale on street or both purchase and sale on street), includes even the receipt of books, news, magazines, cultural products of traders allowed doing business in these products as prescribed by law, for sale on street;

As regulations above, street vendors are not permissible to make a sale in front of pagodas.

Is it permissible to cry wares at night?

Pursuant to Clause 2, Article 7 of the Decree 39/2007/NĐ-CP stipulating ensuring security, order, hygiene and safety in activities of individuals doing trade as follows: 

2. When conduct the movable business, individuals doing trade must put, arrange means of movement, equipment, instruments serving sale of goods, and goods to be clean and order; must have suitable instruments to contain garbage, waste. Strictly prohibit individuals doing trade performing the following acts in the movable business operation:

a) Following up, begging, enticing, scrambling, annoying, bothering customers and having words, gestures rudely or impolitely in respect to customers;

b) Gathering in large numbers or using loudspeakers, gongs, drums, whistles, bugle and other instruments to increasing sound volume to call, propagate, advertise for the movable business operation but not commit with the local authorities where conducting these activities about use properly with purpose and ensure order and social security;

c) Announcing the sale of goods, movable services on street causing noise at public places and influencing the common quiet in duration from 22 o’clock to 5 o’clock of morning of next day;

As regulations above, the Law doesn't allow to cry wares causing noise at public places from 22 o’clock to 5 o’clock of morning of next day.
