In Vietnam, death row inmates are executed by what kind of poison?

Pursuant to Article 4 of Decree 43/2020/ND-CP stipulating drugs used for execution of death sentences as follows:

1. Injectable drugs used for execution of death sentence include:

a) Drugs that cause loss of consciousness;

b) Drugs that paralyze the motor system;

c) Drugs that stop the heart's activity.

2. A dose includes 03 drugs specified in Clause 1 of this Article and is used for 01 person.

3. Drugs used for execution of death sentence shall be issued by the Ministry of Health at the request of the Ministry of Public Security and the Ministry of National Defense.

4. Store drugs according to the conditions stated on the drug dose labels and instructions of the supplier. The handover of drugs must be recorded in writing on delivery and receipt; sealed, strictly managed according to the provisions of law.

According to regulations in Vietnam, your son will be injected with a dose of 3 types of drugs: drugs to lose consciousness; drugs that paralyze the motor system and drugs that stop the heart from working.

The process of administering the death penalty injection in Vietnam

Pursuant to Article 6 of the above Decree, the procedure for drug injection is as follows:

1. The order of execution of the death penalty must comply with the provisions of Clauses 2, 3 and 4, Article 82 of the 2019 Law on Criminal Judgment Execution and the provisions of this Decree.

2. Drugs used for execution of the death sentence must be examined by the death sentence execution council, unsealed and recorded in writing according to regulations.

3. The executed person shall be fixed to the bed in the supine position, ensuring not to obstruct the blood circulation.

4. Officers directly executing the death sentence shall take the following steps:

a) Prepare all 03 doses of the drug (including 02 backup doses);

b) Determine the vein to perform the injection; if the vein cannot be identified, report it to the Chairman of the death sentence execution council to request the doctor's assistance in identifying the vein;

c) Insert a pre-connected needle with an infusion tube into a defined vein according to the following procedure:

Step 1: Inject the drug to lose consciousness.

After injecting the drug, the death penalty expert must conduct an examination, if the person sentenced to death has not lost consciousness, continue to inject the drug until they lose consciousness.

Step 2: Inject drugs that paralyze the motor system.

Step 3: Inject drugs that stop the heart from working.

d) Checking the cardiac activity of the person sentenced to death by electrocardiogram. If after ten minutes, the sentenced person has not died, the examiner must report to the Chairman of the death sentence execution council to order the use of prophylactic drugs;

Each time the death sentence is injected after ten minutes, the examiner must report to the Chairman of the death sentence execution council for an order to continue using the second dose of prophylactic drug. Tuesday;

In case the third dose of drug is administered after ten minutes but the sentenced person has not died, the captain of the judgment enforcement team must report to the chairman of the death sentence execution council for a decision to suspend judgment execution.

5. The implementation of the steps specified at Points b, c and d, Clause 4 of this Article may be carried out by automatic or direct method.

6. At the order of the Chairman of the Death Penalty Execution Council, the forensic doctor shall examine and determine the condition of the executed person and report the results to the Council.

7. After the forensic doctor concludes that the executed person is dead, according to the order of the Chairman of the Death Penalty Execution Council, the death sentence execution officer shall stop transmitting and handing needles and pipes. from the person sentenced to death.

8. The death sentence execution council shall make minutes according to regulations on the death of the sentenced person.

9. The settlement of procedures after the judgment debtor has died shall comply with the provisions of Points e, g and h, Clause 4, Article 82 and Article 83 of the Law on Criminal Judgment Execution 2019.
