In Vietnam, can aircraft with foreign nationality be registered for Vietnamese nationality?
In Article 13 of the Law on Civil Aviation of Vietnam 2006, there are regulations on registration of aircraft nationality as follows:
1. Aircraft is an appliance that is lifted and kept in the atmosphere by mutual interaction with the air, including aircraft, helicopters, gliders, airships and other flying devices, excluding equipment held in the air. atmosphere by interacting with the air reflected from the earth's surface.
2. Aircraft registered with Vietnamese nationality must fully meet the following conditions:
a) Not yet possessing the nationality of any country or having removed his foreign nationality;
b) Having legal papers to prove the ownership of the aircraft;
c) Conform to technical standards prescribed or recognized by competent state agencies.
According to current regulations in Vietnam, in case the aircraft has foreign nationality, it will not be able to register Vietnamese nationality.
In what cases is the aircraft having Vietnamese nationality removed?
In Article 14 of the Law on Civil Aviation of Vietnam 2006, there are provisions on the cases in which the Vietnamese nationality is removed from the aircraft as follows:
An aircraft shall have its Vietnamese nationality registration removed in the following cases:
1. Being declared missing according to the provisions of Clause 3, Article 103 of this Law;
2. Severe damage that cannot be repaired or restored;
3. No longer satisfying the conditions specified in Clause 2, Article 13 of this Law;
4. At the request of the aircraft registrant.
