Pursuant to Decision No.09/2014/QD-UBND dated
February 20, 2014 of People’s Committee of city on construction of essential
works within the protected area of road infrastructure facilities in Ho Chi
Minh City;
Below are instructions of conclusion of an agreement
on water supply and drainage works from the Department of Transport:
I. Components of application for agreement on
locations and route directions:
1. A proposal that includes information on routes
within the area of projects, projects and investments in relevant projects,
commitments and proposals at the time of project execution, expected
construction time and number of enclosed drawing.
2. A description that specifies locations proposed
within the project (including locations under management of Urban Transport
Management Divisions and People's Committees of districts as authorized by the
Department of Transport), necessity of the work, operating area of the work,
plans for connecting the new work with the existing one, plan for installing
and accurately calculating the diameter of the water supply and drainage work
as the basis for issuing the selection plan, construction progress, dossier of
design of road surface restoration according to the survey data on elastic
modulus and structure of current road surface's foundation.

- Document on underground utility detection as
regulated (where necessary)
4. Drawing:
- The floor plan shall clearly present the
location, distance and size of the work to be built and other existing works (e.g.
water supply works, water drainage works, telephone booths, etc)
- A profile drawing shall clearly present locations
of the work to be built and other existing works.
- A cross-section drawing shall indicate both
typical section of the work's location and the section of location after change
in case there is any change made to such work's location.
- The drawing shall illustrate the work restoring
structure, the estimated road surface area used for work construction and
extent of road surface to be restored according to Decision No.09/2014/QD-UBND
dated February 20, 2014 of People’s Committee of the city on construction of
essential works within the protected area of road infrastructure facilities in
Ho Chi Minh City.
5. A compact disc (bearing the names of the project
and the investor) shall contain data on the description and the drawing.

2. With regard to connection of pipes and devices
to the water supply network (new installation): the application’s components
are the same as those specified in Section I excluding Point I.3 regarding
survey report and the investor who carry out the survey shall update
information on underground works at the location of the work under construction
in order to ensure safety of other technical infrastructure works, and detector
for searching underground works is only used at the location of the work under
construction.
3. With regard to replacement of existing devices
of the water supply network: the application’s components are the same as those
specified in Section I excluding the description in Point I.2 and survey report
in Point I.3.
4. With regard to water meter installation,
dismantlement and restoration: the application’s components are the same as
those specified in Section I excluding the description and underground works
searching by a detector.
III. Implementation method:
1. As regards agreement on locations for
construction of water supply and drainage works and works of the water supply
network according to the plan: water supply and drainage units shall inform
such construction to the Department of Transport before the 20th of
every month according to the Table 1 in order for them to invite relevant units
to carry out field inspection and such water supply units shall send the
application to the units participating in the meeting. Water supply units
shall complete their proposal upon consideration of the inspection result
before sending it to the Department of Transport. Components of the application
shall conform to the aforesaid instruction.
2. As regards agreement on installation of water
meter and other installation as required by the citizens: water supply units
shall send the proposal to the Department of Transport following the aforesaid
instruction if required by the citizens.
IV. Extension of time for route agreement:
1. Investors shall send the request for time
extension 15 days before the expiry date of route agreement in order to prevent
re-survey and re-notification of underground works as the location on agreement
is belong to another project. A route agreement may be extended once and
the time extended shall not exceed 12 months.
2. The request for extension shall clearly specify
reasons for project extension, current construction progress, extended time
proposed with the table of detailed progress of other tasks and adjustments (if
any).

V. Number of application, application processing
time and processing unit
1. Number of application: 1
2. Processing time: 10 working days from the date
on which the legally accepted application is received by the Water Supply and
Drainage Management division of the Department of Transport.
3. Processing unit: Water Supply and Drainage
Management Division – Department of Transport shall cooperate with relevant
divisions in considering and processing applications.
V. Notes:
1. In terms of field inspection:
- Agencies or units failing to participate in the
field inspection are required to send their opinions in writing to the Water
Supply and Drainage Management Division - Department of Transport within 3
working days. In case no written opinion is received, such agencies and units
will be considered to consent with the inspection matters.
- Participating agencies and units are required to
make preparation for tasks mentioned in the invitation to the field inspection
in order to ensure efficiency in such inspection and prevent time extension.
- The field inspection record may only be used for
application processing at the inspection time and may not replace the agreement
document.

3. Units in charge of water supply and drainage
work construction shall take responsibility for safety of existing underground
works and cooperate with other units for the purpose of concurrent launching of
relevant projects.
4. The drawing agreed shall include general and
detailed drawings which clearly indicate the size of the work and particular
locations for construction.
5. As regards agreement on installation of new
devices to the water supply network within the road corridor: Water supply
organizations shall provide clear description about the necessity of device
installation and efficiency in such installation.
6. People’s Committees of districts must ask for
professional advice on water supply and drainage from the Department of
Transport when concurring with or approving water supply and drainage works
constructed on roads, sidewalks or in alleys under management of People's
Committees of districts (The document asking for advice shall include all
information on planning for orientation development of the area as a basis for
consideration of the Department of Transport).
7. This Official Dispatch will replace Official
Dispatch No.12835/SGTVT-CTN dated September 03, 2013 of the Department of
Transport regarding guidelines on making application for agreement on locations
of water supply pipes installation.
