DECISION
PROMULGATING THE REGULATION ON APPROVAL AND
DECISION OF ENTRY AND EXIT OF STATE OFFICIALS AND PUBLIC EMPLOYEES OF THE
MINISTRY OF SCIENCE, TECHNOLOGY AND ENVIRONMENT
THE MINISTER OF SCIENCE, TECHNOLOGY AND
ENVIRONMENT
Pursuant to the Government’s Decree No.22/CP of May 22, 1993 on the tasks,
powers and organizational structure of the Ministry of Science, Technology and
Environment;
Pursuant to the Government’s
Decree No.05/2000/ND-CP of March 3, 2000 on Vietnamese citizens’ entry and exit;
Pursuant to Circular No.09/2000/TT-BCA (A18) of June 7, 2000 of the Ministry of
Public Security guiding the granting of general passports in the country under
the Government’s Decree
No.05/2000/ND-CP;
At the proposal of the director of the Department for Scientific Organization
and Personnel,
DECIDES:
Article 1.- To issue together with this Decision the
Regulation on approval and decision of entry and exit of State officials and
public employees of the Ministry of Science, Technology and Environment.
Article 2.- This Decision takes effect 15 days after its
signing and replaces the provisions on entry and exit of the Ministry’s State officials and public employees in Document
No.1674/TCCBKH of October 2, 1995 of the Ministry of Science, Technology and
Environment.
Article 3.- The Ministry’s
leadership members, the leading officials of the units and all State officials
and public employees of the Ministry of Science, Technology and Environment
shall have to implement this Decision.

STATE OFFICIALS AND PUBLIC EMPLOYEES OF THE MINISTRY OF SCIENCE, TECHNOLOGY AND
ENVIRONMENT

of the Ministry of Science, Technology and Environment)
I. SUBJECTS
ASSIGNED THE ENTRY-EXIT MANAGEMENT RESPONSIBILITY
Subjects considered and authorized by the
Minister to approve and decide the entry and exit are:
1. Administrative and public-service units
regularly involved in international relations and satisfying the following
conditions:
- Having been assigned the personnel management
responsibility by the Ministry,

2. State enterprises attached to the Ministry
The list of the units assigned the entry-exit
management responsibility is provided for in Appendix to the Decision
promulgating this Regulation.
II.
APPROVING AND DECIDING LEVELS
1. The Minister shall decide the exit of:
- Vice ministers;
- Subjects being members of the exit-management
authorized units, who are appointed by decisions of the Ministry.
- State officials and public employees of the
units which have not been authorized.
- Officials of the section or higher level and
chief accountants of State enterprises attached to the Ministry.
2. For the Ministry’s
State officials and public employees who travel abroad for execution of plans,
agreements or contracts signed with foreign parties, which have been allowed to
be concluded or ratified by the Ministry:

- For unplanned cases which have not yet been
allowed or ratified by the Ministry, the consent of the Ministry’s leadership is required, based on the consultation
with the Department for Scientific Organization and Personnel before the heads
of the units consider and decide the exit.
III.
RESPONSIBILITY
1. The heads of the units shall have the
responsibility:
To implement the provisions of the Government’s Decree No.05/2000/ND-CP of March 3, 2000 on
Vietnamese citizens’ entry and exit,
Circular No.09/2000/TT-BCA (A18) of June 7, 2000 of the Ministry of Public
Security guiding the granting of general passports, Official Dispatch
No.674LS/XNC of March 24, 2000 of the Consular Department of the Ministry for
Foreign Affairs to annul the provision on producing decisions on sending
persons aboard upon their exits, as well as the following stipulations:
a/ To annually elaborate and submit to the
Ministry’s leadership the entry-exit
plan and promptly report to the latter on unplanned cases.
b/ To consider the matter of personnel,
professional qualifications and skills, foreign language proficiency, working
efficacy and time... related to the units’
State officials and public employees sent abroad.
c/ The authorized units shall, after issuing
exit decisions, have to send a copy thereof to the Department for Scientific
Organization and Personnel for monitoring and sum-up and have to recover and
keep the passports of the persons for whom they have issued the exit decisions
according to their assigned responsibility, and urge the persons whose exits have
been decided by the Ministry to submit their passports to the Department for
Scientific Organization and Personnel right after they return to the country.
d/ To report to the Ministry (Department for
Scientific Organization and Personnel) cases where State officials or public
employees fail to return home on time or the detection of any particular
matters for coordination in handling and report them to the Ministry’s leadership for decision.
e/ Biannually and annually to report to the
Ministry’s leadership on the
situation of the units’ entry and exit.

a/ On the basis of the units’ specific proposals, to consider, sum up and submit
to the Ministry’s leadership the annual
exit plan for training, survey, conferences, workshops, participation in
meetings and evaluation so as to ensure the criteria on personnel, professional
qualifications and foreign language proficiency...for each specific case
submitted by the units.
b/ To inspect the exit management by the
authorized units and propose to the Ministry’s
leadership measures for handling violations, including the cancellation, when
necessary, of exit decisions issued by the units.
c/ To propose to the Ministry’s leadership the exit-related measures for the
management of this work.
d/ To recover and preserve passports of the
subjects whose exits have been decided by the Ministry right after they return
to the country.
e/ Biannually and annually, to sum up and report
the situation of the Ministry’s
exit management work to the Ministry’s
leadership.
f/ Regarding the exit, the Department for
Scientific Organization and Personnel shall report it to the Ministry’s leadership so that the latter may issue decisions
thereon within 5 days after fully receiving valid dossiers, except for special
cases.
3. The Department for International Relations
shall have the responsibility:
a/ To base itself on the units’ specific proposals, to consider and sum up before
submitting to the Ministry’s
leadership the annual exit plan within the framework of implementation of the
commitments already agreed upon in agreements or protocols...
b/ To assume the prime responsibility and
coordinate with the Department for Scientific Organization and Personnel in
guiding the inspection of entry management.

d/ On the basis of the units’ biannual and annual reports, to make sum-up and
report to the Ministry’s leadership on the
Ministry�s entry management
situation.
4. For the Ministry’s
State officials and public employees:
After each exit, the Ministry’s State officials and public employees shall have
to return their passports and report to the heads of their respective units as
well as the Ministry’s leadership on the
results they have gained and may make proposals.
IV.
IMPLEMENTATION ORGANIZATION
The Department for Scientific Organization and
Personnel, the Department for International Relations shall have to oversee and
inspect the implementation of this Regulation. In the course of implementation
of this Regulation, if any problem arises, organizations and individuals should
promptly report it to the Ministry (through the Department for Scientific
Organization and Personnel and the Department for International Relations) for
consideration and settlement.
