HƯỚNG DẪN QUẢN LÝ XUẤT KHẨU, NHẬP KHẨU HOÁ CHẤT ĐỘC VÀ SẢN PHẨM CÓ HOÁ CHẤT ĐỘC HẠI, TIỀN CHẤT MA TUÝ, HOÁ CHẤT THEO TIÊU CHUẨN KỸ THUẬT THUỘC DIỆN QUẢN LÝ CHUYÊN NGÀNH CỦA BỘ CÔNG NGHIỆP

Căn cứ Nghị định số 55/2003/NĐ-CP ngày 28 tháng 5 năm 2003 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Công nghiệp;
Căn cứ Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hoá với nước ngoài;
Căn cứ Nghị định số 100/2005/NĐ-CP ngày 03 tháng 8 năm 2005 của Chính phủ về thực hiện Công ước cấm phát triển sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí hoá học;
Căn cứ Nghị định số 68/2005/NĐ-CP ngày 20 tháng 5 năm 2005 của Chính phủ về An toàn hoá chất;
Căn cứ Luật Phòng, Chống ma tuý và các văn bản hướng dẫn thi hành;
Bộ Công nghiệp hướng dẫn quản lý xuất khẩu, nhập khẩu hoá chất Bảng thuộc Công ước cấm phát triển, sản xuất, tàng trữ, sử dụng và phá huỷ vũ khÝ hoá học; hoá chất độc hại và sản phẩm có hoá chất độc hại, tiền chất ma tuý, hoá chất nhập khẩu theo tiêu chuẩn kỹ thuật thuộc diện quản lý chuyên ngành của Bộ Công nghiệp như sau:

I. NHỮNG QUY ĐỊNH CHUNG

1. Việc xuất khẩu, nhập khẩu hoá chất Bảng 1 thuộc Công ước cấm phát triển sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí hoá học trong những trường hợp đặc biệt cho mục đích nghiên cứu, y tế, dược phẩm hoặc bảo vệ, thực hiện theo quy định Nghị định số 100/2005/NĐ-CP ngày 03 tháng 8 năm 2005 của Chính phủ về thực hiện Công ước và Quyết định số 05/2006/QĐ-BCN ngày 07 tháng 4 năm 2006 của Bộ Công nghiệp.

2. Hàng hoá là hoá chất độc, hoá chất độc hại, sản phẩm có hoá chất độc hại quá cảnh, tạm nhập tái xuất thực hiện theo các quy định của Bộ Thương mại.

3. Việc đảm bảo an toàn cho xuÊt khÈu, nhËp khẩu hoá chất Bảng thuộc Công ước cấm phát triển, sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí hoá học; hoá chất độc hại và sản phẩm có hoá chất độc hại, tiền chất ma tuý, hoá chất nhập khẩu theo tiêu chuẩn kỹ thuật thuộc diện quản lý chuyên ngành của Bộ Công nghiệp thực hiện theo quy định Nghị định số 68/2005/NĐ-CP ngày 20 tháng 5 năm 2005 của Chính phủ về An toàn hoá chất.

4. Thương nhân xuất khẩu, nhập khẩu chịu trách nhiệm về tính chính xác của số liệu khai báo khi xuất khẩu, nhập khẩu; quản lý và sử dụng hoá chất nhập khẩu theo đúng mục đích nhập khẩu và theo các quy định có liên quan; nếu có các hành vi vi phạm sẽ bị xử lý theo qui định của pháp luật.

II. QUY ĐỊNH CỤ THỂ

1. Thương nhân có giấy chứng nhận đăng ký kinh doanh và đã đăng ký mã số doanh nghiệp xuất nhập khẩu tại Cục Hải quan tỉnh, thành phố trực thuộc Trung ương, được phép xuất khẩu, nhập khẩu hoá chất để phục vụ trực tiếp cho sản xuất, nghiên cứu và kinh doanh theo nhu cầu sử dụng và khả năng kinh doanh (trừ các loại hoá chất là tiền chất sử dụng trong lĩnh vực công nghiệp trong Phụ lục số 1).

 Việc xuất khẩu, nhập khẩu những hoá chất là tiền chất sử dụng trong lĩnh vực công nghiệp thuộc Phụ lục số 1 thực hiện theo Luật Phòng, chống ma tuý ngày 09 tháng 12 năm 2000; Quy chế quản lý tiền chất sử dụng trong lĩnh vực công nghiệp đã ban hành kèm theo Quyết định số 134/2003/QĐ-BCN ngày 25 tháng 8 năm 2003 và số 04/2004/QĐ-BCN ngày 07 tháng 01 năm 2004 của Bộ Công nghiệp và các quy định tại Thông tư này.

2. Xuất khẩu, nhập khẩu hoá chất Bảng 2 và hoá chất Bảng 3 thuộc Phụ lục số 2 thực hiện theo Nghị định số 100/2005/NĐ-CP ngày 03 tháng 8 năm 2005 của Chính phủ về thực hiện Công ước cấm phát triển sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí hoá học và các quy định tại Thông tư này.

3. Thương nhân nhập khẩu hoá chất độc hại và sản phẩm có hoá chất độc hại thuộc danh mục nhập khẩu có điều kiện trong Phụ lục số 3 để kinh doanh, phải có Giấy chứng nhận đủ điều kiện bảo vệ môi trường trong kinh doanh hoá chất do Sở Tài nguyên và Môi trường tỉnh, thành phố trực thuộc trung ương cấp theo các quy định của Bộ Tài nguyên và Môi trường.

4. Khi nhập khẩu hoá chất ghi trong Phụ lục số 4 của Thông tư này, thương nhân phải kê khai đầy đủ các tiêu chuẩn chất lượng và tiêu chuẩn kỹ thuật tương ứng để cơ quan Hải quan kiểm tra, đối chiếu. Trường hợp có nghi vấn về khai sai lệch tiêu chuẩn chất lượng và tiêu chuẩn kỹ thuật, Cơ quan Hải quan quyết định trưng cầu giám định, thông quan theo quy định hiện hành. Việc nhập khẩu những hoá chất phục vụ trực tiếp cho sản xuất có tiêu chuẩn thấp hơn quy định tại Phụ lục này phải có ý kiến đồng ý bằng văn bản của Bộ Công nghiệp.

III. ĐIỀU KHOẢN THI HÀNH

Thông tư này có hiệu lực thi hành từ ngày 01 tháng 5 năm 2006. Các quy định trước đây về h­íng dẫn quản lý xuất khẩu, nhập khẩu hoá chất độc; hoá chất độc hại và sản phẩm có hoá chất độc hại, tiền chất ma tuý; hoá chất nhập khẩu theo tiêu chuẩn kỹ thuật thuộc diện quản lý chuyên ngành của Bộ Công nghiệp trái với Thông tư này đều bãi bỏ.

Trong quá trình thực hiện, nếu có khó khăn, vướng mắc, đề nghị các ngành, địa phương, đơn vị phản ánh về Bộ Công nghiệp để kịp thời sửa đổi, bổ sung cho phù hợp./.

CIRCULAR

GUIDING MANAGEMENT OF EXPORT AND IMPORT OF TOXIC CHEMICALS AND PRODUCTS WITH TOXIC CHEMICALS, PRE-SUBSTANCE OF DRUGS AND CHEMICALS ACCORDING TO TECHNICAL STANDARDS SUBJECT TO SPECIALIZED MANAGEMENT OF THE MINISTRY OF INDUSTRY

Pursuant to the Decree No.55/2003/ND-CP of May 28, 2003 of the Government regulating functions, duties, powers and organizational structure of Ministry of Industry;

Pursuant to the Decree No.12/2006/ND-CP dated January 23, 2006 of the Government detailing the implementation of the Commercial Law regarding international purchase and sale of goods and activities of purchase and sale agents, processing and transit of goods with foreign parties;

Pursuant to the Decree No.100/2005/ND-CP dated August 03, 2005 of the Government on implementation of the Convention on prohibition of the development of production, storage, use and destruction of chemical weapons;

Pursuant to the Decree No.68/2005/ND-CP of May 20, 2005 of the Government on Chemical Safety;

Pursuant to the Law on Prevention and Fighting against Drugs and its guiding documents;

The Ministry of Industry guides the management of export and import of chemicals of Table 1 under the Convention on the Prohibition of development of production, storage, use and destruction of chemical weapons; toxic chemicals and products with toxic chemicals, pre-substance of drugs and chemicals imported according to technical standards subject to specialized management of the Ministry of Industry as follows:

I. GENERAL PROVISIONS

2. Goods that are hazardous chemicals, products with hazardous chemicals in transit, temporarily imported for re-export shall comply with the provisions of the Trade Ministry.

3. The assurance of safety for export, import of chemicals of Table 1 under the Convention on the Prohibition of development of production, storage, use and destruction of chemical weapons; toxic chemicals and products with toxic chemicals, pre-substance of drugs and chemicals imported according to technical standards subject to specialized management of the Ministry of Industry shall comply with the provisions of the Decree No.68/2005/ND-CP of May 20, 2005 by the Government on Safety for chemicals.

4. Exporters, importers are responsible for the accuracy of the data declared upon export, import; management and use of imported chemicals for the right purposes and under the relevant regulations; if committing acts of violations, they will be handled according to law provisions.

II. SPECIFIC PROVISIONS

1. Traders who have certificates of business registration and registration for importer and exporter code at the Customs Departments of provinces and cities directly under the Central Government, are allowed to export and import chemicals for direct service for production, research and business by the needs and the ability to do business (other than chemicals as precursor substances used in industrial sector in Appendix 1).

The export and import of chemicals as precursor substances used in the industrial sector under Appendix 1 shall comply with the Law on Prevention and Anti-Drugs dated December 09, 2000; Management Regulation of Pre-substances used in the industrial sector issued together with the Decision No.134/2003/QD-BCN dated August 25, 2003 and No.04/2004/QD-BCN dated January 07, 2004 of Ministry of Industry and the provisions of this Circular.

2. The export and import of chemicals of Table 2 and chemicals of Table 3 of Appendix 2 shall comply with the Decree No.100/2005/ND-CP dated August 03, 2005 by the Government on implementation of the Convention on prohibition of production development, storage, use and destruction of chemical weapons and the provisions of this Circular.

3. Traders who import hazardous chemicals and products containing toxic chemicals on the list of conditional imports of Appendix 3 to do business, are required to have certificates of eligibility for environmental protection in the chemical business issued by the Departments of Natural Resources and Environment of provinces and cities under central authority under the provisions of the Ministry of Natural Resources and Environment.

4. When importing chemicals listed in Appendix 4 of this Circular, the traders must fully declare the standards of quality and corresponding technical standards for the customs offices to check and compare. Where there are questions on the false standards of quality and technical standards, customs offices decide to request expertise, customs clearance under the current regulations. The import of the chemicals in direct service for production with lower standards prescribed in this Appendix is required to be agreed in writing by the Ministry of Industry.

This Circular takes effect from May 01, 2006. The previous regulations on management guidance of export, import of toxic chemicals; toxic chemicals and products containing toxic chemicals, precursor substance of drugs; chemicals imported under the technical standards under the specialized management of the Ministry of Industry contrary to this Circular are hereby annulled.

During the execution, if any difficulties and obstacles arise, the branches, the localities, units report to the Ministry of Industry for timely amending and supplementing accordingly./.
