CIRCULAR
ELIGIBILITY
OF TRAINING, RESEARCH FACILITIES FOR PROVIDING IMPROVEMENT PROGRAMS FOR
TRANSPORT OFFICIALS
Pursuant to the Law on Officials No.
58/2010/QH12 dated November 15, 2010;
Pursuant to Law on amendment to Law on Public
Officials, High-ranking Officials and Law on Officials No. 52/2019/QH14 dated
November 25, 2019;
Pursuant to Decree No. 12/2017/ND-CP dated
February 10, 2017 of Government on functions, tasks, powers, and organizational
structure of Ministry of Transport;
Pursuant to Decree No. 101/2017/ND-CP dated September
1, 2017 of Government on training and improvement of officials and public
employees;
At request of Director of Department of
Personnel and Organization;
Minister of Transport promulgates Circular on
eligibility of training, research facilities for providing improvement programs
for transport officials.

GENERAL PROVISIONS
Article 1. Scope and regulated
entities
1. This Circular prescribes eligibility of
training, research facilities for providing improvement programs for transport officials,
including: conditions of lecturer improvement programs and materials;
infrastructure, practice facilities; experience in organizing training and
improvement of training, research facilities; organizing improvement; assessing
quality of improvement; printing, issuance, and management of certificate of
improvement.
2. This Circular applies to institutes, research
centers, higher education institutions, colleges, intermediate education
facilities, training facilities, and improvement facilities affiliated to
Ministry of Transport (hereinafter referred to as “training, research
facilities”) and relevant agencies, organizations, individuals.
Article 2. Purpose of
improvement
1. Improve specialized capacity and professional
ethics of transport officials.
2. Meet occupational standards as per the law to
consider promotion or compete for promotion according to occupational standards
and implement other relevant policies.
Article 3. Organization of
improvement
1. Academies, research centers, higher education
institutes and training, improvement facilities eligible according to Chapter
II hereof may organize improvement programs for class I transport officials and
class II transport officials.

3. Intermediate education institutions and
training, improvement facilities eligible according to Chapter II hereof may
organize improvement programs for class IV transport officials and class V
transport officials.
Article 4. Assessing quality of
improvement of transport officials and printing, issuance, management of
certificate of improvement
1. Assessing quality of improvement of transport
officials shall conform to Circular No. 10/2017/TT-BNV dated December 29, 2017
of Minister of Home Affairs on assessing quality of improvement of public
officials, high-ranking officials and officials, and other relevant law
provisions.
2. Printing, issuance and management of certificate
of improvement of transport officials shall conform to Article 4 of Circular
No. 01/2018/TT-BNV dated January 8, 2018 of Minister of Home Affairs guiding
Decree No. 101/2017/ND-CP dated September 1, 2017 of the Government.
Chapter II
ELIGIBILITY OF TRAINING,
RESEARCH FACILITIES FOR PROVIDING IMPROVEMENT PROGRAMS FOR TRANSPORT OFFICIALS
Article 5. Improvement programs
1. Improvement programs by
occupational standards of transport officials are issued by Minister of
Transport as per the law.
2. Improvement programs by
requirements of work positions, knowledge, skills, specialties of transport
officials are issued by Minister of Transport

Training, research facilities must obtain improvement
materials composed or selected and issued based on improvement programs under
Article 5 hereof.
Article 7. Lecturers
1. Lecturers of training, research facilities;
part-time lecturers and visiting lecturers must satisfy requirements for
training, improvement lecturers for public officials, high-ranking officials
and officials under Article 34 and Article 35 of Decree No. 101/2017/ND-CP
dated September 1, 2017 of the Government.
2. Lecturers of training, research facilities must
be sufficient to deliver lecture for at least 50% of improvement programs
assigned.
Article 8. Infrastructure and
practice facilities
1. Have adequate classrooms, functional rooms and
necessary equipment for both theory classes and practice classes of
occupational skills depending on improvement programs mentioned under Article 5
hereof.
2. Have adequate sources of materials, including:
books, textbooks, lectures, relevant materials suitable with improvement
programs under Article 5 hereof.
Article 9. Experience in
organizing training, improvement
Training, improvement facilities must have at least
3 years of experience in organizing improvement for officials or organizing
training for intermediate education level or higher in fields within state
management of Ministry of Transport relating to improvement programs by
occupational standards of transport officials.

ORGANIZATION FOR
IMPLEMENTATION
Article 10. Responsibilities
of training, improvement facilities assigned to provide improvement
1. Compiling or selecting and
issuing improvement materials for transport officials according to improvement
programs issued by Minister of Transport while ensuring suitability for
improvement beneficiaries; providing referencing documents to serve teaching, learning.
2. Develop plans and organize improvement for
transport officials for each beneficiary in a manner satisfactory to
regulations and law.
3. Deciding on list of enrollees, managing learning
process, assessing learning results, and accepting learning results of learners
as per the law.
4. On an annual basis, consolidating and sending
improvement results of transport officials to direct superior agencies and
Ministry of Transport.
Article 11. Responsibilities
of agencies and entities having officials participating in improvement programs
1. On an annual basis, developing plans for
improving transport officials under their management; sending to direct
superior supervisory agencies and cooperating with training, improvement
facilities in organizing improvement according to plan.
2. Managing documents; ensuring standards of
officials sent to attend improvement programs as per the law.

1. This Circular comes into force from April 15,
2021.
2. If the legislative documents extracted in this
Circular are approved for amendments or superseded by other legislative
document, the new documents will apply.
Article 13. Responsibility for
implementation
Chief of the Ministry Office, ministerial chief
inspectors, directors of departments, directors of training, research
facilities, heads of agencies, relevant organizations and individuals are
responsible for the implementation of this Circular./.
