PRESCRIBING
RETENTION PERIODS OF RECORDS AND DOCUMENTS IN JUSTICE SECTOR
Pursuant to the Law on Archives dated June
21, 2024
Pursuant to the Government's Decree No.
113/2025/ND-CP dated June 03, 2025 on elaboration of Law on Archives
Pursuant to Government's Decree No.
39/2025/ND-CP dated February 26, 2025 on functions, tasks, powers and organizational
structure of the Ministry of Justice;
At the request of the Chief of the Office of the
Ministry of Justice of Vietnam;
The Minister of Justice promulgates a Circular
prescribing retention periods of records and documents in the justice sector.

Article 2. Regulated entities
This Circular applies to agencies and units in the
Justice sector and other relevant agencies, organizations, and individuals.
Article 3. Record, documents,
and retention periods in the Justice sector
1. The following records and documents shall be
retained in the Justice sector:
a) Records and documents regarding the formulation
of legislative documents;
b) Records and documents regarding inspection,
review, consolidation, systematization of legislative documents, codification
of the system of legal norms;
c) Records and documents regarding handling of
administrative violations; inspection, investigation, survey, processing of
legal enforcement results;
d) Records and documents regarding international
law;
dd) Records and documents regarding international
legal cooperation and judicial reform;

g) Records and documents regarding legal aid;
h) Records and documents regarding civil judgment
enforcement; administrative judgment enforcement; bailiff;

k) Records and documents regarding state
compensation;
l) Records and civil status documents; nationality;
adoption;
m) Records and documents regarding lawyers; legal
consultancy; notarization; authentication; judicial expertise; property
auction; commercial arbitration; commercial mediation; property managers;
n) Records and documents regarding information
access.
2. The retention periods of records and documents
specified in Clause 1 hereof include permanent retention and retention for a
certain period specified under Appendix attached hereto.
3. Records and documents under the state management
of the Ministry of Justice that have not been prescribed retention periods in
this Circular shall apply equivalent retention periods to those of the same
field as prescribed in this Circular and other relevant regulations.

Article 4. Effect
This Circular comes into force from July 01, 2025.
Article 5. Implementation
organization
1. The Chief of Office of Ministries, heads of
agencies, units, and individuals specified in Article 2 are responsible
for the implementation of this Circular.
2. Difficulties that arise during the
implementation of this Circular should be reported to the Ministry of Justice
of Vietnam for consideration./.
