CIRCULAR
ON PROMULGATION OF
THE REGULATION ON ORGANIZATION AND OPERATION OF BOARDING ETHNIC SECONDARY
SCHOOLS
Pursuant to Law on Education dated June 6, 2019;
Pursuant to Decree No. 86/2022/ND-CP dated
October 24, 2022 of the Government defining the function, tasks, powers and
organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 127/2018/ND-CP dated
September 21, 2018 of the Government stipulating the responsibilities for state
management of education;
At the request of the Director of the Ethnic
Education Department;
The Minister of Education and Training
promulgates this Circular on promulgation of the Regulation on organization and
operation of boarding ethnic secondary schools.
Article 1. Promulgate together with this
Circular the Regulation on organization and operation of boarding ethnic
secondary schools.

Article 3. Chief of the Ministry’s Office,
the Director of Department of Ethnic Education, the heads of relevant agencies
affiliated to the Ministry of Education and Training, the Presidents of the
People’s Committees of central-affiliated cities and provinces, and the
Directors of Departments of Education and Training, Director of the Department
of Education, Science and Technology of Bac Lieu province; heads of boarding
ethnic secondary schools, Huu Nghi 80 School, Friendship T78 and Viet Bac
Highland School shall implement this Circular./.

GENERAL PROVISIONS

1. This Regulation sets forth
the organization and operation of boarding ethnic secondary schools
(hereinafter referred to as boarding ethnic schools), including: organization
and administration of the school; enrollment, organization of educational
activities and care, nurturing and management of students; duties and rights of
teachers, staff, and students.
2. This Regulation applies to
boarding ethnic schools and related organizations and individuals.
3. Friendship 80 School,
Friendship T78 School and Viet Bac Highland School may apply this Regulation to
carry out the task of educating boarding ethnic students.
4. Boarding ethnic schools
shall comply with the provisions of the Charter of lower-secondary schools,
upper-secondary schools and multi-level schools (hereinafter referred to as the
Charter of secondary schools) and the provisions of this Regulation.
Article 2. Boarding ethnic schools and boarding
ethnic students
1. The boarding ethnic school
is established by the State for students who are ethnic minorities and students
from families who have permanently settled in extremely disadvantaged areas for
the purpose of training high-qualified human resources for ethnic minority and
mountainous areas, and extremely disadvantaged areas.
2. Boarding ethnic students:
Students who are described in Article 9 of this Regulation and admitted to the
boarding ethnic schools.
Article 3. Duties of boarding ethnic schools
The boarding ethnic school shall perform the tasks
specified in the Charter of secondary schools and the following tasks:

2. Organize special educational
activities suitable for boarding ethnic students.
3. Educate students on the
guidelines and policies of the Party and State on ethnic minorities; cultural
identity and fine traditions of the ethnic groups of Vietnam; on consciousness
of participating in socio-economic development in ethnic minority and
mountainous areas, and extremely disadvantaged areas.
4. Provide vocational
education and traditional vocational training suitable to the capacity and
quality of students, and local socio-economic development conditions and
requirements.
5. Monitor and make statistics
on the number of students, evaluate the educational effectiveness annually and
in each period to develop appropriate solutions to improve the educational
quality of the boarding ethnic schools.
Article 4. The system of boarding ethnic schools
1. Lower-secondary boarding
ethnic schools.
2. Upper-secondary boarding
ethnic schools.
3. Lower-secondary and
upper-secondary boarding ethnic schools.

Lower-secondary boarding ethnic school (or
upper-secondary, or lower-secondary and upper-secondary boarding ethnic school)
+ proper name (if any) + name of district-level (or province-level) administrative
division.
2. The name of the school is
written on the establishment decision, the school name sign, the school's seal
and transaction documents.
3. The school name sign
contains the following contents
a) Upper left corner
- As for the lower-secondary
boarding ethnic school
First line: People's Committee of district, urban
district, town, provincial city or centrally affiliated city (hereinafter
referred to as district-level People's Committee) and district name;
Second line: Committee Division of Education and
Training;
- As for the boarding ethnic
school with the highest education level being upper secondary school
First line: People's Committee of province or
centrally affiliated city (hereinafter referred to as province-level People's
Committee) and province name;

b) The name of the school is written in the middle
as prescribed in Clause 1 of this Article;
c) Below is the address, phone number, email,
website (if any) of the school.
Article 6. Delegation of authority
1. The lower-secondary
boarding ethnic school is established under the decision of the President of
the province-level People's Committee and managed by the district-level
People's Committee.
2. The boarding ethnic school
with the highest educational level being upper secondary school is established
under the decision of the President of the province-level People's Committee
and managed by the Department of Education and Training. The Department of
Education and Training shall coordinate with the district-level People's
Committees in formulating details about coordination in management and
organization of educational activities related to lower-secondary and
upper-secondary boarding ethnic schools.
3. Friendship 80 School,
Friendship T78 School and Viet Bac Highland School shall be managed by
ministries and central agencies; and under the management coordination of the
Department of Education and Training where the school is located in the
implementation of the program, organization of graduation exams and granting
diplomas.
Chapter II
SCHOOL ORGANIZATION AND ADMINISTRATION
Article 7. Organizational structure of boarding
ethnic schools

2. The groups in charge of
special education, caring for, nurturing and managing boarding ethnic students
have the following tasks:
a) Actively develop plans for special education,
caring for, nurturing and managing boarding ethnic students by week, month,
semester and school year; coordinate with other specialized groups in
formulating and implementing education plans of the school;
b) Performing tasks as planned;
c) Participate in professional training as
prescribed;
d) Perform other tasks assigned by the principal;
dd) Organize activities at least once in 2 weeks
and may hold unscheduled meetings according to work requirements or at the
request of the principal. These groups operate on the principle of
democracy, the members help each other to perform well the task of educating,
caring for, nurturing and managing boarding ethnic students.
3. Each class of the boarding
ethnic school has no more than 35 students.
Article 8. Duties and rights of the principal
and vice-principal
In addition to the duties and rights specified in
the Charter of the secondary school, a principal and vice principal of a
boarding ethnic school also has the following duties and rights:

2. Perform the tasks of the
boarding ethnic school specified in Article 3 of this Regulation.
3. Learn the culture,
language, customs, practices and psychological characteristics of ethnic
students in the local area.
4. Formulate plans and
organize special educational activities suitable for boarding ethnic students
specified in Articles 13, 14 and 15 of this Regulation.
5. Coordinate with local
authorities, mass organizations and social organizations in caring, nurturing
and managing boarding ethnic students.
6. To be trained in methods of
education, care and management of boarding ethnic students.
Chapter III
ENROLLMENT, ORGANIZING SPECIAL EDUCATION, CARING FOR,
NURTURING AND MANAGING STUDENTS
Article 9. Eligible candidates for enrollment
1. Students being ethnic
minorities who themselves and their parents or guardians permanently reside for
36 consecutive months or more, up to the date of submission of enrollment documents,

b) Communes, wards and townships of regions II and
I in ethnic minority and mountainous areas according to regulations of
competent authorities.
2. Students from ethnic
minorities with very small population as defined in Decree No. 57/2017/ND-CP
dated May 9, 2017 of the Government stipulating priority policies for
enrollment and learning support for kindergarten children, students from ethnic
minorities with very small population.
3. Students being Kinh people
who themselves and their parents or guardians have permanently resided for 36
consecutive months or more, up to the date of submission of enrollment
documents, in extremely disadvantaged communes and villages. The boarding
ethnic school is allowed to enroll no more than 10% of Kinh students in the
total number of new enrollments each year.
4. In case the number of
eligible candidates specified in Clauses 1, 2 and 3 of this Article is smaller than
the size of the boarding ethnic school in the province, the People's Committee
of the province may specify more regions to create human resources for ethnic
minorities in order to enroll more ethnic minority people from poor or
near-poor households that they and their parents or guardians have resided
since for 36 consecutive months or more in this area, up to the date of
application submission.
Article 10. Eligibility requirements and
application documents
1. Eligibility requirements
for enrollment:
a) Being eligible candidates specified in Article 9
of this Regulation;
b) Meet the requirements in the Regulation on
enrollment of lower-secondary and upper-secondary boarding ethnic schools
promulgated by the Ministry of Education and Training.

- Copy of valid birth
certificate;
- Lawful grounds for
confirming information about residence;
- Primary school transcripts
or other documents that can replace school transcripts;
- Certificate of priority
benefits issued by a competent authority (if any);
b) Upper-secondary school enrollment
- Copy of valid birth
certificate;
- Lawful grounds for
confirming information about residence;
- A certified copy or a
photocopy enclosed with the original for comparison of the lower-secondary
boarding ethnic school diploma or provisional lower secondary school graduation
certificate;
- Lower-secondary school
transcripts;

Article 11. Enrollment method, priority and
direct admission
1. The enrollment method and
priority benefits shall comply with the Regulation on enrollment of
lower-secondary and upper-secondary boarding ethnic schools promulgated by the
Ministry of Education and Training.
2. Direct admission
Direct admission to the upper-secondary boarding
ethnic school of the following:
a) Students from ethnic minorities with very small
population;
b) Lower secondary students specified in Article 9
of this Regulation who have won national or international prizes in culture,
art, physical training, sports, science and technology are admitted directly
into the upper-secondary boarding ethnic school;
c) Primary students specified in Article 9 of this
Regulation who have won provincial prizes or higher in culture, arts, physical
training and sports may be admitted directly to the lower-secondary boarding
ethnic school.

b) Friendship 80 School, Friendship T78 School,
Viet Bac Highland School shall make enrollment plans, report them to the
governing body and submit to the Ministry of Education and Training for
approval.
2. Enrollment
a) The Department of Education and Training
provides guidance on enrollment for boarding ethnic schools with the highest
educational level being upper secondary and enrollment instructions for
Departments of Education and Training that have lower secondary boarding ethnic
schools;
b) Friendship 80 School, Friendship T78 School,
Viet Bac Highland School shall administer enrollment according to the approved
plan.
Article 13. Education programs and educational
plans
The boarding ethnic school develops the school's
educational plan to implement the general education program as prescribed in
the Charter of the high school, in which there is a plan to teach 2 sessions
per day to provide tutoring, retraining and consolidation of knowledge
according to the needs of boarding ethnic students and suitable to the
conditions of the school.
Article 14. Special education activities
1. The boarding ethnic school
shall organize educational activities specified in the Charter of the high
school to implement the general education program, and also organize specific
educational activities to preserve and promote the cultural identity, enhance
skills for boarding ethnic students.
2. Specific educational
activities in the boarding ethnic school include educational activities on
ethnic cultures, traditional occupations, and life skills education suitable
for boarding ethnic students.

4. The boarding ethnic school
performs social work in the school, psychological counseling for students under
the guidance of the Ministry of Education and Training, suitable for boarding
ethnic students living far from their families; building a safe and friendly
educational environment, preventing school violence.
Article 15. Care, nurturing and management of
boarding ethnic students
1. The boarding ethnic school
organizes a collective kitchen for boarding ethnic students to ensure food
safety and hygiene according to current regulations. Nurturing is carried out
openly and transparently according to the provisions of law.
2. The boarding ethnic school
performs school health work to take care of the health of boarding ethnic
students.
3. The boarding ethnic school
comprehensively manages the study, food, accommodation and travel of boarding
ethnic students during their study at the school; organize and manage boarding
affairs according to regulations; guide, check and urge students' self-study
and following daily routines at the boarding school; educate students on the
spirit of mutual assistance, helping each other in learning, building a
civilized lifestyle, maintaining hygiene and protecting the environment.
Chapter IV
DUTIES AND RIGHTS OF TEACHERS, STAFF, STUDENTS
Article 16. Duties and rights of teachers

the Charter of the secondary school, the teachers of the boarding ethnic school
have the following duties and rights:

2. Educate boarding ethnic
students on the guidelines and policies of the Party and the State on ethnic
affairs.
3. Learn the culture,
language, customs, practices and psychological characteristics of ethnic
students in the local area.
4. Apply teaching methods,
forms of organization of teaching and examination and assessment suitable to
boarding ethnic students, ensure the required requirements on the quality and
capacity of students as prescribed; participate in the education, care and
management of students outside of class time and organize special educational
activities; tutor students; guide students to self-study.
5. To be trained in methods of
education, care and management of boarding ethnic students.
Article 17. Duties and rights of staff
In addition to the duties and rights stipulated in
the Charter of the secondary school, the staff of the boarding ethnic school
have the following duties and rights:
1. Comply with the assignment
of the principal and vice principal in performance of the tasks of the boarding
ethnic school.
2. Learn the culture,
language, customs, practices and psychological characteristics of ethnic
students in the local area.
3. To be trained in methods of
education, care and management of boarding ethnic students.

In addition to the duties and rights of students
specified in Charter of the secondary school, boarding ethnic students also
have the following duties and rights:
1. Preserve the cultural
identity of their ethnic minorities, respect the cultural identity of other
ethnic groups.
2. Eat, stay, live in the boarding
area and enjoy the benefits and policies according to the State's regulations.
3. Obtain the permission from
the school according to the regulations before participating in any activities
outside the school./.
