SỬA ĐỔI, BỔ SUNG THÔNG TƯ SỐ 09/2013/TT-BTTTT NGÀY 08 THÁNG 4 NĂM 2013 CỦA BỘ TRƯỞNG BỘ THÔNG TIN VÀ TRUYỀN THÔNG BAN HÀNH DANH MỤC SẢN PHẨM PHẦN MỀM VÀ PHẦN CỨNG, ĐIỆN TỬ

Căn cứ Luật Công nghệ thông tin ngày 29 tháng 6 năm 2006:

Căn cứ Nghị định số 71/2007/NĐ-CP ngày 03 tháng 5 năm 2007 của Chính phủ quy định chi tiết và hướng dẫn thực hiện một số điều của Luật Công nghệ thông tin về công nghiệp công nghệ thông tin;

Căn cứ Nghị định số 17/2017/NĐ-CP ngày 17 tháng 02 năm 2017 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Thông tin và Truyền thông;

Theo đề nghị của Vụ trưởng Vụ Công nghệ thông tin,

Bộ trưởng Bộ Thông tin và Truyền thông ban hành Thông tư sửa đổi, bổ sung Thông tư số 09/2013/TT-BTTTT ngày 08 tháng 4 năm 2013 của Bộ trưởng Bộ Thông tin và Truyền thông ban hành Danh mục sản phẩm phần mềm và phần cứng, điện tử.

Điều 1. Sửa đổi, bổ sung Thông tư số 09/2013/TT-BTTTT ngày 08 tháng 4 năm 2013 của Bộ trưởng Bộ Thông tin và Truyền thông ban hành Danh mục sản phẩm phần mềm và phần cứng, điện tử như sau:

1. Thay thế Phụ lục số 01 Danh mục sản phẩm phần mềm tại Thông tư số 09/2013/TT-BTTTT ngày 08 tháng 4 năm 2013 của Bộ trưởng Bộ Thông tin và Truyền thông bằng Phụ lục 01 Danh mục sản phẩm phần mềm ban hành kèm theo Thông tư này.

Điều 2. Hiệu lực thi hành và quy định chuyển tiếp

1. Thông tư này có hiệu lực thi hành kể từ ngày 02 tháng 02 năm 2022.

2. Các sản phẩm phần mềm đã được xác định thuộc Danh mục sản phẩm phần mềm trước ngày có hiệu lực của Thông tư này thì tiếp tục được áp dụng theo đúng mục đích của Danh mục tại Thông tư số 09/2013/TT-BTTTT ngày 08 tháng 4 năm 2013 của Bộ trưởng Bộ Thông tin và Truyền thông.

Điều 3. Trách nhiệm thi hành

1. Chánh Văn phòng, Vụ trưởng Vụ Công nghệ thông tin, Thủ trưởng các cơ quan, đơn vị thuộc Bộ Thông tin và Truyền thông, Giám đốc Sở Thông tin và Truyền thông các tỉnh, thành phố trực thuộc Trung ương và các doanh nghiệp, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Thông tư này.

2. Trong quá trình thực hiện, nếu phát sinh vướng mắc, đề nghị các tổ chức, cá nhân phản ánh về Bộ Thông tin và Truyền thông để bổ sung, sửa đổi cho phù hợp./.

CIRCULAR

AMENDMENT TO CIRCULAR NO. 09/2013/TT-BTTTT DATED APRIL 8, 2013 OF THE MINISTER OF INFORMATION AND COMMUNICATIONS ISSUING THE LIST OF SOFTWARE, HARDWARE, AND ELECTRONIC PRODUCTS

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decree No. 71/2007/ND-CP dated May 3, 2007 of the Government elaborating and guiding implementation of the Law on Information Technology pertaining to information technology industry;

Pursuant to Decree No. 17/2017/ND-CP dated February 17, 2017 of the Government on functions, tasks, powers, and organizational structures of Ministry of Information and Communications;

At request of Director of Department of Information Technology,

The Minister of Information and Communications promulgates Circular amending the Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications issuing the list of software, hardware, and electronic products.

Article 2. Entry into force and transition clauses

1. This Circular comes into force from February 2, 2022.

2. Software products identified under the List of software products before the effective date hereof shall continue to be applied in their intended purposes according to the List under Circular No. 09/2013/TT-BTTTT dated April 8, 2013 of the Minister of Information and Communications.

Article 3. Responsibilities for implementation

1. Chief of Ministry, Director of Department of Information Technology, heads of agencies and entities affiliated to the Ministry of Information and Communications, Directors of Information Technology Departments of provinces and central-affiliated cities and relevant enterprises, organizations, and individuals are responsible for implementing this Circular.

2. Difficulties that arise during the implementation of this Circular should be reported to the Ministry for consideration./.
