CIRCULAR
VOCATIONAL EDUCATION TRAINING
ASSOCIATION AND COOPERATION
Pursuant to the Law on Vocational Education No. 124/2025/QH15;
Pursuant to the Government’s Decree No. 279/2026/ND-CP dated July 12,
2026 on functions, tasks, powers and organizational structure of the Ministry
of Education and Training of Vietnam;
At the request of the Director of Vocational Education and Continuing
Education Department;
The
Minister of Education and Training shall promulgate Circular on vocational
education training association and cooperation.
Chapter I
GENERAL PROVISIONS

1.
This Circular provides for domestic vocational education training association
and cooperation, including: vocational education cooperation; vocational
education training association; rights, obligations, and responsibilities of
parties participating in vocational education training association and
cooperation, and organization of implementation.
2.
The following activities shall not be governed by this Circular:
a)
Vocational education training association and cooperation involving foreign
elements;
b)
Association in implementation of training programs for the purpose of awarding
degrees/diplomas or certificates to learners by the method of distance training
or combination of in-person and distance training for professions in the fields
of national defense and security; early childhood education; and specific
professions requiring in-person training according to specialized laws;
c)
Association in establishment of specialized training units, centers and
faculties within vocational education institutions under the Ministry of
National Defense.
Article 2. Regulated entities
This
Circular applies to vocational education institutions, institutions
participating in vocational education operations, relevant enterprises,
agencies, organizations and individuals participating in vocational education
training association and cooperation.
Article 3. Interpretation of terms
For
the purposes of this Circular, the terms below shall be construed as follows:

2.
Association in implementation of training program for the purpose of
awarding degree/diploma or certificate refers to cooperation between a unit
presiding over association in training (hereinafter referred to as “presiding
unit”) and a unit cooperating in association in training (hereinafter referred
to as “cooperating unit”) in organizing and implementing a part or the entirety
of a training program specified in points a, b, c, and d, clause 2, Article 6
of the Law on Vocational Education to award the degree/diploma or certificate.
3.
Association in establishment of a specialized training unit, center or
faculty refers to cooperation between a vocational education institution
and an institution conducting vocational education operations as prescribed in
Article 7 of the Law on Vocational Education, a domestic educational
organization, or an enterprise to establish specialized training unit, center
or faculty within the vocational education institution.
4.
Presiding unit refers to a vocational education institution permitted to
provide training in association professions as prescribed; and taking
comprehensive responsibility to the law, learners, and society for training
organization, training quality, and awarding of degrees/diplomas and
certificates to learners.
5.
Cooperating unit refers to an institution conducting vocational
education operations as prescribed in Article 7 of the Law on Vocational
Education, a domestic educational organization, or an enterprise that meets all
conditions regarding facilities, equipment, and educators or experts to satisfy
the requirements for participation in the implementation of the training
program as agreed upon in a training association contract.
Chapter II
COOPERATION IN
VOCATIONAL EDUCATION
Article 4. Cooperation principles
1.
Cooperating on the basis of voluntariness, equality, and respect for the
autonomy and accountability of the parties; maintaining openness and
transparency throughout the cooperation process
2.
Being consistent with functions and tasks of the participating parties;
protecting the legitimate rights and interests of learners and relevant parties.

4.
Complying with regulations of law on occupational safety and health, fire
prevention and fighting, environmental protection, and other relevant
regulations.
5.
Complying with regulations of laws on management and use of public property and
anti-corruption in case public property is used during the training cooperation.
Article 5. Cooperation content and form
1.
Vocational education cooperation content includes:
a)
Cooperation in development of training programs and learning models;
b)
Cooperation in organization of practical training and internships;
c)
Cooperation in management and use of training facilities and equipment;
d)
Cooperation in providing refresher training and updating vocational skills for
learners; and in providing refresher training, updating, and improving
expertise, professional skills, practical skills, and access to new
technologies for educators;
dd)
Cooperation in the application of scientific research, technology transfer, and
innovation to training, development of vocational skills, and improvement of
human resources quality;

2.
Cooperation shall be ensured through written cooperation agreements or
contracts, in conformity with the content and scope of cooperation in
accordance with regulations of law.
3.
The State encourages enterprises to cooperate with vocational education
institutions and other institutions participating in vocational education
operations, linked with labor demand and in accordance with regulations of law.
Article 6. Cooperation requirements
1.
Cooperating parties shall meet the following requirements:
a)
They must be legally established and operate in accordance with the law;
b)
They must have functions, tasks, or professional operations suitable for
cooperation;
c)
They must have human resources, facilities, equipment, or other necessary
conditions that meet the requirements for cooperation;
d)
They are not suspended, dissolved, bankrupt, or prohibited from conducting
operations related to cooperation in accordance with regulations of law;
dd)
They must be responsible for the accuracy of information, quality assurance
conditions, and committed contents during the training cooperation.

3.
Regarding cooperation in organization of practical training and internships as
specified in point b, clause 1, Article 5 of this Circular, the cooperating
parties shall ensure that:
a)
Lecturers, teachers, and vocational instructors participating in teaching and
providing guidance on practical training and internships meet professional
standards and criteria prescribed by the Ministry of Education and Training;
b)
Practical training and internships are suitable for the training program;
c)
Practical training and internships are managed, supervised, and assessed by the
vocational education institution in accordance with regulations.
4.
Regarding cooperation in management and use of training facilities and
equipment as specified in point c, clause 1, Article 5 of this Circular, the
cooperating parties shall ensure that:
a)
Facilities and equipment serving training purposes meet the requirements of the
training program;
b)
Cooperation in use of training facilities and equipment must not alter the
responsibilities of the vocational education institution for organization of
training and training quality assurance;
c)
Management and use of public property at public vocational education
institutions comply with regulations on public property management and use and
relevant laws.
5.
Regarding cooperation in providing refresher training and upgrading vocational
skills for learners, and providing refresher training, updating, and improving
expertise, professional skills, practical skills, and access to new
technologies for educators prescribed in point d, clause 1, Article 5 of this
Circular, the participating parties must ensure that:

b)
Refresher training and updates must be consistent with the participants,
contents, objectives, and actual conditions of the parties;
c)
Refresher training and updating results are managed, used, or recognized in
accordance with regulations of law.
6.
Regarding cooperation in application of scientific research, technology
transfer, and innovation to training as specified in point dd, clause 1,
Article 5 of this Circular, the cooperating parties shall comply with
regulations of law on science, technology, and innovation, and other relevant
laws.
7.
Regarding cooperation in training linked to labor demand, practical training,
internship, support for recruitment, and job referrals for learners as
specified in point e, clause 1, Article 5 of this Circular, the cooperating
parties shall ensure that:
a)
The cooperation is suitable for labor demand and requirements for vocational
skills of the enterprise. In case of cooperation in the form of training for
the purpose of awarding degrees/diplomas or certificates, or establishment of
specialized training units, faculties and centers, vocational education
training association is required in accordance with regulations of Chapter III
of this Circular.
b)
In case learners directly participate in production, business, or production of
products at the enterprise, allowances, wages, or benefits of the learners must
be specifically agreed upon in accordance with regulations of law.
8.
Cooperation in training in specific professions shall comply with relevant
specialized laws.

Article 7. Training program implementation association principles
1.
Association in implementation of training programs for the purpose of awarding
degrees/diplomas or certificates to learners shall comply with regulations of
clause 3, Article 41 of the Law on Vocational Education; and at the same time
organization of implementation, management of learners, and the determination
of responsibilities of the participating parties for association must be public
and transparent.
2.
Association must meet the objectives, standards of learning outcomes, and other
requirements (if any) of the training program; and ensure training quality in
accordance with regulations of law.
3.
The participating parties to association in training shall clearly define their
respective responsibilities for admission, training organization, learner
management, testing, assessment of learning outcomes, graduation recognition,
and awarding of diplomas or certificates to learners in accordance with
regulations.
4.
Training association must protect the legitimate rights and interests of
learners throughout the learning process and after graduation in accordance
with regulations of law. Training must not be organized when the minimum
conditions regarding programs, staff, facilities, and equipment as regulated
are not met.
Article
8. Training program implementation association methods
1.
Association in implementation of training programs for the purpose of awarding
degrees/diplomas or certificates to learners shall be formed through one of the
training methods specified in training regulations for vocational education
levels issued by the Ministry of Education and Training.
2.
Based on training regulations applicable to vocational education levels, the
objectives, standards of learning outcomes, and other requirements (if any) of
the training program, specific professions, and the quality assurance
conditions in accordance with regulations of law, the participating parties to
association in training shall agree to select the method for organization of
implementation of the training program and determine the responsibilities of
each party in the training association contract.

2.
The cooperating unit shall participate in organization of training as agreed
upon with the presiding unit, corresponding to the conditions regarding
programs, staff, facilities, equipment, and practical training and internship
environment; and bear responsibility for the quality of content, training
duration, and tasks assigned under the agreement in the training association
contract.
3.
Admission for association in implementation of the training program must ensure
that:
a)
Admission target is specified in the admission plan of the presiding unit and
is achieved in accordance with regulations of law on admission and training
organization;
b)
Information regarding the program, degrees/diplomas, certificates, location,
form, methods for organization of training, learning conditions, tuition fees,
and other charges for learners is public and transparent in accordance with
regulations.
c)
Regulations on vocational education admission are complied with;
4.
Management of learners during the training association shall comply with
regulations of law on student affairs within the vocational education
institution and internal regulations of the presiding unit.
5.
The training program implementation association organization must be within the
scope of training professions, locations, and methods that have been licensed
or satisfy the conditions prescribed by law. In case of association in
implementation of the training program by the method of distance training or
combination of in-person and distance training, the presiding unit and the
cooperating unit must meet conditions regarding information technology
infrastructure, learning materials, learning management systems, examination,
assessment of learning outcomes, and other quality assurance conditions as prescribed
by law; fully provide practical training, internships, and meet the learning
outcome standards of the training program.
Article 10. Training program implementation association contracts
1.
Association in implementation of the training program for the purpose of
awarding degrees/diplomas and certificates to learners shall be based on a
written training association contract between the presiding unit and the
cooperating unit.

a)
Name of the program, professions, training level, and duration; form and method
for organization of training; training location;
b)
Training program, standards of learning outcomes; assignment of
responsibilities for compilation and updating of the program, materials, and
test, examination, and assessment item banks;
c)
Conditions for training quality assurance: educators; facilities and equipment;
information technology systems and distance training infrastructure (if any);
d)
Training organization plan and schedule; methods of cooperation in management
and support for learners;
dd)
Assignment of responsibilities for testing, assessment, recognition of learning
outcomes, graduation recognition, and awarding of degrees/diplomas and certificates
to learners;
e)
Financial mechanisms for execution of the training association contract;
management and use of facilities, equipment, and assets participating in
training association; rights and responsibilities of the parties to assets and
intellectual property rights arising during the training association (if any);
mechanisms for settlement of disputes arising during the contract execution;
and principles of handling related issues upon the termination of the training
association in accordance with the law.
g)
Rights, obligations, and responsibilities of the parties participating in the
training association; responsibilities for assurance of occupational safety,
occupational hygiene, and practical training or internship environment for
learners; responsibilities for compensation, support, and procedures for
cooperation in handling of occupational accidents, safety incidents, or arising
situations related to learners and educators during the training association;
h)
Handling principles when the training association contract is amended, extended
or terminated before its expiry date; responsibilities of each party, including
responsibility for assurance of the implementation of the training program and
protection of the legitimate rights and interests of learners in case of
termination of the training association contract before its expiry date.
3.
Other relevant contents as agreed upon by the parties in the training
association contract, provided that they are not contrary to regulations of law.

1.
A location for organization of association in implementation of a training
program for the purpose of awarding degrees/diplomas or certificates to
learners must be a training location licensed by the presiding unit for the
corresponding group of professions, or a location lawfully owned or used by the
cooperating unit, or another training location as prescribed by law.
2.
The location must meet the conditions for facilities, training equipment,
learning environment, and other training quality assurance conditions in
accordance with the regulations of the Ministry of Education and Training.
3.
The location must be clearly defined in the training association contract and
publicly announced in accordance with regulations.
4.
The presiding unit shall be responsible for managing training in the location
as prescribed by law.
Section 2. ASSOCIATION IN ESTABLISHMENT OF SPECIALIZED TRAINING UNITS,
CENTERS OR FACULTIES
Article 12. Association in establishment of specialized training units,
centers or faculties
1.
Vocational education institutions may be associated with other institutions
conducting vocational education operations, educational organizations, and
enterprises in Viet Nam to establish faculties, centers, or specialized
training units under such vocational education institutions in accordance with
the law.
2.
The association in establishment of faculties, centers, or specialized training
units is aimed at mobilizing, sharing and effectively exploiting the resources
of all parties regarding staff, facilities, equipment, technology, and
expertise to:
a)
Organize implementation of vocational education training program;

Research and develop the training program;
d)
Apply scientific research, technology transfer, and innovation to training;
dd)
Invest and use facilities and equipment serving training, practical training
and internships;
e)
Carry out other specialized operations serving training in accordance with the
law.
Article 13. Requirements for association in establishment of specialized
training units, centers or faculties
1.
Vocational education institutions shall meet the following requirements:
a)
Being consistent with functions and tasks of vocational education institutions
and the participating parties;
b)
Complying with regulations of law on organizational structure and autonomy
mechanisms of public service providers (for public vocational education
institutions), management and use of public property, finance, intellectual
property, and other relevant laws;
c)
Meeting conditions regarding facilities, equipment, and personnel serving
training;

dd)
Complying with the law on vocational education and relevant laws.
2.
Association in establishment of specialized training units, centers or
faculties must be specified in written agreements or contracts signed by the
parties, clearly defining:
a)
Association objectives, scope and content;
b)
Functions and tasks of specialized training units, centers or faculties;
c)
Responsibilities of the parties for organization of activities, and management
of finance, assets, personnel, and facilities;
d)
Mechanisms for cooperation in management and assurance of quality of training;
dd)
Time limit for association and principles of handling matters upon termination
of the association;
e)
Rights, obligations and responsibilities of the participating parties.

Article 14. Rights of the participating parties
1.
Agree on collection of tuition fees and other charges (if any) from learners in
accordance with the law; and publicly and transparently disclose such charges
prior to admission.
2.
In case a vocational education institution or an institution participating in
vocational education operations cooperates or associates with an enterprise in
training, the parties may agree on regulations on wages, salaries, support, or
other legitimate rights and interests for learners and educators participating
in practical training, internships, or production and business at the
enterprise in accordance with the law. The agreement must be specified in the
written agreement or the contract signed by the parties.
3.
Exercise other rights in accordance with the written agreement or the contract
signed by the parties and regulations of law.
Article 15. Obligations of the participating parties to cooperation
1.
Fully implement the contents of the cooperation agreement or contract.
2.
Fulfill conditions for cooperation in accordance with regulations.
3.
Protect legitimate rights and interests of learners.
Article 16. Obligations of the presiding unit

2.
Preside over admission, organization of training, management of training
program and assurance of training quality as prescribed.
3.
Organize examinations and assessment of learning outcomes, and recognize
graduation for learners; manage learner records and records of awarding
degrees/diplomas or certificates to learners upon completion of the training
program in accordance with regulations.
4.
Organize review and assessment of the fulfillment of conditions for association
in training in accordance with the law and the training association contract
prior to decision on admission; and only decide admission when all conditions
for training association are fully met.
5.
Be responsible for publicly disclosing information regarding training
association on its website in accordance with the law; registering information
on training association in the specialized database of vocational education
prior to admission and organization of training; and updating information upon
any changes in accordance with regulations of the Ministry of Education and
Training.
6.
Cooperate with the cooperating unit in organizing training, managing learners,
and meeting training conditions in accordance with the training association
contract.
7.
Be legally responsible for the training quality and the legitimate rights and
interests of learners.
Article 17. Obligations of the cooperating unit
1.
Cooperate with the presiding unit in preparing and maintaining quality
assurance conditions for participation in the organization of the training association,
in accordance with the terms agreed upon in the training association contract.
2.
Cooperate in the implementation of the training plan and the management of
learners during the training process, in conformity with the contents agreed
upon in the training association contract.

4.
Cooperate in development and compliance with regulations and procedures on
occupational safety and health, and fire prevention and fighting during the
organization of practical training and internships; promptly handle or
cooperate in the handling of arising incidents in accordance with regulations
of law.
5.
Promptly notify the presiding unit of any changes related to facilities,
equipment, staff, or other quality assurance conditions that affect the
training association.
6.
Fulfill other responsibilities according to regulations of the law and the
training association contract.
Article 18. Obligations of the parties to association in establishment
of specialized training units, centers or faculties
1.
Vocational education institutions shall:
a)
Issue or request competent authorities to issue decisions to establish
specialized training units, centers or faculties in accordance with regulations
of law. Regarding public vocational education institutions, the establishment
of specialized training units, centers or faculties shall comply with the
regulations of law on organizational structure, autonomy mechanisms of public
service providers, management and use of public property, and other relevant
laws. Regarding private vocational education institutions, the establishment shall
comply with the regulations on organization and operation of vocational
education institutions and relevant laws.
b)
Organize the management and administration of specialized training units,
centers or faculties in accordance with regulations of law and the contents of
the association agreements or contracts.
c)
Publicly disclose information and update data on association in accordance with
the regulations of the Ministry of Education and Training.
2.
Domestic institutions conducting vocational education operations, educational
organizations, and enterprises participating in the association in
establishment of specialized training units, centers or faculties shall:

b)
Fulfill conditions for human resources, facilities, equipment, technology, and
other committed resources to serve the operations of specialized training
units, centers or faculties;
c)
Cooperate with vocational education institutions in organizing activities,
managing, and efficiently using resources, and ensuring training quality in
accordance with the agreed contents;
d)
Fulfill other rights, obligations and responsibilities according to regulations
of the law and the training association contracts and agreements.
Article 19. Joint responsibilities of the parties participating in
training association and cooperation
1.
Issue or finalize internal regulations on organization of vocational education
training association and cooperation in accordance with regulations of this
Circular and relevant laws.
2.
Organize management, monitoring and supervision of training association and
cooperation in accordance with regulations of law and the contents of the
agreements or contracts signed by the parties.
3.
Store files and records of training association and cooperation, and provide
information and records at the request of competent authorities.
4.
Publicly disclose information and fully and promptly update data on training
association and cooperation to the specialized vocational education database in
accordance with regulations of law.
5.
Annually, before January 15 of the following year, vocational education
institutions engaging in training association and cooperation shall be
responsible for reporting on training association and cooperation of the
previous year (up to December 31) according to the form prescribed in Appendix
I issued together with this Circular to its direct management agency and the
Department of Education and Training of the province where the vocational education
institution's headquarters is located, in accordance with regulations on
reporting. In case the information and data of the report have been fully
updated on the specialized vocational education database, existing contents and
data on the database are not required to be re-reported, except for the purpose
of inspection, examination, or at the request of competent authorities.

Chapter V
IMPLEMENTATION
ORGANIZATION
Article 20. Inspection and supervision of state management of vocational
education training association and cooperation
1.
Competent vocational education management agencies shall inspect and supervise
training association and cooperation in accordance with regulations of law.
2.
Inspection and supervision contents include:
a)
Fulfillment of conditions for organization of training association and
cooperation in accordance with regulations of law.
b)
Admission, organization of implementation of training programs; management,
examination, and assessment of learners' learning outcomes;
c)
Assurance of training quality, fulfillment of conditions for facilities, training
equipment, educators, occupational safety, and health during the organization
of training, practical training, and internships;
d)
Implementation of written training cooperation agreements and association
contracts;

3.
Vocational education institutions, institutions participating in vocational
education operations, organizations and individuals participating in vocational
education training association and cooperation shall be responsible for
providing relevant information and records to serve inspection and supervision
at the request of competent authorities.
Article 21. Responsibilities of the Department of Education and Training
1.
Responsibilities of the Department of Education and Training of the province
where the vocational education institution's headquarters is located
a)
Provide guidance, monitor, and inspect the implementation of regulations of law
on training association and cooperation for vocational education institutions
under its management;
b)
Receive, handle, or recommend competent authorities to handle feedback,
recommendations, complaints, and denunciations (if any) related to training
association and cooperation in accordance with regulations of law.
c)
Receive reports from vocational education institutions; manage and access
information and data on training association and cooperation under its
management on the specialized vocational education database in accordance with
regulations.
d)
Annually, before January 30 of the following year, send a consolidated report
to the Ministry of Education and Training and the provincial People's Committee
on vocational education training association and cooperation within the
province of the previous year (up to December 31) according to the form
prescribed in Appendix II issued together with this Circular. In case the
information and data of the report have been fully updated on the specialized
vocational education database, existing contents and data on the database are
not required to be re-reported, except for the case at the request of competent
authorities.
2.
Responsibilities of the Department of Education and Training of the province
where the location for organization of training association and cooperation
exists
a)
Monitor, and inspect the training association and cooperation within the
province as prescribed by law and under its jurisdiction;

c)
Manage and access information and data on training association and cooperation
within the province on the specialized vocational education database in
accordance with regulations of law;
d)
Cooperate with the Department of Education and Training of the province where
the vocational education institution's headquarters is located in managing,
inspecting, and handling arising issues during the organization of training
association and cooperation within the province.
Article 22. Transitional clauses
1.
Vocational education training cooperation agreements and association contracts
that were signed and are being implemented prior to the effective date of this
Circular, and are consistent with the law at the time of signature, shall continue
to be executed until their expiry dates as agreed and signed, except where the
parties agree on amendments to comply with regulations of this Circular.
2.
In case the contents of the training cooperation agreement or association
contract currently executed are not consistent with regulations of this
Circular, the parties shall be responsible for reviewing and amending them
within 06 months from the effective date of this Circular; such amendments must

participating in the training program.
3.
During the period prior to the amendments in accordance with Clause 2 of this
Article, the parties must take measures to protect the legitimate rights and
interests of learners and report to the competent local vocational education
agency.
Article 23. Effect
1.
This Circular takes effect from October 12, 2026.
2.
This Circular replaces the Circular No. 05/2022/TT-BLDTBXH dated April 05, 2022
of the Minister of Labor, Invalids and Social Affairs.

The Chief of Office, the Director of the Department of Vocational Education and
Continuing Education, heads of relevant units under the Ministry of Education
and Training; Directors of Departments of Education and Training; principals of
vocational education institutions; heads of institutions participating in
vocational education operations, enterprises, and organizations participating
in cooperation and association; and relevant agencies, organizations, and
individuals shall be responsible for implementing this Circular.
2.
Any difficulties, problems or issues arising in the implementation of this
Circular should be reported to the Ministry of Education and Training for
prompt handling./.
