VỀ VIỆC BAN HÀNH CHƯƠNG TRÌNH TỔNG THỂ CỦA CHÍNH PHỦ VỀ THỰC HÀNH TIẾT KIỆM, CHỐNG LÃNG PHÍ NĂM 2023

Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015; Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;

Căn cứ Luật Thực hành tiết kiệm, chống lãng phí ngày 26 tháng 11 năm 2013;

Căn cứ Nghị quyết số 68/2022/QH15 ngày 10 tháng 11 năm 2022 của Quốc hội về Kế hoạch phát triển kinh tế - xã hội năm 2023;

Căn cứ Nghị quyết số 74/2022/QH15 ngày 15 tháng 11 năm 2022 của Quốc hội về tiếp tục đẩy mạnh việc thực hiện chính sách, pháp luật về thực hành tiết kiệm, chống lãng phí;

Căn cứ Nghị định số 84/2014/NĐ-CP ngày 08 tháng 9 năm 2014 của Chính phủ quy định chi tiết một số điều của Luật Thực hành tiết kiệm, chống lãng phí;

Căn cứ Quyết định số 1845/QĐ-TTg ngày 02 tháng 11 năm 2021 của Thủ tướng Chính phủ về việc ban hành Chương trình tổng thể của Chính phủ về thực hành tiết kiệm, chống lãng phí giai đoạn 2021 - 2025;

Theo đề nghị của Bộ trưởng Bộ Tài chính.

QUYẾT ĐỊNH:

Điều 1. Ban hành kèm theo Quyết định này Chương trình tổng thể của Chính phủ về thực hành tiết kiệm, chống lãng phí năm 2023.

Điều 2. Quyết định này có hiệu lực thi hành kể từ ngày ký ban hành.

Điều 3. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương và Tổng Giám đốc Công ty trách nhiệm hữu hạn một thành viên do Nhà nước nắm giữ 100% vốn điều lệ được Thủ tướng Chính phủ quyết định thành lập chịu trách nhiệm thi hành Quyết định này.

TỔNG THỂ CỦA CHÍNH PHỦ VỀ THỰC HÀNH TIẾT KIỆM, CHỐNG LÃNG PHÍ NĂM 2023

I. MỤC TIÊU, YÊU CẦU, NHIỆM VỤ TRỌNG TÂM NĂM 2023

1. Mục tiêu

Mục tiêu của thực hành tiết kiệm, chống lãng phí (sau đây viết tắt là “THTK, CLP”) năm 2023 là thực hiện đồng bộ, có hiệu quả các mục tiêu, nhiệm vụ, giải pháp THTK, CLP trong các lĩnh vực, đưa công tác THTK, CLP trở thành nhiệm vụ trọng tâm, thường xuyên của các cơ quan, tổ chức, đơn vị, góp phần huy động, phân bổ, sử dụng có hiệu quả các nguồn lực để đảm bảo giữ vững ổn định kinh tế vĩ mô, thúc đẩy quá trình phục hồi và tăng trưởng kinh tế - xã hội, củng cố quốc phòng, an ninh, đẩy mạnh hoạt động đối ngoại, tăng cường phòng chống tham nhũng, lãng phí, tiêu cực.

2. Yêu cầu

a) Bám sát các yêu cầu, nhiệm vụ, chỉ tiêu, giải pháp tại Chương trình tổng thể về THTK, CLP của Chính phủ giai đoạn 2021 - 2025; gắn với hoàn thành các chỉ tiêu chủ yếu về kinh tế, xã hội đề ra tại Kế hoạch phát triển kinh tế - xã hội năm 2023.

b) Chương trình THTK, CLP phải đảm bảo tính toàn diện, nhưng cần có trọng tâm, trọng điểm; tập trung vào chủ đề năm 2023 là “Triển khai đầy đủ, nghiêm túc, chất lượng, đảm bảo tiến độ các nhiệm vụ, giải pháp, kiến nghị Quốc hội đã đề ra tại Nghị quyết số 74/2022/QH15 ngày 15 tháng 11 năm 2022 về tiếp tục đẩy mạnh việc thực hiện chính sách, pháp luật về THTK, CLP”.

c) Các chỉ tiêu THTK, CLP trong các lĩnh vực phải được lượng hóa tối đa, phù hợp với tình hình thực tế, bảo đảm thực chất, có cơ sở cho việc đánh giá, kiểm tra, giám sát kết quả thực hiện theo quy định.

d) THTK, CLP phải gắn với tăng cường công tác thanh tra, kiểm tra, kiểm toán, giám sát, thúc đẩy cải cách hành chính, sắp xếp tổ chức bộ máy của hệ thống chính trị, phòng chống tham nhũng, tiêu cực.

3. Nhiệm vụ trọng tâm

Công tác THTK, CLP năm 2023 cần tập trung vào một số nhiệm vụ trọng tâm sau đây:

a) Thực hiện hiệu quả các nhiệm vụ, giải pháp theo Chương trình phục hồi và phát triển kinh tế - xã hội, phấn đấu thực hiện cao nhất các mục tiêu, nhiệm vụ phát triển kinh tế - xã hội năm 2023 đã được Quốc hội đề ra để góp phần đưa tổng sản phẩm trong nước (GDP) tăng khoảng 6,5%, quy mô GDP bình quân đầu người khoảng 4.400 USD/người.

b) Tập trung rà soát, ban hành đầy đủ các văn bản quy phạm pháp luật quy định chi tiết, hướng dẫn thi hành các Luật có liên quan đến công tác thực hành tiết kiệm, chống lãng phí; rà soát và ban hành các quy chuẩn, tiêu chuẩn quốc gia, đơn giá, định mức kinh tế - kỹ thuật trong đầu tư, xây dựng, dịch vụ công còn thiếu hoặc còn chồng chéo, mâu thuẫn; sửa đổi, bổ sung định mức chi tiêu công, tài sản công, xe công, khoán chi, khoán kinh phí sử dụng tài sản công; lao động, biên chế; quản lý, sử dụng tài nguyên, đất, khoáng sản.

c) Siết chặt kỷ luật, kỷ cương tài chính, ngân sách; thực hiện quyết liệt các giải pháp chống thất thu, chuyển giá, trốn thuế, thu hồi nợ thuế; kiểm soát chặt chẽ bội chi ngân sách nhà nước. Phấn đấu cân đối nguồn lực để thực hiện việc cải cách chính sách tiền lương, bảo hiểm xã hội theo các Nghị quyết số 27-NQ/TW và Nghị quyết số 28-NQ/TW của Hội nghị Trung ương 7 (Khóa XII). Quán triệt nguyên tắc công khai, minh bạch và yêu cầu thực hiện tiết kiệm triệt để, chống lãng phí ngay từ khâu xác định nhiệm vụ, đảm bảo việc thực hiện các nhiệm vụ thống nhất từ khâu lập dự toán đến triển khai phân bổ, quản lý, sử dụng ngân sách nhà nước; điều hành chi ngân sách nhà nước chặt chẽ, tiết kiệm, hiệu quả; cắt giảm các khoản chi chưa thực sự cần thiết. Thực hiện rà soát toàn bộ các khoản chi chuyển nguồn ngân sách nhà nước đến ngày 31 tháng 12 năm 2021 để hủy bỏ, thu hồi về ngân sách nhà nước các khoản chuyển nguồn không có nhu cầu sử dụng hoặc quá thời gian giải ngân theo quy định.

d) Tăng cường quản lý, sử dụng vốn đầu tư công; các cấp, các ngành quyết liệt thực hiện các nhiệm vụ, giải pháp giải ngân kế hoạch vốn đầu tư công, coi đây là nhiệm vụ chính trị hàng đầu trong năm 2023; tập trung tháo gỡ khó khăn, vướng mắc cả về thể chế, cơ chế, chính sách, trên nguyên tắc cấp nào ban hành, cấp đó phải tháo gỡ, trường hợp vượt quá thẩm quyền, báo cáo cấp trên trực tiếp. Tăng cường phối hợp giữa các bộ, cơ quan trung ương, địa phương, cơ quan, đơn vị, bảo đảm hiệu quả, thực chất trong xử lý công việc.

đ) Đẩy mạnh triển khai thi hành có hiệu quả Luật Quản lý, sử dụng tài sản công; rà soát, hoàn thiện các văn bản quy định chi tiết và hướng dẫn Luật tạo cơ sở pháp lý đồng bộ, thống nhất, thuận lợi trong tổ chức thực hiện cho các cơ quan, tổ chức, đơn vị.

e) Tăng cường quản lý, khai thác, sử dụng hiệu quả đất đai, tài nguyên, khoáng sản, trong đó, tập trung hoàn thiện thể chế, chính sách về quản lý và sử dụng đất đồng bộ và phù hợp với thể chế phát triển nền kinh tế thị trường định hướng xã hội chủ nghĩa. Nguồn lực đất đai được quản lý, khai thác, sử dụng bảo đảm tiết kiệm, bền vững, hiệu quả cao nhất; đáp ứng yêu cầu đẩy mạnh công nghiệp hoá, hiện đại hoá công bằng và ổn định xã hội; bảo đảm quốc phòng, an ninh; bảo vệ môi trường, thích ứng với biến đổi khí hậu; tạo động lực để nước ta trở thành nước phát triển có thu nhập cao.

g) Đổi mới và nâng cao hiệu quả doanh nghiệp nhà nước. Đẩy mạnh cơ cấu lại, cổ phần hóa, thoái vốn; nâng cao hiệu quả đầu tư vốn nhà nước tại doanh nghiệp.

h) Nâng cao nhận thức của các cấp, các ngành, các cán bộ, công chức, viên chức trong chỉ đạo điều hành và tổ chức thực hiện các chỉ tiêu, giải pháp về THTK, CLP. Tăng cường công tác phổ biến, tuyên truyền cũng như thanh tra, kiểm tra về THTK, CLP gắn với cơ chế khen thưởng, kỷ luật kịp thời nhằm tạo sự chuyển biến rõ nét về nhận thức và tổ chức thực hiện ở các cơ quan, đơn vị.

II. MỘT SỐ CHỈ TIÊU TIẾT KIỆM, CHỐNG LÃNG PHÍ TRONG CÁC LĨNH VỰC

THTK, CLP năm 2023 được thực hiện trên tất cả các lĩnh vực theo quy định của Luật THTK, CLP và pháp luật chuyên ngành có liên quan, trong đó tập trung vào một số lĩnh vực cụ thể sau:

1. Trong quản lý, sử dụng kinh phí chi thường xuyên của ngân sách nhà nước

a) Trong năm 2023, thực hiện siết chặt kỷ luật tài khóa - ngân sách nhà nước; bảo đảm chi ngân sách nhà nước tiết kiệm, hiệu quả và theo đúng dự toán được Quốc hội thông qua, trong đó chú trọng các nội dung sau:

- Cắt giảm các khoản chi chưa thực sự cần thiết, triệt để tiết kiệm các khoản chi thường xuyên, đặc biệt là chi mua sắm công, đi công tác trong và ngoài nước, sử dụng xe ô tô công, tổ chức hội nghị, hội thảo, nghiên cứu, khảo sát, tiết kiệm điện, xăng dầu,… để dành nguồn tăng chi đầu tư phát triển và chi các nhiệm vụ cấp bách khác. Thực hiện tiết kiệm 10% dự toán chi thường xuyên tăng thêm năm 2023 (trừ các khoản tiền lương, phụ cấp, đóng góp theo lương, các khoản có tính chất lương và các khoản chi cho con người theo chế độ) đối với các bộ, cơ quan trung ương; tiết kiệm 10% dự toán chi thường xuyên năm 2023 (trừ các khoản tiền lương, phụ cấp, đóng góp theo lương, các khoản có tính chất lương và các khoản chi cho con người theo chế độ), 70% nguồn tăng thu thực hiện của ngân sách địa phương so với dự toán năm 2022 để tạo nguồn cải cách tiền lương theo quy định.

- Kiểm soát chặt chẽ công tác phân bổ, quản lý, sử dụng các khoản chi ngân sách nhà nước.

b) Tiếp tục đổi mới hệ thống tổ chức và quản lý, nâng cao chất lượng, hiệu quả hoạt động đơn vị sự nghiệp công lập theo tinh thần Nghị quyết số 19-NQ/TW ngày 25 tháng 10 năm 2017 của Hội nghị lần thứ 6 Ban Chấp hành Trung ương Đảng khóa XII về tiếp tục đổi mới hệ thống tổ chức và quản lý, nâng cao chất lượng và hiệu quả hoạt động của các đơn vị sự nghiệp công lập để từng bước giảm chi hỗ trợ từ ngân sách nhà nước cho các đơn vị sự nghiệp công lập theo lộ trình, nâng cao hiệu quả chi ngân sách nhà nước cho đơn vị sự nghiệp công lập để cơ cấu lại ngân sách nhà nước, cải cách tiền lương và nâng cao thu nhập của viên chức trong đơn vị sự nghiệp công lập.

2. Trong quản lý, sử dụng vốn đầu tư công

a) Việc phân bổ vốn đầu tư công năm 2023 bảo đảm tập trung, có trọng tâm, trọng điểm, phù hợp với khả năng cân đối vốn đầu tư công, khả năng thực hiện và giải ngân của dự án; đảm bảo hoàn thiện đầy đủ các thủ tục đầu tư của dự án và tuân thủ thời gian bố trí vốn thực hiện dự án nhóm A, B, C theo quy định của Luật Đầu tư công; tuân thủ điều kiện, thứ tự ưu tiên quy định trong Luật Đầu tư công, Nghị quyết của Quốc hội, Nghị quyết của Ủy ban Thường vụ Quốc hội, bố trí đủ vốn cho các nhiệm vụ, dự án thuộc Chương trình phục hồi và phát triển kinh tế - xã hội theo quy định tại tiết đ điểm 1.2 khoản 1 Điều 3 của Nghị quyết số 43/2022/QH15 ngày 11 tháng 01 năm 2022 của Quốc hội về chính sách tài khóa, tiền tệ hỗ trợ Chương trình phục hồi và phát triển kinh tế - xã hội; ưu tiên thanh toán đủ số nợ đọng xây dựng cơ bản (nếu có), thu hồi toàn bộ số vốn ứng trước còn lại phải thu hồi trong Kế hoạch đầu tư công trung hạn giai đoạn 2021 - 2025; bố trí đủ vốn cho các dự án đã hoàn thành bàn giao đưa vào sử dụng trước năm 2023, vốn đối ứng các dự án ODA và vốn vay ưu đãi nước ngoài, vốn ngân sách nhà nước tham gia vào các dự án PPP, nhiệm vụ chuẩn bị đầu tư, nhiệm vụ quy hoạch; các dự án quan trọng quốc gia, dự án kết nối, có tác động liên vùng có ý nghĩa thúc đẩy phát triển kinh tế - xã hội nhanh, bền vững; sau khi bố trí đủ vốn cho các nhiệm vụ nêu trên, số vốn còn lại bố trí cho các dự án khởi công mới đủ thủ tục đầu tư.

b) Tăng cường kỷ luật, kỷ cương trong giải ngân vốn đầu tư công, xử lý nghiêm các trường hợp vi phạm, cản trở làm chậm tiến độ giao vốn, giải ngân vốn; cá thể hóa trách nhiệm người đứng đầu trong trường hợp giải ngân chậm, gắn với đánh giá mức độ hoàn thành nhiệm vụ được giao. Rà soát, tổng hợp, phân loại và xây dựng kế hoạch, lộ trình để có phương án xử lý dứt điểm khó khăn, vướng mắc, đặc biệt là các dự án quan trọng quốc gia, các dự án trọng điểm, dự án sử dụng vốn ODA không hiệu quả, chậm tiến độ, điều chuyển vốn đầu tư đối với các dự án chậm tiến độ, không giải ngân được hoặc thừa vốn. Khẩn trương đưa các dự án hoàn thành hoặc cơ bản hoàn thành vào khai thác, sử dụng.

c) Rà soát các khoản tạm ứng đảm bảo việc sử dụng vốn tạm ứng đúng mục đích, đúng đối tượng theo quy định của hợp đồng và quy định pháp luật; hoàn thành nghiệm thu khối lượng để thực hiện thu hồi số vốn đã tạm ứng theo đúng thời hạn đã được quy định tại Nghị định số 99/2021/NĐ-CP ngày 11 tháng 11 năm 2021 của Chính phủ quy định về quản lý, thanh toán, quyết toán dự án sử dụng vốn đầu tư công. Tăng cường kiểm tra việc tạm ứng hợp đồng, tạm ứng theo dự toán được cấp có thẩm quyền, kịp thời phát hiện và có biện pháp xử lý việc sử dụng vốn tạm ứng không đúng quy định của chủ đầu tư, nhà thầu, đơn vị cung ứng.

3. Trong quản lý, sử dụng tài sản công

a) Đẩy nhanh tiến độ rà soát, sắp xếp lại tài sản công, đặc biệt là đối với các cơ sở nhà, đất theo quy định tại Nghị định số 167/2017/NĐ-CP ngày 31 tháng 12 năm 2017 của Chính phủ về sắp xếp lại, xử lý tài sản công, Nghị định số 67/2021/NĐ-CP sửa đổi, bổ sung một số điều của Nghị định số 167/2017/NĐ-CP ; có giải pháp xử lý cơ bản các cơ sở nhà, đất bị lấn chiếm, có tranh chấp, sử dụng sai mục đích, thiếu hồ sơ pháp lý chứng minh nguồn gốc. Kiểm tra việc thực hiện phương án sắp xếp các cơ sở đã được phê duyệt, nhất là các cơ sở phải thu hồi, đấu giá. Đẩy nhanh tiến độ sắp xếp xử lý nhà, đất, tài sản ở các cơ quan, đơn vị sau sáp nhập và phê duyệt phương án sắp xếp lại, xử lý nhà, đất theo quy định, không để lãng phí, sai phạm, lấn chiếm, chuyển đổi, sử dụng sai mục đích hoặc để hoang hóa.

b) Tiếp tục rà soát, hoàn thiện đồng bộ hệ thống văn bản quy phạm pháp luật về quản lý, sử dụng tài sản công, trong đó tập trung sửa đổi, bổ sung, ban hành mới các văn bản quy định cụ thể việc quản lý, sử dụng và khai thác đối với một số loại tài sản kết cấu hạ tầng theo quy định của Luật Quản lý, sử dụng tài sản công và các quy định pháp luật chuyên ngành có liên quan, làm cơ sở để tổ chức khai thác có hiệu quả nguồn lực tài chính từ các loại tài sản này.

c) Rà soát, hoàn thiện tiêu chuẩn, định mức về quản lý, sử dụng tài sản công làm cơ sở lập kế hoạch, dự toán, quản lý, bố trí sử dụng, xử lý tài sản công theo đúng quy định; trong đó tập trung sửa đổi, hoàn thiện định mức xe ô tô công cho phù hợp với thực tiễn, đảm bảo tiết kiệm, chống lãng phí trong quản lý, sử dụng tài sản công gắn với nâng cao hiệu quả sử dụng xe ô tô công.

d) Xây dựng Đề án tổng kiểm kê tài sản công tại các cơ quan, tổ chức, đơn vị; tài sản kết cấu hạ tầng do Nhà nước đầu tư, quản lý, đảm bảo trước năm 2025 hoàn thành việc tổng kiểm kê tài sản công.

4. Trong quản lý, khai thác, sử dụng tài nguyên

Thực hiện quản lý, khai thác, sử dụng tài nguyên tiết kiệm, hiệu quả theo các mục tiêu, chỉ tiêu của Chương trình tổng thể về THTK, CLP của Chính phủ giai đoạn 2021 - 2025, trong đó tập trung quản lý chặt chẽ, nâng cao hiệu quả sử dụng, phát huy nguồn lực kinh tế, tài chính từ đất đai cho phát triển kinh tế với các chỉ tiêu cụ thể sau:

a) Hoàn thành sửa đổi Luật Đất đai năm 2013 và một số luật liên quan, bảo đảm tính đồng bộ, thống nhất theo các định hướng tại Nghị quyết số 18-NQ/TW ngày 16 tháng 6 năm 2022, Hội nghị lần thứ năm Ban Chấp hành Trung ương Đảng khóa XIII về tiếp tục đổi mới, hoàn thiện thể chế, chính sách, nâng cao hiệu lực, hiệu quả quản lý và sử dụng đất, tạo động lực đưa nước ta trở thành nước phát triển có thu nhập cao nhằm hạn chế tiêu cực, tham nhũng, lãng phí trong quản lý, sử dụng đất đai.

b) Nghiên cứu giải pháp tăng cường cải tạo, bảo vệ môi trường đất, đặc biệt đối với đất sản xuất nông nghiệp bị thoái hóa, ngăn ngừa, giảm thiểu thoái hóa đất, ô nhiễm đất, nghiên cứu chính sách hỗ trợ người dân phục hồi đất hoang hóa, đất bị thoái hóa do ảnh hưởng của quá trình sản xuất.

c) Điều tra, khai thác hợp lý diện tích đất chưa sử dụng, đất bãi bồi ven sông, ven biển cho phát triển rừng, phát triển cây xanh trong đô thị và khu công nghiệp.

d) Đẩy mạnh tiến độ xây dựng quy hoạch, kế hoạch sử dụng đất đảm bảo trong năm 2023 hoàn thành việc phê duyệt quy hoạch sử dụng đất giai đoạn 2021 - 2030, kế hoạch sử dụng đất 5 năm 2021 - 2025.

đ) Đề xuất các giải pháp xử lý dứt điểm các dự án không đưa đất vào sử dụng, chậm tiến độ sử dụng đất theo đúng quy định pháp luật, bảo đảm công khai, minh bạch, công bằng, hài hòa lợi ích giữa nhà nước, nhà đầu tư, giảm khiếu kiện, khiếu nại để sớm đưa các dự án vào khai thác, sử dụng, phát huy hiệu quả, không gây thất thoát, lãng phí. Rà soát công tác đền bù, bồi thường, giải phóng mặt bằng tại một số địa phương để đề xuất các giải pháp đẩy nhanh tiến độ thực hiện công tác này, góp phần nâng cao hiệu quả quản lý, sử dụng đất.

5. Trong quản lý, sử dụng vốn và tài sản của Nhà nước tại doanh nghiệp

a) Đánh giá và có giải pháp cụ thể để đẩy nhanh việc cơ cấu lại doanh nghiệp trên cơ sở bám sát các quy định tại Quyết định số 360/QĐ-TTg ngày 17 tháng 3 năm 2022 của Thủ tướng Chính phủ phê duyệt Đề án “Cơ cấu lại doanh nghiệp nhà nước, trọng tâm là tập đoàn kinh tế, tổng công ty nhà nước giai đoạn 2021 - 2025” và Quyết định số 22/2021/QĐ-TTg ngày 02 tháng 7 năm 2021 của Thủ tướng Chính phủ về Tiêu chí phân loại doanh nghiệp nhà nước, doanh nghiệp có vốn nhà nước thực hiện chuyển đổi sở hữu, sắp xếp lại, thoái vốn giai đoạn 2021 - 2025 và Quyết định số 1479/QĐ-TTg ngày 29 tháng 11 năm 2022 của Thủ tướng Chính phủ phê duyệt Kế hoạch sắp xếp lại doanh nghiệp nhà nước, doanh nghiệp có vốn nhà nước giai đoạn 2022 - 2025.

b) Xây dựng lộ trình, kế hoạch, giải pháp cụ thể giải quyết các dự án sử dụng vốn nhà nước thua lỗ tại các doanh nghiệp. Làm rõ trách nhiệm và xử lý nghiêm đối với tổ chức, cá nhân, nhất là người đứng đầu doanh nghiệp làm ăn không hiệu quả, gây thua lỗ, thất thoát, lãng phí trong quản lý, sử dụng nguồn vốn nhà nước tại doanh nghiệp và các nguồn vốn nhà nước khác.

c) Thực hiện tiết kiệm chi phí, tối ưu hóa các nguồn lực về vốn, đất đai… của doanh nghiệp nhà nước, giải quyết dứt điểm tình trạng đầu tư dàn trải, ngoài ngành, lĩnh vực kinh doanh chính thông qua việc thoái vốn, bảo đảm các doanh nghiệp nhà nước tập trung vào lĩnh vực kinh doanh chính.

d) Thực hiện quản lý, sử dụng hiệu quả nguồn thu từ cổ phần hóa, thoái vốn nhà nước tại doanh nghiệp đảm bảo tiết kiệm, hiệu quả theo đúng quy định của Chính phủ về quản lý sử dụng nguồn thu từ chuyển đổi sở hữu doanh nghiệp, đơn vị sự nghiệp công lập, nguồn thu từ chuyển nhượng vốn nhà nước và chênh lệch vốn chủ sở hữu lớn hơn vốn điều lệ tại doanh nghiệp.

6. Trong tổ chức bộ máy, quản lý, sử dụng lao động và thời gian lao động

a) Hoàn thành việc rà soát, sắp xếp cơ cấu tổ chức các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ nhiệm kỳ 2021 - 2026 theo hướng tinh gọn, hiệu lực, hiệu quả gắn với tinh giản biên chế, cơ cấu lại và nâng cao chất lượng đội ngũ cán bộ công chức, viên chức.

b) Tiếp tục đẩy mạnh thực hiện tinh giản biên chế theo Nghị quyết Đại hội XIII của Đảng, đảm bảo mục tiêu giai đoạn 2021 - 2026, toàn hệ thống chính trị tinh giản ít nhất 5% biên chế cán bộ, công chức và ít nhất 10% biên chế viên chức hưởng lương từ ngân sách nhà nước theo Kết luận số 40-KL/TW ngày 18 tháng 7 năm 2022 của Bộ Chính trị về nâng cao hiệu quả công tác quản lý biên chế của hệ thống chính trị giai đoạn 2022 - 2026. Khắc phục tình trạng giảm biên chế cơ học, cào bằng, đảm bảo bố trí biên chế phù hợp với từng loại hình tổ chức và từng địa bàn.

c) Đẩy mạnh cải cách hành chính, nhất là cải cách thủ tục hành chính, gắn kết chặt chẽ với việc kiện toàn tổ chức, tinh giản biên chế, bảo đảm dân chủ, công khai, minh bạch, chuyên nghiệp, phục vụ nhân dân; xây dựng và phát triển Chính phủ điện tử hướng tới Chính phủ số theo mục tiêu, nhiệm vụ nêu tại Nghị quyết số 76/NQ-CP của Chính phủ về ban hành Chương trình tổng thể cải cách hành chính nhà nước giai đoạn 2021 - 2030 và Quyết định số 942/QĐ-TTg ngày 15 tháng 6 năm 2021 của Thủ tướng Chính phủ phê duyệt Chiến lược phát triển Chính phủ điện tử hướng tới Chính phủ số giai đoạn 2021 - 2025, định hướng đến năm 2030, Nghị quyết số 131/NQ-CP ngày 06 tháng 10 năm 2022 của Chính phủ về đẩy mạnh cải cách thủ tục hành chính và hiện đại hóa phương thức chỉ đạo, điều hành phục vụ người dân, doanh nghiệp.

III. GIẢI PHÁP THỰC HIỆN MỤC TIÊU, CHỈ TIÊU TIẾT KIỆM, CHỐNG LÃNG PHÍ

Để thực hiện các mục tiêu, chỉ tiêu, tiết kiệm, chống lãng phí năm 2023 cần bám sát các nhóm giải pháp nêu tại Chương trình tổng thể về THTK, CLP của Chính phủ giai đoạn 2021 - 2025. Trong đó, cần chú trọng vào các nhóm giải pháp sau đây:

1. Tăng cường công tác lãnh đạo, chỉ đạo về THTK, CLP

Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ và Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương trong phạm vi quản lý của mình có trách nhiệm chỉ đạo thống nhất việc thực hiện các mục tiêu, chỉ tiêu THTK, CLP năm 2023 theo định hướng, chủ trương của Đảng về THTK, CLP. Xây dựng kế hoạch thực hiện các mục tiêu, chỉ tiêu tiết kiệm trong từng lĩnh vực được giao phụ trách, trong đó cần phân công, phân cấp cụ thể, rõ ràng trách nhiệm của từng cơ quan, tổ chức, đơn vị trực thuộc, từng cán bộ, công chức, viên chức, gắn với công tác kiểm tra, đánh giá thường xuyên, đảm bảo việc thực hiện Chương trình đạt hiệu quả.

2. Đẩy mạnh công tác tuyên truyền, giáo dục nâng cao nhận thức về THTK, CLP

a) Đẩy mạnh thông tin, phổ biến pháp luật về THTK, CLP và các chủ trương, chính sách của Đảng và Nhà nước có liên quan đến THTK, CLP với các hình thức đa dạng nhằm nâng cao, thống nhất nhận thức, trách nhiệm về mục tiêu, yêu cầu, ý nghĩa của công tác THTK, CLP đối với các cơ quan, doanh nghiệp, tổ chức, cá nhân và toàn xã hội.

b) Các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương tích cực phối hợp chặt chẽ với Mặt trận Tổ quốc Việt Nam, các tổ chức chính trị - xã hội, cơ quan thông tấn, báo chí để thực hiện tuyên truyền, vận động về THTK, CLP đạt hiệu quả.

c) Kịp thời biểu dương, khen thưởng những gương điển hình trong THTK, CLP; thực hiện các biện pháp bảo vệ người cung cấp thông tin phát hiện lãng phí.

3. Tăng cường công tác tổ chức THTK, CLP trên các lĩnh vực, trong đó tập trung vào một số lĩnh vực sau:

a) Về quản lý ngân sách nhà nước

- Tổng kết, đánh giá việc thực hiện Luật Ngân sách nhà nước năm 2015 làm cơ sở đề xuất sửa đổi Luật và các văn bản pháp luật liên quan để đổi mới cơ chế phân cấp ngân sách nhà nước, cơ bản khắc phục tình trạng lồng ghép trong quản lý ngân sách nhà nước, tăng cường vai trò chủ đạo của ngân sách trung ương, đồng thời nâng cao tính chủ động cho các địa phương.

Tiếp tục đổi mới phương thức quản lý chi thường xuyên, tăng cường đấu thầu, đặt hàng, khoán kinh phí, khuyến khích phân cấp, phân quyền, giao quyền tự chủ cho các đơn vị sử dụng ngân sách nhà nước, gắn với tăng cường trách nhiệm của các bộ, ngành, địa phương và các đơn vị sử dụng ngân sách nhà nước, cá thể hóa trách nhiệm cá nhân trong quản lý, sử dụng ngân sách nhà nước và các nguồn lực tài chính công.

Tăng cường công tác thanh tra, kiểm tra, giám sát và công khai minh bạch việc sử dụng kinh phí chi thường xuyên của ngân sách nhà nước, nhất là đối với các lĩnh vực dễ phát sinh thất thoát, lãng phí.

- Sửa đổi, bổ sung Nghị định số 60/2021/NĐ-CP ngày 21 tháng 6 năm 2021 của Chính phủ quy định cơ chế tự chủ của đơn vị sự nghiệp công lập để tháo gỡ các vướng mắc trong việc thực hiện cơ chế tài chính của đơn vị sự nghiệp công lập.

Đổi mới hệ thống tổ chức, quản lý và nâng cao hiệu quả hoạt động để tinh gọn đầu mối, khắc phục chồng chéo, dàn trải và trùng lắp về chức năng, nhiệm vụ của các đơn vị sự nghiệp công lập, góp phần nâng cao chất lượng hoạt động cung ứng các dịch vụ sự nghiệp công, đáp ứng yêu cầu của xã hội.

b) Về quản lý, sử dụng vốn đầu tư công

Rà soát và đề xuất sửa đổi, bổ sung các quy định tại các Luật liên quan đến việc thực hiện dự án đầu tư công, giải ngân vốn đầu tư công đang còn bất cập, thiếu đồng bộ, không phù hợp, gây khó khăn, vướng mắc trong thực tiễn.

Nâng cao chất lượng công tác chuẩn bị dự án đầu tư, lựa chọn các tư vấn có năng lực, kinh nghiệm, tiềm lực thực sự, khắc phục tối đa tình trạng điều chỉnh dự án khi đang triển khai, gây mất thời gian và làm chậm tiến độ giải ngân vốn.

Đẩy mạnh công tác số hóa quy trình phân bổ kế hoạch vốn đầu tư công, lập dự toán và công tác kế toán ngân sách nhà nước, quyết toán ngân sách nhà nước, quản lý, giám sát vốn đầu tư công; hiện đại hóa công tác quản lý vốn đầu tư công như kết nối thông tin, chương trình, báo cáo liên thông, chia sẻ dữ liệu giữa các cơ quan liên quan.

Công khai, minh bạch thông tin và tăng cường giám sát, đánh giá, kiểm tra, thanh tra trong quá trình thực hiện các dự án đầu tư công, tháo gỡ khó khăn, vướng mắc cho các dự án để thúc đẩy giải ngân vốn. Có chế tài xử lý nghiêm theo quy định pháp luật các chủ đầu tư, Ban quản lý dự án, tổ chức, cá nhân cố tình gây khó khăn, cản trở, làm chậm tiến độ giao vốn, thực hiện và giải ngân vốn đầu tư công. Thay thế kịp thời những cán bộ, công chức, viên chức yếu kém về năng lực, trì trệ, gây nhũng nhiễu, tiêu cực, kiên quyết xử lý các hành vi tiêu cực trong quản lý đầu tư công.

c) Về quản lý, sử dụng tài sản công

Tiếp tục thực hiện hiện đại hóa công tác quản lý tài sản công và nâng cấp Cơ sở dữ liệu Quốc gia về tài sản công để từng bước cập nhật, quản lý thông tin của tất cả các tài sản công được quy định tại Luật Quản lý, sử dụng tài sản công.

Tăng cường công tác kiểm tra, giám sát việc quản lý, sử dụng tài sản công tại các cơ quan, tổ chức, đơn vị; kiểm điểm trách nhiệm, xử lý nghiêm theo quy định của pháp luật liên quan đối với các tổ chức, cá nhân thuộc thẩm quyền quản lý có hành vi vi phạm.

d) Về quản lý tài nguyên, khoáng sản, đặc biệt là đối với đất đai

Hoàn thiện hệ thống pháp luật đất đai và pháp luật khác có liên quan theo định hướng tại Nghị quyết 18-NQ/TW. Nghiên cứu xây dựng các tiêu chí, định mức, quy định về suất đầu tư trên một đơn vị diện tích để bảo đảm quản lý, sử dụng tiết kiệm, hiệu quả tài nguyên đất đai.

Tăng cường ứng dụng công nghệ thông tin việc lập và giám sát thực hiện quy hoạch, kế hoạch sử dụng đất; dự báo, cảnh báo điều tra, đánh giá, ứng phó với biến đổi khí hậu, quản lý tài nguyên và bảo vệ môi trường đáp ứng yêu cầu quản lý đất đai và hội nhập quốc tế. Đẩy nhanh chuyển đổi số, hướng tới mục tiêu hoàn thiện, kết nối liên thông hệ thống thông tin đất đai và cơ sở dữ liệu đất đai quốc gia tập trung, thống nhất, trong đó có dữ liệu về quy hoạch quản lý cập nhật biến động đến từng thửa đất, công bố công khai, minh bạch, tạo điều kiện cho người dân, doanh nghiệp tiếp cận thông tin dữ liệu về quy hoạch, kế hoạch sử dụng đất.

Công khai, minh bạch quy hoạch, kế hoạch sử dụng đất theo quy định của pháp luật bằng các hình thức phù hợp với từng nhóm đối tượng.

Tăng cường công tác kiểm tra, thanh tra; rà soát, đánh giá đúng thực trạng các dự án không đưa đất vào sử dụng, chậm tiến độ sử dụng đất trên phạm vi toàn quốc, đề xuất các giải pháp nhằm tháo gỡ khó khăn, vướng mắc; tổ chức chỉ đạo, thực hiện có hiệu quả các giải pháp, biện pháp tháo gỡ khó khăn, vướng mắc nhằm giải phóng nguồn lực đất đai, đẩy nhanh việc thực hiện dự án, đưa đất đai vào sử dụng có hiệu quả, phát huy nguồn lực đất đai.

đ) Về quản lý vốn, tài sản nhà nước đầu tư tại doanh nghiệp

Nghiên cứu, sửa đổi, bổ sung Luật Quản lý, sử dụng vốn nhà nước đầu tư vào sản xuất, kinh doanh tại doanh nghiệp và các văn bản quy phạm pháp luật liên quan đến cổ phần hóa, thoái vốn nhà nước tại doanh nghiệp, bảo đảm đồng bộ, thống nhất, khả thi; hoàn thiện các quy định của pháp luật về xác định giá trị doanh nghiệp, việc tính giá trị quyền sử dụng đất vào giá trị doanh nghiệp khi cổ phần hóa, thoái vốn nhà nước tại doanh nghiệp.

Nâng cao năng lực tài chính, đổi mới công tác quản trị, công nghệ, cơ cấu sản phẩm, ngành nghề sản xuất kinh doanh, chiến lược phát triển, cải tiến quy trình sản xuất để nâng cao chất lượng sản phẩm và năng lực cạnh tranh của doanh nghiệp nhà nước.

Doanh nghiệp nhà nước, trọng tâm là các tập đoàn kinh tế, tổng công ty nhà nước khẩn trương thực hiện việc sắp xếp lại, xử lý nhà, đất thuộc phạm vi quản lý theo Đề án “Cơ cấu lại doanh nghiệp nhà nước, trọng tâm là tập đoàn kinh tế, tổng công ty nhà nước giai đoạn 2021 - 2025” đã được Thủ tướng Chính phủ phê duyệt tại Quyết định số 360/QĐ-TTg ngày 17 tháng 3 năm 2022.

Đẩy mạnh thực hiện công tác thanh tra, kiểm tra, kiểm toán, giám sát việc thực hiện chính sách, pháp luật về cổ phần hóa doanh nghiệp nhà nước theo kế hoạch, không để xảy ra tiêu cực, thất thoát vốn, tài sản nhà nước.

e) Về tổ chức bộ máy, quản lý lao động, thời gian lao động

Khẩn trương xây dựng hệ thống vị trí việc làm và cơ cấu ngạch công chức theo Nghị định số 62/2020/NĐ-CP ngày 01 tháng 6 năm 2020 của Chính phủ, vị trí việc làm viên chức theo Nghị định số 106/2020/NĐ-CP ngày 10 tháng 9 năm 2020 của Chính phủ làm căn cứ cho việc quản lý, sử dụng công chức, viên chức, thời gian làm việc hiệu quả và làm cơ sở để thực hiện cải cách tiền lương.

Đổi mới mạnh mẽ quy trình, phương thức và thực hiện công khai, minh bạch, dân chủ trong quy hoạch, đề bạt, bổ nhiệm, luân chuyển cán bộ và tuyển dụng, sử dụng, quản lý công chức, viên chức để thu hút được người có năng lực, trình độ, nâng cao chất lượng đội ngũ cán bộ, công chức, viên chức và giảm khiếu nại, tố cáo liên quan đến cán bộ và công tác cán bộ.

4. Tăng cường kiểm tra, thanh tra, xử lý nghiêm các vi phạm quy định về THTK, CLP

Đẩy mạnh và nâng cao hiệu quả công tác thanh tra, kiểm tra việc xây dựng và thực hiện Chương trình THTK, CLP; thanh tra, kiểm tra việc thực hiện các quy định của pháp luật trong các lĩnh vực theo quy định của Luật THTK, CLP và pháp luật chuyên ngành. Các bộ, ngành, địa phương xây dựng kế hoạch kiểm tra, thanh tra cụ thể liên quan đến THTK, CLP, trong đó cần chú trọng:

a) Xây dựng kế hoạch và tập trung tổ chức kiểm tra, thanh tra một số nội dung, lĩnh vực trọng điểm, cụ thể cần tập trung vào các lĩnh vực sau:

- Quản lý và sử dụng đất, trọng tâm là các dự án không đưa đất vào sử dụng, chậm sử dụng đất;

- Tình hình triển khai thực hiện các dự án đầu tư công;

- Quản lý kinh phí sự nghiệp khoa học công nghệ;

- Việc biên soạn và xuất bản sách giáo khoa.

b) Thủ trưởng các đơn vị chủ động xây dựng kế hoạch kiểm tra, tự kiểm tra tại đơn vị mình và chỉ đạo công tác kiểm tra, tự kiểm tra tại đơn vị cấp dưới trực thuộc.

c) Đối với những vi phạm được phát hiện qua công tác thanh tra, kiểm tra, thủ trưởng đơn vị phải khắc phục, xử lý hoặc đề xuất, kiến nghị cơ quan có thẩm quyền có biện pháp xử lý. Thực hiện nghiêm các quy định pháp luật về xử lý vi phạm đối với người đứng đầu cơ quan, đơn vị và các cá nhân để xảy ra lãng phí. Quyết liệt trong xử lý kết quả thanh tra, kiểm tra để thu hồi tối đa cho Nhà nước tiền, tài sản bị vi phạm, chiếm đoạt, sử dụng sai quy định, lãng phí phát hiện qua công tác thanh tra, kiểm tra.

IV. TỔ CHỨC THỰC HIỆN

1. Căn cứ Chương trình tổng thể về THTK, CLP năm 2023, Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương xây dựng Chương trình THTK, CLP năm 2023 của bộ, ngành, địa phương mình chậm nhất sau 30 ngày kể từ ngày Chương trình tổng thể về THTK, CLP năm 2023 được ban hành; chỉ đạo việc xây dựng Chương trình THTK, CLP năm 2023 của các cấp, các cơ quan, đơn vị trực thuộc. Trong Chương trình THTK, CLP của mỗi cấp, mỗi ngành cần cụ thể hóa các mục tiêu, chỉ tiêu tiết kiệm và yêu cầu chống lãng phí của cấp mình, ngành mình; xác định rõ nhiệm vụ, lĩnh vực trọng tâm, trọng điểm thuộc địa bàn, lĩnh vực phụ trách cũng như những giải pháp, biện pháp cần thực hiện trong năm 2023 để đạt được mục tiêu, chỉ tiêu tiết kiệm đã đặt ra.

2. Các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương chỉ đạo quán triệt về việc:

a) Xác định cụ thể trách nhiệm của người đứng đầu cơ quan, tổ chức khi để xảy ra lãng phí tại cơ quan, đơn vị mình; trách nhiệm trong việc thực hiện kiểm tra, kịp thời làm rõ lãng phí khi có thông tin phát hiện để xử lý nghiêm đối với các tổ chức, cá nhân trong phạm vi quản lý có hành vi lãng phí.

b) Tăng cường công tác thanh tra, kiểm tra việc xây dựng và thực hiện Chương trình THTK, CLP năm 2023; thanh tra, kiểm tra việc thực hiện các quy định của pháp luật về THTK, CLP và việc thực hiện Chương trình THTK, CLP trong phạm vi quản lý.

c) Tăng cường phối hợp với Mặt trận Tổ quốc Việt Nam và các tổ chức đoàn thể trong việc thực hiện Chương trình này. Thực hiện công khai trong THTK, CLP đặc biệt là công khai các hành vi lãng phí và kết quả xử lý hành vi lãng phí; nâng cao chất lượng và đổi mới cách thức đánh giá kết quả THTK, CLP đảm bảo so sánh một cách thực chất và minh bạch kết quả THTK, CLP giữa các cơ quan, đơn vị góp phần nâng cao hiệu quả công tác này.

d) Thực hiện báo cáo tình hình và kết quả thực hiện Chương trình tổng thể của Chính phủ về THTK, CLP và Chương trình THTK, CLP cụ thể của bộ, ngành, địa phương mình và thực hiện đánh giá kết quả THTK, CLP trong chi thường xuyên theo tiêu chí quy định tại Thông tư số 129/2017/TT-BTC ngày 04 tháng 12 năm 2017 của Bộ Tài chính. Trên cơ sở đó, xây dựng Báo cáo THTK, CLP hàng năm để gửi Bộ Tài chính tổng hợp, trình Chính phủ báo cáo Quốc hội tại kỳ họp đầu năm sau đúng thời hạn theo quy định của pháp luật. Riêng đối với các bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, tổng hợp thêm kết quả THTK, CLP trong lĩnh vực quản lý nhà nước của mình để gửi Bộ Tài chính.

3. Tổng Giám đốc Công ty trách nhiệm hữu hạn một thành viên do Nhà nước nắm giữ 100% vốn điều lệ được Thủ tướng Chính phủ quyết định thành lập có trách nhiệm tổ chức xây dựng và thực hiện Chương trình THTK, CLP năm 2023 của đơn vị mình, đảm bảo phù hợp với Chương trình THTK, CLP năm 2023 của Chính phủ và gửi về Bộ Tài chính để theo dõi chung, trong đó, cụ thể hóa các mục tiêu, chỉ tiêu tiết kiệm và yêu cầu chống lãng phí trong quản lý, sử dụng vốn và tài sản của Nhà nước; xác định rõ nhiệm vụ trọng tâm và những giải pháp, biện pháp cần thực hiện để đạt được mục tiêu, chỉ tiêu tiết kiệm đã đặt ra trong năm 2023.

4. Bộ Tài chính thực hiện hướng dẫn, kiểm tra, thanh tra việc triển khai, thực hiện các quy định của pháp luật về THTK, CLP của các bộ, ngành, địa phương, trong đó có kiểm tra, thanh tra việc triển khai thực hiện Chương trình tổng thể của Chính phủ về THTK, CLP và việc xây dựng, ban hành Chương trình THTK, CLP của các bộ, ngành, địa phương theo kế hoạch thanh tra, kiểm tra được phê duyệt.

HEREBY DECIDES:

Article 1. The overall program of the Government for thrift practice and wastefulness prevention in 2023 is promulgated together with this Decision.

Article 2. This Decision takes effect from the date on which it is signed.

Article 3. The Ministers, Heads of the Ministerial-Level agencies, Heads of the Governmental agencies, the Presidents of the People's Committees of provinces and General Directors of single-member limited liability companies 100% of charter capital of which is held by the State under establishment of the Prime Minister shall be responsible for the implementation of this Decision.

THRIFT PRACTICE AND WASTEFULNESS PREVENTION IN 2023
(Issued together with Decision No. 1658/QD-TTg dated December 30, 2022 of the Prime Minister)

I. OBJECTIVES, REQUIREMENTS, KEY TASKS IN 2023

1. Objectives

The objectives of thrift practice and wastefulness prevention in 2023 include synchronous and effective implementation of the objectives, tasks and solutions to thrift practice and wastefulness prevention in all sectors, development of thrift practice and wastefulness prevention into key and regular tasks of agencies, organizations and units, contribution to mobilization, allocation and use of resources in an effective manner for assurance about maintained macroeconomic stability, promotion of socio-economic recovery and development, enhancement of national defense and security, promotion of external activities, enhancement of anti-corruption and wastefulness prevention.

2. Requirements

a) Strictly follow requirements, tasks, targets and solutions in the overall program of the Government for thrift practice and wastefulness prevention in the 2021 - 2025 period and fulfil main socio-economic targets set out in the socio-economic development plan in 2023.

b) Be comprehensive and specific goal-oriented; focus on the theme of 2023 which is "full, strict and effective implementation and assurance about the progress of the tasks, solutions and recommendations set out by the National Assembly in Resolution No. 74/2022/QH15 dated November 15, 2022 on promotion of the implementation of policies and laws on thrift practice and wastefulness prevention".

c) Maximize quantification of thrift practice and wastefulness prevention criteria in the sectors, make sure that they are practical and reveal the true nature and have the basis for the evaluation, inspection and monitoring of the results of implementation in accordance with regulations.

d) Be associated with enhancement of inspection, examination, auditing and supervision, promotion of administrative reform, reorganization of the political system’s apparatus and anti-corruption.

The program for thrift practice and wastefulness prevention in 2023 shall focus on the following key tasks:

a) Effectively implement tasks and solutions under the socio-economic development and recovery program, strive to achieve socio-economic development objectives and tasks of 2023 proposed by the National Assembly in order to contribute to increase of about 6,5% in gross domestic product (GDP) and size of GDP per capita (about 4.400 USD/person).

b) Focus on review and promulgation of legal documents on elaboration and provision of guidance on the implementation of Laws related to thrift practice and wastefulness prevention; review and promulgate national regulations and standards, unit prices, economic-technical norms in investment, construction and public services that are needed, duplicated or conflicting; amend norms of public expenditure, public property, public vehicles, fixed expenditures and fixed funding for the use of public property; personnel and payrolls; management and use of natural resources, land and minerals.

c) Tighten discipline of finance and budget; strictly implement solutions to prevention of revenue loss, transfer pricing, tax evasion and collection of tax arrears; strictly control the state budget deficit. Strive to balance resources to carry out reform in the policies on salary and social insurance according to Resolutions No. 27-NQ/TW and Resolution No. 28-NQ/TW of the seventh plenary session of the 12th Central Executive Committee. Thoroughly grasp the principle of transparency and requirement for thorough thrift and wastefulness prevention right from the stage of identification of tasks to ensure uniform implementation of tasks from the stage of making of estimates to the stage of allocation, management and use of the state budget; strictly, thriftily and effectively control state budget expenditures; cut unnecessary expenses. Review all unused funds by December 31, 2021 to cancel and recover the funds that are not needed or not disbursed within the prescribed duration.

d) Strengthen management and use of public investment capital. Authorities at all levels shall strictly implement tasks and solutions to the plan for disbursement of public investment capital. Consider this as the most important political task of 2023. Focus on resolution to difficulties and obstacles in terms of institutions, mechanisms and policies. In principle, the authority promulgates institutions, mechanisms and policies as follows: Each authority shall resolve the difficulties and obstacles caused by their own policies. Issues that exceed an authority’s jurisdiction shall be reported to the superior authority. Strengthen cooperation between ministries, central and local authorities, agencies and units to handle works in an effective and practical manner.

dd) Promote the effective execution of the Law on management and use of public property; review and complete documents on elaboration and provision of guidance on the Law to create a synchronous and unified legal basis for convenient organization and implementation for agencies, organizations and units.

e) Strengthen management, extraction and use of land, natural resources and minerals in an effective manner. In which, focus on completion of institutions and policies on synchronous management and use of land in conformity with institutions on the development of socialist-oriented market economy. Management, extraction and use of land resources shall ensure the highest efficiency, sustainability and thriftiness; fulfillment of requirements for promotion of fair industrialization, modernization and social stability; national defense and security; environmental protection and adaptation to climate change; creation of the driving force for development of Vietnam into a developed and high-income country.

g) Innovate and improve the effectiveness of state-owned enterprises. Promote restructuring, equitization and divestment; improve the effectiveness of state capital investment in enterprises.

h) Raise the awareness of authorities at all levels, central authorities, officials and public employees about direction, operation and organization the implementation of targets and solutions to thrift practice and wastefulness prevention. Strengthen dissemination, inspection and examination of thrift practice and wastefulness prevention in association with mechanism for prompt reward and discipline to create important change in awareness and organization of implementation at agencies and units.

Thrift practice and wastefulness prevention in 2023 will be carried out in all sectors as prescribed by the Law on thrift practice and wastefulness prevention and relevant specialized laws. In which, thrift practice and wastefulness prevention will focus on some specific sectors as follows:

1. Management and use of recurrent expenditures of the state budget

a) In 2023, tighten state budget - fiscal discipline; ensure that the state budget expenditure is thrifty and effective according to the estimate approved by the National Assembly. In which, focus on the following contents:

- Cut unnecessary expenses, thoroughly save recurrent expenditures, especially expenditures on public procurement, domestic and foreign business trips, use of public cars, organization of conferences, seminars, meetings, research, survey, electricity and gasoline for increase in expenditures on development investment and other urgent tasks. Cut 10% of estimate for increase in recurrent expenditures of 2023 (except for salaries, allowances, salary-based contributions, salary-related expenditures and benefits) for ministries, central agencies; cut 10% of estimate for recurrent expenditures of 2023 (except for salaries, allowances, salary-based contributions, salary-related expenditures and benefits), 70% of the increase in realized revenues of the local- government budget compared to the estimate of 2022 as funds for reform of salary policies according to regulations.

- Strictly control the allocation, management and use of state budget expenditures.

b) Continue to innovate organization and management system, improve the quality and effectiveness of operation of public service providers under Resolution No. 19-NQ/TW dated October 25, 2017 of the 6^th Meeting of the 12^th Central Executive Committee of the Communist Party of Vietnam on innovation of organization and management system and improvement of the quality and effectiveness of operation of public service providers in order to gradually reduce expenditures on support from the state budget for public service providers according to the roadmap, improve the effectiveness of state budget expenditure for public service providers to restructure the state budget, reform salary policies and raise the income of public employees in the public service providers.

2. Management and use of public investment capital

a) The allocation of public investment capital of 2023 shall be focused, specific goal-oriented and consistent with the capacity to balance public investment capital, implement and disburse according to the project; complete all procedures for investment of the project and adhere to disbursement duration of groups A, B and C projects in accordance with regulations of the Law on Public Investment; follow conditions and the order of priority specified in the Law on Public Investment, the Resolution of the National Assembly, the Resolution of the Standing Committee of National Assembly, allocate sufficient capital for tasks and projects under the program for socio-economic development and recovery under the regulations of Point 1.2.dd, Clause 1, Article 3 of the National Assembly's Resolution No. 43/2022/QH15 dated January 11, 2022 on fiscal and monetary policies for supporting socio-economic recovery and development program; prioritize full payment for outstanding debts accruing from capital construction activities (if any) and recovery of the remaining advance funding that must be recovered in the medium-term public investment plan for the 2021-2025 period; allocate sufficient capital for projects that have been completed, handed over and implemented before 2023, reciprocal capital for investment projects using ODA and other preferential borrowed funds of foreign sponsors, state capital for participation in PPP projects, investment preparation and planning; promote rapid and sustainable economic-social development via projects of national importance, projects of interregional connection and impact. After allocation of sufficient capital for the above tasks, the remaining capital shall be allocated for new construction projects with all investment procedures.

b) Impose discipline in the disbursement of public investment capital, strictly handle violations and remove obstructions from the progress in capital allocation and disbursement; attribute responsibility of the head in case of slow disbursement and assess the level of completion of the assigned tasks. Review, synthesize, classify and develop the plan and roadmap to have the plan for complete handling of difficulties and obstacles to projects, especially projects of national importance, key projects and projects funded by ODA capital with ineffective use of the capital and slow progress, transfer of investment capital for projects with slow progress, projects whose capital is not disbursed or not completely used.  Expeditiously operate and use projects that have been completed or projects that have been basically completed.

3. Management and use of public property

a) Accelerate review and disposition of public property, especially for pieces of property according to regulations of Decree No. 167/2017/ND-CP dated December 31, 2017 of the Government on disposition of public property, Decree No. 67/2021/ND-CP on amendments to some Articles of Decree No. 167/2017/ND-CP; adopt solutions to handle pieces of property that are appropriated, under dispute, used for improper purposes or lacking legal documents to prove the origin.  Inspect the implementation of the approved plan on disposition of property, especially property subject to forfeiture and auction. Accelerate disposition of property in the post-merger agencies and units and approval for the plan for disposition of property according to regulations in order to avoid wastefulness, mistakes, appropriation, conversion, use for improper purposes or abandonment.

b) Continue to synchronous complete and review the system of legal documents on management and use of public property. In particular, focus on amendments and promulgation of new documents on elaboration of management and use of number of types of infrastructural property in accordance with the Law on management and use of public property and relevant specialized laws to serve as a basis for organization of effective operation of financial resources from such property.

c) Review and complete standards and norms on management and use of public property to serve as a basis for making of plans, estimates, management, allocation of disposition of public property in accordance with regulations. In particular, focus on amendments and completion of the norms of public cars in conformity with real context, assurance about thrift and wastefulness prevention in management and use of public property in association with improvement of the effectiveness of use of public cars.

d) Develop a scheme on the total stocktaking of public property at agencies, organizations and units; infrastructural property invested and managed by the State. Complete the total stocktaking of public property before 2025.

4. Management, extraction and use of resources

Thriftily and effectively use, manage and extract resources according to the objectives and targets of the overall program for thrift practice and wastefulness prevention of the Government for the 2021 – 2025 period. In particular, focus on strict management, improvement of the effectiveness of use and promotion of economic and financial resources from land for economic development with the following specific criteria:

a) Complete amendments to the 2013 Land Law and some relevant laws, ensure the uniformity and consistency in accordance with the orientations in Resolution No. 18-NQ/TW dated June 16, 2022 of the fifth plenum of the 13^th CPV Central Committee on “ongoing innovation and improvement in regulatory institutions and policies; enhancement of efficiency and effectiveness in management and use of land, serving as the driving force in developing our country into a high-income economy for anti-corruption and wastefulness prevention in management and use of land.

b) Research solutions to enhancement of the improvement and protection of the land environment, especially for degraded land for agricultural production, the prevention and minimization of land degradation and pollution, research policies to assist people in recovering abandoned and degraded land due to the influence of production.

d) Accelerate formulation of land use planning and plan to ensure completion of the approval for the land use planning for the 2021 – 2030 period and the 5-year land use plan for the 2021 – 2025 period in 2023.

dd) Propose solutions to take control of projects that are slow in progress or do not put land into use in accordance with the law, ensure transparency, fairness and harmony between interests of the state and investors, reduce lawsuits and complaints to quickly put projects into operation and use, promote effectiveness without causing loss or wastefulness. Review compensation and land clearance in some local areas to propose solutions to acceleration in the implementation of these works, thereby contributing to improvement of the effectiveness of land management and use.

5. Management and use of capital and assets of the State in enterprises

a) Assess and adopt specific solutions to accelerate the restructuring of enterprises according to regulations of Decision No. 360/QD-TTg dated March 17, 2022 of the Prime Minister on approval for the Scheme" Restructuring of state-owned enterprises with a focus on economic groups and state-owned corporations in the period of 2021 - 2025", Decision No. 22/2021/QD-TTg dated July 2, 2021 of the Prime Minister on criteria for classification of state-owned enterprises and state-invested enterprises undergoing ownership conversion, restructuring and divestment in 2021 – 2025 and Decision No. 1479/QD-TTg dated November 29, 2022 of the Prime Minister on approval for the Plan for rearrangement of state-owned enterprises and state-invested enterprises for the period of 2022 – 2025.

b) Develop specific roadmaps, plans and solutions to handle state-funded projects that cause loss in enterprises. Inspect responsibilities and strictly handle organizations and individuals, especially the heads of enterprises that ineffectively operate and cause loss and wastefulness in management and use of state capital in enterprises and other state capital sources.

c) Cut costs, optimize resources of capital, land…. of state-owned enterprises, completely solve diversified investments outside the main business lines via divestment, ensure that state-owned enterprises focus on their main business lines.

d) Effectively manage and use revenues from equitization and divestment of state capital in enterprises to ensure thrift and effectiveness in accordance with the Government's regulations on management and use of revenues generated by transfer of ownership of enterprises and public service providers, revenues generated by transfer of state capital and equity amount that exceeds charter capital of enterprises.

6. Organization of apparatus, management, use of labor and working time

a) Complete review and reorganization of organizational structure of ministries, ministerial-level agencies and Governmental agencies for the 2021-2026 term towards simplification, effectiveness and efficiency in association with reduction in staff, restructuring and improvement of the quality of officials and public employees.

c) Promote administrative reform, especially administrative procedure reform in association with enhancement of organization, reduction in staff to ensure the democracy, transparency and professionalism, and serve the people; build and develop e-Government towards digital government according to the objectives and tasks specified in the Government's Resolution No. 76/NQ-CP on promulgation of the overall program for state administrative reform for the 2021 - 2030 period and Decision No. 942/QD-TTg dated June 15, 2021 of the Prime Minister on approval for strategy for development of e-Government towards digital government for 2021 - 2025 with orientations towards 2030, Resolution No. 131/NQ-CP dated October 06, 2022 of the Government on promotion of administrative reform and modernization of methods of direction and management to serve people and enterprises.

III. SOLUTIONS TO ACHIEVEMENT IN OBJECTIVES, TARGETS FOR THRIFT AND WASTEFULNESS PREVENTION

it is necessary to stick to the solutions stated in the overall program of the Government for thrift practice and wastefulness prevention in the 2021 - 2025 period to achieve objectives, targets for thrift and wastefulness prevention. In which, it is necessary to focus on the following solutions:

1. Intensification of management and administration of thrift practice and wastefulness prevention

The ministers, heads of ministerial-level agencies, heads of Governmental agencies and the presidents of the People's Committees of provinces shall, within their management, direct and unify the implementation of the objectives and targets for thrift practice and wastefulness prevention in 2023 according to the orientation and policy of the Communist Party on thrift practice and wastefulness prevention. Develop the plan for the implementation of objectives and targets for thrift in each assigned sector. In which it is necessary to clearly decentralize and assign the responsibility of each affiliated unit, agency and organization, each official and public employee in association with regular inspection and assessment to ensure the effective implementation of the program.

2. Promotion of dissemination and education for development of awareness about thrift practice and wastefulness prevention

a) Disseminate information, the law on thrift practice and wastefulness prevention, the guidelines and policies of the Communist Party and the State related to thrift practice and wastefulness prevention in various forms in order to raise and unify the awareness and the responsibility for objectives, requirements and meaning of thrift practice and wastefulness prevention for agencies, enterprises, organizations, individuals and the whole society.

b) The ministries, ministerial-level agencies, Governmental agencies, the People's Committees of provinces shall actively, closely cooperate with the Vietnamese Fatherland Front, socio-political organizations, news agencies and press in effective dissemination of information on thrift practice and wastefulness prevention.

c) Promptly praise and commend good examples of thrift practice and wastefulness prevention; adopt measures to protect information providers who detect wastefulness.

a) Management of state budget

- Summarize and assess the implementation of the 2015 Law on State Budget to serve as a basis for proposal for amendments to the Law and related legal documents in order to innovate state budget decentralization mechanism, basically avoid integration in management of the state budget, strengthen the key role of the central budget and improve the initiative of local authorities.

Continue to innovate the method for management of recurrent expenditure, strengthen tendering, ordering and provision of fixed funding, encourage decentralization and assignment of autonomy to units which use the state budget in association with improvement of the responsibilities of ministries, central and local authorities and units which use the state budget, attribute personal responsibility for management and use of the state budget and public finance resources.

Strengthen inspection, examination, supervision and transparency of the use of recurrent expenditure of the state budget, especially sectors that are prone to loss and wastefulness.

- Amend Decree No. 60/2021/ND-CP dated June, 21 2021 of the Government on financial autonomy of public administrative units to remove obstacles in the implementation of financial autonomy of public administrative units.

Innovate the system of organization and management, improve the effectiveness of operation to decrease the contact points, overcome overlaps, spread and duplications of functions and tasks of public administrative units, thereby contributing to the improvement of the quality of provision of public services for fulfillment of the social requirements.

b) Management and use of public investment capital

Review and propose amendments to regulations of the Laws related to implementation of public investment projects and disbursement of public investment capital which are still inadequate, inconsistent, inappropriate, and cause difficulties and obstacles in real context.

Improve the quality of preparation for investment projects, select the qualified, experienced and potential consultants, minimize adjustment of projects throughout implementation that wastes time and slow down the progress in disbursement.

Publish information and strengthen supervision, assessment, inspection and inspection throughout the implementation of public investment projects, remove difficulties and obstacles for projects to promote disbursement.  Impose sanctions to strictly handle investors, project management boards, organizations and individuals who intentionally cause difficulties, obstruct or slow down the progress of allocation of capital, implementation and disbursement of public investment capital according to the law. Promptly replace officials and public employees who are incapable and stagnant, and cause corruption, strictly handle violations against management of public investment.

c) Management and use of public property

Continue to modernize management of public property and upgrade the national database on public property to gradually update and manage information on all public property specified in the Law on management and use of public property.

Strengthen inspection and supervision of management and use of public property at agencies, organizations and units; review responsibilities and strictly handle organizations and individuals under their management that commit violations according to relevant laws

d) Management of resources and minerals, especially land

Complete the system of land law and other relevant laws according to the orientations in Resolution No. 18-NQ/TW. Research and develop criteria, norms and regulations on investment per m2 to ensure effective and economical management and use of land resources.

Strengthen the application of information technology to the formulation and supervision of the implementation of land use planning and plans; forecast, warn about investigation, assessment, response to climate change, resource management and environmental protection to meet requirements for land management and international integration. Accelerate digital transformation towards completion, integration and connection between the land information system and the centralized and unified national database on land, including the data on planning for update and management of changes to each land plot; publish and create conditions for people and enterprises to access information and data on land use planning and plans.

Publish land use planning and plans in accordance with the law in forms which are suitable for each group of entities.

Strengthen inspection and inspection; review and properly assess the status of projects that are slow in progress or do not put land into use nationwide, propose solutions to remove difficulties and obstacles; effectively direct and adopt solutions and measures to remove difficulties and obstacles in order to tap into land resource, accelerate implementation of projects, put land to use in an effective manner and develop land resource.

Research, amend the Law on management and use of state capital invested in production and business operations of enterprises and legal documents related to equitization and divestment of state capital in enterprises in order to ensure synchronism, consistency and feasibility; complete regulations of the law on enterprise valuation, calculation of the value of land use rights into the enterprise value in case of equitization or divestment of state capital in enterprises.

Improve financial capacity, innovate management, technology, product structure, business lines, development strategies and improve the process of production to improve the quality of products and competitiveness of state-owned enterprises.

State-owned enterprises with a focus on economic groups and state-owned corporations shall urgently dispose property under their management under the Scheme "Restructuring state-owned enterprises with a focus on state-owned corporations and economic groups in the 2021-2025 period", approved by the Prime Minister in Decision No. 360/QD-TTg dated March 17, 2022.

Promote inspection, examination, audit and supervision of the implementation of policies and laws on the equitization of state-owned enterprises according to the plan in order to avoid corruption and loss of state capital and assets.

e) Organization of apparatus, management of labor and working time

Expeditiously build the system of job positions and structure of official ranks according to the Government's Decree No. 62/2020/ND-CP dated June 01, 2020, and working positions of public employees according to Decree No. 106/2020 /ND-CP dated September 10, 2020 of the Government to serve as a basis for management and use of officials, public employees and working time in an effective manner, and reform of salary policies .

Strongly innovate processes and methods; ensure the democracy and transparency in planning, promotion, appointment, rotation of officials and recruitment, use and management of officials and public employees in order to attract capable and qualified people, improve the quality of officials and public employees and reduce complaints and denunciations related to officials and official-related works.

4. Intensification of inspection and strict handling of violations against regulations on thrift practice and wastefulness prevention

Promote and improve the effectiveness of inspection and examination of the formulation and implementation of the program for thrift practice and wastefulness prevention; inspect and examine the implementation of regulations of the law in the sectors as prescribed by the Law on thrift practice and wastefulness prevention and specialized laws. The ministries, central and local authorities shall develop specific plans for inspection related to thrift practice and wastefulness prevention. To be specific:

- Land management and use with a focus on projects that are slow in progress or do not put land into use

-  Implementation of projects on public investment;

- Management of funding for science and technology-related public services;

- Compilation and publication of textbooks.

b) The heads of units shall actively develop the plans for inspection, self-inspection at their units and direct inspection and self-inspection at their inferior units.

c) With regard to violations detected via inspection and examination, the heads of units must remedy, handle or request competent agencies to take handling measures. Strictly comply with regulations of the law on handling of violations of the heads of agencies, units and individuals who cause wastefulness. Strictly handle the results of inspection and examination in order to sufficiently recover assets and money for the State that have been violated, appropriated, used for improper purposes and wasted in case of detection via inspection and examination.

IV. IMPLEMENTATION

1. According to the overall program for thrift practice and wastefulness prevention in 2023, the ministers, the heads of ministerial-level agencies, the heads of Governmental agencies and the Presidents of the People's Committees of provinces shall develop the program for thrift practice and wastefulness prevention in 2023 of their ministries, central and local authorities within 30 days from the date of issuance of the overall program for thrift practice and wastefulness prevention in 2023; direct the development of the program for thrift practice and wastefulness prevention in 2023 of affiliated units, all levels and agencies. In the program for thrift practice and wastefulness prevention of each level, it is necessary to specify objectives and targets for thrift and requirements for wastefulness prevention of its level; clearly identify key tasks and sectors under its management, and solutions and measures that must be adopted in 2023 in order to achieve objectives and targets for thrift which have been set out.

2. The ministries, ministerial-level agencies, Governmental agencies, the People's Committees of provinces shall thoroughly direct the following tasks:

b) Strengthen inspection and examination of the formulation and implementation of the program for thrift practice and wastefulness prevention in 2023; inspect and examine the compliance with regulations of the law on thrift practice and wastefulness prevention and the implementation of the program for thrift practice and wastefulness prevention under their management.

c) Strengthen cooperation with the Vietnam Fatherland Front and mass organizations in the implementation of this program. Ensure transparency in the program for thrift practice and wastefulness prevention, publish acts of wastefulness and the results of handling of such acts; improve the quality and innovate the method of assessment of the result of thrift practice and wastefulness prevention in order to ensure an accurate and transparent comparison of the result of thrift practice and wastefulness prevention between agencies and units, thereby contributing to improvement of the effectiveness.

d) Make report on the situation and result of the implementation of the overall program of the Government for thrift practice and wastefulness prevention and the specific program for thrift practice and wastefulness prevention of their ministries, central and local authorities, and assess the result of thrift practice and wastefulness prevention in recurrent expenditures according to the criteria specified in Circular No. 129/2017/TT-BTC dated December 04, 2017 of the Ministry of Finance. Accordingly, make an annual report on thrift practice and wastefulness prevention to send to the Ministry of Finance for synthesis and submission to the Government to report to the National Assembly at the first meeting of the following year within the prescribed period of time of the law. In particular, the ministries, ministerial-level agencies and Governmental agencies shall synthesize the results of thrift practice and wastefulness prevention in state management and send them to the Ministry of Finance.

3. The General Directors of single-member limited liability companies 100% of charter capital of which is held by the State under establishment of the Prime Minister shall be responsible for organization of the formulation and implementation of the program for thrift practice and wastefulness prevention in 2023 of their companies; follow the program for thrift practice and wastefulness prevention in 2023 of the Government and send it to the Ministry of Finance for general monitoring. In particular, they shall specify objectives, targets for thrift and requirements for wastefulness prevention in management and use of state capital and assets; clearly identify key tasks, solutions and measures that must be adopted to achieve objectives and targets for thrift in 2023 that have been set out.

4. The Ministry of Finance shall guide and inspect the compliance with regulations of the law on thrift practice and wastefulness prevention of ministries, central and local authorities. In particular, the Ministry of Finance shall inspect the implementation of the overall program for thrift practice and wastefulness prevention of the Government and the development and promulgation of the program for thrift practice and wastefulness prevention of ministries, central and local authorities according to the approved plan for inspection and examination.
