Guidance on grant of certificates for female employees’ entitlement to maternity benefits

The Ministry of Health has issued the Circular No. 56/2017/TT-BYT elaborating on certain articles of the Law on Social Security and the Law on Labour Hygiene and Safety in the health sector.

The Circular prescribes issuance of certain certificates for entitlement to maternity insurance coverage as follows:

- Granting the antenatal leave certificate in which antenatal leave is subject to the following provisions:

+ The antenatal leave certificate is awarded to pregnant female employees who have taken leaves from work to obtain outpatient treatment by using the sample certificate given in the Appendix 6 hereto attached; 

+ The certificate of covered leave is awarded to pregnant female employees who are paying compulsory social security contributions and take leave from work to obtain outpatient treatment by using the sample certificate given in the Appendix 7 hereto attached;    

+ The Medical Assessment Report is prepared using the sample report given in the Appendix to the Circular No. 52/2016/TT-BYT if the report is issued by that Council;

+ The hospital discharge certificate is granted according to the sample one given in the Appendix 3 or the medical summary form given in the Appendix 4 hereto attached. 

- Granting the certificate of childcare incapacity after childbirth or after having a child through surrogacy.

In addition, the Circular No. 56/2017/TT-BYT also provides instructions on documentation on medical check-up for assessment purpose for certifying that female employees are not healthy enough to take care of their child after birth, after having a child through surrogacy, or they must take leave from work to obtain antenatal care.
