New regulation on control of Vietnamese citizens’ entry and exit at border checkpoints

On November 7, 2024, the Minister of Public Security of Vietnam promulgated Circular No. 59/2024/TT-BCA on amendments to Circular No. 74/2020/TT-BCA on the control of Vietnamese citizens’ entry and exit at border checkpoints.

According to Circular No. 59/2024/TT-BCA the regulations on inspection and verification of persons and entry/exit papers prescribed in Article 5 of Circular No. 74/2020/TT-BCA are amended. Specifically:

- Clause 1a is added to Article 5 of Circular No. 74/2020/TT-BCA on entry and exit verification as follows:

+ Entry and exit verification is the process of confirming that Vietnamese citizens have completed entry or exit procedures, including affixing verification stamps or not on entry/exit papers.

+ Information on the entry or exit process stored in the national database on entry and exit may replace the verification stamps on citizens’ entry/exit papers.

- Additionally, amendments to Point dd Clause 1 Article 5 of Circular No. 74/2020/TT-BCA concerning affixing verification stamps on entry/exit papers are as follows:

+ Affixing verification stamps on the entry/exit papers of citizens entering or exiting through port border checkpoints and land border checkpoints not connected with the national database on entry and exit.

+ Not affixing verification stamps on entry/exit papers of Vietnamese citizens entering or exiting through air border checkpoints and land border checkpoints connected with the national database on entry and exit;

- Circular No. 59/2024/TT-BCA also adds Point g to Clause 1 Article 5 of Circular No. 74/2020/TT-BCA on the collection of portraits and fingerprints of citizens at border checkpoints according to the law.
