New regulations on the management, provision, and use of Internet services and cyber information:
(1) Verification of user accounts via phone numbers
According to Point e Clause 3 Article 23 of Decree No. 147/2024/ND-CP regarding the verification of user accounts via phone numbers, foreign providers of social network services shall implement the verification of user accounts via identification numbers only when users confirm to not have any phone number in Vietnam under the law on e-identification and authentication.
According to Point b Clause 3 Article 27 of Decree No. 147/2024/ND-CP providers of social network services shall implement the verification of user accounts via identification numbers when users use the livestream feature for commercial purposes under the law on e-identification and authentication.
Only verified accounts can post information (articles, comments, and livestream sessions) and share information on social networks.
According to Clause 10 Article 82 of Decree No. 147/2024/ND-CP within 90 days from the effective date of Decree No. 147/2024/ND-CP foreign providers of cross-border information into Vietnam and domestic providers of social network services shall implement the verification of active accounts of users of social network services under Point e Clause 3 Article 23 and Point b Clause 3 Article 27 of Decree No. 147/2024/ND-CP.
(2) Removal of content violating the law upon requests
According to Points b and c Clause 3 Article 23 of Decree No. 147/2024/ND-CP inspect, supervise, and remove information, services, and applications violating the law following Article 8 of the Law on Cybersecurity 2018; and
Prevent and remove information, services, and applications violating the law following Article 8 of the Law on Cybersecurity 2018 and relevant laws upon requests from the Ministry of Information and Communications of Vietnam, Ministry of Public Security of Vietnam, or competent authorities according to specialized laws and the handling process prescribed in Clause 5 Article 23 of Decree No. 147/2024/ND-CP.
(3) Suspension and ban of accounts, groups, and channels violating the law
According to Clause 7 Article 35 of No. 147/2024/ND-CP:
- User accounts, community pages, community groups, and channels are suspended when:
+ They have provided content violating the law at least 5 times within 30 days;
+ They have provided content violating the law at least 10 times within 90 days.
- User accounts, community pages, community groups, and channels are banned when:
+ They post content infringing on national security.
+ They have been suspended for at least 3 times.
