Applications and procedures for restructuring crops and livestock on paddy land in Vietnam
According to Article 8 of Decree No. 112/2024, any paddy land user that wishes to convert to cultivating perennial crops or rice cultivation in association with aquaculture shall implement the following procedures:
(1) The paddy land user shall submit a written registration for restructuring crops and livestock on paddy land (written registration) to the People’s Committee of the commune;
(2) The People’s Committee of the commune shall assess the conformity:
Within 5 working days from the receipt of the valid written registration for restructuring crops and livestock on paddy land, the People’s Committee of the commune shall assess the conformity of the written registration with the annual plan to restructure crops and livestock on paddy land of the commune.
- Where the written registration is conformable with the annual plan to restructure crops and livestock on paddy land of the commune, the People's Committee of the commune shall issue a written approval permitting the restructuring and send it to the paddy land user;
- Where the written registration is unconformable with the annual plan to restructure crops and livestock on paddy land of the commune, the People's Committee of the commune shall issue a written notice to the paddy land user.
Attention: The restructuring of crops on specialized paddy land to perennial crops approved in the annual plan to restructure crops or permitted by competent authorities before the effective date of Decree No. 112/2024 shall continue to comply with Decree No. 94/2019/ND-CP on plant varieties and crop cultivation.
The restructuring from rice cultivation to rice cultivation in association with aquaculture may use up to 20% of the area of paddy land to lower the aquaculture surface to a depth of no more than 120 centimeters compared to the field surface.
Paddy land after the restructuring of crops and livestock under Decree No. 112/2024 shall be reckoned paddy land.
