Pursuant to this Circular, the donor operator (the enterprise that is currently providing network services for subscribers) is entitled to reject the request for mobile network porting if:
- Subscriber’s information included in the request for mobile network porting submitted to the recipient operator (the enterprise that will provide mobile network services for subscribers) is not consistent with the information kept by the donor operator.
- The requesting subscriber has violated regulations laid down in Article 12 of the Law on Telecommunications or requirements set out by competent authorities.
- The requesting subscriber has breached a telecommunication service contract or other general contractual terms and conditions agreed upon with the donor operator.
- Any complaint or dispute between the requesting subscriber and the donor operator arises during rendering and use of telecommunication services.
Additionally, the recipient operator is allowed to provide mobile network services to the requesting subscriber only after they have completely made all careful review and inspection of subscription information to ensure that such information is checked, entered, stored and managed in the correct procedures.
The Circular No. 35/2017/TT-BTTT is set to commence on January 8, 2018.
