CIRCULAR

PROVIDING FOR RATES, COLLECTION, TRANSFER, EXEMPTION, MANAGEMENT AND USE OF FEES FOR EXPLOITING AND USING NATIONAL REMOTE SENSING DATA

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Law on State Budget dated June 25, 2015;

Pursuant to the Law on Tax Administration dated June 13, 2019;

Pursuant to the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 elaborating some Articles of the Law on Fees and Charges;

Pursuant to the Government’s Decree No. 03/2019/ND-CP dated January 04, 2019 on remote sensing activities;

Pursuant to the Government’s Decree No. 126/2020/ND-CP dated October 19, 2020 elaborating some Articles of the Law on Tax Administration; the Government’s Decree No. 91/2022/ND-CP dated October 30, 2022 amending some Articles of Decree No. 126/2020/ND-CP;

The Minister of Finance hereby promulgates a Circular providing for rates, collection, transfer, exemption, management and use of fees for exploiting and using national remote sensing data.

Article 1. Scope and regulated entities

1. This Circular provides for rates, collection, transfer, exemption, management and use of fees for exploiting and using national remote sensing data.

2. This Circular applies to agencies, organizations and individuals that are relevant to the management, exploitation and use of fees for exploiting and using national remote sensing data.

Article 2. Collecting organizations and fee payers

1. Any authorities, organizations or individuals that submit applications requesting national remote sensing data must pay fees in compliance with regulations herein.

2. Collecting organizations include the Central Ground Segment of Remote Sensing (CGSR) affiliated to the National Remote Sensing Department under the Ministry of Natural Resources and Environment; authorities assigned to provide national remote sensing data as prescribed by law.

Article 3. Fee rates and fee exemption

2. The rates of fees for exploiting and using national remote sensing data for national defense and security purposes or in the event of emergency are 60% of the corresponding fee rates specified in clause 1 of this Article.

3. The national remote sensing data shall be provided free of charge as requested by leaders of the Communist Party and of the State.

Article 5. Declaring and paying fees

1. Fee payers shall pay the fees according to the rates mentioned in Article 3 of this Circular to the collecting organizations using the methods specified in Circular No. 74/2022/TT-BTC dated December 22, 2022 of the Minister of Finance on methods, deadlines for collection, transfer and declaration of fees and charges under the jurisdiction of the Ministry of Finance.

2. No later than the 05^th of each month, collecting organizations shall transfer the fees that were collected in the previous month to their accounts designated for amounts pending transfer to state budget opened at State Treasury. Collecting organizations shall declare, collect, transfer and finalize fees in accordance with Circular No. 74/2022/TT-BTC (fees collected by central authorities shall be transferred to the central government budget; fees collected by local authorities shall be transferred to local government budgets).

Article 5. Management and use of fees

1. The collecting organization that is a public service provider may retain 55% of the sum of collected fees to cover its expenditures on service provision and fee collection as prescribed in Article 5 of the Government’s Decree No. 120/2016/ND-CP dated August 23 elaborating some Articles of the Law on Fees and Charges and transfer the remaining 45% to the state budget.

2. The collecting organization that is a state agency shall transfer 100% of the collected fees to state budget. The funding for covering expenditures on service provision and fee collection shall be covered by funding from state budget included in that collecting organization’s estimate under policies and levels of state budget expenditures as regulated by law.

In case the collecting organization is a state agency that is permitted to use its revenue to cover its operating costs according to clause 1 Article 4 of the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016, it may retain 55% of the collected fees to cover the expenditures specified in Article 5 of Decree No. 120/2016/ND-CP and transfer the remaining 45% to the state budget.

1. This Decree comes into force from August 01, 2023.

2. This Circular replaces Circular No. 187/2016/TT-BTC dated November 08, 2016 of the Minister of Finance on rates, collection, transfer, exemption, management and use of fees for exploiting and using national remote sensing data and Circular No. 108/2017/TT-BTC dated October 16, 2017 of the Minister of Finance amending Article 3 of the Circular No. 187/2016/TT-BTC dated November 08, 2016 of the Minister of Finance on rates, collection, transfer, exemption, management and use of fees for exploiting and using national remote sensing data.

3. Other contents relevant to fee collection, transfer, management, use, receipt vouchers, disclosure of collection regulations that are not mentioned in this Circular shall comply with the following documents: the Law and Fees and Charges, Decree No. 120/2016/ND-CP; the Law on Tax Administration; Decree No. 126/2020/ND-CP; Decree No. 91/2022/ND-CP; Decree No. 11/2020/ND-CP; Decree No. 123/2020/ND-CP; Circular No. 78/2021/TT-BTC.

4. In case any document referred to in this Circular is amended or replaced, the newest document shall apply.

5. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Finance for consideration and guidance./.
