BAN HÀNH DANH MỤC THUỐC CÓ ÍT NHẤT 03 HÃNG TRONG NƯỚC SẢN XUẤT TRÊN DÂY CHUYỀN SẢN XUẤT THUỐC ĐÁP ỨNG NGUYÊN TẮC, TIÊU CHUẨN EU-GMP HOẶC TƯƠNG ĐƯƠNG EU-GMP VÀ ĐÁP ỨNG TIÊU CHÍ KỸ THUẬT THEO QUY ĐỊNH CỦA BỘ Y TẾ VÀ VỀ CHẤT LƯỢNG, GIÁ, KHẢ NĂNG CUNG CẤP

Căn cứ Luật Dược số 105/2016/QH13 ngày 06 tháng 4 năm 2016;

Căn cứ Luật Đấu thầu số 22/2023/QH15 ngày 23 tháng 06 năm 2023;

Căn cứ Nghị định số 95/2022/NĐ-CP ngày 15 tháng 11 năm 2022 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Y tế;

Theo đề nghị của Cục trưởng Cục Quản lý Dược;

Bộ trưởng Bộ Y tế ban hành danh mục thuốc có ít nhất 03 hãng trong nước sản xuất trên dây chuyền sản xuất thuốc đáp ứng nguyên tắc, tiêu chuẩn EU-GMP hoặc tương đương EU-GMP và đáp ứng tiêu chí kỹ thuật theo quy định của Bộ Y tế và về chất lượng, giá, khả năng cung cấp.

Điều 1. Phạm vi điều chỉnh

Thông tư này quy định nguyên tắc, tiêu chí xây dựng, ban hành và công bố danh mục thuốc có ít nhất 03 hãng trong nước sản xuất trên dây chuyền sản xuất thuốc đáp ứng nguyên tắc, tiêu chuẩn EU-GMP hoặc tương đương EU-GMP và đáp ứng tiêu chí kỹ thuật theo quy định của Bộ Y tế và về chất lượng, giá, khả năng cung cấp (sau đây gọi tắt là danh mục thuốc).

Điều 2. Nguyên tắc, tiêu chí xây dựng danh mục thuốc

Thuốc đưa vào danh mục phải đáp ứng tất cả các nguyên tắc, tiêu chí sau đây:

1. Có ít nhất từ 03 (ba) giấy đăng ký lưu hành của ít nhất 03 (ba) hãng sản xuất trong nước đáp ứng nguyên tắc, tiêu chuẩn EU-GMP hoặc tương đương EU-GMP và đáp ứng tiêu chí kỹ thuật Nhóm 1, Nhóm 2 theo quy định tại Thông tư quy định về đấu thầu thuốc tại cơ sở y tế công lập do Bộ trưởng Bộ Y tế ban hành.

2. Giá thuốc sản xuất trong nước (giá thuốc trúng thầu trung bình theo phương pháp tính trung bình cộng) không cao hơn so với giá thuốc nhập khẩu có tiêu chí kỹ thuật tương đương (phù hợp với các quy định ưu đãi cho thuốc sản xuất trong nước tại Luật Đấu thầu).

3. Có khả năng cung cấp thuốc cho các cơ sở y tế.

Điều 3. Ban hành và công bố danh mục thuốc

1. Ban hành kèm theo Thông tư này danh mục 93 thuốc có ít nhất 03 hãng trong nước sản xuất trên dây chuyền sản xuất thuốc đáp ứng nguyên tắc, tiêu chuẩn EU-GMP hoặc tương đương EU-GMP và đáp ứng tiêu chí kỹ thuật theo quy định của Bộ Y tế và về chất lượng, giá, khả năng cung cấp.

2. Công bố danh mục 93 thuốc tại Phụ lục ban hành kèm theo Thông tư này trên Cổng thông tin điện tử của Bộ Y tế và Trang thông tin điện tử của Cục Quản lý Dược.

Điều 4. Cập nhật danh mục thuốc

Trong thời gian tối đa 02 (hai) năm, trên cơ sở các nguyên tắc, tiêu chí xây dựng danh mục thuốc tại Điều 2 Thông tư này và căn cứ thông tin giá thuốc trúng thầu trung bình của năm liền kề trước đó, Cục Quản lý Dược xây dựng và trình Bộ trưởng Bộ Y tế ban hành Thông tư cập nhật danh mục thuốc.

Điều 5. Hiệu lực thi hành

1. Thông tư này có hiệu lực thi hành kể từ ngày ký ban hành.

2. Thông tư số 03/2019/TT-BYT ngày 28 tháng 03 năm 2019 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc sản xuất trong nước đáp ứng yêu cầu về điều trị, giá thuốc và khả năng cung cấp và Điều 1 Thông tư số 15/2022/TT-BYT ngày 09 tháng 12 năm 2022 của Bộ trưởng Bộ Y tế sửa đổi, bổ sung một số điều và Phụ lục tại Thông tư số 03/2019/TT-BYT ngày 28 tháng 3 năm 2019 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc sản xuất trong nước đáp ứng yêu cầu về điều trị, giá thuốc và khả năng cung cấp và Thông tư số 15/2020/TT-BYT ngày 10 tháng 8 năm 2020 của Bộ trưởng Bộ Y tế ban hành Danh mục thuốc đấu thầu, Danh mục thuốc đấu thầu tập trung, Danh mục thuốc được áp dụng hình thức đàm phán giá hết hiệu lực kể từ ngày Thông tư này có hiệu lực thi hành.

Điều 6. Điều khoản chuyển tiếp

Đối với những gói thầu đã được phê duyệt kế hoạch lựa chọn nhà thầu và đã phát hành hồ sơ mời thầu, hồ sơ yêu cầu trước ngày Thông tư này có hiệu lực thi hành thì được tiếp tục thực hiện theo các quy định trước ngày Thông tư này có hiệu lực thi hành; trừ trường hợp các đơn vị, cơ sở y tế tự nguyện thực hiện theo quy định tại Thông tư này kể từ ngày Thông tư này có hiệu lực thi hành.

Điều 7. Trách nhiệm thi hành

1. Chánh Văn phòng Bộ, Cục trưởng Cục Quản lý Dược, Vụ trưởng Vụ Kế hoạch - Tài chính, Thủ trưởng các đơn vị liên quan chịu trách nhiệm thi hành Thông tư này.

2. Trong quá trình thực hiện, nếu có khó khăn vướng mắc, đề nghị các cơ quan, tổ chức, cá nhân kịp thời phản ánh về Bộ Y tế (Cục Quản lý Dược) để xem xét, giải quyết./.

Ghi chú:

1. Về cách ghi tên hoạt chất của thuốc:

- Thuốc có cách ghi danh pháp khác với cách ghi tên hoạt chất tại Cột (2) và cách ghi này được ghi tại các tài liệu chuyên ngành về dược (như Dược điển, Dược thư Quốc gia và các tài liệu khác) thì vẫn thuộc danh mục (Ví dụ: Paracetamol hay Acetaminophen; Acyclovir hay Aciclovir; Cefuroxime hoặc Cefuroxim; Sodium hay Natri; Hydrochloride hoặc Hydroclorid ...).

- Trường hợp hoạt chất tại Cột (2) không ghi gốc muối thì các thuốc có dạng muối khác nhau của hoạt chất này sau khi quy đổi về dạng base có cùng nồng độ - hàm lượng tại Cột (3) (nếu có cùng chỉ định, liều điều trị) thì vẫn thuộc danh mục.

2. Việc tham dự thầu của thuốc có dạng bào chế khác với dạng bào chế ghi tại Cột (4) thực hiện theo quy định về đấu thầu thuốc.

3. “Đối với dạng bào chế của thuốc ghi tại Cột (4):

- Dạng bào chế “Viên”, “Thuốc tiêm” ghi tại Cột 4 là các dạng bào chế quy ước (Thuốc viên; Viên nén, Viên nang; Thuốc tiêm: Dung dịch tiêm, Hỗn dịch tiêm, Nhũ tương dùng đường tiêm).

- Các đơn vị, cơ sở y tế được xây dựng kế hoạch lựa chọn nhà thầu và trong hồ sơ mời thầu, hồ sơ yêu cầu được quy định nhà thầu được chào thầu thuốc nhập khẩu đối với các thuốc có dạng bào chế đặc biệt hoặc thuốc có sinh khả dụng khác với dạng bào chế quy ước (Ví dụ: Viên bao tan ở ruột, Viên giải phóng có kiểm soát, Viên hòa tan nhanh, Viên sủi, Viên đặt dưới lưỡi; Thuốc tiêm đông khô, Thuốc tiêm liposome/nano/phức hợp lipid, Thuốc tiêm nhãn cầu, Thuốc tiêm tác dụng kéo dài, Thuốc tiêm định liều đóng sẵn trong dụng cụ tiêm ...)”.

4. Nhà thầu không được chào thầu thuốc nhập khẩu đối với thuốc có Nhóm tiêu chí kỹ thuật ghi tại Cột (6).

CIRCULAR

PROMULGATING LIST OF DRUGS MANUFACTURED BY AT LEAST 03 DOMESTIC DRUG COMPANIES IN PROCESSES THAT MEET EU-GMP PRINCIPLES AND STANDARDS OR EQUIVALENTS AND TECHNICAL SPECIFICATIONS IN ACCORDANCE WITH REGULATIONS OF THE MINISTRY OF HEALTH CONCERNING QUALITY, PRICE, AVAILABILITY

Pursuant to the Law on Pharmacy No. 105/2016/QH13 dated April 06, 2016;

Pursuant to the Law on Procurement No. 22/2023/QH15 dated June 23, 2023;

Pursuant to Decree No. 95/2022/ND-CP dated November 15, 2022 of the Government on functions, tasks, powers and organizational structure of the Ministry of Health of Vietnam;

At the request of the Director General of Traditional Medicine Administration (TMA);

The Minister of Health hereby promulgates a list of drugs manufactured by at least 03 domestic drug companies in processes that meet EU-GMP principles and standards or equivalents and technical specifications in accordance with regulations of the Ministry of Health concerning quality, price, availability.

Article 1. Scope

Article 2. Principles and criteria of compiling the list of drugs

Each drug included in the list must satisfy all the principles and criteria bellows:

1. There are at least 03 (three) Marketing authorization approval certificates of at least 03 (three) domestic drug companies meeting EU-GMP principles and standards or equivalents and technical specifications of Category 1 and/or Category 2 in accordance with regulations in Circular prescribing bidding for supply of drugs for public health facilities promulgated by the Minister of Health of Vietnam.

2. The domestic drug price (arithmetic mean of successful bids) must not exceed the price for imported drugs with equivalent specifications (in conformity with regulations of the Law on Bidding on incentives for domestically manufactured drugs).

3. This drug must be adequate for health facilities.

Article 3. Promulgation and disclosure of the list of drugs

1. The list of 93 drugs manufactured by at least 03 domestic drug companies in processes that meet EU-GMP principles and standards or equivalents and technical specifications in accordance with regulations of the Ministry of Health concerning quality, price, availability is enclosed herewith.

2. The list of 93 drugs is disclosed in the Appendix enclosed herewith on the Web portal of the Ministry of Health and the website of the Traditional Medicine Administration.

Article 5. Effect

1. This Circular comes into force from the day on which it is signed.

2. The Circular No. 03/2019/TT-BYT dated March 28, 2019 of the Minister of Health promulgating list of domestically manufactured drugs meeting treatment requirements, drug prices and availability and Article 1 of Circular No. 15/2022/TT-BYT dated December 09, 2022 of the Minister of Health amending certain Articles and Appendices of Circular No. 03/2019/TT-BYT and Circular No. 15/2020/TT-BYT shall be invalid from the effective date of this Circular.

Article 6. Transitional provisions

If the contractor selection plan is approved and the request for proposals/bidding documents of a bidding package is issued before the effective date of this Circular, the regulations that are applicable before the effective date of this Circular may be applied, unless the health facility or procuring unit voluntarily applies the regulations of this Circular from the effective date thereof.

Article 7. Implementation responsibilities

1. The Chief of the Ministry Office, the Director General of Traditional Medicine Administration, the Director of Department of Planning and Finance, Heads of relevant units are responsible for implementation of this Circular.

2. Agencies, organizations and individuals should report difficulties that arise during the implementation of this Circular to the Ministry of Health (via the Traditional Medicine Administration) for consideration and settlement./.

1. Regarding names of active ingredients of drugs:

- If the name of a drug is different from the name of the active ingredient (chemical name) in Column (2) and is written in specialized pharmaceutical documents (such as Pharmacopoeia, National Pharmacopoeia and other documents), the drug still belongs to the list (E.g. Paracetamol or Acetaminophen; Acyclovir or Aciclovir; Cefuroxime or Cefuroxim; Sodium or Natri; Hydrochloride or Hydroclorid, etc.).

- If the salt base of an active ingredient in Column (2) is not specified, different salts of this active ingredient, after being converted into bases with the same concentrations and content in Column (3) (with the same indications and dosage) still belong to the list.

2. The bidding for a drug whose dosage form is different from that written in Column (4) shall comply with regulations on drug bidding.

3. “Regarding dosage forms written in Column (4):
