QUY ĐỊNH HỒ SƠ LÂM SẢN HỢP PHÁP VÀ KIỂM TRA NGUỒN GỐC LÂM SẢN

Căn cứ Luật Bảo vệ và phát triển rừng ngày 3 tháng 12 năm 2004;

Căn cứ Nghị định số 23/2006/NĐ-CP ngày 03 tháng 3 năm 2006 của Chính phủ về thi hành Luật Bảo vệ và phát triển rừng;

Căn cứ Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 và Nghị định số 75/2009/NĐ-CP ngày 10 tháng 9 năm 2009 của Chính phủ về sửa đổi Điều 3 Nghị định số 01/2008/NĐ-CP ngày 03 tháng 01 năm 2008 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Nông nghiệp và Phát triển nông thôn;

Bộ Nông nghiệp và Phát triển nông thôn quy định hồ sơ lâm sản hợp pháp và việc kiểm tra nguồn gốc lâm sản như sau:

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Thông tư này quy định hồ sơ lâm sản hợp pháp và kiểm tra nguồn gốc gỗ, lâm sản ngoài gỗ (sau đây viết chung là lâm sản) trên lãnh thổ nước Cộng hoà xã hội chủ nghĩa Việt Nam.

Điều 2. Đối tượng áp dụng

Thông tư này áp dụng đối với tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân trong nước; tổ chức, cá nhân nước ngoài có hoạt động khai thác, vận chuyển, chế biến, kinh doanh, cất giữ lâm sản trên lãnh thổ nước Cộng hoà xã hội chủ nghĩa Việt Nam.

Điều 3. Giải thích từ ngữ

Một số từ ngữ trong Thông tư này được hiểu như sau:

1. Cơ quan kiểm lâm sở tại bao gồm: Hạt Kiểm lâm các khu rừng đặc dụng, Hạt Kiểm lâm các khu rừng phòng hộ; Hạt Kiểm lâm huyện, thị xã, quận, thành phố (sau đây viết chung là Hạt Kiểm lâm cấp huyện); Chi cục Kiểm lâm tỉnh, thành phố trực thuộc Trung ương ở những địa phương không có Hạt Kiểm lâm cấp huyện.

2. Hồ sơ lâm sản là các tài liệu ghi chép về lâm sản được thiết lập, lưu giữ tại cơ sở sản xuất, kinh doanh lâm sản và lưu hành cùng với lâm sản trong quá trình khai thác, mua bán, vận chuyển, chế biến, cất giữ.

3. Lâm sản ngoài gỗ là động vật rừng, thực vật rừng không đủ tiêu chuẩn là gỗ quy định tại điểm b, c, Khoản 3, Điều 5 của Thông tư này và các bộ phận, dẫn xuất của chúng.

4. Dẫn xuất của động vật rừng, thực vật rừng là toàn bộ các dạng vật chất được lấy ra từ động vật rừng, thực vật rừng như: máu, dịch mật của động vật rừng; nhựa, tinh dầu được lấy ra từ thực vật rừng chưa qua chế biến.

5. Bảng kê lâm sản là bảng ghi danh mục lâm sản trong cùng một lần nghiệm thu, mua bán, xuất, nhập hoặc lâm sản vận chuyển trên một phương tiện theo đúng quy định tại mẫu số 01 ban hành kèm theo Thông tư này.

6. Sổ theo dõi nhập, xuất lâm sản là sổ ghi chép lâm sản nhập, xuất của tổ chức khai thác, chế biến, kinh doanh lâm sản theo đúng quy định tại mẫu số 02 ban hành kèm theo Thông tư này.

7. Vận chuyển nội bộ là trường hợp lâm sản được vận chuyển giữa các đơn vị hạch toán phụ thuộc như: lâm trường, các công ty lâm nghiệp, nhà máy chế biến, các chi nhánh, cửa hàng ... trong một doanh nghiệp có tư cách pháp nhân và hạch toán độc lập; hoặc trường hợp lâm sản được vận chuyển từ doanh nghiệp có tư cách pháp nhân và hạch toán độc lập đến các tổ chức hạch toán phụ thuộc và ngược lại.

Trường hợp chủ rừng hoặc tổ chức, cá nhân mua lâm sản theo hình thức mua bán cây đứng, việc vận chuyển từ bãi gỗ khai thác về kho hàng hoặc cơ sở chế biến của mình cũng là vận chuyển nội bộ.

8. Xác nhận lâm sản là xác định tính hợp pháp về hồ sơ lâm sản và sự phù hợp giữa hồ sơ với lâm sản.

9. Lâm sản chưa qua chế biến là lâm sản sau khai thác, nhập khẩu, xử lý tịch thu chưa được tác động bởi các loại công cụ, thiết bị, còn giữ nguyên hình dạng, kích thước ban đầu.

Điều 4. Xác định số lượng, khối lượng lâm sản

1. Xác định khối lượng gỗ tròn, gỗ xẻ, gỗ đẽo hộp thực hiện theo quy định về quản lý và đóng búa bài cây, búa kiểm lâm của Bộ Nông nghiệp và Phát triển nông thôn.

Đối với gỗ gốc, rễ, gỗ có hình thù phức tạp, gỗ dạng cây cảnh, cây bóng mát, cây cổ thụ bao gồm cả rễ, thân, cành, lá, nếu không thể đo được đường kính, chiều dài để xác định khối lượng, thì cân trọng lượng theo đơn vị là ki-lô-gam (kg) và quy đổi cứ 1.000 kg bằng 1 m^3 gỗ tròn hoặc đo, tính theo đơn vị ster và quy đổi cứ 1 ster bằng 0,7 m^3 gỗ tròn.

2. Xác định số lượng đối với động vật rừng là số cá thể và cân trọng lượng theo đơn vị là kg; trường hợp không thể xác định được số cá thể thì cân trọng lượng theo đơn vị là kg.

Đối với bộ phận, dẫn xuất của động vật, thực vật rừng xác định khối lượng bằng cân trọng lượng theo đơn vị là kg hoặc bằng dung tích theo đơn vị là mi-li-lít (ml) nếu bộ phận, dẫn xuất của động vật rừng ở dạng thể lỏng.

3. Xác định số lượng đối với lâm sản từ thực vật rừng ngoài gỗ bằng cân trọng lượng theo đơn vị là kg.

Điều 5. Bảng kê lâm sản

1. Mẫu bảng kê lâm sản ban hành kèm theo Thông tư này áp dụng thống nhất đối với tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân.

2. Bảng kê lâm sản do tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân có hoạt động khai thác, nhập, xuất lâm sản lập khi nghiệm thu, đóng búa kiểm lâm hoặc nghiệm thu, xuất lâm sản trên cùng một lần và một phương tiện vận chuyển.

Tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân lập bảng kê lâm sản chịu trách nhiệm trước pháp luật về sự chính xác và nguồn gốc lâm sản hợp pháp tại bảng kê lâm sản.

3. Phương pháp lập bảng kê lâm sản

a) Chủ lâm sản ghi đầy đủ các nội dung về lâm sản tại bảng kê lâm sản.

b) Ghi chi tiết đối với khúc, lóng gỗ tròn nguyên khai, gỗ đẽo tròn, gỗ lóc lõi có đường kính đầu nhỏ từ 10 cm đến dưới 20 cm, chiều dài từ 1 mét trở lên hoặc có đường kính đầu nhỏ từ 20 cm trở lên, chiều dài từ 30 cm trở lên và những tấm, hộp gỗ xẻ, gỗ đẽo hộp có chiều dài từ 1m trở lên, chiều rộng từ 20 cm trở lên và chiều dày từ 5 cm trở lên.

c) Ghi tổng hợp chung số lượng, khối lượng hoặc trọng lượng đối với gỗ tròn, gỗ đẽo, gỗ xẻ không đủ kích thước quy định tại điểm b Khoản này.

d) Ghi chi tiết hoặc ghi tổng hợp chung số lượng, khối lượng hoặc trọng lượng đối với từng loại lâm sản ngoài gỗ phù hợp với thực tế.

đ) Tại cuối mỗi trang của bảng kê lâm sản ghi tổng khối lượng lâm sản.

Điều 6. Sổ theo dõi nhập, xuất lâm sản

1. Mẫu sổ theo dõi nhập, xuất lâm sản ban hành kèm theo Thông tư này áp dụng thống nhất đối với tổ chức có hoạt động khai thác, chế biến, kinh doanh lâm sản.

2. Sổ theo dõi nhập, xuất lâm sản phải được quản lý tại tổ chức quy định tại Khoản 1 Điều này. Chủ lâm sản có trách nhiệm ghi vào sổ theo dõi lâm sản ngay khi nhập, xuất lâm sản thể hiện rõ các nội dung: ngày tháng nhập, xuất lâm sản; tên lâm sản, nguồn gốc lâm sản; quy cách, số lượng, khối lượng, tồn đầu kỳ, tồn cuối kỳ.

Tổ chức quy định tại Khoản 1 Điều này khi nhập gỗ có nguồn gốc khai thác từ rừng tự nhiên trong nước phải báo cơ quan kiểm lâm sở tại kiểm tra, ký xác nhận tại sổ theo dõi nhập, xuất lâm sản.

Điều 7. Xác nhận lâm sản

1. Cơ quan có thẩm quyền xác nhận lâm sản

a) Hạt Kiểm lâm cấp huyện, Chi cục Kiểm lâm tỉnh, thành phố trực thuộc Trung ương ở những địa phương không có Hạt Kiểm lâm cấp huyện xác nhận lâm sản trong các trường hợp sau:

- Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng tự nhiên, rừng trồng tập trung trong nước của tổ chức xuất ra;

- Lâm sản có nguồn gốc nhập khẩu chưa qua chế biến ở trong nước của tổ chức, cá nhân xuất ra;

- Động vật rừng gây nuôi trong nước và bộ phận, dẫn xuất của chúng của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

- Lâm sản sau xử lý tịch thu chưa chế biến của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

- Lâm sản sau chế biến của tổ chức, cộng đồng dân cư, hộ gia đình, cá nhân xuất ra;

- Lâm sản vận chuyển nội bộ giữa các địa điểm không cùng trên địa bàn một tỉnh, thành phố trực thuộc Trung ương.

b) Hạt Kiểm lâm khu rừng đặc dụng, Hạt Kiểm lâm khu rừng phòng hộ xác nhận lâm sản xuất ra có nguồn gốc khai thác hợp pháp trong khu rừng đặc dụng, khu rừng phòng hộ đó và lâm sản sau xử lý tịch thu theo thẩm quyền xử lý của mình.

c) Kiểm lâm địa bàn tham mưu cho Ủy ban nhân dân xã, phường, thị trấn (sau đây viết chung là Uỷ ban nhân dân cấp xã) xác nhận lâm sản trong các trường hợp sau:

- Lâm sản chưa qua chế biến có nguồn gốc khai thác từ vườn nhà, trang trại, cây trồng phân tán của tổ chức xuất ra;

- Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng tự nhiên trong nước, rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra.

2. Trình tự, hồ sơ đề nghị xác nhận lâm sản

a) Chủ lâm sản nộp trực tiếp 01 bộ hồ sơ (bản chính) đề nghị xác nhận lâm sản tại cơ quan nhà nước có thẩm quyền quy định tại Khoản 1 của Điều này.

b) Hồ sơ đề nghị xác nhận lâm sản gồm: bảng kê lâm sản, hoá đơn bán hàng theo quy định của Bộ Tài chính (nếu có) và các tài liệu về nguồn gốc của lâm sản theo quy định hiện hành của Nhà nước.

Trường hợp lâm sản mua của nhiều cộng đồng, hộ gia đình, cá nhân khai thác từ vườn nhà, trang trại, cây trồng phân tán thì người mua lâm sản lập bảng kê lâm sản, có chữ ký xác nhận của đại diện cộng đồng, hộ gia đình, cá nhân đó.

3. Thời gian xác nhận

a) Thời gian xác nhận lâm sản và trả kết quả tại cơ quan xác nhận không quá 03 ngày làm việc kể từ khi nhận đủ hồ sơ hợp lệ. Trường hợp kiểm tra hồ sơ và lâm sản đảm bảo đúng quy định thì tiến hành xác nhận ngay.

Trường hợp hồ sơ không hợp lệ thì cơ quan tiếp nhận hồ sơ có trách nhiệm thông báo ngay cho chủ lâm sản biết và hướng dẫn chủ lâm sản hoàn thiện hồ sơ.

b) Trường hợp cần phải xác minh về nguồn gốc lâm sản trước khi xác nhận thì cơ quan tiếp nhận hồ sơ thông báo ngay cho chủ lâm sản biết và tiến hành xác minh những vấn đề chưa rõ về hồ sơ lâm sản, nguồn gốc lâm sản, số lượng, khối lượng, loại lâm sản; kết thúc xác minh phải lập biên bản xác minh. Sau khi xác minh, nếu không có vi phạm thì tiến hành ngay việc xác nhận lâm sản theo quy định tại Thông tư này. Thời gian xác nhận lâm sản trong trường hợp phải xác minh tối đa không quá 05 ngày làm việc kể từ khi nhận đủ hồ sơ hợp lệ.

Trường hợp xác minh phát hiện có vi phạm thì phải lập hồ sơ để xử lý theo quy định của pháp luật hiện hành.

c) Người đại diện cơ quan Nhà nước xác nhận lâm sản phải ghi ý kiến xác nhận của mình về các nội dung do chủ lâm sản đã ghi trong hồ sơ lâm sản, kể cả số, ngày, tháng, năm ghi trong hoá đơn kèm theo, biển kiểm soát của phương tiện vận chuyển (nếu có); ngày, tháng, năm xác nhận; ký, ghi rõ họ tên, chức vụ, đóng dấu của cơ quan tại bảng kê lâm sản, chịu trách nhiệm trước pháp luật về sự chính xác và nguồn gốc lâm sản hợp pháp khi xác nhận.

Trường hợp xác nhận lâm sản của Uỷ ban nhân dân cấp xã quy định tại điểm c, Khoản 1 Điều này còn phải có thêm chữ ký của Kiểm lâm địa bàn tại bảng kê lâm sản; Kiểm lâm địa bàn cũng phải chịu trách nhiệm trước pháp luật về sự chính xác và nguồn gốc lâm sản hợp pháp trong việc tham mưu đó.

Điều 8. Quản lý, lưu giữ hồ sơ lâm sản

1. Chủ lâm sản có trách nhiệm quản lý hồ sơ lâm sản (bản chính) cùng với lâm sản; lưu giữ hồ sơ lâm sản, sổ theo dõi nhập, xuất lâm sản trong thời hạn 05 năm kể từ khi lâm sản được xuất ra.

2. Cơ quan có thẩm quyền xác nhận lâm sản có trách nhiệm lưu giữ bảng kê lâm sản sau khi đã xác nhận (bản chính) và các tài liệu về nguồn gốc lâm sản (bản sao chụp) tại trụ sở cơ quan.

Chương II

HỒ SƠ LÂM SẢN HỢP PHÁP

Mục 1. HỒ SƠ NGUỒN GỐC LÂM SẢN

Điều 9. Lâm sản khai thác trong nước

1. Hồ sơ gỗ khai thác chính, khai thác tận dụng, tận thu từ rừng tự nhiên, rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán.

a) Các tài liệu về khai thác gỗ theo quy định tại Thông tư số 35/2011/TT-BNNPTNT ngày 20/5/2011 của Bộ Nông nghiệp và Phát triển nông thôn hướng dẫn thực hiện việc khai thác, tận thu gỗ và lâm sản ngoài gỗ (sau đây viết tắt là Thông tư 35/2011/TT-BNNPTNT) và các quy định hiện hành của Nhà nước.

b) Đối với gỗ đủ tiêu chuẩn đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn gồm: biên bản xác nhận gỗ đóng dấu búa kiểm lâm kèm theo bảng kê lâm sản.

Đối với gỗ không đủ tiêu chuẩn đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Hồ sơ lâm sản ngoài gỗ khai thác từ rừng trong nước

a) Đối với thực vật rừng hồ sơ gồm: các tài liệu về khai thác lâm sản ngoài gỗ quy định tại Thông tư 35/2011/TT-BNNPTNT ; bảng kê lâm sản.

b) Đối với động vật rừng: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

Điều 10. Lâm sản nhập khẩu

1. Tờ khai hải quan lâm sản nhập khẩu có xác nhận của cơ quan Hải quan cửa khẩu theo quy định hiện hành của Nhà nước.

2. Bảng kê lâm sản (Packing-list) của tổ chức, cá nhân nước ngoài xuất khẩu lâm sản.

3. Văn bản chứng nhận về nguồn gốc lâm sản và các tài liệu khác của nước xuất khẩu (nếu có).

4. Giấy phép CITES đối với lâm sản thuộc danh mục các Phụ lục I, II của Công ước về buôn bán quốc tế các loài động vật, thực vật hoang dã nguy cấp.

Điều 11. Lâm sản xử lý tịch thu

Hồ sơ lâm sản xử lý tịch thu gồm: quyết định xử lý vụ vi phạm hành chính hoặc quyết định xử lý vật chứng của cơ quan Nhà nước có thẩm quyền tịch thu lâm sản sung công quỹ Nhà nước, kèm theo biên bản vụ vi phạm và bảng kê lâm sản.

Mục 2. HỒ SƠ LÂM SẢN TRONG LƯU THÔNG

Điều 12. Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng tự nhiên trong nước

1. Hồ sơ lâm sản của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Hồ sơ lâm sản của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản có xác nhận của Uỷ ban nhân dân cấp xã.

Điều 13. Lâm sản chưa qua chế biến có nguồn gốc khai thác từ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán

1. Hồ sơ lâm sản có nguồn gốc khai thác từ rừng trồng tập trung của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Hồ sơ lâm sản có nguồn gốc khai thác từ vườn nhà, trang trại, cây trồng phân tán của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của Uỷ ban nhân dân cấp xã.

3. Hồ sơ lâm sản do cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản có xác nhận của Uỷ ban nhân dân cấp xã.

Điều 14. Lâm sản nhập khẩu chưa qua chế biến ở trong nước

1. Hồ sơ lâm sản của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Hồ sơ lâm sản của cá nhân xuất ra: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

Điều 15. Động vật rừng được gây nuôi trong nước; bộ phận, dẫn xuất của chúng

1. Hồ sơ của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Hồ sơ của cộng đồng, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

Điều 16. Lâm sản sau xử lý tịch thu chưa qua chế biến

1. Hồ sơ lâm sản do cơ quan nhà nước có thẩm quyền xử lý xuất ra gồm: hoá đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản do cơ quan bán lâm sản lập.

2. Hồ sơ lâm sản do tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

3. Hồ sơ lâm sản do cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

Điều 17. Lâm sản sau chế biến

1. Hồ sơ lâm sản sau chế biến từ gỗ rừng tự nhiên trong nước của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

2. Lâm sản sau chế biến từ gỗ nhập khẩu, gỗ sau xử lý tịch thu

a) Hồ sơ lâm sản sau chế biến từ gỗ nhập khẩu, gỗ sau xử lý tịch thu của tổ chức quy định tại điểm a, Khoản 4, Điều 26 của Thông tư này xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản.

b) Hồ sơ lâm sản sau chế biến từ gỗ nhập khẩu, gỗ sau xử lý tịch thu của tổ chức quy định tại điểm b, Khoản 4, Điều 26 của Thông tư này xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

3. Hồ sơ lâm sản sau chế biến từ gỗ rừng tự nhiên trong nước, gỗ nhập khẩu, gỗ sau xử lý tịch thu của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản có xác nhận của cơ quan kiểm lâm sở tại.

4. Hồ sơ lâm sản sau chế biến từ gỗ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán.

a) Hồ sơ lâm sản sau chế biến từ gỗ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản.

b) Hồ sơ lâm sản sau chế biến từ gỗ rừng trồng tập trung, vườn nhà, trang trại, cây trồng phân tán của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản.

5. Hồ sơ lâm sản ngoài gỗ sau chế biến

a) Hồ sơ lâm sản ngoài gỗ sau chế biến của tổ chức xuất ra gồm: hóa đơn bán hàng theo quy định của Bộ Tài chính, kèm theo bảng kê lâm sản.

b) Hồ sơ lâm sản ngoài gỗ sau chế biến của cộng đồng dân cư, hộ gia đình, cá nhân xuất ra: bảng kê lâm sản.

Điều 18. Vận chuyển lâm sản nội bộ

1. Hồ sơ vận chuyển lâm sản nội bộ trong địa bàn của một tỉnh, thành phố trực thuộc Trung ương gồm: phiếu xuất kho nội bộ, kèm theo bảng kê lâm sản.

2. Hồ sơ vận chuyển lâm sản nội bộ giữa các địa điểm không cùng trên địa bàn một tỉnh, thành phố trực thuộc Trung ương.

a) Hồ sơ vận chuyển gỗ, động vật rừng, bộ phận, dẫn xuất của chúng gồm: phiếu xuất kho nội bộ, kèm theo bảng kê lâm sản trên từng phương tiện vận chuyển có xác nhận của cơ quan kiểm lâm sở tại.

b) Hồ sơ vận chuyển lâm sản không thuộc quy định tại điểm a của Khoản này gồm: phiếu xuất kho nội bộ, kèm theo bảng kê lâm sản.

Điều 19. Vận chuyển lâm sản quá cảnh

1. Tờ khai hải quan lâm sản quá cảnh có xác nhận của cơ quan Hải quan cửa khẩu theo quy định hiện hành của Nhà nước.

2. Bảng kê lâm sản (Packing-list) của tổ chức, cá nhân nước ngoài xuất khẩu lô hàng đó.

3. Giấy phép CITES đối với lâm sản thuộc danh mục các Phụ lục I, II của Công ước về buôn bán quốc tế các loài động vật, thực vật hoang dã nguy cấp.

4. Trường hợp lâm sản vận chuyển quá cảnh được bốc dỡ trên lãnh thổ của Việt Nam để chuyển tiếp do thay đổi phương tiện vận chuyển hoặc qua trung chuyển tại bến cảng, nhà ga..., hồ sơ lâm sản vận chuyển quá cảnh tiếp theo gồm: bảng kê lâm sản cho từng chuyến, từng phương tiện vận chuyển, kèm theo bản sao chụp có chứng thực hồ sơ lâm sản vận chuyển quá cảnh quy định tại các Khoản 1, 2, 3 của Điều này.

Mục 3. HỒ SƠ LÂM SẢN TẠI CƠ SỞ CHẾ BIẾN, KINH DOANH, CẤT GIỮ

Điều 20. Hồ sơ lâm sản tại cơ sở chế biến, kinh doanh, gây nuôi động vật rừng

Hồ sơ lâm sản tại cơ sở chế biến, kinh doanh, gây nuôi động vật rừng gồm: sổ theo dõi nhập, xuất lâm sản; hoá đơn bán hàng; bảng kê lâm sản và các tài liệu khác liên quan đến lâm sản nhập vào, xuất ra quy định tại Thông tư này.

Điều 21. Hồ sơ lâm sản tại nơi cất giữ

Hồ sơ lâm sản tại nơi cất giữ tương ứng với từng loại lâm sản ở các giai đoạn của quá trình chu chuyển lâm sản (nguồn gốc lâm sản; lưu thông lâm sản; chế biến, kinh doanh) theo quy định tại Thông tư này.

Chương III

KIỂM TRA NGUỒN GỐC LÂM SẢN

Mục 1. NGUYÊN TẮC KIỂM TRA LÂM SẢN

Điều 22. Tổ chức hoạt động kiểm tra

1. Kiểm tra lâm sản được thực hiện trong quá trình khai thác, vận chuyển, chế biến, kinh doanh, gây nuôi, cất giữ lâm sản do cơ quan Kiểm lâm các cấp thực hiện.

Trường hợp khi kiểm tra, phát hiện chủ lâm sản không có đầy đủ hồ sơ lâm sản hoặc lâm sản thực tế không phù hợp với hồ sơ lâm sản quy định tại Thông tư này, cơ quan thực hiện kiểm tra phải tổ chức điều tra, xác minh về nguồn gốc lâm sản.

2. Hoạt động kiểm tra lâm sản thực hiện theo kế hoạch hoặc kiểm tra đột xuất khi phát hiện hoặc có thông tin về dấu hiệu vi phạm pháp luật của chủ lâm sản. Trong quá trình thực hiện kiểm tra, công chức kiểm lâm phải mặc đồng phục kiểm lâm, đeo cấp hiệu, phù hiệu, biển hiệu đúng quy định của Nhà nước.

3. Mọi trường hợp kiểm tra lâm sản phải thực hiện đúng trình tự, thủ tục kiểm tra theo quy định của pháp luật; phải lập biên bản theo mẫu số 03 hoặc 04 (đối với kiểm tra khai thác lâm sản) ban hành kèm theo Thông tư này. Trường hợp kiểm tra phát hiện có vi phạm các quy định của Nhà nước phải lập biên bản vi phạm hành chính theo quy định tại Nghị định số 99/2009/NĐ-CP ngày 02/11/2009 của Chính phủ về xử phạt vi phạm hành chính trong lĩnh vực quản lý rừng, bảo vệ rừng và quản lý lâm sản.

Điều 23. Kiểm tra theo tin báo

1. Tiếp nhận, xử lý tin báo

a) Khi nhận tin báo về hành vi vi phạm pháp luật, công chức kiểm lâm nhận tin báo phải báo cáo Thủ trưởng đơn vị. Trường hợp công dân trực tiếp đến trụ sở cơ quan để tố cáo phải được lập biên bản về tiếp nhận tin báo của công dân. Trường hợp nhận tin báo qua điện thoại, công chức kiểm lâm nhận tin báo phải đề nghị người báo tin cung cấp các thông tin về: họ tên, địa chỉ, số điện thoại của mình; nếu người báo tin không cung cấp các thông tin này, thì công chức kiểm lâm nhận tin phải báo cáo ngay Thủ trưởng đơn vị.

b) Thủ trưởng cơ quan kiểm lâm có trách nhiệm lập sổ theo dõi tin báo và tổ chức quản lý sổ theo dõi tin báo theo chế độ quản lý tài liệu mật.

2. Tổ chức kiểm tra theo tin báo

Tin báo của các tổ chức, cá nhân dưới mọi hình thức được coi là căn cứ để xem xét việc tổ chức kiểm tra lâm sản. Thủ trưởng đơn vị nhận tin báo quyết định việc triển khai kiểm tra theo tin báo khi có căn cứ xác đáng.

Mục 2. KIỂM TRA KHAI THÁC LÂM SẢN

Điều 24. Kiểm tra thực hiện các quy định về khai thác lâm sản

1. Nội dung kiểm tra

a) Việc chấp hành quy định của pháp luật trước khi khai thác: phê duyệt thiết kế khai thác, giấy phép khai thác, chuẩn bị hiện trường (phát luỗng rừng, làm mới, sửa chữa đường vận xuất, kho bãi gỗ, mốc giới khu khai thác).

b) Việc chấp hành quy định của pháp luật trong và sau quá trình khai thác: địa danh khai thác; chấp hành quy trình kỹ thuật; số lượng, khối lượng, chủng loại lâm sản khai thác chính, tận dụng, vệ sinh rừng; việc bàn giao rừng, bảo vệ rừng sau khai thác.

c) Hồ sơ, tài liệu liên quan đến khai thác lâm sản.

2. Phương pháp kiểm tra

a) Kiểm tra toàn bộ tại hiện trường hoặc chọn ngẫu nhiên tối thiểu 30% (ba mươi phần trăm) diện tích rừng được phép khai thác.

b) Đối chiếu hồ sơ khai thác với lâm sản khai thác thực tế tại hiện trường.

Điều 25. Kiểm tra lâm sản được khai thác

1. Đối với gỗ đã khai thác, vận xuất, vận chuyển tới tại bãi tập trung thực hiện kiểm tra gỗ đồng thời với đóng dấu búa kiểm lâm như sau:

a) Kiểm tra địa điểm tập trung gỗ sau khai thác; số lượng, khối lượng, tên loài, việc cắt khúc, đánh số thứ tự đầu cây; dấu búa bài cây ... theo quy định của Bộ Nông nghiệp và Phát triển nông thôn.

b) Kiểm tra hồ sơ khai thác theo quy định tại Điều 24 của Thông tư này.

2. Đối với lâm sản ngoài gỗ kiểm tra về số lượng, khối lượng, tên loài; kiểm tra, xác nhận tại bảng kê lâm sản; hồ sơ khai thác theo quy định tại Điều 24 của Thông tư này.

Mục 3. KIỂM TRA LÂM SẢN TẠI CƠ SỞ CHẾ BIẾN, KINH DOANH, NƠI CẤT GIỮ; CƠ SỞ GÂY NUÔI ĐỘNG VẬT RỪNG

Điều 26. Kiểm tra cơ sở chế biến, kinh doanh lâm sản

1. Khi kiểm tra lâm sản tại cơ sở chế biến, kinh doanh lâm sản phải có văn bản của Thủ trưởng cơ quan kiểm lâm có thẩm quyền.

Trường hợp phát hiện lâm sản có nguồn gốc không hợp pháp, thì công chức kiểm lâm đang thi hành công vụ được quyền tổ chức kiểm tra ngay, đồng thời báo cáo cho Thủ trưởng cơ quan.

2. Chủ cơ sở chế biến, kinh doanh phải chấp hành các yêu cầu kiểm tra của công chức kiểm lâm kiểm tra; xuất trình ngay hồ sơ về quản lý cơ sở chế biến, kinh doanh và nguồn gốc lâm sản theo quy định tại Thông tư này.

3. Nội dung kiểm tra

a) Hồ sơ quản lý cơ sở chế biến, kinh doanh: Giấy chứng nhận đăng ký kinh doanh, trong đó có hoạt động về chế biến, kinh doanh lâm sản do cơ quan Nhà nước có thẩm quyền cấp.

b) Hồ sơ lâm sản.

c) Lâm sản hiện có tại cơ sở chế biến, kinh doanh.

d) Kiểm tra dấu búa kiểm lâm đối với gỗ phải đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn.

đ) Việc lưu trữ hồ sơ lâm sản.

4. Trong quý I hàng năm Chi cục Kiểm lâm có trách nhiệm rà soát, phân loại; thông báo công khai đến cơ sở chế biến, kinh doanh lâm sản trên địa bàn và niêm yết tại trụ sở Chi cục Kiểm lâm, đồng thời báo cáo Cục Kiểm lâm về việc chấp hành pháp luật của các tổ chức này theo hai loại:

a) Cơ sở chế biến, kinh doanh lâm sản chấp hành tốt các quy định của Nhà nước.

b) Cơ sở chế biến, kinh doanh lâm sản có vi phạm các quy định của Nhà nước về hồ sơ lâm sản hoặc chấp hành chưa đầy đủ các quy định của Nhà nước.

Điều 27. Kiểm tra cất giữ lâm sản

1. Kiểm tra nơi cất giữ lâm sản không thuộc quy định tại Điều 26 của Thông tư này kể cả nhà ga, bến cảng, kho vận phải có văn bản của Thủ trưởng cơ quan kiểm lâm.

Trường hợp phát hiện lâm sản có nguồn gốc không hợp pháp, thì công chức kiểm lâm đang thi hành công vụ được quyền tổ chức kiểm tra ngay, đồng thời báo cáo cho Thủ trưởng cơ quan.

2. Chủ nơi cất giữ và chủ lâm sản phải chấp hành các yêu cầu của công chức kiểm lâm; xuất trình ngay hồ sơ lâm sản đang được cất giữ theo quy định tại Thông tư này.

3. Nội dung kiểm tra

a) Hồ sơ lâm sản đang cất giữ.

b) Lâm sản hiện có tại nơi cất giữ.

c) Kiểm tra dấu búa kiểm lâm đối với gỗ phải đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn.

Điều 28. Kiểm tra cơ sở gây nuôi động vật rừng

1. Khi kiểm tra cơ sở gây nuôi động vật rừng công chức kiểm lâm kiểm tra phải có văn bản của Thủ trưởng cơ quan kiểm lâm có thẩm quyền.

Trường hợp phát hiện lâm sản có nguồn gốc không hợp pháp, thì công chức kiểm lâm đang thi hành công vụ được quyền tổ chức kiểm tra ngay, đồng thời báo cáo cho Thủ trưởng cơ quan.

2. Nội dung kiểm tra

a) Việc chấp hành quy định của pháp luật về gây nuôi: giấy chứng nhận đăng ký gây nuôi, điều kiện chuồng trại, nguồn gốc động vật, vệ sinh môi trường.

b) Hồ sơ nhập, xuất động vật rừng.

c) Động vật rừng đang nuôi.

Mục 4. KIỂM TRA LÂM SẢN TRONG LƯU THÔNG

Điều 29. Kiểm tra lâm sản đang vận chuyển

1. Công chức kiểm lâm chỉ được dừng phương tiện đường bộ, đường thuỷ đang lưu thông để kiểm tra lâm sản khi có căn cứ xác định trên phương tiện có vận chuyển lâm sản trái pháp luật. Người chỉ huy dừng phương tiện phải chịu trách nhiệm trước pháp luật về quyết định dừng phương tiện của mình.

Hiệu lệnh dừng phương tiện có thể sử dụng một hoặc sử dụng kết hợp còi, cờ hiệu kiểm lâm, đèn pin.

Không đặt sào chắn (ba-ri-e) trên đường bộ để dừng phương tiện giao thông để kiểm tra lâm sản. Trường hợp đặc biệt, phải được Chủ tịch Uỷ ban nhân dân cấp tỉnh quyết định và chịu trách nhiệm về chỉ đạo, tổ chức thực hiện.

2. Người điều khiển phương tiện vận chuyển lâm sản phải chấp hành hiệu lệnh dừng phương tiện của công chức kiểm lâm; xuất trình ngay hồ sơ lâm sản (bản chính) trên phương tiện theo quy định tại Thông tư này và hồ sơ về phương tiện vận chuyển theo quy định hiện hành của Nhà nước.

3. Nội dung kiểm tra

a) Hồ sơ lâm sản.

b) Lâm sản hiện có trên phương tiện vận chuyển.

c) Kiểm tra dấu búa kiểm lâm đối với gỗ phải đóng búa kiểm lâm theo quy định của Bộ Nông nghiệp và Phát triển nông thôn.

Sau khi kiểm tra, người chủ trì kiểm tra phải ghi tên của cơ quan kiểm tra; ngày, tháng, năm, địa điểm kiểm tra; khối lượng, số lượng lâm sản trên phương tiện vận chuyển; ký, ghi rõ họ tên tại mặt sau tờ hoá đơn bán hàng và bảng kê lâm sản.

Điều 30. Kiểm tra lâm sản nhập khẩu, xuất khẩu, quá cảnh tại cửa khẩu

Trong trường hợp cần xác minh nguồn gốc lâm sản nhập khẩu, xuất khẩu, quá cảnh, Chi cục Kiểm lâm phối hợp với cơ quan Hải quan cửa khẩu tổ chức kiểm tra, xác minh nguồn gốc lâm sản theo quy định tại Thông tư này và các quy định hiện hành của pháp luật.

Chương IV

TỔ CHỨC THỰC HIỆN

Điều 31. Hiệu lực thi hành

1. Thông tư này có hiệu lực sau 45 ngày kể từ ngày ký ban hành.

2. Thông tư này thay thế Quyết định số 59/2005/QĐ-BNN ngày 10/10/2005 của Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn về việc ban hành Quy định về kiểm tra, kiểm soát lâm sản.

Điều 32. Chế độ báo cáo

1. Định kỳ 03 tháng một lần vào ngày cuối quý, cơ sở khai thác, chế biến, kinh doanh lâm sản gửi báo cáo theo mẫu số 05 ban hành kèm theo Thông tư này về tình hình nhập, xuất lâm sản cho cơ quan kiểm lâm sở tại.

2. Đối với các cơ quan có thẩm quyền xác nhận lâm sản

a) Định kỳ 01 tháng một lần vào tuần đầu của tháng kế tiếp, Uỷ ban nhân dân cấp xã gửi báo cáo theo mẫu số 06 ban hành kèm theo Thông tư này về tình hình xác nhận lâm sản cho cơ quan kiểm lâm sở tại, nếu trong tháng có xác nhận lâm sản quy định tại Thông tư này.

b) Định kỳ 01 quý một lần vào tuần thứ 2 của quý kế tiếp, cơ quan kiểm lâm sở tại gửi báo cáo theo mẫu số 06 ban hành kèm theo Thông tư này về tình hình nhập, xuất lâm sản trên địa bàn cho Chi cục Kiểm lâm cấp tỉnh.

c) Chi cục Kiểm lâm cấp tỉnh có trách nhiệm cung cấp, báo cáo tình hình quản lý lâm sản và kiểm tra nguồn gốc lâm sản trên địa bàn theo quy định tại Thông tư này khi Cục Kiểm lâm yêu cầu.

Điều 33. Xử lý vi phạm

Tổ chức, cá nhân vi phạm các quy định tại Thông tư này, tùy theo tính chất, mức độ vi phạm, bị xử lý kỷ luật, xử phạt vi phạm hành chính hoặc bị truy cứu trách nhiệm hình sự theo quy định của pháp luật./.

CIRCULAR

STIPULATING DOSSIERS OF LAWFUL FOREST PRODUCTS AND INSPECTION OF THE ORIGIN OF FOREST PRODUCTS

Pursuant to the December 3, 2004 Law on Forest Protection and Development;

Pursuant to the Government's Decree No. 23/2006/ND-CP of March 3, 2006, on implementation of the Law on Forest Protection and Development;

Pursuant to the Government's Decree No. 01/2008/ND-CP of January 3, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development, and Decree No. 75/2009/ND-CP of September 10, 2009, amending Article 3 of Decree No. 01/2008/ND-CP;

The Ministry of Agriculture and Rural Development stipulates dossiers of lawful forest products and inspection of the origin of forest products as follows:

Chapter I

GENERAL PROVISIONS

This Circular stipulates dossiers of lawful forest products and inspection of the origin of timber and non-timber forest products (below commonly referred to as forest products) within the territory of the Socialist Republic of Vietnam.

Article 2. Subjects of application

This Circular applies to domestic organiza­tions, population communities, households and individuals; and foreign organizations and individuals that are engaged in the exploitation, transportation, processing, trading and storage of forest products within the territory of the Socialist Republic of Vietnam.

Article 3. Interpretation of terms

In this Circular the terms and expressions below are construed as follows:

1. Local forest protection agencies include forest ranger offices of special-use forests and protection forests: forest ranger offices of rural districts, towns, urban districts, cities (below collectively referred to as district-level forest ranger offices); provincial-level forest protection sub-departments of localities without district-level forest ranger offices.

2. Dossier of forest products means documentary records of forest products made and kept at forest product production and trading establishments and circulated together with forest products during the exploitation, trading, transportation, processing and storage.

3. Non-timber forest product means a forest animal or plant which does not meet the standards of timber specified at Points b and c, Clause 3, Article 5 of this Circular and its parts and derivatives.

4. Forest animal or plant derivative means any form of material extracted from a forest animal or plant, such as blood and biliary fluid of a forest animal; resin and essential oil extracted from an unprocessed forest plant.

6. Forest product receipt and delivery monitoring book means a book made according to Form No.2 attached to this Circular (not printed herein) for recording forest products received, delivered and kept by a forest product exploitation, processing or trading establishment.

7. Internal transportation means the transportation of forest products between dependent cost-accounting units such as forest farms, forestry companies, processing plants, branches or stores of an independent cost-accounting enterprise with the legal person status; or the transportation of forest products from an independent cost-accounting enterprise with the legal person status to its dependent cost-accounting units and vice versa.

For forest owners, organizations or individuals that purchase standing trees, the transportation of these forest products from timber exploitation sites to their warehouses or processing establishments is also considered internal transportation,

8. Certification of forest products means determination of the lawfulness of dossiers of forest products and compatibility of these dossiers with forest products.

9. Unprocessed forest product means a forest product which, after being exploited, delivered and confiscated, has not yet been treated by any tools or equipment and is still in its original shape and size.

Article 4. Determination of forest product quantity and volume

1. Volume of round timber, sawn timber and square timber shall be determined under the Ministry of Agriculture and Rural Development's regulations on management and hammer marking of trees.

For stumps and roots, timber with complex shape, ornamental trees, trees for shadow or secular trees, including their roots, trunks, branches and leaves, which cannot be measured for determining their volumes, they shall be weighed in kilogram (kg) and converted at the ratio of 1,000 kg equivalent to 1 m3 of round timber or measured in ster and converted at the ratio of one ster equivalent to 0.7 m3 of round limber.

2. Quantity of forest animals shall be determined in number of forest animal individuals which are weighed in kg. If it is impossible to determine the number of individuals, these animals will be weighed in kg.

3. Quantity of forest products from non-timber forest plants shall be determined by weighing in kg.

Article 5. Packing lists of forest products

1. The form of packing lists of forest organizations, communities, households and individuals.

2. Packing lists of forest products shall be made by organizations, communities, households and individuals engaged in forest product exploitation, receipt and delivery upon each pre-receipt inspection and forest protection hammer marking or pre-receipt inspection and delivery of forest products carried on the same vehicle.

Organizations, communities, households and individuals that make packing lists of forest products shall take responsibility before law for the accuracy and lawful origin of forest products specified in their packing lists.

3. Method of making a packing list of forest products:

a/ The forest product owner writes all contents of forest products in the packing list.

b/ He/she enumerates in detail raw logs, round timber and timber with the smaller end's diameter of between 10 and 20 cm and a length of 1 m or longer or with the smaller end's diameter of 20 cm or larger and a length of 30 cm or more, and sawn timber planks and cut timber blocks of a length of 1 m or more, a width of 20 cm or more and a thickness of 5 cm or more.

c/ He/she writes the total quantity, volume or weight of round timber, cut timber and sawn timber with sizes smaller than those specified at Point b of this Clause.

e/ At the bottom of each page of the packing list, he/she writes the total volume of forest products.

Article 6. Forest product receipt and delivery monitoring books

1. The form of forest product receipt and delivery monitoring books provided in this Circular applies to all forest product exploitation, processing and trading organizations.

2. Forest product receipt and delivery monitoring books shall be managed at organizations specified in Clause 1 of this Article. Immediately after forest products are received or delivered, forest product owners shall clearly write in the book the following information: date of receipt or delivery; names and origin of forest products; specifications, quantity, volume, and balances at the beginning and the end of the period.

When receiving timber exploited from natural forests in the country, organizations mentioned in Clause 1 of this Article shall report such to local forest protection agencies for inspection and signing for certification in their forest product receipt and delivery monitoring books.

Article 7. Certification of forest products

1. Agencies competent to certify forest products

a/ District-level forest ranger offices or provincial-level forest protection sub-departments in localities having no district-level forest ranger offices may certify the following forest products:

- Unprocessed forest products exploited from natural forests or consolidated planted forests in the country, of delivering organizations;

- Forest animals raised in the country and their parts or derivatives, of delivering organizations, communities, households or individuals;

- Confiscated unprocessed forest products of receiving organizations, communities, households or individuals;

- Processed forest products of receiving organizations, communities, households or individuals;

- Forest products transported internally among places not in the same province or centrally run city.

b/ Forest ranger offices of special-use forests or protection forests may certify forest products lawfully exploited from these forests and confiscated forest products according to their competence;

c/ Local forest protection agencies shall advise People's Committees of communes, wards or townships (below collectively referred to as commune-level People's Committees) may certify the following forest products:

- Unprocessed forest products exploited from home gardens, farms or scattered trees by delivering organizations;

- Unprocessed forest products exploited from natural forests in the country, consolidated planted forests, home gardens, farms or scattered trees by delivering communities, households or individuals.

2. Procedures and dossiers of request for forest product certification

b/ A dossier of request for forest product certification comprises a packing list of forest products, sale invoices under the Ministry of Finance's regulations (if any) and documents on the origin of forest products under the State's current regulations.

For forest products purchased from many communities, households or individuals that have exploited them from their home gardens, farms or scattered trees, the forest product purchaser shall make a packing list with the signatures of representatives of such communities, households or individuals.

3. Certification time limit

a/ The time limit for forest product certification and notification of certification results is 3 working days after the date of receiving a complete and valid dossier. Certification must be given immediately in case the examined dossier is valid and forest products are compliant with regulations.

For an invalid dossier, the dossier-receiving agency shall promptly notify such to and guide the forest product owner in completing the dossier.

b/ In case of necessity to verify the origin of forest products before certification, the dossier-receiving agency shall promptly notify such to the forest product owner and verify unclear matters in the forest product dossier, origin, quantity, volume and category and make a written record of the verification upon completing the verification. If the verification finds no violation, forest products shall be promptly certified under this Circular. In case of verification, the time limit for forest product certification is 5 working days after the receipt of a complete and valid dossier.

In case a violation is detected through verification, a dossier shall be made for handling the violation under current laws.

c/ The representative of the stale agency certifying forest products shall write his/her opinions on the details provided by the forest product owner in the forest product dossier, including the number and date written in the enclosed invoices, license plate number of the vehicle (if any); date of certification; and sign and write his/her full name and position and append the seal of his/her agency on the packing list, and take responsibility before law for the accuracy and lawful origin of certified forest products.

In case of certification of forest products by commune-level People's Committees under Point c, Clause I of this Article, signatures of local rangers on packing lists of forest products are also required. For their advice, local ranger officers shall also take responsibility before law for the accuracy and lawful origin of forest products.

1. Forest product owners shall manage forest product dossiers (original) together with forest products; and preserve these dossiers and forest product receipt and delivery monitoring books for 5 years after forest products are delivered.

2. Agencies competent to certify forest products shall preserve the packing lists of forest products (original) after giving certification and documents on the origin of forest products (copies) at their offices.

Chapter II

DOSSIERS OF LAWFUL FOREST PRODUCTS

Section 1: FOREST PRODUCT ORIGIN DOSSIERS

Article 9. Domestically exploited forest products

1. A dossier of timber exploited as primary or secondary forest products or fully extracted from natural forests or consolidated planted forests, home gardens, farms or scattered trees comprises:

a/ Documents on timber exploitation under the Ministry of Agriculture and Rural Development's Circular No. 35/2011/TT-BNNPTNT of May 20, 2011, guiding the exploitation and full extraction of timber and non-timber forest products (below referred to as Circular No. 35/2011/TT-BNNPTNT) and other relevant current regulations.

b/ For timber eligible for forest ranger hammer-marking under the Ministry of Agriculture and Rural Development's regulations, such a dossier comprises a written certification of timber bearing forest ranger hammer marks enclosed with a packing list of forest products.

2. A dossier of non-timber forest products exploited from domestic forests:

a/ For forest plants: documents on exploitation of non-timber forest products as specified in Circular No. 35/2011/TT-BNNPTNT; and a packing list of forest products.

b/ For forest animals: A packing list of forest products with the certification of the local forest protection agency.

Article 10. Imported forest products

1. Customs declaration of imported forest products with the certification of the border-gate customs office under the State's current regulations.

2. Packing list of forest products made by the foreign forest product exporter.

3. Written certification of the origin of forest products and other documents of the country of exportation (if any).

4. CITES permit for forest products on the list provided in Annex I or 11 to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Section 2: DOSSIERS OF FOREST PRODUCTS IN CIRCULATION

Article 12. Unprocessed forest products exploited from natural forests in the country

1. A forest product dossier of a delivering organization comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of a local forest protection agency.

2. A forest product dossier of a delivering community, household or individual comprises a packing list of forest products with the certification of the commune-level People's Committee.

Article 13. Unprocessed forest products exploited from consolidated planted forests, home gardens, farms or scattered trees

1. A dossier of forest products exploited from consolidated planted forests of a delivering organization comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of a local forest protection agency.

2. A dossier of forest products exploited from home garden, farm or scattered trees of a delivering organization comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of the commune-level People's Committee.

3. A forest product dossier of a delivering community, household or individual comprises a packing list of forest products with the certification of the commune-level People's Committee.

Article 14. Imported forest products which are not processed in the country

2. A forest product dossier of a delivering individual comprises a packing list of forest products with the certification of a local forest protection agency.

Article 15. Forest animals raised in the country and their parts or derivatives

1. A dossier of a delivering organization comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of a local forest protection agency.

2. A dossier of a delivering community, household or individual comprises a packing list of forest products with the certification of a local forest protection agency.

Article 16. Confiscated unprocessed forest products

1. A forest product dossier of a delivering state agency with handling competence comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products made by the forest product-selling agency.

2. A forest product dossier of a delivering organization comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of a local forest protection agency.

3. A forest product dossier of a delivering community, household or individual comprises a packing list of forest products with the certification of a local forest protection agency.

Article 17. Processed forest products

2. For forest products processed from imported or confiscated timber:

a/ A dossier of forest products processed from imported or confiscated timber of a delivering organization defined at Point a. Clause 4, Article 26 of this Circular comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products.

b/ A dossier of forest products processed from imported or confiscated timber of an organization defined at Point b, Clause 4, Article 26 of this Circular comprises sale invoices under the Ministry of Finance's regulations, enclosed with a packing list of forest products with the certification of a local forest protection agency.

3. A dossier of forest products processed from timber from natural forests in the country, imported or confiscated timber of a delivering community, household or individual comprises a packing list of forest products with the certification of a local forest protection agency.

4. A dossier of forest products processed from timber of consolidated planted forests, home gardens, farms or scattered trees:

a/ A dossier of forest products processed from limber of consolidated planted forests, home gardens, farms or scattered trees of a delivering organization comprises sale invoices under the Ministry of Finance's regulations enclosed with a packing list of forest products.

b/ A dossier of forest products processed from timber of consolidated planted forests, home gardens, farms or scattered trees of a delivering community, household or individual comprises a packing list of forest products.

5. A dossier of processed non-timber forest products:

a/ A dossier of processed non-timber forest products of a delivering organization comprises sale invoices under the Ministry of Finance's regulations enclosed with a packing list of forest products.

Article 18. Internal transportation of forest products

1. A dossier of internal transportation of forest products within a province or centrally run city comprises an internal ex-warehousing bill enclosed with a packing list of forest products.

2. A dossier of internal transportation of forest products between places not within the same province or centrally run city.

a/ A dossier of transportation of timber, forest animals or their parts or derivatives comprises an internal ex-warehousing bill enclosed with a packing list of forest products on each transportation vehicle with the certification of a local forest protection agency.

b/ A dossier of transportation of forest products other than those specified at Point a of this Clause comprises an internal ex-warehousing bill enclosed with a packing list of forest products.

Article 19. Transportation of in-transit forest products

1. Customs declaration of in-transit forest products with the certification of a border-gate customs office under the State's current regulations.

2. Packing list of forest products of the foreign organization or individual that exports the goods lot.

3. CITES permit, for forest products on the list in Annex I or II to the Convention on International Trade in Endangered Species of Wild Fauna and Flora.

Section 3: FOREST PRODUCT DOSSIERS AT PROCESSING TRADING OR STORING ESTABLISHMENTS

Article 20. Forest product dossiers at establishments processing, trading in or raising forest animals

A forest product dossier at an establishment processing, trading in or raising forest animals comprises a forest product receipt and delivery monitoring book; sale invoices; a packing list of forest products and other documents related to received or delivered forest products as specified in this Circular.

Article 21. Forest product dossiers at storage places

Forest product dossiers at storage places are made for each category of forest products in the different stages of the forest product circulation process (origin of forest products; forest product circulation, processing and trading) under this Circular.

Chapter III

INSPECTION OF ORIGIN OF FOREST PRODUCTS

Section 1: PRINCIPLES OF INSPECTION OF FOREST PRODUCTS

Article 22. Organization of inspection

In case forest product owners are detected through inspection as having incomplete forest product dossiers or actual forest products are inconsistent with their dossiers specified in this Circular, inspecting agencies shall investigate and verify the origin of these forest products.

2. Inspection of forest products shall be conducted under plans or upon detection or receipt of information on violations of forest product owners. In the course of inspection, forest protection officers shall wear their uniform, badges and insignias according to the State's regulations.

3. Every inspection of forest products shall be conducted according to the law-prescribed order and procedures and recorded in writing according to Form No. 03 or 04 attached to this Circular (not printed herein). In case of detecting a violation of the State's regulations, a written record of administrative violation must be made under the Government's Decree No. 99/2009/ND-CP of November 2, 2009, on sanctioning of administrative violations in the field of forest management and protection and forest product management.

Article 23. Report-based inspection

1. Receipt and processing of reports:

a/ Upon receiving a report on a violation, a forest protection officer shall report it to the head of his/her unit. In case a citizen personally denounces at the forest protection office, the receipt of the report must be recorded in writing. In case of receiving a report via phone, a forest protection officer shall request the reporting person to provide on his/her full name, address and telephone number. If the reporting person fails to provide such information, the forest protection officer shall immediately report such to the head of his/her unit.

b/ The head of a forest protection agency shall compile a book, for monitoring reports and manage such book according to the regime of management of confidential documents.

2. Report-based inspection

Reports of organizations and individuals in any form are regarded as grounds for considering the inspection of forest products. Heads of report-receiving units shall decide to conduct report-based inspection when there are reliable grounds.

Article 24. Inspection of compliance with regulations on exploitation of forest products

1. Inspection covers:

a/ Observance of laws before the exploitation: Approval of exploitation design, exploitation permit, preparation of exploitation site (clearance of bushes, building or repair of roads, timber storing yards and warehouses, placement of exploitation area markers).

b/ Observance of laws during and after the exploitation: places of exploitation; observance of technical processes; quantities, volumes and categories of forest products from primary or secondary exploitation or forest cleaning; handover of forests or forest protection after exploitation.

c/ Dossiers and documents related to forest product exploitation.

2. Inspection methods

a/ Inspection of the entire exploitation site or inspection of randomly selected areas accounting for at least 30% (thirty percent) of the total forest area permitted for exploitation.

b/ Comparison of exploitation dossiers against forest products actually exploited from the exploitation site.

Article 25. Inspection of exploited forest products

a/ Inspection of storage places of exploited timber; quantities, volumes, names of plant species, log cutting and numbering, hammer mark, etc., under regulations of the Ministry of Agriculture and Rural Development.

b/ Inspection of exploitation dossiers under Article 24 of this Circular.

2. For non-timber forest products, inspection quantities, volumes and names of species shall be inspected; inspection and certification shall be made on packing lists of forest products and exploitation dossiers under Article 24 of this Circular.

Section 3: INSPECTION OF FOREST PRODUCTS AT PROCESSING TRADING OR STORING ESTABLISHMENTS; FOREST ANIMAL RAISING ESTABLISHMENTS

Article 26. Inspection of forest product processing or trading establishments

1. In case of inspection of forest products at forest product processing or trading establishments, written decisions of heads of competent forest protection agencies are required.

When detecting forest products of unlawful origin, forest protection officers on duty may immediately organize an inspection and concurrently report such to their heads.

2. Owners of processing or trading establishments shall comply with inspection requests of forest protection officers on duty; and promptly produce dossiers on the management of these processing or trading establishments and origin of forest products under this Circular.

3. Inspection contents:

b/ Forest product dossier.

c/ Forest products currently available at the processing or trading establishment.

d/ Forest ranger hammer marks on timber subject to forest ranger marking under the Ministry of Agriculture and Rural Development's regulations.

e/ Preservation of forest product dossiers.

4. In the first quarter every year, forest protection sub-departments shall review and classify forest product processing or trading establishments in their localities, notify review and classification results to these establishments and publicly post up these results at their offices and concurrently report to the Forest Protection Department on the observance of law by these establishments which are divided into two groups:

a/ Forest product processing or trading establishments that have properly observed the State's regulations.

b/ Forest product processing or trading establishments that have violated the State's regulations on forest product dossiers or improperly observed the Slate's regulations.

Article 27. Inspection of forest product storage

1. In case of inspection of forest product storage places which are not specified in Article 26 of this Circular, including stations, ports and forwarding warehouses, written decisions of heads of forest protection agencies are required.

2. Storage place owners and forest product owners shall comply with requests of forest protection officers and promptly produce dossiers of stored forest products under this Circular.

3. Inspection contents:

a/ Dossier of stored forest products.

b/ Forest products currently available at the place of storage;

c/ Forest ranger hammer marks on timber subject to forest ranger marking under the Ministry of Agriculture and Rural Development's regulations.

Article 28. Inspection of forest animal-raising establishments

1. When inspecting forest animal-raising establishments, forest protection officers shall produce written decisions of heads of competent forest protection agencies.

Upon detecting forest products of unlawful origin, forest protection officers on duty may immediately organize an inspection and concurrently report such to their heads.

2. Inspection contents:

b/ Forest animal receipt and delivery dossier.

c/ Forest animals currently raised.

Section 4: INSPECTION OF FOREST PRODUCTS IN CIRCULATION

Article 29. Inspection of forest products in transportation

1. Forest protection officers may stop road vehicles or waterway craft for inspection of forest products when having grounds to believe these vehicles or craft are transporting unlawful forest products. Persons who stop the vehicles or craft shall take responsibility before law for their decisions.

An order to stop a vehicle or craft may use one or a combination of forest ranger whistle, flag and torch.

Barriers are not allowed to be put up on roads to stop vehicles for inspection of forest products. In special cases, there must be decisions of chairpersons of provincial-level People's Committees who shall take responsibility for directing and organizing the putting up of barriers.

2. Drivers of forest product-transporting vehicles shall obey stop orders of forest protection officers; and immediately produce dossiers (original) of forest products on their vehicles under this Circular and dossiers of their vehicles under the State's current regulations.

3. Inspection contents

b/ Forest products on the vehicle.

c/ Forest protection hammer marks on timber subject to forest ranger marking under the Ministry of Agriculture and Rural Development's regulations.

After the inspection, the inspector in charge shall write the name of the inspecting agency; date and place of inspection; quantity and volume of forest products on the vehicle; sign and write his/her full name on the back side of the sale invoice and packing list of forest products.

Article 30. Inspection of imported, exported or transited forest products at border gates

When necessary to verify the origin of imported, exported or transited forest products, forest protection sub-departments shall coordinate with border-gate customs offices in inspecting and verifying the origin of forest products under this Circular and current relevant laws.

Chapter IV

ORGANIZATION OF IMPLEMENTATION

Article 31. Effect

1. This Circular takes effect 45 days after its signing.

Article 32. Reporting regime

1. On the last day of every quarter, forest product exploiting, processing or trading establishments shall send reports, made according to Form No. 05 attached to this Circular (not primed herein), on the situation of forest product receipt or delivery to local forest protection agencies.

2. For agencies competent to certify forest products

a/ In the first week of every month, commune-level People's Committees shall send reports, made according to Form No. 06 attached to this Circular (no! printed herein), on the preceding month's certification of forest products to local forest protection agencies, if they certify forest products under this Circular in that month.

b/ In the second week of every quarter, local forest protection agencies shall send reports, made according to Form No. 06 attached to this Circular, the receipt and delivery of forest products in their localities in the preceding quarter to provincial-level forest protection sub-departments.

c/ Provincial-level forest protection sub-departments shall provide information and report on the management of forest products and inspection of their origin in their localities under this Circular to the Forest Protection Department at the latter's request.

Article 33. Handling of violations

Violators of this Circular shall, depending on the nature and severity of their violations, be disciplined or administratively sanctioned or examined for penal liability under law.-
