CIRCULAR
ON HONORARY
CONSULS OF THE SOCIALIST REPUBLIC OF VIETNAM
Pursuant to Law on Overseas Representative offices of
Socialist Republic of Vietnam dated June 18, 2009;
Pursuant to Law on amendments to Law on Overseas
Representative Missions of Socialist Republic of Vietnam dated November 21,
2017;
Pursuant to Decree No.26/2017/ND-CP dated March 14, 2017 of
Government on functions, tasks, powers, and organizational structure of
Ministry of Foreign Affairs;
At request of Director General of Consular Department;
Minister of Foreign Affairs promulgates Circular on Honorary
Consuls of the Socialist Republic of Vietnam.

Article 1. Scope and regulated
entities
1. This Circular provides guidelines for assignment, operation, dismissal
of operation, functions, tasks and powers of honorary consuls of the Socialist
Republic of Vietnam.
2. This Circular applies to honorary consuls of the Socialist Republic of
Vietnam and relevant agencies, organizations and individuals.
Article 2. Honorary consul tenure
Honorary consuls shall be assigned by Minister of Foreign
Affairs with tenure of 3 years at the request of heads of Vietnamese diplomatic
missions in host countries or at request of Director General of Consular Department.
At the end of the tenure, an honorary consul may be reassigned
by Minister of Foreign Affairs at the request of heads of Vietnamese diplomatic
missions in host countries or at request of Director General of Consular Department.
Article 3. Ranking honorary consuls,
consular regions and locations of head offices of honorary consuls
Ranking of honorary consuls, consular regions and locations
of head offices of honorary consuls shall be determined by agreements with host
countries.

Article 5. Management and direction
of honorary consuls
1. Honorary consuls shall be subject to management and direction of heads
of Vietnamese diplomatic missions in host countries.
2. If necessary, Minister of Foreign Affairs may authorize Director General
of Consular Department to directly manage and direct operations of honorary
consuls.
Article 6. Commendations
Minister of Foreign Affairs shall request Vietnamese
Government to commend an honorary consul who contributes significantly
development of amity relations and cooperation between Vietnam and host country
and/or protects interests of the Government, legal rights and benefits of
Vietnamese nationals and juridical persons.
Chapter II
FUNCTIONS, TASKS AND
POWERS OF HONORARY CONSULS
Article 7. Principles of
implementing consular functions
1. An honorary consul shall execute some or every consular functions
specified from Article 8 to Article 13 of this Circular according to assignment
of Minister of Foreign Affairs without infringing regulations and law or practices
of host country.

2. An honorary consul shall not authorize other persons to execute consular
functions specified under Clause 1 of this Article, unless permitted by
Minister of Foreign Affairs.
Article 8. Consular protection
functions
1. Honorary consuls shall adopt all appropriate measures to provide consular
protection for interests of the Government, legal rights and interests of Vietnamese
nationals and juridical persons in consular regions satisfactory to regulations
and law of Vietnam, regulations and law of the host country, international agreements
to which Vietnam and the host country are signatories and international
practices and laws.
2. Honorary consuls are obliged to provide all available information in case
Vietnamese nationals are arrested, detained, impounded or serving prison sentences
in consular regions for Vietnamese diplomatic missions in host countries or for
Consular Department and execute relevant directions issued by these agencies.
Article 9. Information provision
functions
1. Honorary consuls shall provide reports on economic, commercial,
investment, cultural, education - training, science - technology and tourism affairs
in consular regions for Vietnamese diplomatic missions in host countries or
Ministry of Foreign Affairs upon request.
2. Honorary consuls shall furnish Vietnamese nationals and juridical
persons in consular regions with information relating to regulations and law and
practices of host countries, especially regulations and law relating to entry,
exit, residence, labor and study of foreigners and operations of foreign
juridical persons in host countries.
Article 10. National assistance and aid
functions
1. Honorary consuls shall assist and aid cultural and social activities of
Vietnamese nationals in consular regions.

3. Honorary consuls shall receive and transfer documents on civil status and
request relating to Vietnamese nationality of Vietnamese nationals living in
consular regions for Vietnamese diplomatic missions in host countries or to
Consular Department.
Article 11. Functions related to
inheritance
1. In case inheritance is left for Vietnamese nationals in consul33r
regions who are not present in host countries or do not authorize other persons
to represent their interests, honorary consuls shall promptly adopt necessary
measures to protect interests of these individuals to whom the inheritance is
left while inform Vietnamese diplomatic missions in host countries or to Consular
Departments.
2. In case inheritance in consular regions is left for Vietnamese
Government or juridical persons, honorary consuls are obliged to perform similar
obligations.
Article 12. Functions related to
ships, aircrafts and other means of transport
1. Honorary consuls must provide all necessary assistance and interference
to enable Vietnamese ships, aircrafts and other means of transport in consular
regions to fully benefit from rights and interests in host countries according
to regulations and law of host countries and satisfactory to international agreements
to which Vietnam and the host countries are signatories and international
practices and laws.
2. In case vehicles specified under Clause 1 of this Article meet with
accidents, incidents or theft in consular regions, honorary consuls must immediately
adopt possible measures to deal with the consequences and assist endangered
individuals and vehicles while inform Vietnamese diplomatic missions in host
countries or to Consular Department.
In case accidents and/or incidents occur near consular
regions and require emergency medical aid, honorary consuls must immediately
inform Vietnamese diplomatic missions in host countries or Consular Department
to enable these entities to request competent agencies of the host countries to
protect endangered individuals and vehicles.

Article 14. Tasks and powers of
honorary consuls
1. Honorary consuls are tasked with protecting interests of Vietnamese Government,
nationals and juridical persons in consular regions satisfactory to regulations
and law of Vietnam, regulations and law of the host country, international agreements
to which Vietnam and the host country are signatories and international
practices and laws.
2. Honorary consuls shall promote and encourage economic, commercial,
investment, cultural, education – training, science – technology and tourism
relations between Vietnam and host countries.
3. Honorary consuls must provide reports on operation results of honorary
consuls and orientations in the future on a yearly basis (each report shall be concluded
each year on December 20 inclusively). These
reports are submitted to Vietnamese diplomatic missions in host countries and
Consular Department.
When tenure of an honorary consul expires, the honorary consul
is responsible for submitting final reports concluding his/her tenure to aforementioned
agencies.
4. During execution of consular functions, honorary consuls must respect
regulations and law and practices of Vietnam and host countries, arrange head
offices and other necessary working equipment as specified under Clause 2
Article 20 of this Circular and ensure classified consular documents as
specified under Clause 1 Article 21 of this Circular.
After an honorary consul is dismissed, he/she is responsible
for transferring the stamp, title stamp, name stamp, National flag, National
emblem, signboard, honorary consul card and consular documents as specified in
Point b Clause 4 Article 18, Clause 3 Article 19 and Clause 2 Article 21 of
this Circular.
5. During execution of consular functions, an honorary consul may contact and
utilize communication devices as specified in Article 22 and Article 23 of this
Circular.
6. During execution of consular functions, an honorary consul shall be
furnished with necessary information and documents by Ministry of Foreign
Affairs and Vietnamese diplomatic mission in host country.

ASSIGNMENT, OPERATION
AND DISMISSAL OF HONORARY CONSULS
Article 15. Honorary consul
eligibility
An individual must satisfy following requirements in order
to be assigned as an honorary consul:
1. He/she is a Vietnamese national, a national of the host country or third
party country;
2. He/she lives in the host country;
3. He/she is socially reputable and financially competent;
4. He/she has clear judicial record;
5. He/she has knowledge about Vietnam and the host country;
6. He/she is not governmental officials, public employees of Vietnam or any
country and does not receive salaries taken from governmental budget of Vietnam
or any country.

1. Application for honorary consul title:
a) Written letter submitted to Ministry of Foreign Affairs
specifying desire to be an honorary consul and committing to incurring all operational
costs of honorary consul if assigned, not receiving salary from Vietnamese
Government and respecting regulations, law and practices of Vietnam and host
country. The letter should also specify head
office location of honorary consul and consular region;
b) Personal background sheet with 1 4x6 cm photo (recently taken,
white background, straight look, no headwear, no tinted glasses);
c) 2 2x3 cm photos for honorary consul card (recently taken,
white background, straight look, no headwear, no tinted glasses);
d) Certified true copy of passport. In case of Vietnamese nationals or nationals of third party
country, submit certified true copies of passport and permanent residence card
in host country;
dd) Judicial record issued by competent agencies of the host
country up to 1 year before the date of application;
e) Estimated action programs and plans.
2. application for reassignment consists of documents specified in Points a,
c, d and dd Clause 1 of this Article and final report concluding honorary
consul tenure.
3. Documents in the applications that are in languages other than English
or Vietnamese must be translated to English or Vietnamese with translator’s
signature authentication as per the law. Judicial
record must be consular legalized as per the law prior to being translated and authenticated
for translator’s signature, except for cases in which consular legalization is
exempted according to international agreements in which Vietnam is a signatory
or reciprocity principle.

1. Procedures for assigning honorary consuls
a) A person who wishes to become an honorary consul (hereinafter
referred to as “honorary consul candidate”) shall submit 1 application for
honorary consul specified in Clause 1 Article 16 of this Circular to Consular
Department (in person or via Vietnamese diplomatic missions in host countries).
b) Consular Department is responsible for examining the applications. If the applications are inadequate or unsatisfactory,
provide guidance on revision and completion.
In case of adequate applications, the Consular Department shall
request Vietnamese diplomatic missions in host countries to provide feedback on
necessity for honorary consul, honorary consul candidates, and propositions regarding
consular regions and ranking of honorary consuls.
Vietnamese diplomatic missions in host countries are
responsible for consulting ministries of foreign affairs of the host countries
regarding feasibility of accepting honorary consuls and inform Consular Department
about the result.
c) After receiving comments of Vietnamese diplomatic
missions in host countries, Consular Department shall discuss with relevant
entities and agencies in the Ministry and request Minister of Foreign Affairs
to consider and decide on assigning honorary consuls.
d) Once Minister of Foreign Affairs agrees on principles for
assigning honorary consuls, Consular Department shall request Vietnamese
diplomatic missions in host countries to issue offici33l diplomatic notes to request
ministries of foreign affairs of the host countries to agree on assignment of
honorary consuls.
dd) Once ministries of foreign affairs of the host countries
issue official diplomatic notes accepting assignment of honorary consuls,
Consular Department shall request Minister of Foreign Affairs to sign Decision
on assigning honorary consuls and honorary consul assignment orders.
e) Consular Department shall request the Administrative and
Financial Department and Administrative Agency of Ministry of Foreign Affairs
to provide stamps, title stamps, name stamps, National flag, National emblem and
signboards. Director General of Consular Department
shall issue honorary consul card (using Form attached to this Circular).

Consular Department (or Vietnamese diplomatic missions in
host countries) shall assign Decision on assigning honorary consuls, honorary
consul assignment order and necessary equipment specified in Point e of this Clause
to honorary consuls.
2. Procedures for reassigning honorary consuls
a) Within 3 months prior to expiration of a tenure, a honorary
consul who wishes to be reassigned as an honorary consul shall submit 1 application
as specified in Clause 2 Article 16 of this Circular to Consular Department (via
Vietnamese diplomatic missions in host countries).
Depending on practical demands, heads of Vietnamese
diplomatic missions in host countries or Director General of Consular Department
shall request Minister of Foreign Affairs to consider and decide on reassigning
honorary consuls.
b) After discussing with relevant entities in Ministry and
Vietnamese diplomatic missions in host countries, Consular Department shall
re4uest Minister of Foreign Affairs to consider and decide on reassigning honorary
consul and sign Decision on assigning honorary consul and honorary consul assignment
order (in cast ministries of foreign affairs of host countries re4uire new
honorary consul assignment order). Director
General of Consular Department shall issue honorary consul card.
c) Consular Department shall transfer information for Vietnamese
diplomatic mission in the host country to inform Ministry of Foreign Affairs of
the host country and the honorary consul.
The honorary consul shall contact Consular Department (via
Vietnamese diplomatic missions in host countries if convenient) to receive original
copies of Decision on assigning honorary consuls and honorary consul assignment
order (in case of being issued with honorary consul assignment order) and honorary
consul card.
3. In case an honorary consul who is dismissed according to Article 18 of
this Circular wishes to become an honorary consul, follow Clause 1 Article 16 and
Clause 1 of this Article.
4. In case Minister of Foreign Affairs rejects assignment of honorary
consuls, Consular Department shall transfer the information to Vietnamese
diplomatic missions in host countries to inform honorary consul candidates (in
case of assignment) or honorary consuls (in case of reassignment).

1. An honorary consul shall be dismissed according to decision of Minister
of Foreign Affairs or when the host country ceases to accept assignment of
honorary consul.
2. Minister of Foreign Affairs shall decide on dismissal of an honorary
consul when any of the following situations occur:
a) The honorary consul fails to adequately execute assigned
tasks; or
b) Honorary consul assignment is no longer required; or
c) The honorary consul is deemed by the host country as
“persona non grata”; or
d) The honorary consul no longer satisfies requirements
specified in Article 15 of this Circular; or
dd) The honorary consul wishes to resign.
3. Apart from causes under Clause 2 of this Article, Minister of Foreign Affairs
may decide on dismissal of an honorary consul at any given time without explanation.
4. Procedures for dismissing an honorary consul

Upon receiving re4uest for dismissing honorary consul,
Consular Department shall request Minister of Foreign Affairs to consider and
decide on dismissing the honorary consul (after consulting Vietnamese
diplomatic mission in the host country and relevant entities in the Ministry).
b) In case Minister of Foreign Affairs agrees to dismiss the
honorary consul, Consular Department shall re4uest Minister of Foreign Affairs
to sign Decision on dismissal of honorary consul.
Once Minister of Foreign Affairs signs Decisions on dismissal
of honorary consul, Consular Department shall transfer information to Vietnamese
diplomatic mission in the host country to inform Ministry of Foreign Affairs of
the host country and the honorary consul.
The honorary consul is responsible for transferring the stamp,
title stamp, name stamp, National flag, National emblem, signboard, honorary
consul card and consular documents to Vietnamese diplomatic mission in the host
country for storage and preservation or to individuals authorized by Minister
of Foreign Affairs.
c) Vietnamese diplomatic mission in the host country shall
inform Consular Department after having received all equipment and consular
documents of honorary consular of the honorary consul as specified in Point b
of this Clause.
Depending on practical situations, Consular Department shall
instruct Vietnamese diplomatic mission in the host country to transfer operational
equipment and consular document to new honorary consuls or to Ministry of
Foreign Affairs for disposal in case of no new honorary consul candidate.
Article 19. National flag, National
emblem, stamp, title stamp, name stamp, signboard and honorary consul card
1. Vietnamese National flag and National emblem shall be hung in respectable
position in head offices of honorary consuls, signboard shall specify name of
head offices of honorary consuls in Vietnamese and English (or official language(s)
of host countries) and shall be attached to entrances of the head offices.
Vietnamese National flag shall be hung on houses and means
of transport of honorary consuls when said vehicles are used for official affairs
of the honorary consuls.

3. An honorary consul shall be issued with a stamp bearing the National
emblem in Vietnamese and English (or official language(s) of the host country). Contents of the stamp shall be described in detail under
Annex attached hereto.
The honorary consul may use the stamp in official affairs of
the honorary consul and is responsible for preserving, protecting and transferring
the stamp to heads of Vietnamese diplomatic mission in host country or to
individuals authorized by Minister of Foreign Affairs when the honorary consul
is dismissed.
4. An honorary consul shall be issued with 1 title stamp in English and 1
title stamp in English (or official language(s) of host countries) satisfactory
to ranking of the honorary consul, name stamps shall be used in official affairs
of the honorary consul.
5. An honorary consul shall be issued with an honorary consul card (using
form attached hereto) which shall be used in official affairs of the honorary
consul, to be specific:
a) A general honorary consul shall be issued with the “General
honorary consul card”.
b) An honorary consul shall be issued with the “Honorary
consul card”.
Article 20. Maintaining operation of
honorary consuls
1. Honorary consuls may hire employees to serve consular operations and shall
be responsible and incur all expenditure on hiring employees.

Article 21. Consular documents
1. Honorary consuls are obliged to ensure secrecy of consular documents and
refrain from mixing consular documents with their personal documents, especially
documents related to occupational or commercial activities.
2. Honorary consuls shall transfer consular documents to Vietnamese
diplomatic missions in host countries when they are dismissed. In case transfer to aforementioned agencies is not possible,
the honorary consuls shall transfer the consular documents to individuals authorized
by Minister of Foreign Affairs.
Article 22. Contact for work
purposes
1. During execution of consular functions, an honorary consul may directly
contact local competent agencies within consular region.
In case contact with central competent agencies of the host
country is necessary, the honorary consul must rely on Vietnamese diplomatic
mission in the host country; the honorary
consul may directly contact if allowed by regulations and law or practices of
the host country or previously agreed upon by Vietnam and the host country.
2. With respect to issues related to consular operations, an honorary
consul must rely on Vietnamese diplomatic mission in the host country to contact
Vietnamese central and local agencies, organizations and individuals; the honorary
consul may rely on Consular Department to contact if necessary.
Article 23. Communication – contact
methods
1. an honorary consul may use phone, fax, letters and e-mail to communicate
with Ministry of Foreign Affairs and foreign Vietnamese representative agencies
for official affairs satisfactory to regulations and law of host country.

Chapter IV
IMPLEMENTATION
Article 24. Honorary consul card and
Annexes regarding contents and presentation of signboards and stamps
1. Honorary consul card shall follow the form attached hereto, consisting
of:
a) General honorary consul card (Form No. 01/BM-LSDD);
b) Honorary consul card (Form No. 02/BM-LSDD);
2. Contents and presentation of signboard and stamps shall comply with
Annex attached hereto.
Article 25. Implementation
1. This Circular comes into effect from March 23, 2020 and replaces Regulation
on Honorary Consuls of Socialist Republic of Vietnam attached to Decision No.
06 NG/QD dated January 8, 1994 of Minister of Foreign Affairs.

1. Signboard contents
A signboard shall bear national emblem of the Socialist
Republic of Vietnam, national flag of “Cộng hòa xã hội chủ nghĩa Việt Nam”
(Socialist Republic of Vietnam), ranking of the honorary consul and where the
head office of honorary consul is situated, to be specific:

Honorary consul of Socialist Republic of Vietnam in Republic
of Colombia shall be issued with a signboard that specifies “Honorary consul of
Socialist Republic of Vietnam in Republic of Colombia”.
2. Signboard presentation
The signboard shall be rectangul33r whose width to length ratio
is 2:3 and hung horizontally. Dimension of the signboard shall be designed compatibly
with dimension of the entrance where the signboard is situated.
The signboard shall be made of golden brass with red engraved
letters. The signboard shall be outlined with a single continuous line 1 cm in
from the edge of the signboard.
National emblem of Socialist Republic of Vietnam shall be
engraved. The National emblem shall be displayed on golden signboard and in red
according to regulations on national emblem in the Constitution of the
Socialist Republic of Vietnam.
Presentation location of signboard contents in order of
vertical appearance:
The National emblem shall be placed at the top and center
horizontally. Diameter of the National emblem must not be smaller than thrice
the height of the letters of honorary consul ranking in Vietnamese
Below the National emblem, honorary consul ranking, National
flag and head office location of the honorary consul shall be displayed
respectively from top to bottom and centered.
The signboard shall be displayed in 2 languages, Vietnamese and
English (or official language of the host country) in following order: Vietnamese
first and the foreign language second. Vietnamese and the foreign language must
be written all in capital letters and in the same font if the foreign language
utilizes Latin script.

and sized 10 cm x 7 cm with red outline.
- Front side:
+ Official country name is engraved, yellow and centered.
+ Font size compatible to card size.
+ The phrase “THẺ TỔNG LÃNH SỰ DANH DỰ
HONORARY CONSUL GENERAL CARD” must be in red and have a font size larger than
font sizes of other contents on the front size of the card.
