CIRCULAR
PROMULGATION
OF HS CODES OF COMMODITIES UNDER MANAGEMENT OF MINISTRY OF AGRICULTURE AND
RURAL DEVELOPMENT AND LIST OF IMPORTS AND EXPORTS SUBJECT TO SPECIALIZED INSPECTION
IN FIELD OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Government’s
Decree No. 105/2022/ND-CP dated December 22, 2022 defining functions, missions,
authority and organizational structure of the Ministry of Agriculture and Rural
Development of Vietnam;
Pursuant to the Government’s
Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating some articles of the
Law on Foreign Trade Management;
Pursuant to the Government’s
Decree No. 85/2019/ND-CP dated November 14, 2019 on handling of administrative
procedures via national single window and ASEAN single-window system and
specialized inspection for imports and exports;
At the request of the
Directors (General) of the Legislation Department, the Department of Forestry,
the Department of Fisheries, the Plant Protection Department, the Department of
Animal Health, the Department of Livestock Production, the Department of
Cooperatives and Rural Development, and the National Authority for
Agro-Forestry-Fishery Quality, Processing and Market Development;
The Minister of Agriculture
and Rural Development promulgates a Circular promulgating HS codes of
commodities under management of the Ministry of Agriculture and Rural
Development and list of imports and exports subject to specialized inspection
in the field of agriculture and rural development.
Article 1. Lists of HS
codes of commodities under management of Ministry of Agriculture and Rural
Development and list of imports and exports subject to specialized inspection
in field of agriculture and rural development are enclosed herewith.

1. Lists of commodities which
are under the management of the Ministry of Agriculture and Rural Development
of Vietnam and to which HS codes have been assigned enclosed herewith shall be
used as the basis for making customs declaration upon export or import of the
listed commodities.
2. Upon export or import of
commodities in the agricultural sector whose HS codes have yet to be included
in the lists enclosed herewith, customs declaration shall be made according to
actual description of the commodities and the Vietnam’s nomenclature of exports
and imports enclosed with the Circular No. 31/2022/TT-BTC dated June 08, 2022
of the Minister of Finance of Vietnam. After customs clearance, the
importer/exporter shall send a written request to the Ministry of Agriculture
and Rural Development of Vietnam to, in cooperation with the Ministry of
Finance of Vietnam, consider promulgating additional list of HS codes.
3. Specialized inspection of
exports under the management of the Ministry of Agriculture and Rural
Development shall be carried out at the request of enterprises to serve the
clearance of their goods in countries of import.
Article 3. Effect
1. This Circular comes into
force from March 20, 2024.
2. Some Circulars and
regulations are replaced and abrogated by this Circular. To be specific:
a) The Circular No. 11/2021/TT-BNNPTNT
dated September 20, 2021 of the Minister of Agriculture and Rural Development
promulgating HS codes of commodities under management of the Ministry of
Agriculture and Rural Development and list of imports and exports subject to
specialized inspection in the field of agriculture and rural development is
abrogated;
b) Section 3.1, Section 4,
Section 8, Section 9 of the Annex enclosed with the Circular No.
16/2021/TT-BNNPTNT dated December 20, 2021 of the Minister of Agriculture and
Rural Development promulgating list of potentially unsafe products and goods
under the authority of Ministry of Agriculture and Rural Development are
replaced with corresponding sections in Annex IV enclosed herewith;
c) Article 9 of the Circular
No. 01/2022/TT-BNNPTNT dated January 18, 2022 of the Minister of Agriculture
and Rural Development of Vietnam providing amendments to some Circulars on
fisheries is abrogated;

Article 4. Responsibility
for implementation
1. Chief of the Ministry's
Office, Director of the Legislation Department, heads of units and agencies
affiliated to the Ministry of Agriculture and Rural Development, and relevant
authorities, organizations and individuals shall be responsible for the
implementation of this Circular.
2. Difficulties that arise
during the implementation of this Circular should be reported to the Ministry
of Agriculture and Rural Development for consideration./.
