Supreme People’s Court provides guidance on the service abroad of judicial documents

Supreme People’s Court issues the Official Dispatch No. 33/TANDTC-HTQT regarding the mutual legal assistance and the service abroad of judicial documents.

According to this document, Supreme People’s Court provides guidance on the service abroad of judicial documents as follows:

- Courts can serve judicial documents by post to the involved parties who are Vietnamese citizens, Vietnamese citizens holding citizenship in other countries, foreigners, and foreign organizations whose offices are located in countries that do not oppose the service of judicial documents under Article 10 (a) of the Convention on the Service Abroad of Documents, irrespective of whether or not litigants that are organizations or individuals hold citizenship in the sending or receiving countries.   

- The list of non-opposing countries is annexed to the Official Dispatch No. 33/TANDTC-HTQT dated February 21, 2017; the Official Dispatch No. 101/TANDTC-HTQT dated June 25, 2020, and in this document.

- Hungary is a country declaring opposition against another country’s service of documents under Article 10 (a) of the Service Convention.

However, according to the Mutual Legal Assistance Agreement between Vietnam and Hungary, Courts may serve judicial documents to litigants whose addresses are in Hungary by post as per requirements set out in clause 7 of Article 10 in this Agreement.
