The Circular prescribes that spontaneous inspections occur in the following cases:
+ Cases prescribed in clause 1 of Article 17 in the Decree No. 136/2020/ND-CP (cases of temporary suspension of services of establishments providing road transport services, means of transport, households or persons that fail to meet fire safety requirements). .
+ There is any violation against fire safety regulations that may cause fire or explosion risks under point dd of clause 3 of Article 16 in the Decree No. 136.
+ The spontaneous inspection is carried out to ensure public security and order according to the directives of competent authorities put under the control of the authorities conducting such spontaneous inspections.
+ There is any sign of breach of requirements for fire service businesses prescribed in Article 41 of the Decree No. 136, or of any abuse of fire services for infringement upon public security and order which is subject to actions proposed by competent authorities.
Circular No. 141/2020/TT-BCA is entering into force as of February 8, 2021.
