Official instructions about grant of “Red books” for condotel are now available for use

On February 14, 2020, the Ministry of Natural Resources and Environment issued the Official Dispatch No. 703/BTNMT-TCQLDD providing instructions about use of land and grant of certificates of ownership of construction works other than residential homes, including vacation hotel condos (condotel).

This Document provides instructions on grant of certificates of ownership of construction works other than residential homes as follows:

If condotel or vacation villa projects meet regulatory requirements for transfer under the provisions of the Law on Real Property Business, granting certificates of ownership of such construction works to transferees will be subject to regulations laid down in Article 32 in the Decree No. 43/2014/ND-CP regulating details about implementation of several articles of the Law on Land, and clause 22 of Article 2 in the Decree No. 01/2017/ND-CP amending and supplementing several Decrees elaborating on implementation of the Law on Land. 

Application and documentation requirements and procedures for grant of such Certificates are subject to regulations laid down in Article 70 and 79 in the Decree No. 43/2014/ND-CP Article 8 and 9 in the Circular No. 24/2014/TT-BTNMT regulating cadastral documentation requirements; clause 8 of Article 6 in the Circular No. 33/2017/TT-BTNMT elaborating on implementation of the Decree No. 01/2017/ND-CP amending and supplementing several Decrees providing details about implementation of the Law on Land and amending or supplementing several articles of Circulars providing instructions about implementation of the Law on Land.

Ministry of Natural Resources and Environment has ordered Departments of Natural Resources and Environment in provinces and centrally-affiliated cities to review approved investment projects, transfer or lease of land for use in specific projects in order to determine purposes of use of land and land use term as provided in laws on land.   

If applicants meet specified requirements to obtain certificates in accordance with laws on land and other relevant legislation, land users and owners of property attached to land must be granted these certificates in order to ensure their legitimate rights and interests without being affected by any change in sizes, targets and planning schemes of approved projects.
