Agroforestry and fishery businesses ineligible for certificates of conformance to food safety regulations are required to sign in written commitments on safe food production and business by using the form given in the Appendix I of this Circular once every three years.
Businesses subject to signing of commitments include:
- Businesses performing small-scale initial production activities; businesses performing food production and business activities without fixed locations, except for fishing vessels with the maximum length of at least 15 meters; small-scale food processing businesses;
- Small-scale food businesses; ready-to-eat food businesses.
In addition, the Circular prescribes that any business violating commitments will be subject to sanctions, specifically including:
- First violation: Caution.
- Second violation: Declaring that the violating business fails to comply with its commitments on safe food production and business.
- Third violation or violation of commitments resulting in serious consequences: Depending on the degree of violation, authorized regulatory bodies will request competent authorities to handle violations in accordance with laws.
The Circular No. 17/2018/TT-BNNPTNT is set to commence on January 1, 2019.
