According to this document, if the employee is sick during an annual leave or an unpaid leave, he/she may fall into 2 following cases:
- If he/she plans to take paid or unpaid leave accepted by the employer, but is sick during his/her leave, he/she will not be entitled to the sickness benefit;
- If the employee randomly takes unpaid leave, then is sick and has to stay away from work while intending to resume work, he/she will be entitled to the sickness benefit for sick leave days in accordance with regulations in force.
The Official Dispatch No. 2219/BHXH-CD provides further guidance on health rehabilitation and recovery benefits, specifically including:
- If the employee has taken both short and long sick leave; if the number of days in either leave does not qualify as the health rehabilitation and recovery leave, but the number of days in both leave qualifies as the health rehabilitation and recovery leave, he/she will be entitled to 5 days of the health rehabilitation and recovery leave;
- If the health rehabilitation and recovery leave extends as far as the beginning of the following year, the rest period will be included in the year in which the employee qualifies for the health rehabilitation and recovery leave.
