New regulations coming into force from the middle of November, 2017

From November 11 to November 20, 2017, multiple regulations on tax and fees, finance and banking, import and export are coming into force. Noticeable regulations include:

1. New regulations on payment of charges for business registration

 The Circular No. 96/2017/TT-BTC on amendments to the Circular No. 250/2016/TT-BTC providing guidelines for fees and charges imposed by People’s Committees of provinces and central-affiliated cities is coming into force from November 11, 2017,.

According to the Circular, apart from households, cooperatives and cooperative unions prescribed by applicable regulations, individuals and individual groups shall pay charges for business registration.

Besides, the abovementioned entities shall only pay charges for business registration when they are issued with one of the following documents:

- Household business registration certificate;

- Cooperative registration certificate

- Cooperative union registration certificate.

2. New conditions for provision of guarantee for off-plan houses by commercial banks

This noticeable regulation is provided by the Circular No. 13/2017/TT-NHNN on amendments to the Circular No. 07/2015/TT-NHNN on bank guarantee.

According to the Circular, a commercial bank will be eligible for providing guarantee for off-plan houses if it satisfies the following conditions:

- Its license or revised license for establishment and operation covers the guarantee operation;

- It is not prohibited to provide guarantee for off-plan houses while it is under a special control.

The Circular No. 13/2017/TT-NHNN is coming into force from November 15, 2017.

3. Documents to be submitted when an airplane is going through procedures for entry

This is one of the noticeable regulations of the Decision No. 43/2017/QD-TTg on responsibility for going through procedures for entry, exit and transit of airplanes through the Vietnam national single window.

According to the Circular, original copies of the following documents shall be submitted to regulatory authorities at airports:

- An aviation general declaration (including medical declaration) which is submitted to the border quarantine station;

- A phytosanitary declaration (if the goods are required to undergo plant quarantine), which shall be submitted to the phytosanitary authority;

- A sanitary declaration (if the goods are required to undergo animal quarantine), which shall be submitted to the sanitary authority;

- A medical declaration of corpses, remains or bone-ashes (if any), which shall be submitted to the border quarantine station;

- A medical declaration of samples of medical microbiology, biological products or tissues and organs of human body (if any), which shall be submitted to the border quarantine station;

In addition, the person going through procedures for entry of an airplane shall present original copies of the documents prescribed in Points e, g and h Clause 2 Article 5 of the Decision No. 43/2017/QD-TTg to the regulatory authorities at airports.

4. New instructions on development of new technologies in districts

The Circular No. 20/2017/TT-BCT on amendments to the Circular No. 46/2012/TT-BCT providing guidelines for certain articles of the Decree No. 45/2012/ND-CP is coming into force from November 16, 2017.

The Circular deals with development of demonstration models for popularizing new technologies or manufacturing new products in districts when the national industrial encouragement scheme is carried out. To be specific:

- Each district shall be provided with assistance in developing a model of application of new technologies and a model of production of new products which have not been applied or produced.

- Districts located in the prioritized areas prescribed in Clause 1 Article 6 of the Circular No. 46/2012/TT-BCT shall be provided with assistance in developing 2 models for popularizing new technologies or manufacturing new products.
