How is cooperation in issuing entry, exit, and residence documents to foreigners in Vietnam regulated?

Under Decree No. 286/2026/ND-CP how must authorities cooperate in issuing entry, exit, and residence documents to foreigners in Vietnam?

On July 17, 2026, the Government of Vietnam promulgated Decree No. 286/2026/ND-CP on the cooperation mechanism among ministries, ministerial agencies, and People’s Committees of provinces and cities in managing the entry, exit, transit, and residence of foreigners in Vietnam.

According to the Decree, cooperation in issuing entry, exit, and residence documents to foreigners shall be carried out as follows:

- The Ministry of Public Security of Vietnam shall direct the immigration authority to exchange and provide data on foreigners approved for visa issuance at international border checkpoints managed by the Ministry of National Defense of Vietnam to the immigration control units under the Ministry of National Defense of Vietnam before such foreigners arrive at the border checkpoints.

- The Ministry of Foreign Affairs of Vietnam shall direct its competent authorities to:

+ Update data on foreigners issued visas or temporary residence cards by competent authorities of the Ministry of Foreign Affairs of Vietnam under the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam in the National Immigration Database immediately after issuance. Where the infrastructure conditions required for updating the data have not yet been satisfied, the list shall be transferred to the immigration authority within 5 working days from the date of issuance;

+ Cooperate in verifying information concerning foreigners at the request of the immigration authority to facilitate the handling of violations and issuance of documents valid for residence for the purposes of requesting departure, compelling departure, or enforcing expulsion.

- The Ministry of Foreign Affairs of Vietnam shall direct Vietnam’s competent overseas visa-issuing authorities, and the Ministry of National Defense of Vietnam shall direct its immigration control units, during the processing of visa applications, to withhold visa issuance if they detect complicated issues relating to national security or defense or signs of document forgery. They shall promptly consult and reach agreement with the immigration authority regarding visa issuance.

- The Ministry of Public Security of Vietnam shall direct the immigration authority to immediately notify Vietnam’s competent overseas visa-issuing authorities and immigration control units to refuse visa issuance or revoke or invalidate an issued visa upon detecting the forgery of documents used to obtain approval for visa issuance or discovering, after approval, complicated issues relating to national security or defense.

- Ministries, ministerial agencies, and provincial People’s Committees shall direct their competent authorities to share and integrate data generated from the processing of administrative procedures within their assigned functions and tasks concerning foreigners. Such data shall support the immigration authority in issuing foreigners with entry or exit documents or documents valid for residence.
