Under Decree No. 284/2026/ND-CP what is the fine for unlawfully offering or issuing crypto assets?

On July 16, 2026, the Government of Vietnam promulgated Decree No. 284/2026/ND-CP on administrative penalties for violations relating to crypto assets and the crypto asset market, including fines for unlawfully offering or issuing crypto assets.

Accordingly, Article 6 of Decree No. 284/2026/ND-CP prescribes a fine ranging from VND 150.000.000 to VND 200.000.000 for a crypto asset issuer that commits either of the following violations:

- Offering or issuing crypto assets to ineligible persons;

- Offering or issuing crypto assets without fully satisfying the conditions specified in Article 5 of Resolution No. 05/2025/NQ-CP.

In addition to the fine, the following additional penalty and remedial measure shall apply:

- Suspension of the offering or issuance of crypto assets for a period ranging from 6 to 12 months;

- Compulsory cancellation of the crypto asset offering or issuance and compulsory refund of all proceeds collected from that offering or issuance.

Note: The above fine applies to organizations. Where an individual commits the same violation, the fine shall equal one-half of that imposed on an organization.

For violations committed after Resolution No. 05/2025/NQ-CP ceases to be effective, administrative penalties shall be imposed under the legislative document effective at that time.

Where the Government of Vietnam decides to cease temporarily, suspend, or terminate the pilot implementation of the crypto asset market in Vietnam under Clause 2 Article 4 of Resolution No. 05/2025/NQ-CP: violations completed before the temporary cessation, suspension, or termination of the pilot program but not yet sanctioned shall continue to be sanctioned under Decree No. 284/2026/ND-CP; for ongoing violations, penalties shall be imposed under the legislative document effective when the violations are detected.
