Point c Clause 6 Article 36 of Decree No. 208/2026/ND-CP provides that, for a flight delayed by 4 hours or more, the carrier shall provide non-refundable advance compensation to passengers who have confirmed reservations and tickets for the flight. Non-refundable advance compensation shall be provided only once for each flight, including cases of on-board flight delays specified in Article 38 of Decree No. 208/2026/ND-CP.
The Minister of Construction of Vietnam is also assigned to elaborate on the amount, method, and time limit for providing non-refundable advance compensation, as well as the carrier’s information disclosure and reporting obligations in the event of a flight delay, flight cancellation, or denial of carriage.
According to Article 5 of Circular No. 48/2026/TT-BXD the amounts of non-refundable advance compensation are prescribed as follows:
(1) The amount of non-refundable advance compensation for each passenger on a domestic flight is as follows:
- A flight with a route distance of under 500 km: VND 220. 000
- A flight with a route distance of between 500 km and under 1.000 km: VND 330.000
- A flight with a route distance of 1.000 km or more: VND 440.000
(2) The amount of non-refundable advance compensation for each passenger on an international flight is as follows:
- A flight with a route distance of under 1.000 km: USD 28
- A flight with a route distance of between 1.000 km and under 2.500 km: USD 55
- A flight with a route distance of between 2.500 km and under 5.000 km: USD 88
- A flight with a route distance of 5.000 km or more: USD 165
A carrier may provide non-refundable advance compensation exceeding the amounts prescribed in Clauses (1) and (2).
Where a flight is delayed for 4 hours or more and subsequently cancelled, non-refundable advance compensation shall be provided only once.
