According to the Circular, self-certification of origin of goods from the European Union is regulated as follows:
(i) Exporters are entitled to self-certify the origin of goods where such goods originate in the European Union and satisfy other requirements of the EVFTA.
(ii) Exporters shall carry out a self-certification of goods origin on an invoice, delivery note, or other commercial document containing sufficient details to identify the goods, by typing, stamping, or printing the prescribed text of the origin declaration on such document. Exporters shall use the wording of the origin declaration in one of the language versions specified in Appendix VI issued together with Circular No. 14/2026/TT-BCT and in accordance with the laws of the European Union. Where the declaration is completed by hand, it shall be written in ink in printed (capital) characters.
(iii) The term “other commercial document” referred to in (ii) may include a consignment note, pro forma invoice, or packing list. Transport documents, such as a bill of lading or air waybill, shall not be regarded as other commercial documents.
(iv) The origin self-certification shall not be made on a separate form. It may be made on a separate page of a commercial document, provided that such page is clearly identifiable as forming part of that commercial document.
(v) The origin self-certification must bear the handwritten signature of the exporter. However, eligible exporters under the laws of the European Union may be exempt from the signature requirement, provided that they submit a written undertaking to the competent authorities of the exporting Member State accepting full responsibility for the origin self-certification.
(vi) An origin self-certification may be published after exportation, provided that it is presented in the importing Member State no later than 2 years, or within the period prescribed by the importing Member State, from the date the goods are imported into the territory of that Member State.
