According to Article 4 of Circular No. 26/2025/TT-BKHCN the procedures for authorizing the import of goods on the list of used information technology products prohibited from import are as follows:
- Traders shall submit 1 application as prescribed in Clauses 2 and 3 of this Article through one of the following methods: in person, by post, or online via the National Public Service Portal or the Administrative Procedure Settlement Information System of the Ministry of Science and Technology of Vietnam.
- The procedures for authorizing the import of goods on the list of used information technology products prohibited from import shall comply with Section 1 Appendix X of Decree No. 146/2025/ND-CP.
- The application for requesting import authorization includes:
+ Written request for import of goods on the list of used information technology products prohibited from import, using Form No. 1 provided in the Appendix of Circular No. 26/2025/TT-BKHCN;
+ Explanatory documents on the plan for use, the process for managing imported goods during their use in Vietnam, and the plan for handling the goods after use in Vietnam;
+ Report on the implementation of previously issued permits (if any), using Form No. 2 provided in the Appendix of Circular No. 26/2025/TT-BKHCN.
Cases in which the import of goods on the list of used information technology products prohibited from import may be authorized include:
- For special-use purposes, including:
+ Relocation of production equipment within the same organization;
+ Use as equipment for controlling, operating, utilizing, or inspecting the operation of part or all of a system or production line;
+ Direct service of software production, business-process outsourcing using information technology, or data processing for foreign partners;
+ Use as specialized information technology products;
+ Re-import of information technology products whose warranty period has expired after being sent abroad for repair;
+ Used products or components that have been refurbished for replacement or repair for domestic users in cases where such products or components are no longer manufactured.
- For scientific research purposes.
- For performing the processing of goods on the list of used information technology products prohibited from import for foreign traders for consumption abroad.
