CIRCULAR

GUIDELINES FOR TRADE PROMOTION FOR FOREIGN TRADE DEVELOPMENT UNDER THE NATIONAL PROGRAM ON TRADE PROMOTION

Pursuant to the Law on Foreign Trade Management dated June 12, 2017;

Pursuant to the Government's Decree No. 98/2017/ND-CP dated August 18, 2017 on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Government’s Decree No. 28/2018/ND-CP dated March 1, 2018 on guidelines for the Law on Foreign Trade Management regarding foreign trade development measures;

Pursuant to Decision No. 72/2010/QD-TTg dated November 15, 2010 of the Prime Minister on promulgation of Regulations on formulation, management and implementation of National Program on Trade Promotion;

Pursuant to Decision No. 12/2019/QD-TTg dated February 26, 2019 of the Prime Minister on amendments to Regulations on formulation, management and implementation of National Program on Trade Promotion issued together with Decision No. 72/2010/QD-TTg dated November 15, 2010 of the Prime Minister;

Chapter I

GENERAL PROVISIONS

Article 1. Scope

This Circular sets forth criteria, details and supportive budget for trade promotion for foreign trade development within the framework of the National Program on Trade Promotion (hereinafter referred to as Program).

Article 2. Regulated entities

 This Circular applies to organizations which host the Program (hereinafter referred to as host organizations), organizations which participate in scheme of the Program (hereinafter referred to as participating organizations), and managing authorities of the Program, authorities allocating supportive budget, and organizations and individuals relating to the National Program on Trade Promotion.

Article 3. Criteria for formulation and adoption of scheme of National Program on Trade Promotion

1. The scheme shall conform to regulations of Article 8 of Government's Decree No. 28/2018/ND-CP dated March 1, 2018.

2. The scheme provides trade promotion for industries, products with export potential of the country, economic region or at least 2 provinces and central-affiliated cities; or products geographical indication, collective mark, certification mark were protected.

1. The scheme is appraised according to the criteria prescribed in the Appendix issued herewith.

2. The scheme eligible for approval is a scheme obtaining at least 85 score of appraisal.

3. Rules for approval for scheme

a) The scheme is passed the appraisal as prescribed in Clause 2 of this Article;

b) In consideration of budget expenditure estimate of the Program notified by the Ministry of Finance, the Minister of Industry and Trade shall consider approving the scheme and supportive budget according to the principle that total supportive budget of the schemes does not exceed the total given budget estimate.

Chapter II

DETAILS OF TRADE PROMOTION FOR FOREIGN TRADE DEVELOPMENT UNDER THE NATIONAL PROGRAM ON TRADE PROMOTION

Section 1. CONNECTING TRADE, JOINING THE DISTRIBUTION SYSTEM OVERSEAS AND IN VIETNAM

a) Promotion:

- Promotion on the media, forms of promotion of trade fairs and exhibitions;

- Introduction of information about trade fairs, exhibitions, business delegations attending trade fairs and exhibitions;

- Holding trade shows to attract visitors to trade fairs and exhibitions hosted or co-hosted by Vietnam overseas with capacity of at least 100 booths (if any).

b) Organization and arrangement of national exhibition area (if any);

c) Organization and arrangement of stalls:

Overall and detailed design;

Space rental, electricity, water, security, protection, environment hygiene;

Arranging areas of general trade promotion information, product showcase (if any);

- General decoration.

d) Opening ceremonies (for trade fairs or exhibitions hosted or co-hosted by Vietnam with capacity of at least 100 booths of Vietnamese enterprises or for trade fairs or exhibitions overseas attended by Vietnam with capacity of at least 30 booths): welcoming, reception, decoration, trade show, stage, sound and light;

dd) Daily allowances paid to personnel of host organizations;

e) Holding seminars: halls, equipment, decoration, sound, light, interpreters, security, reception, tea break, materials, speakers (if any);

g) Advising on choosing participating products (if any).

2. Scale: Multi-industry trade fairs and exhibitions with scale of at least 12 booths and at least 12 attending enterprises. Specialized trade fairs and exhibitions with scale of at least 06 booths and at least 06 attending enterprises.

3. Support: The State shall finance up to 100% of funding to carry out activities prescribed in Point a, Point b, Point c, Point d and Point dd Clause 1 hereof.

Article 6. Holding international trade fairs and exhibitions in Vietnam for exported products

2. Scale

a) Multi-industry trade fairs and exhibitions with a minimum scale of 300 booths according to standard booth (3m x 3m) and 150 participating organizations of Vietnam when being held in central-affiliated cities, 200 standard booths and 100 participating organizations of Vietnam when being held in other cities and provinces;

b) Specialized trade fairs and exhibitions with a minimum scale of 100 booths according to standard booth (3m x 3m) when being held in central-affiliated cities, 80 booths of Vietnamese enterprises according to standard booth (3m x 3m) when being held in other cities and provinces;

3. Support: The State shall finance up to 100% of funding to carry out activities prescribed in Point a and Point b Clause 1 hereof.

Article 7. Holding international trade fairs and exhibitions in Vietnam for products of foreign enterprises seeking import from Vietnam

a) Promotion:

- Promotion on the media;

- Introduction about trade fairs and exhibitions.

2. Scale: Trade fairs and exhibitions with a minimum scale of 60 booths according to standard booth (3m x 3m), including at least 15 booths of foreign enterprises seeking import.

3. Support: The State shall finance up to 100% of funding to carry out activities prescribed in Clause 1 hereof.

3. Support: Finance up to 100% of funding to carry out activities prescribed in Point a Clause 1 hereof.

Article 9. Displaying, introducing and exporting goods through common booths on e-commerce trading floor

1. Details

a) Open an account on an e-commercial trading floor;

b) Maintain membership;

c) Formulate process, code, manage stocks of products intended to be sold through common booths on e-commerce trading floor;

dd) Register product labels in export markets at the request of e-commerce trading floor and export markets;

e) Redesign packages and labels according to the standards of e-commerce trading floor and export markets;

g) Take photos of products according to the standards of e-commerce trading floor;

h) Manage common booths online: update photos, information, prices of each product according to the list of e-commerce trading floor, confirm orders, notify warehouse from which goods are discharged, receive matters arising after sale;

i) Promote common booths through social networks, Internet search engines;

k) Ship orders;

l) Other activities:

- Research consumer trends and competitors on e-commerce trading floor to develop marketing and promotion strategies;

- Build digital content (video clips) to promote common booths or products;

2. Scale: At least 15 participating organizations, each organization provides at least 3 products which are manufactured in Vietnam.

The e-commerce trading floor chosen to organize booths must belong to the world’s top 20 e-commerce trading floors according to ratings of Alexa Internet or Similarweb.

3. Support: Finance up to 100% of funding for not exceeding 12 months to carry out activities prescribed in Point a, Point b, Point h and Point i Clause 1 hereof.

Article 10. Organization of trade delegations overseas

1. Details

a) Promotion and invitation of foreign organizations and enterprises to carry on trade:

- Promotion on the media;

- Introduction and information about delegations of enterprises.

b) Organization of seminars and trade: Halls, equipment, decoration, sample product display area, interpreters, reception, tea break, materials, badges, stationery;

d) Organization and management activities of host organizations;

dd) Participating organizations: Air tickets/train tickets/car tickets, the cost of transport of sample products, food, accommodation and travel costs.

2. Scale: At least 15 participating organizations in case of multi-industry delegations, 7 participating organizations in case of specialized delegations.

3. Support: Finance up to 100% of funding to carry out activities prescribed in Point a, Point b and Point c Clause 1 hereof and travel cost, including: air tickets, train tickets, car tickets from Vietnam to the country to which the business trip is taken and vice versa (including air tickets, train tickets and car tickets within the territory of that country) for 1 person per participating organization.

Article 11. Organization of foreign enterprise delegations to enter Vietnam to purchase goods

1. Details

a) Promotion:

- Invitation of foreign and Vietnam organizations and enterprises;

- Introduction and information about foreign enterprise delegations and Vietnamese enterprises.

c) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery;

d) Participating foreign enterprises: food, accommodation, travel in Vietnam;

dd) Round-trip air tickets, food, accommodation and travel in Vietnam for personnel of the partners which take the delegation into Vietnam;

e) Local enterprises: Goods, equipment for display, transport, food, accommodation, travel, taking foreign enterprise delegations to visit factories, production facilities, raw material areas.

2. Scale

a) At least 7 foreign enterprises, 21 Vietnamese enterprises in case of specialized trade delegations;

b) At least 20 foreign enterprises, 60 Vietnamese enterprises in case of multi-industry trade delegations.

3. Support

a) Finance up to 100% of funding to carry out activities prescribed in Point a, Point b and Point c Clause 1 hereof;

c) Finance up to 100% of funding to carry out activities prescribed in Point dd Clause 1 hereof and no more than 4 days and 3 nights for 1 person per delegation with at least 7 foreign enterprises.

Article 12. Organization of international conferences in Vietnam on export industry

1. Details

a) Promotion:

- Invitation of foreign and Vietnam organizations and enterprises;

- Introduction and information about international conferences on industries.

b) Halls, equipment, decoration, interpreters, translators, printing of materials, tea break;

c) Speakers: remuneration, food, accommodation, travel in Vietnam;

d) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery.

3. Support: Finance up to 100% of funding to carry out activities prescribed in Point a, Point b and Point d Clause 1 hereof.

Article 13. Connection of trade relations in Vietnam between suppliers and export enterprises and trade promotion organizations

1. Details

a) Promotion and invitation of organizations and enterprises to carry on trade;

b) Organization of trade:

- Halls, equipment, decoration, interpreters, translators, printing of materials, tea break;

- Arrange booths, display area of products.

c) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery.

2. Scale: At least 21 suppliers and 7 export enterprises.

Section 2. ASSISTANCE IN DEVELOPMENT AND OPERATION OF TRADE INFRASTRUCTURE AND LOGISTICS FOR FOREIGN TRADE

Article 14. Organization and participation in overseas trade fairs and exhibitions on logistics

Support shall be provided as prescribed in Article 5 of this Circular.

Article 15. Inviting foreign enterprise delegations to Vietnam to exchange investment opportunities, cooperation in development of logistics services, logistic centers for foreign trade

Support shall be provided as prescribed in Article 11 of this Circular.

Article 16. Holding logistics forums in Vietnam, holding international trade fairs and exhibitions on logistics in Vietnam

1. Hold international logistics forums in Vietnam

a) Support shall be provided as prescribed in Clause 1 and Clause 3 Article 12 of this Circular;

b) Scale: At least 50 Vietnamese enterprises, 10 enterprises and foreign organizations operating in logistics industry.

Section 3. ASSISTANCE IN RESEARCH, DEVELOPMENT, IMPROVEMENT OF QUALITY OF PRODUCTS AND GOODS

Article 17. Developing and issuing information and database on products, industries and markets

1. Details

a) Collect and buy information and database on local and foreign industries, markets, and products;

b) Aggregate, analyze and process information and data;

c) Edit and prepare reports, database and other information products;

d) Issue in print form (print, release), e-publications or make public at conferences, seminars, training courses.

2. Support: Finance up to 100% of funding to carry out activities prescribed in Point a, Point b and Point c Clause 1 hereof.

a) Develop instructions about regulations, standards, and conditions of importers, international commitments on imported and exported products;

b) Dissemination and training:

- Lecturers and speakers: Remuneration, food, accommodation, travel.

c) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery.

2. Scale: At least 70 participating organizations.

Article 19. Organization and participation in surveys and finding out information about products, industries and markets

1. Details

a) Collect information and research products, industries, markets;

b) Carry out field research in Vietnam and/or overseas;

c) Prepare research reports on products, industries and markets;

d) Issue research reports in the form of printed copies (print, publication) or e-publications or disseminate at conferences, seminars, training;

dd) Organization and management activities of host organizations: Post, telephone, stationery.

2. Support: Finance up to 100% of funding to carry out activities prescribed in Point c and Point dd Clause 1 hereof.

a) At least 100 participating organizations in the program providing information on development of products and export markets;

b) At least 50 foreign enterprises in the program providing promotion information about products and industries of Vietnam.

3. Support: Finance up to 100% of funding to carry out activities prescribed in Point a, Point c and Point dd Clause 1 hereof.

Article 22. Providing consulting activities, hiring consultants, supporting design and development of products

1. Details

a) Consulting, design, development of (groups) of products:

- Specialists: Remuneration, food, accommodation, travel or all-inclusive contracts;

- Consulting: Halls, equipment, decoration, interpreters, translators, printing of materials, tea break.

b) Implementing results of consulting, design, development of products to enterprises (if any);

c) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery.

2. Scale: At least 50 participating enterprises.

Article 23. Organizing activities to connect enterprises and designers

1. Details

a) Promotion and invitation of participating organizations and enterprises;

b) Halls, equipment, decoration, interpreters, translators, printing of materials, tea break;

c) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, post, telephone, stationery;

d) Arrangement of display area for design products (if any).

2. Scale: At least 50 enterprises and 10 design service providers.

3. Support: The State shall finance 100% of funding to carry out activities prescribed in Point a and Point c Clause 1 hereof.

Article 24. Propagation and promotion of industries, geographical indication, collective mark, certification mark of Vietnam overseas

a) Engage consultants to elaborate content and plans, promotion strategies;

b) Promotional products:

- Develop promotional products: Design, collect data, write articles, produce films, communication products;

- Promote, publish at trade promotion events and on the media.

2. Prepare and implement plans for at least 3 consecutive years but not exceeding 5 years for a target market.

3. Support: Finance up to 100% of funding to carry out activities prescribed in Clause 1 hereof.

Article 25. Invitation of foreign media organizations and experts into Vietnam to produce communication products to promote Vietnamese export industry overseas

Section 4. TRAINING AND CAPACITY BUILDING IN TRADE PROMOTION AND MARKET DEVELOPMENT

Article 26. Training and capacity building in trade promotion and market development

1. Details

a) Compiling training contents;

b) Translation, interpretation;

c) Printing of documents, stationery;

d) Lecturers and speakers: Remuneration, food, accommodation, travel;

2. Scale: At least 50 participating organizations.

3. Support:

a) Finance up to 100% of funding to carry out activities prescribed in Clause 1 hereof;

b) No more than 2 trainees are provided with support in each participating organization.

Article 27. Organization of and participation in package training courses of training institutions (face-to-face and online)

1. Details

a) All-inclusive tuition of the course;

b) Organization and management activities of host organizations: Daily allowances for personnel of host organizations, promotion, invitation, telephone, stationery.

3. Support:

a) Finance up to 50% of funding to carry out activities prescribed in Point a Clause 1 hereof;

b) No more than 2 trainees are provided with support in each participating organization.

Chapter III

IMPLEMENTATION

Article 28. Contracts for assignment of adoption of scheme

1. Based on the decision on approval for Program of the Minister of Industry and Trade, the Vietnam Trade Promotion Agency shall conclude contracts for assignment of adoption of scheme with host organizations and make payment and statements of supportive budget according to the concluded contracts.

2. Host organizations shall prepare initiation plans, financial plans, detailed budget estimates to adopt the approved scheme enclosed with relevant documents and send them to the Vietnam Trade Promotion Agency so as to conclude contracts for assignment of adoption of scheme. If a scheme requires selection of preferred bidders as prescribed in the Law on Bidding and its applicable guiding documents, the host organization shall send the estimate and relevant documents to conclude such a contract at least 45 days before the bidding date.

3. The content of the contract shall conform to Article 12 of Government's Decree No. 28/2018/ND-CP dated March 1, 2018.

1. Prepare plans, schemes, estimates for annual National Program on Trade Promotion.

2. Seek consultations from regional trade promotion agencies in case of schemes for trade promotion of products in regions; seek consultations from relevant business associations in case of schemes for multi-industry trade promotion.

3. Report on performance of the scheme as prescribed in Article 14 of Government's Decree No. 28/2018/ND-CP dated March 1, 2018.

4. Maintain records and documents related to schemes under National Program on Trade Promotion as per the law.

5. Fully execute the contract concluded with the Vietnam Trade Promotion Agency.

6. Make payments and statements of budget in conformity with time for performance of the scheme, in accordance with laws and regulations on use of state budget, regulations in this Circular and corresponding regulations of law.

Article 30. Responsibilities of the Department of Industry and Trade

1. Advise the People’s Committees of provinces and central-affiliated cities to promulgate mechanism to cooperate and initiate schemes under National Program on Trade Promotion in provinces or cities.

2. Cooperate with the Vietnam Trade Promotion Agency, relevant agencies in supervising schemes under National Program on Trade Promotion in provinces or cities.

1. The Vietnam Trade Promotion Agency shall act as the focal point to assume the prime responsibility for management and implementation of the National Program on Trade Promotion and take responsibility for:

a) Guiding host organizations to prepare plans, schemes, estimates of annual Program;

b) Receiving, preliminarily evaluating, appraising and submit schemes under Program to the Minister of Industry and Trade for approval;

c) Organizing and guiding the implementation of the approved program plan and advancing, paying and making statement of budget of the Program;

d) Approving plans for selection of preferred bidder of schemes in which certain items or components so require;

dd) Urge and supervise the execution of contract to adopt the scheme; guide host organizations to initiate schemes in conformity with approved objectives and contents and in accordance with relevant laws;

e) Take charge and cooperate with relevant agencies in inspecting and evaluating performance of schemes, and management and use of budget of the Program;

g) Summarize, evaluate and report to the Ministry of Industry and Trade on the implementation of the Program.

2. European - American, Asian - African Market Departments, Department of Domestic Market, Department of Export and Import and Vietnamese trade representatives in foreign countries shall cooperate with the Vietnam Trade Promotion Agency and host organizations of schemes in implementing the approved National Program on Trade Promotion in an effective manner.
