Căn cứ Bộ luật Tố tụng hình sự ngày 27 tháng 11 năm 2015; Luật sửa đổi, bổ sung một số điều của Bộ luật Tố tụng hình sự ngày 12 tháng 11 năm 2021;

Căn cứ Luật Ban hành văn bản quy phạm pháp luật ngày 22 tháng 6 năm 2015; Luật sửa đổi, bổ sung một số điều của Luật Ban hành văn bản quy phạm pháp luật ngày 18 tháng 6 năm 2020;

Viện trưởng Viện kiểm sát nhân dân tối cao, Bộ trưởng Bộ Công an, Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn, Bộ trưởng Bộ Tài chính thống nhất ban hành Thông tư liên tịch quy định chi tiết việc áp dụng căn cứ tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh theo điểm c khoản 1 Điều 148, điểm d khoản 1 Điều 229 và điểm d khoản 1 Điều 247 Bộ luật Tố tụng hình sự.

Điều 1. Phạm vi điều chỉnh, đối tượng áp dụng

1. Thông tư liên tịch này quy định chi tiết việc áp dụng căn cứ tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh quy định tại điểm c khoản 1 Điều 148, điểm d khoản 1 Điều 229 và điểm d khoản 1 Điều 247 Bộ luật Tố tụng hình sự, gồm các nội dung sau:

a) Nguyên tắc áp dụng căn cứ tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh;

b) Tạm đình chỉ vì lý do bất khả kháng do thiên tai;

c) Tạm đình chỉ vì lý do bất khả kháng do dịch bệnh;

d) Phối hợp quản lý, giải quyết các vụ việc, vụ án tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh.

2. Thông tư liên tịch này áp dụng đối với:

a) Cơ quan điều tra các cấp của Công an nhân dân, Cơ quan điều tra các cấp trong Quân đội nhân dân, Cơ quan điều tra Viện kiểm sát nhân dân tối cao, Cơ quan điều tra Viện kiểm sát quân sự trung ương;

b) Cơ quan được giao nhiệm vụ tiến hành một số hoạt động điều tra theo quy định tại khoản 1 Điều 35 Bộ luật Tố tụng hình sự;

c) Viện kiểm sát nhân dân, Viện kiểm sát quân sự các cấp;

d) Người có thẩm quyền tiến hành tố tụng thuộc các cơ quan quy định tại các điểm a, b và c khoản này;

đ) Cơ quan, tổ chức, cá nhân khác có liên quan.

Điều 2. Nguyên tắc áp dụng căn cứ tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh

Khi áp dụng căn cứ tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh quy định tại điểm c khoản 1 Điều 148, điểm d khoản 1 Điều 229 và điểm d khoản 1 Điều 247 Bộ luật Tố tụng hình sự, cơ quan, người có thẩm quyền tiến hành tố tụng phải thực hiện các nguyên tắc sau đây:

1. Tuân thủ quy định của Bộ luật Tố tụng hình sự và quy định của pháp luật khác có liên quan;

2. Chỉ áp dụng khi có đủ các căn cứ theo quy định tại Điều 3, Điều 4 Thông tư liên tịch này;

3. Bảo đảm quyền con người, quyền và lợi ích hợp pháp của cơ quan, tổ chức, cá nhân liên quan;

4. Bảo đảm thận trọng khi quyết định áp dụng đối với từng vụ việc, vụ án cụ thể, nghiêm cấm việc lạm dụng;

5. Bảo đảm kiểm soát tội phạm, không gây ảnh hưởng đến việc giải quyết vụ việc, vụ án khi được phục hồi.

Điều 3. Tạm đình chỉ vì lý do bất khả kháng do thiên tai

1. Cơ quan, người có thẩm quyền tiến hành tố tụng chỉ được tạm đình chỉ giải quyết vụ việc, vụ án vì lý do bất khả kháng do thiên tai quy định tại điểm c khoản 1 Điều 148, điểm d khoản 1 Điều 229 hoặc điểm d khoản 1 Điều 247 Bộ luật Tố tụng hình sự khi có đủ các căn cứ sau đây:

a) Đã áp dụng mọi biện pháp cần thiết theo quy định của pháp luật mà không thể tiến hành được một hoặc một số hoạt động tố tụng để kết thúc việc giải quyết tố giác, tin báo về tội phạm, kiến nghị khởi tố; kết thúc điều tra hoặc quyết định việc truy tố do thuộc một trong các trường hợp quy định tại khoản 2 Điều này;

b) Đã hết thời hạn giải quyết tố giác, tin báo về tội phạm, kiến nghị khởi tố; thời hạn điều tra hoặc thời hạn quyết định việc truy tố.

2. Các trường hợp bất khả kháng do thiên tai:

a) Người tham gia tố tụng hoặc cơ quan, người có thẩm quyền tiến hành tố tụng đang ở vùng được ban bố tình trạng khẩn cấp về thiên tai hoặc vùng có tình huống khẩn cấp về thiên tai theo quy định của pháp luật về tình trạng khẩn cấp, pháp luật về phòng, chống thiên tai;

b) Địa điểm cần tiến hành các hoạt động tố tụng trong vùng được ban bố tình trạng khẩn cấp về thiên tai hoặc vùng có tình huống khẩn cấp về thiên tai theo quy định của pháp luật về tình trạng khẩn cấp, pháp luật về phòng, chống thiên tai.

Điều 4. Tạm đình chỉ vì lý do bất khả kháng do dịch bệnh

1. Cơ quan, người có thẩm quyền tiến hành tố tụng chỉ được tạm đình chỉ giải quyết vụ việc, vụ án vì lý do bất khả kháng do dịch bệnh quy định tại điểm c khoản 1 Điều 148, điểm d khoản 1 Điều 229 hoặc điểm d khoản 1 Điều 247 Bộ luật Tố tụng hình sự khi có đủ các căn cứ sau đây:

a) Đã áp dụng mọi biện pháp cần thiết theo quy định của pháp luật mà không thể tiến hành được một hoặc một số hoạt động tố tụng để kết thúc việc giải quyết tố giác, tin báo về tội phạm, kiến nghị khởi tố; kết thúc điều tra hoặc quyết định việc truy tố do thuộc một trong các trường hợp quy định tại khoản 2 Điều này;

b) Đã hết thời hạn giải quyết tố giác, tin báo về tội phạm, kiến nghị khởi tố; thời hạn điều tra hoặc thời hạn quyết định việc truy tố.

2. Các trường hợp bất khả kháng do dịch bệnh:

a) Người tham gia tố tụng, cơ quan, người có thẩm quyền tiến hành tố tụng hoặc địa điểm cần tiến hành các hoạt động tố tụng trong vùng được ban bố tình trạng khẩn cấp về dịch theo quy định của pháp luật về tình trạng khẩn cấp, pháp luật về phòng, chống bệnh truyền nhiễm;

b) Người tham gia tố tụng đang bị cách ly y tế theo quyết định của cơ quan, người có thẩm quyền do bị mắc bệnh dịch thuộc nhóm A hoặc do thuộc trường hợp khác liên quan đến bệnh dịch thuộc nhóm A theo quy định của pháp luật về phòng, chống bệnh truyền nhiễm;

c) Người tham gia tố tụng, cơ quan, người có thẩm quyền tiến hành tố tụng hoặc địa điểm cần tiến hành các hoạt động tố tụng trong vùng được Thủ tướng Chính phủ hoặc Bộ trưởng Bộ Y tế công bố dịch đối với bệnh truyền nhiễm thuộc nhóm A theo quy định của pháp luật về phòng, chống bệnh truyền nhiễm.

Điều 5. Phối hợp quản lý, giải quyết các vụ việc, vụ án tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh

Việc phối hợp quản lý, giải quyết các vụ việc, vụ án tạm đình chỉ; phục hồi giải quyết tố giác, tin báo về tội phạm, kiến nghị khởi tố; phục hồi, đình chỉ điều tra đối với vụ án đã tạm đình chỉ trong giai đoạn điều tra; phục hồi, đình chỉ đối với vụ án đã tạm đình chỉ trong giai đoạn truy tố; áp dụng, hủy bỏ biện pháp ngăn chặn, biện pháp cưỡng chế; quản lý, xử lý vật chứng, tài liệu, đồ vật, tài sản tạm giữ trong vụ việc, vụ án tạm đình chỉ; lập hồ sơ, quản lý hồ sơ vụ việc, vụ án tạm đình chỉ; thực hiện chế độ thông tin, thống kê, báo cáo đối với các vụ việc, vụ án tạm đình chỉ vì lý do bất khả kháng do thiên tai, dịch bệnh được thực hiện theo quy định của Bộ luật Tố tụng hình sự và Thông tư liên tịch số 01/2020/TTLT-VKSNDTC-TANDTC-BCA-BQP-BNNPTNT-BTC-BTP ngày 01/6/2020 của Viện trưởng, Viện kiểm sát nhân dân tối cao, Chánh án Tòa án nhân dân tối cao, Bộ trưởng Bộ Công an, Bộ trưởng Bộ Quốc phòng, Bộ trưởng Bộ Nông nghiệp và Phát triển nông thôn, Bộ trưởng Bộ Tài chính, Bộ trưởng Bộ Tư pháp quy định phối hợp thực hiện một số điều của Bộ luật Tố tụng hình sự về quản lý, giải quyết các vụ án, vụ việc tạm đình chỉ.

Điều 6. Điều khoản thi hành

1. Thông tư liên tịch này có hiệu lực thi hành từ ngày 01 tháng 12 năm 2021.

2. Viện kiểm sát nhân dân tối cao, Bộ Công an, Bộ Quốc phòng, Bộ Nông nghiệp và Phát triển nông thôn, Bộ Tài chính trong phạm vi chức năng, nhiệm vụ, quyền hạn của mình chịu trách nhiệm tổ chức thực hiện Thông tư liên tịch này.

Trong quá trình thực hiện Thông tư liên tịch này, nếu có vướng mắc, hoặc phát sinh những vấn đề cần phải bổ sung thì kịp thời phản ánh về Viện kiểm sát nhân dân tối cao, Bộ Công an, Bộ Quốc phòng, Bộ Nông nghiệp và Phát triển nông thôn, Bộ Tài chính để xem xét, hướng dẫn thực hiện hoặc sửa đổi, bổ sung cho phù hợp./.

JOINT CIRCULAR

ELABORATION OF SUSPENSION OF CASES DUE TO FORCE MAJEURE (NATURAL DISASTERS OR EPIDEMICS) ACCORDING TO POINT C CLAUSE 1 ARTICLE 148, POINT D CLAUSE 1 ARTICLE 229 AND POINT D CLAUSE 1 ARTICLE 247 OF CRIMINAL PROCEDURES CODE

Pursuant to the Criminal Procedure Code dated November 27, 2015; the Law on amendments to some articles of the Criminal Procedure Code dated November 12, 2021;

Pursuant to Law on Promulgation of legislative documents dated June 22, 2015; the Law on amendments to some articles of Law on Promulgation of legislative documents dated June 18, 2020;

The Procurator General of the Supreme People's Procuracy, the Minister of Public Security, the Minister of National Defense, the Minister of Agriculture and Rural Development and the Minister of Finance unanimously promulgate a Joint Circular on elaboration of suspension of cases due to force majeure (natural disasters or epidemics) according to Point c Clause 1 Article 148, Point d Clause 1 Article 229 and Point d Clause 1 Article 247 of Criminal Procedures Code.

Article 1. Scope and regulated entities

1. This Joint Circular elaborates suspension of cases due to force majeure (natural disasters or epidemics) according to Point c Clause 1 Article 148, Point d Clause 1 Article 229 and Point d Clause 1 Article 247 of Criminal Procedures Code. To be specific:

a) Principles for suspension of cases due to force majeure (natural disasters or epidemics)

c) Suspension due to force majeure (epidemics);

d) Cooperation in management and settlement of cases subject to suspension due to force majeure (natural disasters or epidemics).

2. This Circular applies to the following entities:

a) Investigation authorities at all levels of the People's Public Security, investigation authorities at all levels in the People's Army, investigation authorities of the Supreme People's Procuracy and the investigation authorities of the Central Military Procuracy;

b) Agencies assigned to conduct a number of investigation activities in Clause 1, Article 35 of the Criminal Procedure Code;

c) Supreme People's Procuracy, Military Procuracy at all levels;

d) Persons who have power to institute proceedings of the agencies specified at Points a, b and c of this Clause;

dd) Relevant organizations, individuals, authorities.

Article 2. Principles for suspension of cases due to force majeure (natural disasters or epidemics)

1. Comply with regulations of the Criminal Procedure Code and relevant laws;

2. Apply in case there is substantiation as prescribed in Articles 3 and 4 of this Joint Circular;

3. Ensure human rights, lawful rights and interests of relevant agencies, organizations and individuals;

4. Ensure caution in case of decision on application to each specific case; prohibit abuse;

5. Ensure control of crime; fail to affect the settlement of cases in case of resumption.

Article 3. Suspension due to force majeure (natural disasters)

1. The authorities and persons given authority to institute proceedings shall only be subject to suspension of the processing of cases due to force majeure (natural disasters) specified at Point c, Clause 1, Article 148, Point d, Clause 1, Article 229 or Point d, Clause 1, Article 247 of the Criminal Procedure Code if the following substantiation are fully satisfied:

a) All necessary measures as prescribed by law have been applied but it is impossible to conduct one or several activities of criminal procedures in order to end the processing of denunciations, criminal information disclosed and requisitions for charges; investigation or decide prosecution due to one of cases specified in Clause 2 of this Article;

b) The time limit for processing of denunciations, criminal information disclosed and requisitions for charges, the time limit for investigation or the time limit for decision on the prosecution has expired.

a) Entities engaging in proceedings or authorities and persons given authority to institute proceedings are residing in the area where the state of emergency has been declared or where there are emergency cases of natural disasters in accordance with the law on state of emergency, prevention and control of natural disasters;

b) Location where the activities of criminal procedures are conducted falls into the area where the state of emergency has been declared or where there are emergency cases of natural disasters in accordance with the law on state of emergency, prevention and control of natural disasters

Article 4. Suspension due to force majeure (epidemics)

1. The authorities and persons given authority to institute proceedings shall only be subject to suspension of the processing of cases due to force majeure (epidemics) specified at Point c, Clause 1, Article 148, Point d, Clause 1, Article 229 or Point d, Clause 1, Article 247 of the Criminal Procedure Code if the following substantiation are fully satisfied:

a) All necessary measures as prescribed by law have been applied but it is impossible to conduct one or several activities of criminal procedures in order to end the processing of denunciations, criminal information disclosed and requisitions for charges; investigation or decide prosecution due to one of cases specified in Clause 2 of this Article;

b) The time limit for processing of denunciations, criminal information disclosed and requisitions for charges, the time limit for investigation or the time limit for decision on the prosecution has expired.

2. Force majeure (epidemics):

a) Entities engaging in proceedings or authorities and persons given authority to institute proceedings are residing or location where the activities of criminal procedures are conducted falls into the area where the state of emergency has been declared in accordance with the law on state of emergency, prevention and control of infectious diseases;

b) Entities engaging in proceedings are subject to medical isolation according to the decision of competent agencies or persons due to being infected with a group A epidemic or another case relevant to a group A epidemic as prescribed by the law on prevention and control of infectious diseases.

Article 5. Cooperation in management and settlement of cases subject to suspension due to force majeure (natural disasters or epidemics).

Cooperation in management and settlement of cases subject to suspension; resumption of the processing of denunciations, criminal information disclosed and requisitions for charges; resumption and suspension of investigation of cases subject to suspension in the stage of investigation; resumption and suspension of investigation of cases subject to suspension in the stage of prosecution, application or cancellation of preventive or coercive measures; management and handling of evidences, documents, objects and assets that are temporarily seized in cases subject to suspension; making and management of documents on cases subject to suspension; implementation of information, statistics and reporting regime for cases subject to suspension due to force majeure (natural disasters or epidemics) shall comply with regulations of Criminal Procedure Code and the Joint Circular No. 01/2020/TTLT-VKSNDTC-TANDTC-BCA-BQP-BNNPTNT-BTC-BTP dated June 1, 2020 of the Procurator General of the Supreme People's Court, the Chief Judge of the Supreme People's Court, the Minister of Public Security, the Minister of National Defense, the Minister of Agriculture and Rural Development, the Minister of Finance, the Minister of Justice on cooperation in implementation of some articles of the Criminal Procedure Code on the management and settlement of cases subject to suspension.

Article 6. Implementation provision

1. This Joint Circular comes into force as of December 01, 2021.

2. The Supreme People's Procuracy, the Ministry of Public Security, the Ministry of National Defense, the Ministry of Agriculture and Rural Development and the Ministry of Finance, within the scope of their functions, tasks and powers, shall be responsible for implementation of this Circular.

Any difficulty or problem that arises during the implementation of this Circular should be reported to the Supreme People's Procuracy, the Ministry of Public Security, the Ministry of National Defense, the Ministry of Agriculture and Rural Development and the Ministry of Finance for consideration, implementation and amendments.
