DECISION
PROMULGATING REGULATION ON FORMS OF ASSEMBLY AND
MANUFACTURE OF MOTORCYCLES
THE MINISTER OF SCIENCE, TECHNOLOGY AND
ENVIRONMENT
Pursuant to the
Goods Quality Ordinance dated December 27, 1990;
Pursuant to Decree
No. 86/CP dated December 08, 1995 by the Government providing for assignment of
State management on goods quality;
Pursuant to Decree
No. 22/CP dated May 22, 1993 by the Government on tasks, power and organization
of the Ministry of Science, Technology and Environment;
Pursuant to the
direction of the Prime Minister in Official Dispatch No. 1440/KTTH dated
November 07, 1998 on tax policy according to import substitution ratio;
Pursuant to
Decision No. 254/1998/QD-TTg dated 30/12/1998 by the Prime Minister on
direction of goods export and import in 1999;

DECIDES
Article 1. “Regulation on forms of assembly and manufacture of
motorcycle” is enclosed with this Decision.
Article 2: This Decision is applicable to enterprises having the
license for investment in manufacture and assembly of motorcycles issued by
regulatory agencies.
Article 3: This Decision comes into effect after 15 days since it is
signed.
Decision No. 65/TDC-QD
dated 16/3/1995 and Decision No. 52/TDC-QD dated 27/3/1998 of the Directorate
for Standards, Metrology and Quality.

REGULATION
ON FORMS OF ASSEMBLY AND MANUFACTURE OF MOTORCYCLES
(Enclosed with Decision No. 648/1999/QD-BKHCNMT dated April 17, 1999 by the
Minister of Science, Technology and Environment)
1. This document
providing for forms of assembly and manufacture of motorcycle that are
assembled from details and parts imported and/or made in Vietnam.
2. “Details/parts
produced in Vietnam” in this document can be construed as details and parts
that are produced and assembled in Vietnam for import substitution.
3. 5 forms of
assembly:
3.1. CKD1: All details
that are imported are classified into 6 groups as follows (Appendixes 1 and 2):
3.1.1. Group 1 –
Engine: engine, gearbox, complete generator, unassembled into the frame.
Carburetor, air filter and silencer, unassembled.
3.1.2. Group 2 – Frame:
Frame, absorber, fork and every details in the group that are assembled with
bolt, screw nut and screwdriver, unassembled. Completely painted.
3.1.3. Group 3 – Chain
drive and wheel: felloe, wheel, spoke, tyre and tube, brake system, chain wheel
and roller chain, unassembled.

3.1.5. Group 5 –
Electricity system: electricity system, headlight, taillight, turn signal,
unassembled.
3.1.6. Group 6 –
Fairing and auxiliary equipment: all the fairings and auxiliary equipment,
unassembled.
Notes: Appendixes 1
and 2 enclosed with this document illustrate the separation of details of the
form CKD1 for both male and female motorcycles without technical meaning of
structure. If the structure of the motorcycle contains peculiar details other
than those specified in these Appendix, then the determination of form of
assembly will not concern about such details.
3.2. CKD2: Similar to
CKD1, except that all the engine, gearbox and generator are unassembled. If the
assembled engine, gearbox and generator are allowed to import according to the
license for investment in the manufacture and assembly of motorcycles, then
only details produced in Vietnam with value at ≥ 5% of that of a CBU.
3.3. IKD1: Similar to
CKD2, except that a number of details in group 6 and group 3 are produced in Vietnam. Details produced in Vietnam must be value at ≥ 10% (in case engines,
gearboxes and generators are unassembled) or ≥ 15% (in case engines,
gearboxes and generators are imported in assembled form) of the total value of
a CBU.
3.4. IKD2: Similar to
CKD2 except that there shall be bodywork and a number of details in group 4 or
group 5 that are produced in Vietnam; engines, gearboxes and generators shall
be unassembled. Total value of details and parts that are produced in Vietnam shall be at ≥ 30% of total value of a CBU.
3.5. IKD3: Similar to
IKD2 except that total value of details/parts produced in Vietnam shall be at ≥ 60% of total value of a CBU, where value of details of an engine
shall be 30% of its value.
4. Any
motorcycle-assembling establishment shall have production lines for assembling,
processing and inspecting of technical conditions according to each form of
assembly specified above.
5. Any
motorcycle-assembling establishment shall conduct quality inspection of
motorcycles and issue slips of completion of testing for motorcycles that are
shipped.
