CIRCULAR
ON
NON-REFUNDABLE ADVANCE COMPENSATION IN PASSENGER AIR TRANSPORTATION
Circular No. 14/2015/TT-BGTVT dated April 27, 2015
of the Minister of Transport on non-refundable advance compensation in
passenger air transportation, coming into force from July 1, 2015 and amended
by:
1. Circular No. 27/2017/TT-BGTVT dated August 25,
2017 on amendment to Circular No. 36/2014/TT-BGTVT dated August 29, 2014 of the
Minister of Transport on passenger service quality at airports and Circular No.
14/2015/TT-BGTVT dated April 27, 2015 of the Minister of Transport on
non-refundable advance compensation in passenger air transportation, coming
into force from November 1, 2017;
2. Circular No. 21/2020/TT-BGTVT dated September
28, 2020 on amendment to Circular No. 81/2014/TT-BGTVT dated December 30, 2014
of the Minister of Transport on air transportation and general aviation
operations, Circular No. 14/2015/TT-BGTVT dated April 27, 2015 of the Minister
of Transport on non-refundable advance compensation in passenger air
transportation and Circular No. 33/2016/TT-BGTVT dated November 15, 2016 of the
Minister of Transport on operational report and statistic report in Vietnam

The Minister of Transport promulgates Circular
on non-refundable advance compensation in passenger air transportation[1].
Chapter I
GENERAL PROVISIONS
Article 1. Scope and regulated
entities
1. This Circular prescribes non-refundable advance
compensation in passenger air transportation in situations where passengers are
denied boarding or flights are cancelled or flights are delayed for a long
period of time as a result of carrier’s fault after passengers’ seats have been
confirmed.
2. This Circular applies to organizations and
individuals related to non-refundable advance compensation in passenger air
transportation in Vietnam.
Article 2. Definitions

1. non-refundable advance compensation means
a compensation in form of money or other appropriate means that a carrier must
pay to their passengers under certain circumstances as per the law regardless
of actual damage suffered by the passengers.
2. denied boarding passenger means a
passenger who has obtained his/her air ticket and has his/her seat on the
flight confirmed and who is not allowed to board by carrier.

4. a long delayed flight means a flight
whose AOBT is more than 4 hours later than its scheduled off block time
(hereinafter referred to as “SOBT”) in reference flight schedule.
5. carrier means an airline that provides
flights.
6. seat confirmation means carrier’s
confirming that passenger has acquired a seat on the flight.
7. reference flight schedule means an
airline’s flight schedule updated in database of airport operator as of 10 p.m.
(in Hanoi’s time) of the day that precedes the date of execution.
Article 3. Rules of
implementation
1. Non-refundable advance compensation shall apply
to flights departing from Vietnam where passengers are denied boarding, flights
are cancelled, and flights are delayed for a long period of time.
2. Execution of non-refundable advance compensation
obligation shall not affect execution of other obligations of carriers in
regard to passenger transportation as per the law.
3. If carriers are required to compensate for
damage as per civil liability, the non-refundable advance compensation
hereunder shall be deducted from the civil liability compensation payable by
the carriers.

Article 4. Obligations of
carriers [3]
1. Non-refundable advance compensation shall be
paid to passengers who have obtained air tickets and have had their seats
confirmed in accordance with Article 8 hereof in case of denied boarding or
cancelled flights or flights delayed for a long period time, except for
exemptions under Article 5, Article 6, and Article 7 hereof.
2. Publicize cases eligible for non-refundable
advance compensation, compensation amount, methods, time limit, and address for
receiving compensation on website of carriers, at airports, at representative
offices, ticket agencies, and ticket agency system of carriers.
3. Inform Airport Authority, airport enterprises,
passenger terminal service providers about causes of cancelled flights and
flights delayed for a long period of time as soon as cancellation decision is
made or flights are determined to be delayed for a long period of time in order
to supervise and update via information system of airports and aerodromes.
4. Within 72 hours from SOBT[4] (in case of
cancelled flights) or AOBT (in case of flights with passengers denied boarding
or flights delayed for a long period of time) or when Airport Authority
requires, airlines are responsible for filing reports on non-refundable advance
compensation to Airport Authority as follows:
a) Name of report: Report on non-refundable advance
compensation for passengers denied boarding and passengers of cancelled
flights;
b) Content: information on flights of airlines;
information of passengers denied boarding and passengers of cancelled flights;
solutions of airlines;
c) Report filing and receipt methods: report shall
be in physical or electronic form and filed directly, via post service, fax, or
other appropriate means as per the law;
d) Report form: under Appendix I attached hereto.

6. Record contact address provided by passengers such
as: mobile phone number, fixed phone number, email address, or phone number of
relatives in order to provide information on cancelled flights or flights
delayed for a long period of time 24 hours prior to SOBT[5] which serves as the basis for exemption
of obligations under Clause 1 Article 7 hereof.
Article 5. Exemption from
obligations of carriers in denied boarding situation
Carriers shall be exempt from the obligation to
make non-refundable advance compensation when denying boarding of passengers
who have obtained air tickets and have their seats confirmed or are travelling
between itineraries in accordance with Article 146 of the Law on Vietnam Civil
Aviation, to be specific:
1. The carriers deem that transportation or
subsequent transportation of the passengers will endanger the passengers, other
people boarding the aircrafts, or the flights as a result of health conditions
of said passengers.
2. Denied boarding is implemented for the purpose
of preventing spread of diseases.
3. The passengers fail to comply with regulations
on aviation safety, aviation security, air transportation operation, and
administrative penalties in civil aviation.
4. The passengers cause public disorder, endanger
flight safety, or affect lives, health, property of other people.
5. The passengers have unruly behavior as a result
of being under the influence of alcohol or other stimulants.
6. Denied boarding is implemented for security
reasons notified by competent authority.

Article 6. Exemption from
obligations of carriers in cancelled flights or flights delayed for a long
period of time
Carriers shall be exempt from the obligation to
make non-refundable advance compensation when flights are cancelled or delayed
for a long period of time if:
1. Weather conditions affect safe operation of the
flights.
2. Security risks affect safe operation of the
flights.
3. The flights cannot be operated or are delayed
for a long period of time according to decision of competent state authority.
4. The flight cancellation or delay occurs as a
result of passengers’ medical conditions (passengers are severely ill or die
after boarding the aircrafts).
5. The aircrafts to be operated according to flight
schedule are sabotaged or aircrews thereof are sabotaged.
6. The flight cancellation or delay occurs as a
result of armed conflict, political unrest, or strike.
7. Aviation infrastructure or air navigation
services are insufficient to warrant flight operation.

9. Passengers are re-routed to their planned
destination via different flights whose actual in-block time is within 4 hours
of schedule in-block time of the flights on which the passengers have confirmed
seats.
10. Passengers are arranged to reach next points in
their itinerary within 6 hours of schedule in-block time of connecting flights
if destination of said connecting flights is a connecting point in the
passengers’ itinerary.
11. Other force majeure occurs.
Article 7. Exemption from
obligations of carriers in other situations
1. Carriers shall be exempt from the obligation to
make non-refundable advance compensation for passengers if carriers can prove
that:
a) They have informed passengers via direct
conversation, messages, or email about flight cancellation or long flight delay
at least 24 hours prior to AOBT via contact address under Clause 7 Article 4
hereof; if carriers inform passengers via phone calls, they must make 2 phone
calls which are 20 minutes apart and both calls must be within 7 a.m. and 10
p.m.
b) The passengers fail to register contact
information as per the law;
c) The passengers cannot be contacted via
registered contact information.
2. [6]
Carriers shall be exempt from the obligation to make non-refundable advance compensation
if passengers are transported for free or at a industry discount or agent
discount or discount applicable to partners of airlines.

4. Carriers shall be exempt from the obligation to
make non-refundable advance compensation if passengers voluntarily reject
confirmation.
Article 8. Amount of
non-refundable advance compensation
1. Compensation per passenger of domestic flight:
a) Flight whose length is under 500 km: 200.000
VND;
b) Flight whose length ranges from 500 km to under
1.000 km: 300.000 VND;
c) Flight whose length exceeds 1.000 km: 400.000
VND.
2. Compensation per passenger of international
flight:
a) Flight whose length is under 1.000 km: 25 USD;
b) Flight whose length ranges from 1.000 km to
under 2.500 km: 50 USD;

d) Flight whose length exceeds 5.000 km: 150 USD.
3. Carriers are allowed to regulate non-refundable
advance compensation as long as the compensation must not be lower than minimum
amounts under Clause 1 and Clause 2 of this Article.
4. [7] If a flight is delayed for a long period of
time and later cancelled, non-refundable advance compensation shall only apply
once.
Article 9. Method and time
limit for non-refundable advance compensation
1. Carriers may make non-refundable advance
compensation in form of:
a) Cash;
b) Bank transfer or other appropriate intermediary
payment services required by passengers. Should carriers choose this method,
the carriers are responsible for making non-refundable advance compensation
within 14 working days from the date on which they receive request of
passengers;
c) Free tickets, reimbursement instruments for
further use of services of carriers or other free services should the
passengers approve.
2. If passengers are denied boarding due to
carriers’ faults, carriers are responsible for immediately compensating
passengers at:

b) Branches or representative offices designated by
carriers as per agreement with passengers in case the passengers initiated
procedures outside of airports; or
c) Accounts provided by passengers should the
passengers choose method under Point b Clause 1 of this Article.
3. If flights are cancelled, carriers are responsible
for compensating passengers:
a) At airports where the flights are cancelled;
b) At branches or representative offices of
carriers at request of passengers or designated by carriers within 14 working
days from the date on which the flights are cancelled;
c) Accounts provided by passengers should the
passengers choose method under Point b Clause 1 of this Article.
4. If flights are delayed for a long period of
time, carriers are responsible for compensating passengers:
a) At airports where flights take off [8] or
land;
b) At branches or representative offices of
carriers at request of passengers or designated by carriers;

Article 10. Rights of
passengers
1. Receive information on Clause 3 Article 4
hereof.
2. Receive non-refundable advance compensation from
carriers via methods and within time limits set forth under this Circular.
3. If passengers do not receive the non-refundable
advance compensation or the compensation is not compliant with this Circular,
the passengers shall file a request to the carriers within 90 days from the
date on which the flights are supposed to depart[9] to request carriers
to fulfill the obligation. Within 7 days from the date on which carriers
receive request filed by passengers, the carriers are responsible for
responding in writing regarding execution of obligation to make non-refundable
advance compensation in accordance with this Circular.
4. Passengers have the right to file a lawsuit
against carriers for damage compensation according to civil laws if they
disagree with decisions of the carriers under Clause 3 of this Article.
Article 11. Obligations of
passengers
1. Adequately and accurately provide information
under Clause 7 Article 4 hereof.
2. Choose and inform passengers about methods of
receiving non-refundable advance compensation.

Article 12. Responsibilities
of Vietnam Civil Aviation Authority
1. Publish length of international and domestic
flights originating from Vietnam which serves as the basis for calculating
non-refundable advance compensation under Article 8 hereof.
2. Inspect, supervise, and deal with execution of
regulations on non-refundable advance compensation in passenger air
transportation.
Article 13. Responsibilities
of Airport Authority [10]
1. Publicly list length of flights and regulations
of this Circular at airports.
2. Examine, inspect, and deal with execution of
obligations of carriers in situations where passengers are denied boarding,
flights are cancelled, flights are delayed for a long period of time under this
Circular.
3. File monthly or irregular report to Vietnam
Civil Aviation Authority on supervision of non-refundable advance compensation
of airlines.
Monthly reports on supervision of non-refundable
advance compensation of airlines shall contain:
a) Name of report: Report on supervising
non-refundable advance compensation of airports;

c) Report filing and receipt methods: report shall
be in physical or electronic form and filed directly, via post service, fax, or
other appropriate means as per the law;
d) Deadline: before the 10th of next
month;
dd) Report data: collected from the 1st
to the final date of reporting month;
e) Report form: under Appendix II attached hereto.
Article 14. Responsibilities
of airport enterprises and passenger terminal service providers [11]
Airport enterprises and passenger terminal service
providers are responsible for updating information on cancelled flights and
flights delayed for a long period of time on information system of airports as
soon as they are informed by carriers in accordance with Clause 4 Article 4
hereof.
Article 15. Entry into force
[12]
1. This Circular comes into force from July 1,
2015.
2. Annul Decision No. 10/2007/QD-BGTVT dated
February 27, 2007 of the Minister of Transport.

Article 3 of Circular No. 27/2017/TT-BGTVT dated August 25, 2017 on amendment
to Circular No. 36/2014/TT-BGTVT dated August 29, 2014 of the Minister of
Transport on passenger service quality at airports and Circular No.
14/2015/TT-BGTVT dated April 27, 2015 of the Minister of Transport on
non-refundable advance compensation in passenger air transportation, coming
into force from November 1, 2017 regulates:
“Article 3. Organizing implementation
1. This Circular comes into force from November
1, 2017.
2. Chief of Office, the Chief Inspector,
directors, Director of Civil Aviation Authority of Vietnam, heads of agencies,
relevant organizations and individuals are responsible for the implementation
of this Circular./.”
Article 4 of Circular No. 21/2020/TT-BGTVT dated
September 28, 2020 on amendment to Circular No. 81/2014/TT-BGTVT dated December
30, 2014 of the Minister of Transport on air transportation and general aviation
operations, Circular No. 14/2015/TT-BGTVT dated April 27, 2015 of the Minister
of Transport on non-refundable advance compensation in passenger air
transportation and Circular No. 33/2016/TT-BGTVT dated November 15, 2016 of the
Minister of Transport on operational report and statistic report in Vietnam
civil aviation operation, coming into force from November 15, 2020 regulates:
“Article 4. Implementation
1. This Circular comes into force from November
15, 2020.
2. This Circular annuls:

b) Clause 2 Article 2 of Circular No. 27/2017/TT-BGTVT
dated August 25, 2017 of the Minister of Transport on amendment to Circular No.
36/2014/TT-BGTVT dated August 29, 2014 of the Minister of Transport on
passenger service quality at airports and Circular No. 14/2015/TT-BGTVT dated
April 27, 2015 of the Minister of Transport on non-refundable advance
compensation in passenger air transportation.
3. Chief of Ministry Office, the Chief
Inspector, directors, Director of Civil Aviation Authority of Vietnam, heads of
agencies, relevant organizations and individuals are responsible for the
implementation of this Circular./.”.
Article 5 of Circular No. 19/2023/TT-BGTVT on
amendment to articles under Circulars relating to air transportation, coming
into force from September 1, 2023, regulates:
“Article 5. Entry into force
1. This Circular comes into force from September
1, 2023.
2. Registration for issuance of house airway
bills submitted to Civil Aviation Authority of Vietnam before the effective
date hereof shall conform to Circular No. 21/2020/TT-BGTVT.
3. Certificate of registration for house airway
bills issued before the effective date hereof shall remain valid until it is
revoked.
4. Chief of Office, the Chief Inspector,
directors, Director of Civil Aviation Authority of Vietnam, heads of agencies,
relevant organizations and individuals are responsible for the implementation
of this Circular./.”

This Appendix is amended in accordance with Clause 3 Article 2 of Circular No.
21/2020/TT-BGTVT dated September 28, 2020 on amendment to Circular No.
81/2014/TT-BGTVT dated December 30, 2014 of the Minister of Transport on air
transportation and general aviation operations, Circular No. 14/2015/TT-BGTVT
dated April 27, 2015 of the Minister of Transport on non-refundable advance
compensation in passenger air transportation and Circular No. 33/2016/TT-BGTVT
dated November 15, 2016 of the Minister of Transport on operational report and
statistic report in Vietnam civil aviation operation, coming into force from
November 15, 2020.
