APPOINTMENT TO PROFESSOR OR ASSOCIATE PROFESSOR TITLE; PROCEDURES FOR
CANCELLATION OF RECOGNITION AND REMOVAL OF PROFESSOR OR ASSOCIATE PROFESSOR
TITLE
Pursuant to the Law on Government Organization
dated June 19, 2015;
Pursuant to the Law on Education dated June 14,
2005; the Law on Amendment and Supplement to the Law on Education dated
November 25, 2009;
Pursuant to the Law on Higher Education dated June
18, 2012;
Pursuant to the Government's Decree No.
75/2006/ND-CP dated August 2, 2006, elaborating and providing guidance on the
implementation of a number of articles of the Law on Education; the
Government's Decree No. 31/2011/ND-CP dated May 11, 2011 on amendments and
supplements to the Government's Decree No. 75/2006/ND-CP dated August 2, 2006,
elaborating and providing guidance on the implementation of a number of
articles of the Law on Education;
Upon the request of the Minister of Education
and Training;
The Prime Minister hereby promulgates the
Decision on standards and procedures for consideration of recognition of
accreditation and appointment to professor or associate professor title;
procedures for cancellation of recognition and removal of professor or
associate professor title.

GENERAL PROVISIONS
Article 1. Scope and subjects
of application
1. This Decision provides for standards, procedures
for consideration of recognition of accreditation and appointment to professor
or associate professor title; procedures for cancellation of recognition and
removal of professor or associate professor title.
2. This Decision shall apply to lecturers teaching
at national universities, universities, colleges, academies, research
institutes permitted to provide doctoral training programs, practical
facilities of higher education establishments training in the healthcare
discipline in Vietnam and other relevant organizations and individuals.
Article 2. Definition
For the purposes of this Decision, terms used
herein shall be construed as follows:
1. “Lecturer" of higher education institutions
is classified into the tenured lecturer and the guest lecturer in accordance
with laws.
2. “Head of educational institution” is a general
phrase referring to such titles as Director of a national university, Director
of a university, Director of an academy, President of a higher education
institution and Director of a research institute licensed to provide a doctoral
degree program.
3. “Scientific paper” refers to the scientific
research work by an author that has been published in a scientific journal with
the international standard code ISSN, explicitly expresses scientific ideas,
rationales, national and international studies, major theoretical and practical
contributions; methods, means of study, cited sources and references.

a) “Textbook” refers to a teaching and learning
material which has contents suitable for a training and educational program, is
reviewed and selected by the head of a higher education establishment, or
approved by the Minister of Education and Training;
b) “Monograph” refers to a scientific research
representing the results of an intensive and comparatively comprehensive
research on a scientific issue arising in the research specialty;
c) “Reference book” refers to a scientific research
work with contents appropriate for training and educational programs which a
higher education institution accepts as reference materials intended for
lecturers and students;
d) “Instructional book” refer to a book that a
higher education institution uses for guiding students, for providing guidance
on practical activities in an academic major, practical activities based on a
textbook, internship activities in hospitals and practical activities in a
workshop; specialized dictionaries.
5. “Proficient in using foreign languages/ foreign
language proficiency for performing research tasks of a person” (with respect
to a single foreign language) shall be determined if
a) he/she is able to comprehensively read an
academic article or material; able to write academic articles; able to present
or discuss (listen and speak) any academic issues in a specified foreign
language;
b) he/she has studied and researched full time in
foreign countries, and is awarded the BA, MA or doctorate degree by an overseas
higher education institution;
c) he/she is teaching a major in a specified
foreign language;
d) he/she has graduated from a foreign linguistics
university with a bachelor degree in the foreign linguistics;

6. “Able/ability to communicate in English” refers
to an ability to express what a person wants the other person to understand and
understand what the other person speaks in English about general academic
information and in common conversational situations.
Article 3. Duties of a
professor and an associate professor
1. Perform tasks of lecturers under the provisions of
the Law on Education, the Law on Higher Education, working regimes of lecturers
and other relevant laws.
2. Design the academic curriculum, syllabus and
other books used for academic purposes; deliver lectures and provide
instructions for preparation of undergraduate essays, dissertations, master's
theses, specialty or major theses, doctoral dissertations, and perform other
relevant tasks.
3. Research and promote scientific application and
technology transfer, and assure the training quality.
4. Train himself/herself in ethics, scientific
etiquette, professional skills and knowledge, and provide the major group or
team's members with orientations towards involvement in scientific and
technological researches.
5. Collaborate with other colleagues in performing
academic duties; participate in scientific and technological counseling and
technology transfers in order to meet the needs for performing economic,
social, national defence and security activities and other tasks.

1. Avoid violating the teacher's ethics, not to be
subject to disciplinary actions which may be a reprimand or more serious one or
execution of criminal judgements; ensure authenticity and impartiality for
training, scientific research and other activities.
2. Standards concerning the period of performance
of duties of a lecturer at the undergraduate or higher level:
a) He/she must accumulate adequate time to perform
lecturing duties at the undergraduate and higher level under the provisions of
Clause 2 Article 5 of this Decision with respect to the professor title;
Clauses 2 and 3 Article 6 of this Decision with respect to the associate
professor title;
b) The period during which he/she holds the
position as an educational expert at an overseas higher education establishment
shall be assumed as the period of performance of lecturing duties at the
undergraduate and higher level as provided by a diplomatic note or guest
lecturer contract of that establishment, clearly stating his/her duties and
lecturing timelength, or under the decision of the Minister of Education and
Training that sends him/her abroad as an overseas educational expert;
c) He/she has been acquiring 10 successive years'
experience in performing lecturing duties at the undergraduate and higher level
till the submission deadline. With respect to such period of experience, if
he/she has received internship or refresher programs for less than 12 months in
the last 3 years, that 12-month timelength shall not be considered as an
interval in the period of these last 3 years.
3. He/she must successfully finish assigned duties
and fully meet lecture hour requirements in accordance with regulations adopted
by the Minister of Education and Training, including at least a half of such
lecture hours during which he/she is directly giving in-class lectures. Guest
lecturers shall be required to attain at least 50% of the lecture hour norm as
prescribed in this clause.
The head of a higher education establishment shall
review and evaluate in writing the tasks assigned to lecturers, clearly stating
the course's title, level of training, fostering, level of completion of
teaching volume, dissertation guide, thesis, project or thesis; about the
training results and research of the lecturers.
4. Proficiency in at least one foreign language for
professional work and ability to communicate in English.
5. Have enough grades of scientific works converted
into minimum grades as prescribed in Clause 9, Article 5 of this Decision, for
professor titles and Clause 8, Article 6 of this Decision, for the position of
associate professor.

1. Meet the general criteria of the professor title
stipulated in Article 4 of this Decision.
2. Have been assigned the title of associate
professor for full 03 years or more up to the deadline for submission of
dossiers of registration for recognition of the professor title at the
grassroots-level Council (hereinafter referred to as submission deadline )
Candidates who have already been appointed as associate professors but have not
yet completed 3 years and who have not enough teaching hours as prescribed in
Clause 3, Article 4 of this Decision must have at least twice more than the
minimum contribution from scientific studies from scientific articles or
patents; utility solution; works of art, achievements in training and
competitions in physical training and sports that have won national or
international prizes specified at Point b, Clause 9 of this Article.
3. Assume the prime responsibility for, or
participate in, the formulation and development of programs of training and
fostering from universities or higher levels or scientific and technological
tasks (programs, projects, research subjects), application deployment Science
and technology in line with the branch or specialty of science which has been
registered for recognition and accreditation of the professor title and is
established by the head of a tertiary education institution or a competent body
verified and put into use.
4. Announcement of scientific research results
a) The applicant is the principal author who
publishes at least three scientific papers or patents; utility solution; works
of art, achievements in training and competitions in international physical
training and sport. Candidates who do not have enough scientific works defined
at this point must have at least 02 scientific works mentioned above and 01
training book chapters published by a prestigious publishing house in the world
or at least 02 of the above scientific works and 01 monographs published by a
prestigious publishing house.
b) The applicant is the principal author who
publishes at least three scientific papers or patents; utility solution; works
of art, achievements in training and competitions in international physical
training and sport. Candidates who do not have enough scientific works defined
at this point must have at least 03 scientific works mentioned above and 02
training book chapters published by a prestigious publishing house in the world
or at least 03 of the above scientific works and 02 monographs published by a
prestigious publishing house.
5. Assume the prime responsibility for compiling
books in service of training of university or higher degree suitable to the
majors for recognition of the professor title.
6. Assume the prime responsibility for implementing
at least two ministerial-level scientific and technological tasks or one
national-level scientific and technological task, which have been accepted by
the State. Candidates failing to perform the scientific and technological tasks
prescribed in this Clause shall be replaced by scientific papers or patents;
utility solution; works of art, achievements in training and competitions in
international physical training and sport. Each ministry-level scientific and
technological task shall be replaced with another scientific paper or
scientific work mentioned in this Clause.
7. Main guidelines for at least 02 PhD students are
required by law. Candidates who fail to provide sufficient instruction in this
clause shall be replaced by a scientific paper or (i) patent; utility solution;
art works, achievements in training and competitions in physical training and
sports to win international prizes; Main instructor for 01 doctoral student
that is replaced by 03 scientific articles or scientific works defined at this
point.

9. Candidates must have at least 20.0 points for
scientific research, including:
a) At least 5.0 points will be taken in the last
three years up to the deadline for submission;
b) Candidates in the fields of natural sciences,
engineering and technology, health science must have at least 12.0 points
scientific works calculated from scientific articles or (i) patent the utility
solution. Candidates in the fields of social sciences and humanities, the arts,
physical training and sports must have at least 8.0 scientific works points
calculated from scientific articles or (or) useful solutions; art works,
training achievements, sports competitions and national and international
awards.
c) Candidates in the field of natural sciences,
engineering and technology, health science must have at least 3.0 scientific
work points calculated from the compilation of books for training, of which at
least 1.5 points from curriculum development or (or) monographs. Candidates in
social sciences and humanities; Arts and physical training and sports must have
at least 5.0 scientific points calculated from the compilation of books in
service of training, of which at least 2.5 points will be calculated from the
curriculum development or (and ) monographs. Candidates who fail to meet the
points prescribed in this Clause shall be replaced by the points converted from
scientific articles or patents; utility solution; works of art, achievements in
training and competitions in international physical training and sport.
Article 6. Standards of
associate professor title
1. Meet the general criteria of the professor title
stipulated in Article 4 of this Decision.
2. Having obtained a doctor's diploma for 03 years
or more from the date of signing the decision granting the diploma to the
deadline for submission of the application.
3. At least 06 years, including the last three
consecutive years of training and retraining from the university or higher
level up to the deadline for submission of applications. Candidates who have
not been qualified for 6 years and those who do not have enough teaching hours
as stipulated in Clause 3, Article 4 of this Decision, must have at least twice
the minimum scientific works' points contributed from articles. study or (i)
patent; utility solution; Works of art, achievements in training or competition
in physical training and sports, which have been awarded national or
international prizes prescribed at Point b, Clause 8 of this Article..

b) From January 1, 2020: Candidate is the principal
author who publishes at least 03 scientific papers or patents; utility
solution; works of art, achievements in training and competitions in
international physical training and sport. Candidates who do not have enough
scientific works defined at this point must have at least 02 of the above-said
works and 01 training book chapter published by one of the prestigious
publishing houses in the world or with few 02 of the works mentioned above and
01 book of monographs published by a prestigious publishing house.
5. Assume the prime responsibility for implementing
at least two grassroots-level scientific and technological tasks or one
ministerial-level scientific and technological task which has been accepted by
the Ministry. Candidates failing to fulfill the scientific and technological
tasks prescribed in this Clause shall be replaced by one scientific paper or
one of the works: patent for invention; utility solution; works of art,
achievements in training and competitions in international physical training
and sport.
6. Instruct at least 02 trainees who are awarded
master's degree or master's or secondary level of at least 01 PhD student. For
health sciences, guiding 01 trainees successfully defending a dissertation or
resident doctor shall be counted as guiding one trainee to obtain a master's
degree; Candidates who fail to provide sufficient guidance on traineeships or
doctoral students specified in this Clause shall be replaced by the converted
scientific works. Guiding 01 master's degree student to be replaced with one of
the works: Scientific paper; patent; utility solution; books for training;
works of art, achievements in training and competitions in international
physical training and sport.
7. The scientific articles prescribed in Clauses 4,
5 and 6 of this Article are scientific papers published in prestigious
international scientific journals after the candidates successfully defend
their doctoral theses..
8. Candidates must have at least 10.0 points for
scientific research, including:
a) At least 2.5 points will be taken in the last
three years up to the deadline for submission;
b) Candidates in the field of natural sciences,
engineering and technology, health science must have at least 6.0 scientific
work points calculated from scientific articles, patent or utilities.
Candidates in the fields of social sciences and humanities, arts, physical
training and sports must have at least 4.0 scientific research points
calculated from scientific papers or utility solutions; art works, training
achievements, sports competitions and national and international awards.

1. Scientific works permitted for calculation of

b) Results of research and application of science
and technology have been registered and patented in the country or
internationally.
c) Useful solutions have been applied effectively
in state management practice, in management reform and socio-economic
development;
d) Books for training have been established by the
head of a tertiary education institution or a competent level and accepted and
used for training and fostering from a university or higher degree. The book
chapter is published by a prestigious publishing house in the world;
dd) Scientific reports are published full-text in
the yearbook with international standard ISBN codes of national scientific
seminars;
e) Works of art (including compositions of music,
theater, cinema, dance, fine arts, architecture and art performance), national
and international achievements in training and competitions.
2. Each type of scientific work specified in Clause
1 of this Article must have contents suitable to the scientific branch or
specialized branch of the candidate registered for consideration and
recognition of the professor and associate professor titles, and shall be
calculated in points the conversion specified in Appendix I to this Decision.
The calculation of points for scientific works shall be based on the scientific
quality of each work; For scientific articles, based on the influence factor of
the magazine, the citation index of the article.
3. A published scientific work with contents
overlapping with other works of 30% or more shall be counted only once. News
articles and scientific dissertation books, summary of research results,
summary reports, reviews, comments, evaluations and translations are not
counted as scientific works.
Article 8. Method of
calculation of points for authors of scientific works
When multiple scientific works are involved, the
principal author shall be entitled to one third of the works' scores; the
remaining points are divided according to the contribution of each person
including the principal author. In case it is impossible to determine the
specific value of each person's contribution, the remaining points will be
divided equally for each participant.

Section 1. PROCEDURES FOR
CONSIDERATION OF RECOGNITION OF ACCREDITATION FOR THE PROFESSOR OR ASSOCIATE
PROFESSOR TITLE AT HIGHER EDUCATION ESTABLISHMENTS
Article 9. Application
requirements for consideration of recognition of accreditation for the professor
or associate professor title
1. A written registration for consideration and
recognition of the professor and associate professor titles (form No. 01,
Appendix II to this Decision).
2. A copy of the decision recognizing or appointing
the title of associate professor for the applicant registering for
accreditation of professor title. Copies of doctoral degrees for candidates who
register for recognition and accreditation of associate professors.
3. Copies of diplomas and certificates evidencing
proficiency in foreign languages of candidates according to the provisions of
Clause 5, Article 2 of this Decision.
4. Copy of the decision on or contract for hiring
of guest lecturers, required for guest lecturers.
5. Comments of heads of tertiary education institutions
on training results and scientific research for lecturers (Form No 02, Appendix
II issued together with this Decision).
6. Copies of the decisions on assignment of tasks
of instruction for doctors and masters.

8. A copy of the decision or contract assigning the
scientific and technological task; The record on acceptance or decision on the
recognition of results of performance of scientific and technological tasks.
9. Copies of patents, utility solutions, national
and international awards and supporting documents.
10. A copy of the diplomatic note or teaching
contract of a foreign educational establishment stating clearly the duration of
working as an expert and the decision on sending to work as an education expert
abroad by the Ministry of Education and Training of Vietnam.
11. The scientific report (Form 03, Appendix II
issued with this Decision).
12. A copy of the published scientific paper, training
book has been assessed and tested in accordance with regulations.
13. Certificate of purpose of using books,
certificate of participation in the development, development of training
programs or programs of research and application of science and technology of
heads of tertiary education institutions.
14. Copies of diplomas, certificates, decisions,
diplomatic notes or contracts must be authenticated or notarized according to
the provisions of law.
Article 10. Forms and
characteristics of the application dossier

b) The file is in two volumes. Volume I includes
the documents specified in Clauses 1 thru 11 of Article 9 of this Decision;
Episode II includes scientific papers and training books arranged by the
applicant according to each type of works in chronological order and the
documents specified in Clauses 12 and 13, Article 9 of this Decision (form No.
04, Appendix II issued together with this Decision).
c) All documents are digitized in PDF format
(called electronic files) and registered online on the website of the higher
education institution (where the application file is received). ) and on the
Web site of the State Council.
2. General scientific report on the implementation
of the tasks stipulated in Article 3 of this Decision in the form of a
scientific work, presentation of scientific ideas, main research directions,
research methods, training results and Studying after the diploma granting or
granting of a PhD degree to a candidate for registration for recognition of an
associate professor title; since being appointed associate professor title for
candidates registered for recognition for qualification of professor title. The
scientific report does not exceed 10 A4 pages.
3. Candidates are responsible for the legality,
accuracy of documents and copies. When the competent authority so requests, the
applicant shall provide the originals or original documents for comparison.
4. Scientific works, patents for inventions and
utility solutions of agencies, organizations or citizens related to the
contents of State secrets and secrets in the field of national defense and
security must be protected in accordance with the provisions of law soft and
comply with the regulations of the Minister of Public Security, the Minister of
Defense and the competent State bodies.
Article 11. Registration
procedures
1. Candidates are university faculty members who
submit directly or by post: 01 copy of registration for recognition of professors
and associate professors with 2 portraits (4 cm x 6 cm); One set of dossier
specified in Clause 1, Article 10 of this Decision at the grassroots Council of
their own units and online electronic dossier registration on the website of
the tertiary education institution and on the website. electronic information
of the State Council.
2. Candidates who are full-time lecturers of
tertiary education institutions shall not set up grassroots councils and
candidates who are visiting lecturers shall submit directly or by post: 01
written registration for consideration and recognition of qualifications
Professors, associate professors with 2 portraits (4 cm x 6 cm); a full address
of the candidate in the recipient section; One set of dossier specified in Clause
1, Article 10 of this Decision at the grassroots Council of Candidates shall be
selected and registered by online candidates on the website of the tertiary
education institution (where receiving the applicant's profile) and on the Web
site of the State Council.
3. The applicant's electronic profile must be
publicly available on the website of the higher education institution (where
the applicant's application is submitted) and the website of the State Council.

Article 12. Organization of
consideration of application dossiers at higher education institutions
1. Establishing the faculty-level Councils of
Professors at a higher education institutions
a) Annually, basing itself on the need for
recognition and recognition of the titles of professors and associate
professors, heads of tertiary education institutions shall decide on the
establishment of the faculty-level Councils;
b) The faculty council has between 9 and 15
members. In order to have sufficient number of members, tertiary education
institutions may invite professors and associate professors at home and abroad
to join or may associate with other tertiary education establishments in order
to set up the faculty-level professor councils;
c) The Academic and Training Council of a tertiary
education institution shall nominate members to join the grassroots-level
Council on the grassroots-level websites. Based on the list of nominees, the
head of the tertiary education institution shall select persons who satisfy the
criteria prescribed in Article 17 of this Decision to set up the faculty-level
Council of Professors;
d) After deciding on the establishment of the
grassroots Councils, the head of the tertiary education institution shall hold
the meeting of the grassroots-level Council for the first session to elect its
chairman, vice chairmen and secretaries. 10 Appendix II issued together with
this Decision). Based on the election results, the head of the tertiary
education institution shall issue decisions on the appointment of the above
titles;
dd) The chairmen of the grassroots Councils shall
have to assign specific tasks to the members of the Board;
e) The faculty-level Council shall hold a one-year
term of office. The heads of the tertiary education institutions shall have to
arrange material foundations, equipment, funds, means and other necessary
conditions for the Councils.

b) The chairmen of the grassroots Councils shall
review the applicants' dossiers and consider the conditions prescribed in
Articles 4, 5, 6 and 7 of this Decision, assign the members of the Board or
invite professors , assistant professor at home or abroad for evaluation;
c) Each member is responsible for verifying the
legality and accuracy of the file. Copy documents; length of training and
results of training, scientific research of the candidate and signature of the
signed examination, clearly stating the pros and cons of each dossier (Form No.
05 in Appendix II issued together with Decision). On the basis of the
evaluation form, the grassroots-level Council will decide on the list of
eligible applicants to present the overview report;
d) Candidates present an overview of the scientific
report. The members of the grassroots-level Council exchanged, discussed
publicly and democratically the candidates' dossiers; Discuss directly with the
applicant the contents presented in the overview report and relevant contents
of the candidate's profession;
dd) Basic faculty councils coordinate with higher
education institutions to organize the assessment of foreign language skills in
service of professional work and the ability to communicate in English of each
candidate.
e) Pass the list of qualified candidates to the
State Council for Recognition and Recognition of Professors and Associate
Professors in the form of vote of confidence (Form 11, Appendix II issued
together with under this Decision). Each applicant's CV must be at least 2/3 of
the total number of members of the Basic Council
3. Publicize the results of consideration by the
grassroots Council
The chairmen of the grassroots Councils shall
organize the summing up of the results of consideration and recognition of the
titles of professors and associate professors, publicize them on the websites
of the tertiary education institutions and report the results thereof at the
head of the tertiary education institution. After publicizing at least 15 days,
heads of tertiary education institutions shall report their results to the
State Council for Education.
4. Reporting dossier of results of consideration
submitted by higher education institutions
a) The official dispatch of the head of the
tertiary education institution shall request the State Council for Professor to
consider and recognize the professors and associate professor titles;

Article 13. Composition and
processes for establishment of the State Council for Professor Title
1. The State Council consists of the president; a
Vice President and Secretary General; a Vice President in charge of natural
sciences, engineering and technology; a Vice President in charge of health
science; a Vice President in charge of the social sciences and humanities,
arts, physical training and sports and members. The Chairman of the Council is
the Minister of Education and Training.

3. The Prime Minister assigns the Minister of
Education and Training - the President of the State Council to decide on the
appointment of members of the State Council and review the regular adjustment.
4. The term of office of the State Council is five
years. The members of the State Council are not more than two consecutive
terms. The chairman, the vice chairman and the members of the council shall
work on a part-time basis. The Vice-President cum Secretary General works on a
full-time basis.
5. The State Council has a seal of national emblem,
private account and separate working place. The operating budget is allocated
from the state budget through the Ministry of Education and Training.
6. The State Council has an assistant group which
comprises the Office and sectoral or intersectoral Council of Professors.
7. The Minister of Education and Training issues
the regulations on organization and operation of the State Council; the
sectoral or intersectoral Council; the faculty-level Council of Professors and
the Office of the State Council of Professors.
Article 14. Duties and
authority of the State Council
1. The State Council of Professors shall guide the
operation of faculty-level Councils and sectoral or inter-sectoral Councils.
2. Organize the receipt of reports from higher
education institutions, to classify the applicants' dossiers proposed by the
tertiary education institutions according to their branches and specialties,
and publicize their dossiers on the Portal of the State Council and transferred
to the sectoral or intersectoral Council of professors.
3. Consider approving the list of candidates
eligible for accreditation for the professor or associate professor title
proposed by the sectoral or intersectoral Councils for Professors.

5. Consider annulling the recognition of the
professor or associate professor titles and cancel the recognition of the
accredited professors or associate professors who have been recognized as
failing to meet the prescribed criteria.
6. Coordinate with competent state agencies in
settling complaints and denunciations on the consideration and recognition of
qualified members, appointing and dismissing the professor or associate
professor titles (if any) according to the provisions of law.
7. Advise the Minister of Education and Training on
orienting the development of professors and associate professors; the quality
of doctoral training and participation in the development of the policy of
developing professors and associate professors.
Article 15. Duties and
authority of the Standing Committee of the Council and the Chairperson of the
State Council
1. The Standing Committee of the State Council
consists of the president, vice president and general secretary and other vice
presidents. The standing body of the State Council is responsible for settling
the regular and ad hoc work between the two sessions of the Council.
2. Duties and authority of the Chairperson of the
State Council
a) Preside over meeting sessions and deal with
activities of the State Council during intervals between two meeting sessions;
b) Make a decision on appointment of members of the
State Council;
c) Make a decision on establishment and appointment
of the Chairperson and members of the sectoral or intersectoral Council;

equipment, funding, means and other necessary conditions for the State Councils
for Teachers, the sectoral or intersectoral Councils;
e) Guide the operation of the State Council,
sectoral or inter-sectoral Councils and faculty-level Councils;
g) Issue resolutions, sign recognition decisions
and issue certificates of qualification for professor or associate professor
titles;
h) Participate in the activities of the Council of
State as a member of the Council.
Article 16. Duties and
authority of the sectoral and intersectoral Council
1. Sectoral and intersectoral Council of professors
is a specialized division of the State Council. The President of the State
Council shall decide on the establishment and appointment of members according
to the Regulation on organization and operation of the State Council on
Education, promulgated by the Minister of Education and Training.
2. Assist the State Council in identifying
professional competencies, research results, research orientations of members
in each specialty.
3. Conduct evaluation of the dossier of each
candidate and the results of consideration of the dossier by the faculty-level
Council applying for consideration of recognition of accreditation for the
professor or associate professor title.
4. Consolidate results and report to the State
Council.

6. Coordinate with competent state agencies in

Article 17. Standards of
members of the State Council, sectoral or intersectoral Councils and the

1. Have good political and moral standards and
clear criminal records.
2. Show honesty and scientific credentials, have
research results published in prestigious international scientific journals or
published at reputable publishing houses for 5 years immediately preceding the
time of appointment as Members of the Council.
3. Proficiently use foreign languages for
professional work and good communication in English; have a high sense of
responsibility in carrying out assigned tasks.
4. Members of the Council must hold the professor
title, unless otherwise decided by the Prime Minister. Members of the sectoral
or intersectoral Councils or faculty-level Councils must hold the professor or
associate professor title.
5. Currently participate in trainings and occupy
the managerial position holding at least the undergraduate degree.
6. Have health and time to perform assigned tasks.

2. Meeting sessions of the State Council, sectoral
or intersectoral Councils and faculty-level Councils shall be organized only if
at least 3/4 of total membership participate in the meeting.
3. List of candidates eligible for consideration of
recognition of accreditation for the professor or associate professor title;
4. The State Council, the sectoral and
intersectoral Councils shall hold regular or extraordinary meetings at the
proposal of the Chairman of the Council or by more than half of the members of
the Council for discussion and proposing issues related to the operation of the
Council.
5. Regular or extraordinary meetings of the State
Council, the Standing Board of the State Council can be held in the form of:
Direct meetings, online meetings or written comments.
6. The reorganized meeting for consideration shall
be conducted only when there is a document from the competent body concluding
that the consideration for accreditation has met the criteria of the title of
professor or associate professor who has violated the current provisions of law
(Form No.13, Appendix II issued together with this Decision).
Article 19. Processes for
consideration by the sectoral or intersectoral Council of Professors
1. Appraisal of dossiers: Each dossier of
registration for consideration and recognition of the professorship must be
approved by at least 3 professors of the same branch or specialized science
with the appraised candidate, with the signature and comment on scientific
capability and assess whether or not to meet the standards. Each dossier of
registration for recognition and recognition of an associate professor title
must be signed by at least 03 professors or associate professors of the same
branch or specialized science with the appraised candidate. The tasks
prescribed in Article 3 of this Decision (Form No. 06, Appendix II to this Decision).
The appraiser must be responsible for results of appraisal, evaluation and
his/her comments on the candidate’s dossiers.
2. Assessment and conclusion of the candidate’s
dossiers: The members of the sectoral or intersectoral councils shall exchange and
discuss publicly and democratically the appraisal, evaluation opinions and
remarks on each dossier. On that basis, each member of the Council shall write
a signed statement indicating the candidate's strengths and weaknesses, and
conclude whether or not the applicant meets or exceeds the criteria for
recognition as a professor (Form No. 07, Appendix II issued together with this
Decision).
3. Candidates shall presents the overview reports
in English. The members of the sectoral or intersectoral Council shall directly
discuss contents specified in the overview report and professional and skill
issues with candidates; assess English communications level of each candidate.
As for specific academic disciplines, candidates may present overview reports
in English. The sectoral or intersectoral Council in collaboration with the
State Council shall conduct assessment of English communications level of each
candidate.

5. Each candidate’s dossier must receive at least
2/3 trust votes from total membership of the sectoral or intersectoral Council.
Results of casting of trust votes shall be publicly disclosed in the Council’s
meeting.
6. Publicize the results of consideration by the
sectoral or intersectoral Council
a) The Chairperson of the sectoral or intersectoral
Council shall be held responsible for publicizing the results of the Council
for at least 15 days on the Portal of the State Council before reporting to the
State Council on results of consideration by the sectoral or intersectoral
Council;
b) Contents of consideration results to be publicly
disclosed shall include total score and converted score of: Scientific papers, monographs,
textbooks, reference books, instructional books; the results of application of
patented science and technology; utility solutions; art works, training
achievements, sports competitions in which national and international prizes
have been obtained.
7. Report to the State Council on the results of
consideration by the sectoral or intersectoral Council.
a) Report of results of consideration by the
sectoral or intersectoral Council (Form No. 14 Appendix II hereto attached);
b) List of candidates eligible for consideration of
recognition of accreditation for the professor or associate professor title;
c) Summary of candidates' standards (Form No 09,
Appendix II issued together with this Decision);

Article 20. Processes for
consideration by the State Council
1. The State Council’s Chairperson holds meetings
so that the Chairperson of the sectoral or intersectoral council reports on the
results of consideration by the sectoral or intersectoral council, and answer
oral questions of members of the State Council.
2. Members of the State Council publicly and
democratically discuss the results of dossier appraisal and organization of
consideration by the sectoral or intersectoral Council.
3. Elect members of the Vote Count Board and
proceed to cast votes (Form No. 11 in the Appendix II hereto attached) to come
with the results of consideration by the sectoral or intersectoral Council and
determine the list of candidates eligible for recognition of accreditation for
the professor or associate professor title. There must be more than a half of total
membership of the State Council casting unanimous votes.
4. The State Council passes the resolution of the
meeting, publishes the results on the portal of the State Council and the
portal of the Ministry of Education and Training.

b) The State Council shall be responsible for
sending the decision along with the list of lecturers achieving the recognition
of accreditation for the professor or associate professor title to the Ministry
of Education and Training, higher education institutions, organizations or
individuals concerned and reporting to the Prime Minister.
Article 21. Special cases
Teachers or scientists who have significant contributions
to scientific and technological tasks in the country and the world shall be
exceptionally exempted from standards prescribed in Article 5 hereof (with
respect to the professor title) and Article 6 hereof (with respect to the
associate professor title).
Article 22. Dossier appraiser
1. The dossier appraiser must work in the same
discipline or specialty as candidates for registration of consideration of
accreditation for the professor or associate professor title.
2. Grassroots-level Councils, sectoral and
intersectoral Councils may invite domestic or foreign professors or associate
professors who have expertise in the profession of candidates, have earned high
academic reputation, have good qualities and show their honesty in order to
appraise all or a part of each candidate’s dossier.
3. Selection of appraiser of dossiers and appraisal
results shall be kept confidential until the date of disclosure of recognition
of accreditation for the professor or associate professor title on the Portal
of the State Council.
Article 23. Dossier management
1. The candidate's dossiers and documents stating
consideration of accreditation must be kept and preserved at the
grassroots-level Council. The unit keeping dossiers must ensure safety and
convenience for access, consideration and appraisal during the process of
consideration of accreditation and appointment to the professor and associate
professor title.

3. Storage and management of dossiers for
recognition of accreditation for the professor and associate professor title
shall be subject to the Law on Archival and relevant legislations.
Section 3. APPOINTMENT TO THE
PROFESSOR OR ASSOCIATE PROFESSOR TITLE AT HIGHER EDUCATION ESTABLISHMENTS
Article 24. Determination of
demands for appointment to the professor and associate professor title
1. Pursuant to the provisions laid down in the Law
on Education, the Law on Higher Education, the Law on Public Officers and other
relevant legislations; according to requirements concerning educational and
scientific research quality and prestige of higher education institutions, the
head of a higher education institution shall define the position, number,
criteria and conditions for the appointment of professors and associate
professors according to their positions, suitable to each training discipline
but is not lower than the standards prescribed in this Decision, and make known
to the public before implementation.
2. According to regulations in force and demands of
higher education institutions, on an annual basis, the head of a higher
education institution shall disclose position, quantity, standard and
conditions for appointment to the professor and associate professor title at
each major or specialty of each higher education institution before receipt of
the application dossier for appointment.
Article 25. Requirements for
appointment to the professor and associate professor title
1. Candidates must obtain recognition of
accreditation for the professor or associate professor title, and meet appointment
requirements of each higher education institution.
2. Candidates must obtain recognition of
accreditation for the professor or associate professor title from foreign
higher education institutions, and meet appointment requirements of each higher
education institution. Foreign higher education institutions regulated in this
clause have been appraised and accredited by an appraising organization
authorized under the host country’s law.

accreditation for the associate professor title with respect to candidates who
register for the appointment to the associate professor title
3. Copy of the decision on appointment to the
associate professor title and the decision on recognition of accreditation for
the professor title with respect to candidates who register for the appointment
to the professor title.
4. Proof of appointment to the professor or
associate professor title by foreign higher education institutions (if
available).
5. Copies must be authenticated or notarized under
the provisions of laws or compared with originals upon submission.
Article 27. Processes for
appointment to the professor and associate professor title
1. Higher education institution receives dossiers
submitted to apply for registration of appointment to the professor or
associate professor title; classifies dossiers by academic disciplines or
specialties.
2. Head of higher education institution decides
establishment of the Board of consideration of appointment to the professor or
associate professor title.
3. Board member makes public discussions on each
candidate’s dossier. In order to be shortlisted as those in the list of
recommended candidates, he/she must receive unanimous votes from more than a
half of total membership. Results of consideration must be published on the
portal of higher education institution.
4. Within a period of15 days after the date of
disclosure of appointment results, the head of higher education institution
shall issue a decision on appointment to the professor or associate professor
title to candidates accredited and eligible for the title depending on the
structure of such titles. The appointment decision must clarify academic
disciplines or specialties of candidates and name of appointing higher
education institutions. Candidates shall be recognized to hold the professor or
associate professor title after receipt of the appointment decision of the head
of higher education institution.

6. Higher education institutions shall be
responsible for reporting on the appointment results to the Minister of
Education and Training and the head of the host institution. Reporting dossier
shall include: Results of consideration at the grassroots-level institution
together with the report (Form No. 16 in the Appendix II to this Decision) and
the decision on appointment to the professor or associate professor title.
Article 28. Appointment to the
professor and associate professor title
1. Lecturers who have become public officers of
state-owned higher education institutions after being appointed to the
professor or associate professor title shall be considered to be appointed to
the teaching public officer rank and shall implement regimes and policies
applied to public officers under laws.
2. Non-state higher education institutions shall elaborate
on appointment, preference policies and work requirements with respect to the
professor or associate professor at the grassroots-level institutions.
Chapter IV
PROCEDURES FOR
CANCELLATION OF RECOGNITION AND REMOVAL OF PROFESSOR OR ASSOCIATE PROFESSOR
TITLE

3. Those who hold professor or associate professor
title have been subject to a disciplinary action in the form of dismissal.
4. Those who hold professor or associate professor title
have been charged by the court under the judgement in effect.
Article 30. Processes for
consideration of cancellation of recognition of professor or associate
professor title
Whenever there is any complaint, accusation or
report of an organization or entity or individual on cases specified in Article
29 hereof, the State Council shall convene a meeting to consider cancellation
of recognition of the professor or associate professor title according to the
following process:
1. The Chairperson of the State Council presides
over and collaborates with higher education institutions and other entities
concerned in verifying cases in which cancellation of recognition of professor
or associate professor title is considered.
2. The State Council conducts the appraisal of each
case, promulgates the resolution to cancel recognition of the professor or
associate professor title.
3. According to the resolution of the State
Council, the Chairperson of the Council issues the decision on cancellation of
recognition of the professor or associate professor title with respect to cases
prescribed in Article 29 hereof; informs authorities having competencies in
managing lecturers, higher education institutions and persons subject to
cancellation of recognition of professor or associate professor title.

Article 32. Processes for
consideration of removal of professor and associate professor title
1. Upon receipt of the decision to cancel the
recognition of the professor or associate professor title from the State
Council, or the legal proof that cases of inconformity with unconformity with
appointment standards and requirements or cases of assessment as failure to
complete the assigned tasks under Article 31 hereof are determined, the head of
higher education establishments shall set up councils to consider the removal
from the professor or associate professor title for review and consideration on
a case-by-case basis.
2. Based on the conclusions of the Council of
consideration of removal of the professor or associate professor title, the
head of higher education institution shall issue the decision on removal of the
professor or associate professor title, and then report to the head of the host
institution and the Minister of Education and Training.

laws.
2. Preside over and collaborate with organizations
or individuals concerned in dealing with complaints, accusations or
denunciations relating to consideration of recognition of accreditation for the
professor or associate professor title (if any).
3. Cooperate with the Ministry of Home Affairs and
ministries or sectoral administrations concerned in formulating and appealing
the Government and the Prime Minister to promulgate policies and benefits
applied to professors and associate professors.
Article 34. Responsibilities
of the Ministry of Home Affairs
Preside over and cooperate with ministries and
sectoral administrations concerned in formulating and appealing the Government
and the Prime Minister to promulgate policies and benefits applied to
professors and associate professors.
Article 35. Responsibilities
of the head of higher education establishment
1. Make a decision on appointment to the professor
or associate professor title with respect to lecturers conforming to
requirements referred to in Article 24 and Article 25 hereof.
2. Make a decision under his/her jurisdiction or
request competent authorities to issue the decision on appointment to the
professional rank as public officers with respect to lecturers who have been appointed
to the professor or associate professor title in state-owned higher education
institutions.

4. Coordinate with competent state agencies in
settling complaints and denunciations on the consideration and recognition of
qualified members, appointing and dismissing the professor or associate
professor title (if any) according to the provisions of law.
Article 36. Entry into force
1. This Decision shall be in effect from October
15, 2018.
2. The Prime Minister’s Decision No.
174/2008/QD-TTg dated December 31, 2008 issuing standards, procedures for
appointment and removal of the professor or associate professor title; the
Prime Minister’s Decision No. 20/2012/QD-TTg dated April 27, 2012 amending and
supplementing Regulations on standards and procedures for appointment and
removal of the professor and associate professor title issued together with the
Decision No. 174/2008/QD-TTg dated December 31, 2008, shall become invalid from
the date of entry into force of this Decision.
3. Ministers, Heads of Ministry-level agencies,
Heads of Governmental bodies, Chairpersons of People’s Committees of
centrally-affiliated cities and provinces, and other organizations and individuals
involved, shall be responsible for implementing this Decision./.
