Fines for labor-related administrative violations are hiked up

Recently, the Government has promulgated the Decree No. 28/2020/ND-CP regulating fines for administrative violations related to labor, social insurance or sending of Vietnamese workers abroad.

According to this Decree, employers will be fined from 2 – 25 million dong, depending on the affected number of employees (compared to 1 – 20 million dong prescribed in existing regulations) if they commit one of the following acts:

- Fail to conclude written employment contracts for works with duration of 03 months or longer;

- Fail to conclude employment contracts of correct type with employees;

- Make employment contracts lacking main terms and conditions;

- Enter into employment contracts if they appoint an employee to a director of a state-invested company without compliance with regulations in force.

If employers coerce or maltreat employees to the extent of not being liable for criminal prosecutions, they will be fined from 50 to 75 million dong.

Decree No. 28/2020/ND-CP is entering into force on April 15, 2020.
