Fines of up to 1 million dong for use of earphones to listen to music while driving are imposed

This is the highlight of the Decree No. 100/2019/ND-CP prescribing administrative penalties for violations arising from road and rail traffic activities.

This Decree prescribes that riders of motorcycles or mopeds (including electric bikes) using hand phones or other audio devices (e.g. earphones for listening to music) will be fined from 600,000 dong to 1 million dong (except hearing aids).

In addition to being subject to fines, the aforesaid violators will be deprived of the rights to use driving licenses for the period from 01 month to 03 months, and from 02 months to 04 months in case of any traffic crash occurring.

With regard to motor vehicle drivers, if they use hand phones while driving, they will be faced with the following fines and punishment forms:

- They will be fined from 1 million dong to 2 million dong;

- They will be deprived of the rights to use driving licenses for the period from 01 month to 03 months, and from 02 months to 04 months in case of any traffic crash occurring.

"Decree No. 100/2019 has imposed strict sanctions (for instance, a number of new regulations on fines and higher levels of fine) which can intimidate persons who frequently commit traffic violations.  Communications agencies need to disseminate these regulations to the public so that they are aware and observe them to enhance traffic safety as well as protect themselves and others", Mr. Bui Tuong Vu, Legal Advocate and Director of THƯ VIỆN PHÁP LUẬT Co., stressed.


The Decree No. 100/2019/ND-CP is entering into force on January 1, 2020.
