Significant elements will be included in the 2014 Law on National Assembly Organization

1. Clear definition of durations during which deputies are required to work full time or part time

- Full-time deputies must spend their entire stipulated time length performing their duties and exercising their powers at National Assembly’s bodies or local National Assembly delegations.   

- Part-time deputies must spend at least 1/3 of work time length in a year performing their duties and exercising their powers assigned to National Assembly deputies.

2. New rights of National Assembly deputies

- Become members of and engage in operations of the Council on Ethnicity Affairs and a Committee of the National Assembly.

 National Assembly deputies who are not members of the Council on Ethnicity Affairs and the Committees of the National Assembly will be entitled to attend meetings held by this Council or Committee to discuss any issue in which they have interest.  

- Stand for election or recommend any candidate for election of positions elected by the National Assembly.

 Recommended candidate will have the right to withdraw from the election.

3. Additional regulations regarding privileges accorded National Assembly deputies

In addition to privileges defined in the 2001 Law on National Assembly Organization,

- Time length per a year that a part-time deputy spend performing assigned duties as referred to in paragraph 2 Article 24 of this Law will be calculated in total work hours that this deputy spend working at his/her employment place.

- A National Assembly deputy will be accorded advantageous treatment in buying train, bus, vessel and airplane tickets, or crossing bridges or get aboard a ferry.

- In case of suffering from a disease, a National Assembly deputy who is not in the list of medium-ranking or high-ranking officials will be entitled to healthcare services that meet regulatory standards intended for medium-ranking officials.  

- A National Assembly deputy or a former National Assembly deputy who is not an official, public servant or employee, in case of death, will be accorded stipulated treatment in funeral service to which an official and public servant are entitled.  

4. Other allowances and benefits accorded a National Assembly deputy

Specific regulations on other allowances and benefits accorded a National Assembly deputy include:

- Other allowances and benefits accorded a full-time National Assembly deputy, or allowances accorded a National Assembly deputy who does not obtain salary from the state budget are decided by the National Assembly Standing Committee. 

- A National Assembly deputy is provided with monthly operating expense or budget for payments for experts or assistant secretaries hired on a lump-sum basis and other operations of this deputy in accordance with regulations of the National Assembly Standing Committee. 

5. Regulations on cooperation in performing work activities between the National Assembly Standing Committee and other institutional and individual entities

- When implementing its duties or powers, the National Assembly Standing Committee must work with the State President, Government, Prime Minister, Supreme People’s Court, Supreme People’s Procuracy, Auditor General of the State Audit, National Election Council, Presidium of the Central Committee of Vietnamese Fatherland Front; request representatives of other agencies or organizations and citizens to engage in such implementation if necessary. 

- The Government, Supreme People’s Court, Supreme People’s Procuracy, other state bodies, socio-political organization, social organization, socio-professional organization, economic organization, people’s armed units and citizens take responsibility to comply with requests made by the National Assembly Standing Committee.

6. Establishment, dissolution, merging, splitting and adjustment of territorial administrative divisions inferior to these of centrally-affiliated cities and provinces   

- The National Assembly Standing Committee is vested with authority to establish, dissolve, merge, split and adjust territorial administrative divisions inferior to these of centrally-affiliated cities and provinces upon the request of the Government.

- The scheme for establishing, dissolving, merging, splitting and adjusting territorial administrative divisions inferior to these of centrally-affiliated cities and provinces will be subject to investigations conducted by the National Assembly before being submitted to the National Assembly Standing Committee for review or decision.

7. Responsibilities of the National Assembly Standing Committee for holding of a referendum

- The National Assembly Standing Committee must hold a referendum under the National Assembly’s decision. 

- The National Assembly Standing Committee must provide for vote forms used in a referendum, voting and vote counting procedures; decide scheduled time for this referendum, information contained in a referendum vote in accordance with the National Assembly’s resolution regarding such referendum; inspect and oversee such referendum.   

- The National Assembly Standing Committee must assume responsibility to report on the referendum result to the National Assembly in the coming plenum.
